<section commented="no" id="HAC46951F16614C09AF3930A8162E7719" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Child Left Inside Act of 2008</short-title></quote>.</text> </section> 
<section id="H0E4A1D0E536647F9972FCBED70472F7B"><enum>2.</enum><header>National Environmental Education Act amendments</header> 
<subsection id="H56D5C9BA22CA4C429767378D379C2608"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 3 of the National Environmental Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/5502">20 U.S.C. 5502</external-xref>) is amended—</text> 
<paragraph id="H52A5816190534A5985C948919F7E22D2"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (12), by striking <quote>and</quote> at the end;</text> </paragraph> 
<paragraph id="HF1563424510D4BDA92B55CB2E4709EF6"><enum>(2)</enum><text>in paragraph (13), by striking the period at the end and inserting a semicolon; and</text> </paragraph> 
<paragraph id="H7F34C53F8E51439EB0E62274D4AB81BA"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H2BED1E88D353420288B9E958008E1E13" style="OLC"> 
<paragraph id="H3E39D3E6B7D74A9E9F7917E8BA888FB5"><enum>(14)</enum><text display-inline="yes-display-inline"><term>principles of scientific research</term> means principles of research that—</text> 
<subparagraph id="HFC1C07DA5C98430CA9E29CC9DCB74308"><enum>(A)</enum><text>apply rigorous, systematic, and objective methodology to obtain reliable and valid knowledge relevant to education activities and programs;</text> </subparagraph> 
<subparagraph id="HA2AAD13926C84121A3198CBA3416B200"><enum>(B)</enum><text>present findings and make claims that are appropriate to, and supported by, the methods that have been employed; and</text> </subparagraph> 
<subparagraph id="H151FFB40829D4CF2B84EB7872D5255F"><enum>(C)</enum><text>include, appropriate to the research being conducted—</text> 
<clause id="H3C205D581EE94E1F94D416F1691CDC8B"><enum>(i)</enum><text>use of systematic, empirical methods that draw on observation or experiment;</text> </clause> 
<clause id="HAA7B5A1734DA4EC4A552D7644627C800"><enum>(ii)</enum><text>use of data analyses that are adequate to support the general findings;</text> </clause> 
<clause id="H53AECD20DB9A42D5A2F7E824E5C64E48"><enum>(iii)</enum><text>reliance on measurements or observational methods that provide reliable and generalizable findings;</text> </clause> 
<clause id="H529B24F0CCD74B44AE706D5580063D1C"><enum>(iv)</enum><text>strong claims of causal relationships, only with research designs that eliminate plausible completing explanations for observed results, such as, but not limited to, random-assignment experiments;</text> </clause> 
<clause id="H6B855946FD2D4D21946E367F808B7700"><enum>(v)</enum><text>presentation of studies and methods in sufficient detail and clarity to allow for replication or, at a minimum, to offer the opportunity to build systematically on the findings of the research;</text> </clause> 
<clause id="H2B3900D297A34C86ACB192B95596000"><enum>(vi)</enum><text>acceptance by a peer-reviewed journal or critique by a panel of independent experts through a comparably rigorous, objective, and scientific review; and</text> </clause> 
<clause id="H924DFE4840FA4A31853DB769956800F3"><enum>(vii)</enum><text>consistency of findings across multiple studies or sites to support the generality of results and conclusions;</text> </clause></subparagraph></paragraph> 
<paragraph id="HAEFFE177A1954FA596D945169EA3C8E"><enum>(15)</enum><text><term>scientifically valid research</term> includes applied research, basic research, and field-initiated research in which the rationale, design, and interpretation are soundly developed in accordance with principles of scientific research;</text> </paragraph> 
<paragraph id="HC895018C09B842EF939FED92E70705D1"><enum>(16)</enum><text display-inline="yes-display-inline"><term>State</term> has the meaning given such term in section 9101 of the Elementary and Secondary Education Act of 1965; and</text> </paragraph> 
<paragraph id="H7AD7AB1C94474CAF956823C1B8A64CD0"><enum>(17)</enum><text display-inline="yes-display-inline"><term>State educational agency</term> has the meaning given such term in section 9101 of the Elementary and Secondary Education Act of 1965.</text> </paragraph> <after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="H61C036F2CC13419B80ACE09F15A14698"><enum>(b)</enum><header>Environmental education and training program</header><text display-inline="yes-display-inline">Section 5 of the National Environmental Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/5504">20 U.S.C. 5504</external-xref>) is amended—</text> 
<paragraph id="H3FE25DB53D294C34BA728BEC2DA3C027"><enum>(1)</enum><text>in subsection (b)—</text> 
<subparagraph id="H47F8A26987BA4F63A9631D90E6DF73D2"><enum>(A)</enum><text>in paragraph (1)—</text> 
<clause id="HB5CEE7FF4DF64C3BB7A1EEFCD5394624"><enum>(i)</enum><text>by inserting <quote>creating opportunities for enhanced and ongoing professional development and</quote> before <quote>classroom</quote>; and</text> </clause> 
<clause id="H49DE6663D2624C76BBE2AEAC8F433844"><enum>(ii)</enum><text>by inserting <quote>(including integrating scientifically valid research teaching methods and technology-based teaching methods into the curriculum)</quote> after <quote>practices</quote>;</text> </clause></subparagraph> 
<subparagraph id="HB9162D647E2647FF8D0044D21526D035"><enum>(B)</enum><text>in paragraph (3)—</text> 
<clause id="H03DE06F98EB84FCD00BB9C4848D477DA"><enum>(i)</enum><text>by striking <quote>curriculum, including</quote> and inserting <quote>curriculum (including</quote>;</text> </clause> 
<clause id="H052F122700BC405D9216DD7737BBC53E"><enum>(ii)</enum><text>by striking <quote>groups;</quote> and inserting <quote>groups) which—</quote>; and</text> </clause> 
<clause id="H91BE77714BC045E296312093005E9F68"><enum>(iii)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H90EA449883014D29AD3FE45E685F3FC8" style="OLC"> 
<subparagraph id="HE39DA0B4038342B1B7CAAAAD6DDF152"><enum>(A)</enum><text>are aligned with challenging State and local academic content standards to the extent such standards exist; and</text> </subparagraph> 
<subparagraph id="HAE9E1B73086749BA9F35A9E53800F00"><enum>(B)</enum><text>advance the teaching of interdisciplinary courses that integrate the study of natural, social, and economic systems and that include strong field components;</text> </subparagraph> <after-quoted-block>;</after-quoted-block></quoted-block> </clause></subparagraph> 
<subparagraph id="H402DC7F12EFB40BD888F004CBE923287"><enum>(C)</enum><text>in paragraph (7), by striking <quote>and forums;</quote> and inserting <quote>forums, and bringing teachers into contact with working professionals in environmental fields to expand such teachers’ subject matter knowledge of, and research in, environmental issues;</quote>;</text> </subparagraph> 
<subparagraph id="H1A80707876D44D0D81C8FE6F7358E500"><enum>(D)</enum><text>in paragraph (8), by striking <quote>; and</quote> and inserting <quote>, including environmental education distance learning programs for teachers using curricula that are innovative, content-based, and based on scientifically valid research that is current as of the date of the program involved;</quote>;</text> </subparagraph> 
<subparagraph id="HD3B6A36D0FD74854B4D512A3EBC974D7"><enum>(E)</enum><text>by redesignating paragraph (9) as paragraph (13);</text> </subparagraph> 
<subparagraph id="H2FFC3069E41F46CD9E58C538487BC0E1"><enum>(F)</enum><text>by redesignating paragraphs (4) through (8) as paragraphs (5) through (9), respectively;</text> </subparagraph> 
<subparagraph id="H2001F4B828074C0AAF00AB8F24D99970"><enum>(G)</enum><text>by inserting after paragraph (3) the following:</text> 
<quoted-block display-inline="no-display-inline" id="HE5E8A890E30A427CB9FA00FF43E8549" style="OLC"> 
<paragraph id="H7127EEE7EB0848BDBCBDFB59C18B7D44"><enum>(4)</enum><text display-inline="yes-display-inline">encouraging individuals traditionally under-represented in environmental careers to pursue postsecondary degrees in majors leading to such careers;</text> </paragraph> <after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph> 
<subparagraph id="H26869E78D5674998BE9DAB17DCC7AA00"><enum>(H)</enum><text>by inserting after paragraph (9) (as so redesignated) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H090A19474BE74D7189EF077FD37BBDDA" style="OLC"> 
<paragraph id="H095836F6D7EE495397E5245EF2EEB4D0"><enum>(10)</enum><text display-inline="yes-display-inline">establishment of programs to prepare teachers at a school to provide environmental education professional development to other teachers at the school and programs to promote outdoor environmental education activities as part of the regular school curriculum and schedule in order to further the knowledge and development of teachers and students;</text> </paragraph> 
<paragraph id="H07F4AD8B49734AFB865E4E00CEC0F21F"><enum>(11)</enum><text display-inline="yes-display-inline">summer workshops or institutes, including follow-up training, for elementary and secondary school environmental education teachers;</text> </paragraph> 
<paragraph id="H31BBBD1C7F6E4F1285E0BD7D46CB9CCE"><enum>(12)</enum><text>encouraging mid-career environmental professionals to pursue careers in environmental education; and</text> </paragraph> <after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph> 
<paragraph id="HA746AE28F8CC45FDB2263E222C291ED"><enum>(2)</enum><text>in subsection (c)(1), by inserting <quote>, in consultation with the Secretary,</quote> after <quote>Administrator</quote>.</text> </paragraph></subsection> 
<subsection id="H2D503C03B5A94FFC94CD5426CD9B13FA"><enum>(c)</enum><header>Authorization</header><text display-inline="yes-display-inline">Section 11(a) of the National Environmental Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/5510">20 U.S.C. 5510(a)</external-xref>) is amended by striking <quote>Act</quote> and all that follows through the period at the end and inserting <quote>Act, except for section 11, $14,000,000 for fiscal year 2009.</quote>.</text> </subsection> 
<subsection id="H20E46497F1F647038E6D133537BE46A"><enum>(d)</enum><header>National capacity environmental education grant program; accountability</header><text>The National Environmental Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/5501">20 U.S.C. 5501 et seq.</external-xref>) is amended—</text> 
<paragraph id="H3242C39A5C4943269C9907058B009DAF"><enum>(1)</enum><text>by redesignating section 11 as section 13; and</text> </paragraph> 
<paragraph id="HF703F13EA1B44DC59DF5D16F11CAC0EA"><enum>(2)</enum><text>by inserting after section 10 the following:</text> 
<quoted-block display-inline="no-display-inline" id="HE44F516BCF664453A9003131D3E99F94" style="OLC"> 
<section id="H7FE89E88BE114169AF98FB526D73A32E"><enum>11.</enum><header>National capacity environmental education grant program</header> 
<subsection id="H00F07AA31D2245AC91673C2C568CE133"><enum>(a)</enum><header>Grants authorized</header> 
<paragraph id="H64D85BE6C9DD47199799EA862E1B5226"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary is authorized to award grants, on a competitive basis, to nonprofit organizations, State educational agencies, local educational agencies, municipalities, or institutions of higher education that have demonstrated expertise and experience in the development of the institutional, financial, intellectual, or policy resources needed to help the field of environmental education become more effective and widely practiced. Notwithstanding any other provision of this section, a State educational agency, a local educational agency, an institution of higher education, a municipality, or a not-for-profit organization may use funds provided under this section to coordinate with any program or unit operated by a Federal Natural Resource Management Agency to carry out environmental education programs based on the full range of the resources and mission of the Agency.</text> </paragraph> 
<paragraph id="HDEEA7C4297334A87890038E0600B306"><enum>(2)</enum><header>Duration</header><text>The Secretary shall award each grant under this section for a period of not less than 1 year and not more than 3 years.</text> </paragraph></subsection> 
<subsection display-inline="no-display-inline" id="HBF8F6FCFA03449BEAB1C4753ACF98B00"><enum>(b)</enum><header>Use of funds</header><text>Grant funds made available under this section shall be used for 1 or more of the following:</text> 
<paragraph id="HA43B5F7C69444036AD993685DF22732"><enum>(1)</enum><text>Developing and implementing challenging State academic content standards, student academic achievement standards, and State curriculum frameworks in environmental education, including the need to balance conservation of the environment with the development of the Nation’s energy resources.</text> </paragraph> 
<paragraph id="HF165D7312DAE42E5A5EC8EF213F927CC"><enum>(2)</enum><text>Replicating or disseminating information about proven and tested model environmental education programs that—</text> 
<subparagraph id="HD03E6C50B7294F82B1F3D8A88DE5637E"><enum>(A)</enum><text>use the environment as an integrating theme or content throughout the curriculum;</text> </subparagraph> 
<subparagraph id="H8887C3E3B6D14C92A3576F91C0008FD9"><enum>(B)</enum><text>provide integrated, interdisciplinary instruction about natural, social, and economic systems along with field experience that provides students with opportunities to directly experience nature in ways designed to improve overall academic performance, self-esteem, personal responsibility, community involvement, personal health (including addressing child obesity issues), or their understanding of nature;</text> </subparagraph> 
<subparagraph id="H2AC48FC111E44B6ABB01DEF72D1DA9AB"><enum>(C)</enum><text display-inline="yes-display-inline">provide integrated instruction on waste reduction, reuse, recycling, and composting programs and, when possible, promote such activities within the school; or</text> </subparagraph> 
<subparagraph id="HEA3BD0D4F15F484DB381332EC4F004C"><enum>(D)</enum><text display-inline="yes-display-inline">address issues of environmental justice, including policies and methods for eliminating disparate enforcement of environmental laws and regulations, including with respect to low-income communities.</text></subparagraph></paragraph> 
<paragraph id="H73C5AB915EF2452491906B62007582B8" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">Developing and implementing new policy approaches to environmental education, which shall include a discussion of—</text> 
<subparagraph id="H29D5E64AE8804A248596546F1FA17F80"><enum>(A)</enum><text display-inline="yes-display-inline">the benefits and costs to the environment and to consumers regarding increasing the supply of energy produced in the United States from—</text> 
<clause id="H6F3FC07CD2CF4E69A43BE924E80584D"><enum>(i)</enum><text>oil and gas drilling;</text></clause> 
<clause id="HD5C4FFCC05F641E9B262B1A1E65A106"><enum>(ii)</enum><text>nuclear power;</text></clause> 
<clause id="H5B7A35145B824BC6A0D2A582D44F471"><enum>(iii)</enum><text>new coal technologies; and</text></clause> 
<clause id="H47D143D1E2B94A3EB64E7188002B097F"><enum>(iv)</enum><text>clean renewable and alternative sources of energy, including wind, solar, geothermal, hydropower, and advanced biofuels; and</text></clause></subparagraph> 
<subparagraph id="H0869500F2108491E8CB9914FC2EDB583"><enum>(B)</enum><text display-inline="yes-display-inline">the best strategies for reducing energy consumption through an enhanced emphasis on efficiency and conservation.</text></subparagraph></paragraph> 
<paragraph id="H43A429BCB2064AEEA35E7CF13CC87852"><enum>(4)</enum><text>Conducting studies of national significance that—</text> 
<subparagraph id="HFCE02672CB1F40BFB9FC0538DF4F14FE"><enum>(A)</enum><text>evaluate the effectiveness of teaching environmental education as a separate subject, and as an integrating concept or theme;</text> </subparagraph> 
<subparagraph id="H835D5DC5E66045D5BFFA8C9800A22306"><enum>(B)</enum><text>evaluate the effectiveness of using environmental education in helping students improve their assessment scores in mathematics, reading or language arts, science, and the other core academic subjects; or</text> </subparagraph> 
<subparagraph id="HE5356C2BC1BB474DB782087622F943A2"><enum>(C)</enum><text display-inline="yes-display-inline">evaluate ways to coordinate activities under this Act with existing Federal science teacher in-service training or professional development programs.</text> </subparagraph></paragraph> 
<paragraph id="H89D1B1A7080B4A64AFA7AEC915FEFFD"><enum>(5)</enum><text>Executing projects that advance widespread State and local educational agency adoption and use of environmental education content standards, including adoption and use of such standards in textbook selection criteria.</text> </paragraph> 
<paragraph display-inline="no-display-inline" id="H1BF51891EA4B48788CA0F16FF43D718"><enum>(6)</enum><text display-inline="yes-display-inline">Developing a State environmental literacy plan that includes the following:</text> 
<subparagraph id="H465CA9E9C5EE46A68DD806DF671D614"><enum>(A)</enum><text>A description of how the State educational agency will measure the environmental literacy of students, including—</text> 
<clause id="H0C2275480C7B4710BC10DFD4139409D5"><enum>(i)</enum><text>relevant State academic content standards and content areas regarding environmental education, and courses or subjects where environmental education instruction will take place; and</text> </clause> 
<clause id="H5386739F732D4D13A677005E627C87A2"><enum>(ii)</enum><text>a description of the relationship of the plan to the secondary school graduation requirements of the State.</text> </clause></subparagraph> 
<subparagraph id="H513504FC373148629E10DF68F7AEE87"><enum>(B)</enum><text>A description of programs for professional development for teachers to improve the teachers’—</text> 
<clause id="H6FEE38FC188A4ABBBF9609DC98C4729"><enum>(i)</enum><text>environmental content knowledge;</text> </clause> 
<clause id="H3D63CF5709964D65B85290B400737914"><enum>(ii)</enum><text>skill in teaching about environmental issues; and</text> </clause> 
<clause id="H2627EB807B2243FE8BBEE3B05FAB0024"><enum>(iii)</enum><text>field-based pedagogical skills.</text> </clause></subparagraph> 
<subparagraph id="HF87E5FEBAEA94D2591E36B55AC191322"><enum>(C)</enum><text>A description of how the State educational agency will implement the plan, including securing funding and other necessary support.</text> </subparagraph></paragraph> 
<paragraph id="H415101E3B80E45C88F002CE5AF31161E"><enum>(7)</enum><text>Developing evidence-based approaches to build capacity to increase the number of elementary and secondary environmental educators.</text> </paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H09FADCA3C26A49FDBC5FE0BB076406C4"><enum>(c)</enum><header>Applications</header><text display-inline="yes-display-inline">Each municipality, nonprofit organization, State educational agency, local educational agency, or institution of higher education desiring a grant under this section shall submit to the Secretary an application that contains a plan to initiate, expand, or improve environmental education programs in order to make progress toward meeting State standards for environmental learning (to the extent such standards exist) and environmental literacy and contains an evaluation and accountability plan for activities assisted under this section that includes rigorous objectives that measure the impact of activities funded under this section. Such application may describe how the applicant has partnered, or intends to partner, with a State and local park and recreation department.</text> </subsection> 
<subsection display-inline="no-display-inline" id="HF45B972F079C4DCAA836915F448D5882"><enum>(d)</enum><header>Requirements</header> 
<paragraph commented="no" id="HC6DD606D17E140EC8C1F576FCB2DB09B"><enum>(1)</enum><header>Annual report</header><text>In order to continue receiving grant funds under this section after the first year of a multi-year grant under this section, the grantee shall submit to the Secretary an annual report that—</text> 
<subparagraph commented="no" id="HEC30543A794B46FE90CCEC7EEB1C7953"><enum>(A)</enum><text>describes the activities assisted under this section that were conducted during the preceding year;</text> </subparagraph> 
<subparagraph commented="no" id="H7FE8465B094348818828DC7EF1EBAAA8"><enum>(B)</enum><text display-inline="yes-display-inline">describes the results of the grantee’s evaluation and accountability plan; and</text> </subparagraph> 
<subparagraph commented="no" id="H228341629A124C0FB7353990D105FD43"><enum>(C)</enum><text display-inline="yes-display-inline">demonstrates that the grantee has undertaken activities to accomplish at least one of the following:</text> 
<clause commented="no" id="HF94A9864E5FD4F0681DE19EA74965A0"><enum>(i)</enum><text>Responsibly preparing children to understand and address major challenges facing the United States, such as increasing the supply of clean energy, climate change, environmental health risks, and environmental disaster and emergency preparedness.</text> </clause> 
<clause commented="no" id="HDE8D6C2FF4CC42A3B058E434FADD412B"><enum>(ii)</enum><text>Supporting systemic education reform by strengthening environmental education as an integral part of the elementary school and secondary school curriculum.</text> </clause> 
<clause commented="no" id="HEBE2F74198674BABAC2FC7F1B9F1285B"><enum>(iii)</enum><text>Helping ensure that all students meet challenging State academic content and student academic achievement standards in environmental learning.</text> </clause> 
<clause commented="no" id="HE0657BF5E8844769BDB0C500A6FE6CB6"><enum>(iv)</enum><text>Supporting efforts to enable students to engage in environmental education.</text> </clause> 
<clause commented="no" id="HD78F8782B81D4859B433751B81AA4BF"><enum>(v)</enum><text>Leveraging and expanding private and public support for environmental education partnerships at national, State, and local levels.</text> </clause> 
<clause commented="no" id="H34AE1C7DE8504BECA61B00C400329B61"><enum>(vi)</enum><text>Awarding grants to initiate, expand, or improve environmental education programs for elementary and secondary students.</text> </clause> 
<clause commented="no" id="H11F4CC183F804F5F8E8F74EF34FE4781"><enum>(vii)</enum><text>Restoring and increasing field experiences as part of the regular school curriculum and schedule in order to improve students’ overall academic performance, self-esteem, personal responsibility, community involvement, personal health (including addressing child obesity issues), and understanding of nature.</text> </clause></subparagraph></paragraph> 
<paragraph id="H341E4AA7CCD14B13A04C2029B6417B23"><enum>(2)</enum><header>Administrative expenses</header><text>Not more than 5 percent of the grant funds made available to a nonprofit organization, State educational agency, local educational agency, or institution of higher education under this section for any fiscal year may be used for administrative expenses.</text> </paragraph> 
<paragraph id="H8326FC3F0809402E86B842E6600FF8F"><enum>(3)</enum><header>State environmental literacy plans</header> 
<subparagraph id="HCB74760BFFAD497192007FD04DD84490"><enum>(A)</enum><header>In general</header><text>A State educational agency receiving a grant under this section shall—</text> 
<clause id="H01EABF6B931B49B5BE7112544917A9ED"><enum>(i)</enum><text>have a State environmental literacy plan that is consistent with the requirements of subsection (b)(6) and that is peer reviewed within the State by a panel composed of experts in environmental education and representatives from other related State agencies; or</text> </clause> 
<clause id="H092E9E0D98F7453DA88CFDF3014B6562"><enum>(ii)</enum><text display-inline="yes-display-inline">develop a State environmental literacy plan described in subsection (b)(6) with funds made available under this section prior to using the grant funds for any other purpose.</text> </clause></subparagraph> 
<subparagraph id="HBB7E2EFDBF9C4F25BE5610881BDB2B2"><enum>(B)</enum><header>Peer review</header><text>If an environmental literacy plan described in subparagraph (A)(i) has not been peer reviewed within the State, the State educational agency, notwithstanding subsection (b), shall use funds made available under this section to complete such review, as described in such subparagraph, prior to using the grant funds for any other purpose.</text> </subparagraph> 
<subparagraph id="H73C1F9C0D9B84D41A50788A9FEE35233"><enum>(C)</enum><header>Other grantees</header><text display-inline="yes-display-inline">An applicant for a grant under this section that is not a State educational agency and applies for funding to be used for the purpose described in subsection (b)(6) shall demonstrate in the application that the applicant has consulted with the State educational agency about such use of funds.</text> </subparagraph></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H64F95EC8A32B440D9BFE008D060606B3"><enum>(e)</enum><header>Administrative provisions</header> 
<paragraph id="H3B105067334848C299E7D717FDEA4D8E"><enum>(1)</enum><header>Federal share</header><text>The Federal share under this section shall not exceed—</text> 
<subparagraph id="HC631506EB46E4DCCB34197C4F043BAFC"><enum>(A)</enum><text>90 percent of the total cost of a program assisted under this section for the first year for which the program receives assistance under this section;</text> </subparagraph> 
<subparagraph id="H4452797725D746A48708843B40585C9C"><enum>(B)</enum><text>75 percent of such cost for the second; and</text> </subparagraph> 
<subparagraph commented="no" id="HF389F9E4829348B7A5F7CB8D8416545"><enum>(C)</enum><text>50 percent of such cost for each subsequent such year.</text> </subparagraph></paragraph> 
<paragraph id="H5F7BFC8D201C4E78823DF91542229900"><enum>(2)</enum><header>Report to Congress</header><text>Not later than one year after enactment of this bill, the Secretary shall submit to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report that—</text> 
<subparagraph id="HB73640702E4B41568C4EE2B91E42F7D5"><enum>(A)</enum><text>describes the programs assisted under this section;</text> </subparagraph> 
<subparagraph id="HE6EDDDC31C7547FEB57850731BB391FF"><enum>(B)</enum><text>documents the success of such programs in improving national and State environmental education capacity; and</text> </subparagraph> 
<subparagraph id="HE593A88591B846779DB8E2343FC2FD4"><enum>(C)</enum><text>makes such recommendations as the Secretary determines appropriate for the continuation and improvement of the programs assisted under this section.</text> </subparagraph></paragraph> 
<paragraph id="H5D0411932B7043B7925EB8A515A78162"><enum>(3)</enum><header>Availability of funds</header><text>Amounts made available to the Secretary to carry out this section shall remain available until expended.</text> </paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H1EC61BC338F6489C84EFEF784200F657"><enum>(f)</enum><header>Supplement, not supplant</header><text>Funds made available under this section shall be used to supplement, and not supplant, any other Federal, State, or local funds available for environmental education activities.</text> </subsection> 
<subsection id="H3FE6FFE8BE4240B39BB8C76C7F4E212F"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for fiscal year 2009.</text> </subsection></section> 
<section id="H61FF48915800416F8C1C9C8B8F4DD9B2"><enum>12.</enum><header>Accountability</header> 
<subsection id="H6DCB87D3F16E47058440EBC3B1EBB40"><enum>(a)</enum><header>Quality indicators</header><text display-inline="yes-display-inline">The Administrator, the Secretary, and the Foundation each shall establish indicators of program quality for the programs and activities funded under this Act (other than fellowship awards funded under section 7) that such official or entity administers.</text> </subsection> 
<subsection id="HE3C67904A0054BFEB765A46487892447"><enum>(b)</enum><header>Minimum indicators</header><text display-inline="yes-display-inline">Such indicators of program quality, at a minimum, shall—</text> 
<paragraph id="HC3D2DA44FDC24DA0AFDCA424D1F6A4D0"><enum>(1)</enum><text>enhance understanding of the natural and built environment;</text> </paragraph> 
<paragraph id="H482FA0CFE6FE4728A93EFCB1CEA9E000"><enum>(2)</enum><text>foster a better appreciation of the interdisciplinary nature of environmental issues and conditions;</text> </paragraph> 
<paragraph id="HCC2CD6BAD0974D6C8859EC2EC352A500"><enum>(3)</enum><text>increase achievement in related areas of national interest, such as mathematics and science;</text> </paragraph> 
<paragraph id="H8A1DE83159444511A422040127A93564"><enum>(4)</enum><text>increase understanding of the benefits of exposure to the natural environment;</text> </paragraph> 
<paragraph id="H4D67DEEDC6084606A0A4AC1C19A51012"><enum>(5)</enum><text>improve understanding of how human and natural systems interact together;</text> </paragraph> 
<paragraph id="HB8A65262AE2D44A700A6D1244E583D9D"><enum>(6)</enum><text>broaden awareness of environmental issues; and</text> </paragraph> 
<paragraph id="HCD11D2A48BC34DFAACF1E3E2C3893D4"><enum>(7)</enum><text>include such other indicators as the Administrator, Secretary, or Foundation may develop.</text> </paragraph></subsection> 
<subsection id="H8476571C14A84679BD6CC7E4BA170863"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Each recipient receiving funds under this Act, other than fellowship recipients under section 7, shall report annually to the Administrator, the Secretary, or the Foundation regarding progress made in meeting the minimum indicators of program quality established under subsection (b). The Administrator, the Secretary, and the Foundation shall disseminate such information widely to the public through electronic and other means.</text> </subsection></section> <after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H47810ADDB7AC4437A6A4AD19E42109C3"><enum>(e)</enum><header>Restrictions on Federal Government and use of Federal funds</header><text display-inline="yes-display-inline">The National Environmental Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/5501">20 U.S.C. 5501 et seq.</external-xref>), as amended by subsection (d), is further amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H5F506695843548ED86ADC99D32E9EFF9" style="OLC"> 
<section id="H00CF586DC6234AF0B86BE564834287E6"><enum>14.</enum><header>Restrictions on Federal Government and use of Federal funds</header> 
<subsection id="H5D95937A3E994EE6A0F1CC9B572005E"><enum>(a)</enum><header>General Prohibition</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to authorize an officer or employee of the Federal Government to mandate, direct, or control a State, local educational agency, or school’s curriculum, program of instruction, specific instructional content, academic achievement standards, assessments, or allocation of State or local resources, or mandate a State or any subdivision thereof to spend any funds or incur any costs not paid for under this Act.</text> </subsection> 
<subsection id="H7C9FBF0D09DC4546841F97E04EBE35DF"><enum>(b)</enum><header>Prohibition on Endorsement of Curriculum</header><text>No funds provided to the Administrator or Secretary under this Act may be used by the Agency or Department of Education to endorse, approve, or sanction any curriculum designed to be used in an elementary school or secondary school.</text> </subsection> 
<subsection id="H3AAEC61A6A264557A308446C8ED3EAD7"><enum>(c)</enum><header>Prohibition on requiring Federal approval or certification of standards</header><text>No State shall be required to have academic content or student academic achievement standards approved or certified by the Federal Government, in order to receive assistance under this Act.</text> </subsection> 
<subsection id="H5816FF638E8E4EBD8DB6D145A623C9CA"><enum>(d)</enum><header>Restrictions on partisan political influence</header> 
<paragraph id="H84981E27284F4016B7A26CD005B0CF20"><enum>(1)</enum><header>In general</header><text>In carrying out the activities described in this Act, the Administrator and Secretary shall ensure that such activities—</text> 
<subparagraph id="HF0F554D97FC64DF0BB2FA48DE927B94E"><enum>(A)</enum><text>conform to high standards of quality, integrity, and accuracy;</text> </subparagraph> 
<subparagraph id="H371FEC7A00BA4FD6B7121FA294229063"><enum>(B)</enum><text>are objective, neutral, and nonideological and are free of partisan political influence; and</text> </subparagraph> 
<subparagraph id="H0AC0B9A126B142698113A73E79D13EFB"><enum>(C)</enum><text>do not advocate a particular political viewpoint.</text> </subparagraph></paragraph> 
<paragraph id="HDEC342E921844D559544D073C381013D"><enum>(2)</enum><header>Actions to implement and enforce</header><text>The Administrator and Secretary shall take such actions as are necessary to ensure that the provisions of this section are vigorously implemented and enforced.</text> </paragraph></subsection></section> <after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H9BF943D1916043399E7617782F6C0640"><enum>(f)</enum><header>Conforming amendment</header><text>The table of contents in section 1(b) of the National Environmental Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/5501">20 U.S.C. 5501</external-xref> note) is amended by striking the item relating to section 11 and inserting the following:</text>
