		<section id="HFD924CD1C6D343D384003556C24BE4A0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Effective Law Enforcement through
			 Transparent Interrogations Act of 2007</short-title></quote>.</text>
		</section><section id="HF237CF4FF0CE4F14B6FEE6B1E0D370EF"><enum>2.</enum><header>Recording of
			 Federal investigative interrogations</header>
			<subsection id="HE4C94B7EFE3F481AB60058B7EAA6D000"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/223">Chapter 223</external-xref> of title 18,
			 United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF7D9967CB1F4473A96CF12E497B5453" style="USC">
					<section id="H7BDF0C064F7F4FA4A387DB6102B17C70"><enum>3512.</enum><header>Recording of
				Federal investigative interrogations</header>
						<subsection id="H70E8D051A5044E079816B36595B54281"><enum>(a)</enum><header>Generally
				required</header><text>Except as provided in this section, statements by an
				individual obtained in an unrecorded custodial interrogation after the date of
				the enactment of this section are inadmissible against that individual in a
				prosecution for a Federal felony.</text>
						</subsection><subsection id="HD6BB0A65C27F41BF9EAAC971C6A38BED"><enum>(b)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Subsection (a) does not apply if the court
				determines an imminent threat of bodily injury or other exigent circumstance
				made the recording of the interrogation impracticable.</text>
						</subsection><subsection id="HF9CBC100D892435C9CBCFF2EFDD415D6"><enum>(c)</enum><header>Definitions</header><text>In
				this section—</text>
							<paragraph id="H9B39CC22CB124DC5B57EE600DADEE4"><enum>(1)</enum><text>the term
				<term>custodial interrogation</term> means questioning of an individual while
				the individual is in the custody of a law enforcement officer in connection
				with a criminal investigation;</text>
							</paragraph><paragraph id="H47446B07DF474C89B3DAE99B15510592"><enum>(2)</enum><text>the term
				<term>unrecorded</term> means, with respect to a custodial interrogation, that
				the interrogation, including the advice required by law to be given to the
				individual of that individual’s constitutional rights, was not entirely
				captured in an electronic recording that is available at the time of the trial
				for the felony in which evidence is sought to be introduced;</text>
							</paragraph><paragraph id="H3D9E3689DD3B41BBBF8DB800CEC5BA49"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>electronic recording</term>
				means a complete and authentic electronic recording created by visual or audio
				media, including by motion picture, videotape, audio tape or digital media;
				and</text>
							</paragraph><paragraph id="H08058717BD8A48DFB8C1F147BC7B9988"><enum>(4)</enum><text>the term <term>law
				enforcement officer</term> means an individual acting with public authority to
				investigate or prosecute a criminal
				offense.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H34D6F69BC95E4F1388C42CF9CE3B6B6C"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections at the beginning of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/223">chapter 223</external-xref> of title 18,
			 United States Code, is amended by adding at the end the following new
			 item:</text>
