		<section id="HD074B4D5424F41D7AFB969851B549CCF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Market
			 Transparency Reporting of United States Transactions Act of
			 2007</quote>.</text>
		</section><section id="H0FFA26B09FA44EE38876CC26E330099"><enum>2.</enum><header>Over-the-counter
			 transactions in natural gas</header>
			<subsection id="HF5D9AA265C184010AB4800C600A7B21"><enum>(a)</enum><header>Definitions</header><text>Section
			 1a of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1a">7 U.S.C. 1a</external-xref>) is amended by adding at the end
			 the following:</text>
				<quoted-block id="H58EB8A21C38640ABA76CCB00A2C8B985" style="OLC">
					<paragraph id="HA4FD6CC3E8304AE5A56C713D00EB7FA"><enum>(34)</enum><header>Included natural
				gas transaction</header><text>The term <quote>included natural gas
				transaction</quote> means a contract, agreement, or transaction in natural gas
				that is entered into—</text>
						<subparagraph id="H704B698C020947EDAE6169CC7B5110BD"><enum>(A)</enum><text>in reliance on the
				provisions of subsection (g) or (h) of section 2; or</text>
						</subparagraph><subparagraph id="H2F7A16612A6E4FD783603800726D48E1"><enum>(B)</enum><text>by use of a
				domestic technology or software providing direct access to a foreign board of
				trade.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8CEF2585BDA34982BDDF521575879E8E"><enum>(b)</enum><header>Reporting of
			 excluded transactions in natural gas</header><text>Section 2(g) of such Act (7
			 U.S.C. 2(g)) is amended—</text>
				<paragraph id="HAA88F394620145E692C5A2C9DEE62CD"><enum>(1)</enum><text>by
			 striking <quote>or</quote> after <quote>5d,</quote>;</text>
				</paragraph><paragraph id="HEC5952DBC953489399FF81BE2E59C5EF"><enum>(2)</enum><text>by inserting
			 <quote>, or paragraphs (4) and (5) of this subsection (with respect to any
			 contract, agreement, or transaction in natural gas))</quote> after
			 <quote>12(e)(2)</quote>; and</text>
				</paragraph><paragraph id="H090EDAA0EAC54B9F975C1E7B2EFAD24"><enum>(3)</enum><text>by
			 adding at the end the following:</text>
					<quoted-block id="HB56C5A386F014044A08868E7AE914400" style="OLC">
						<paragraph id="HF0081713BD5244B18694475481B7000"><enum>(4)</enum><text>It shall be a
				violation of this subsection for any person to enter into any contract,
				agreement, or transaction in natural gas relying on the exemption provided in
				this subsection if the person, directly or indirectly, has, obtains, owns,
				controls, or maintains a position in a contract, agreement, or transaction in
				natural gas equal to or in excess of such amount as the Commission from time to
				time shall fix, unless the person files or causes to be filed with the properly
				designated officer of the Commission such reports as the Commission may require
				by rule, regulation, or order with respect to any position in any contract,
				agreement, or transaction in natural gas described in this section.</text>
						</paragraph><paragraph id="HC75B693320AA44BAAE402EEF4364515"><enum>(5)</enum><text>Any person entering
				into any contract, agreement, or transaction relying on the exemption provided
				in this subsection shall maintain books and records relating to each such
				transaction, showing complete details of the transactions, positions,
				inventories, and commitments, including the names and addresses of all persons
				having any interest therein, for a period of 5 years, in such form as the
				Commission shall require by rule, regulation, or order. The books and records
				shall be open for inspection by any representative of the Commission or of the
				Department of
				Justice.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HCFEC29ED7429448B00D44499ECBEC04D"><enum>(c)</enum><header>Reporting of
			 exempt transactions in natural gas</header><text>Section 2(h) of such Act (7
			 U.S.C. 2(h)) is amended—</text>
				<paragraph id="H4D6ED257BBC24288AC1265632C7CE577"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="H573C59A8FBE642C8B99265EEC663B8C"><enum>(A)</enum><text>by inserting
			 <quote>and the persons that enter into such a contract, agreement, or
			 transaction</quote> after <quote>subsection</quote>;</text>
					</subparagraph><subparagraph id="H2CE2FB0ACDC245CDA5690210EDBE62D"><enum>(B)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (B);</text>
					</subparagraph><subparagraph id="HFC3B550ACDE04793BC70A720D8B9F98E"><enum>(C)</enum><text>by striking the
			 period at the end of subparagraph (C) and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="H2D1E0474868C4D12B9569D24002CAAC3"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H43C63B3DC720461E9C1913225F0919EE" style="OLC">
							<subparagraph id="H5E9854C2F2E94003BA84059FA77CB249"><enum>(D)</enum><text>paragraphs (7) and
				(8) of this
				section.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HBE4ACD1C15F447A89CACE3F7F840BB41"><enum>(2)</enum><text>in paragraph
			 (4)—</text>
					<subparagraph id="H6A0283B6251D4E639F36584C381CA387"><enum>(A)</enum><text>by inserting
			 <quote>and the persons that enter into such a contract, agreement, or
			 transaction</quote> after <quote>subsection</quote>;</text>
					</subparagraph><subparagraph id="HF2168DC461E14769A0DB852171BAC487"><enum>(B)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (C);</text>
					</subparagraph><subparagraph id="H2AA0FDF214054036889BB58C2C6B5E84"><enum>(C)</enum><text>by redesignating
			 subparagraph (D) as subparagraph (E) and inserting after subparagraph (C) the
			 following:</text>
						<quoted-block id="H654B287E8B424066A91452EAAE82DA00" style="OLC">
							<subparagraph id="HFD41580B62434192A9A850E5F5E6E6CC"><enum>(D)</enum><text>paragraphs (7) and
				(8) of this section; and</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HF19F513E994841A1AEB4703FB63E54F8"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HB86E22A160FB4A0CBDDFCDBF9EB40041" style="OLC">
						<paragraph id="H6BEE9DEE0F9343C088A1DDEA119D5705"><enum>(7)</enum><text>It shall be a
				violation of this subsection for any person to enter into any contract,
				agreement, or transaction in natural gas relying on the exemption provided in
				this subsection if the person, directly or indirectly, has, obtains, owns,
				controls, or maintains a position in a contract, agreement, or transaction in
				natural gas equal to or in excess of such amount as the Commission from time to
				time shall fix, unless the person files or causes to be filed, or with respect
				to a contract, agreement, or transaction entered into on an electronic trading
				facility, the electronic trading facility files or causes to be filed on such
				person’s behalf, with the properly designated officer of the Commission, such
				reports as the Commission may require by rule, regulation, or order with
				respect to any position in such contracts, agreements, or transactions in
				natural gas described in this section.</text>
						</paragraph><paragraph id="H610C281E7C0B4C8287AE960C6E46FF0"><enum>(8)</enum><text>Any person entering
				into any contract, agreement, or transaction in natural gas relying on the
				exemption provided in this subsection shall maintain books and records relating
				to each such transaction and showing complete details of such transactions,
				positions, inventories, and commitments, including the names and addresses of
				all persons having any interest therein, for a period of 5 years, in such form
				as the Commission shall require by rule, regulation, or order. The records
				shall be open for inspection by any representative of the Commission or of the
				Department of
				Justice.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H030D6DEE3A314351AE7722E75076E644"><enum>3.</enum><header>Authority to
			 require filing of reports</header><text display-inline="no-display-inline">The
			 Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1">7 U.S.C. 1–25</external-xref>) is amended by inserting after section 4p
			 the following:</text>
			<quoted-block display-inline="no-display-inline" id="H18AC1035FC954ECDB539A777CEEE9A2" style="OLC">
				<section id="H159B09DE010C45A4970037669E410892"><enum>4q.</enum><header>Filing of
				reports of transactions in natural gas</header>
					<subsection id="H7BD2FE616C484B5C8CF2493DC73527ED"><enum>(a)</enum><header>In
				general</header><text>The Commission shall establish a reporting system with
				respect to large positions in included natural gas transactions, as defined in
				section 1a(34), that a person may, directly or indirectly, have, obtain, own,
				control, or maintain.</text>
					</subsection><subsection id="H39643080F5454B46860053B35E491312"><enum>(b)</enum><header>Required
				information</header><text>Such required reports with respect to included
				natural gas transactions, as defined in section 1(a)(34), shall be in
				sufficient detail and with sufficient frequency to enable the Commission to
				assess the overall trading activities, potential market power, and
				concentration of positions directly or indirectly held, obtained, owned,
				controlled, or maintained by the largest traders and to assess these factors in
				relation to the amount of potential deliverable supplies in natural gas
				directly or indirectly held, obtained, owned, controlled or maintained by the
				traders and shall enable the Commission to aggregate the positions with respect
				to the person’s separately owned or controlled accounts.</text>
					</subsection><subsection id="H79455245EBBC4EBA85048E42B579FB31"><enum>(c)</enum><header>Confidentiality
				of information</header><text>The reports with respect to included natural gas
				transactions described in subsection (b) shall be subject to section 8.</text>
					</subsection><subsection id="HE9324B97EC474B9E992CF5E256C9BE8"><enum>(d)</enum><header>Market
				transparency</header><text>The Commission shall publish on a regular basis a
				report or reports with respect to the information reported to it with respect
				to included natural gas transactions. The report or reports shall include on a
				summary basis information with respect to aggregate reportable positions held
				by commercial persons and noncommercial persons and may not reveal the specific
				identity or size of positions of individual persons.</text>
					</subsection><subsection id="H14DDF7D9525A4ED797BC4B832108524C"><enum>(e)</enum><header>Required
				rules</header><text>The Commission shall issue rules, regulations, or an order
				to implement this section within 270 days after the date of the enactment of
				this
				section.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H4AF71EB3CA79499187A8DB44594BEBA2"><enum>4.</enum><header>Criminal and
			 civil penalties</header>
			<subsection commented="no" id="H7429E351A61C4122A3759098D871F062"><enum>(a)</enum><header>Civil money
			 penalties</header><text>Section 6(c) of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/9">7 U.S.C. 9</external-xref>,
			 15) is amended in clause (3) of the 10th sentence, by striking
			 <quote>$100,000</quote> and inserting <quote>$500,000</quote>.</text>
			</subsection><subsection id="H07498C9F57DF4BBBA157C11E45FF8C3F"><enum>(b)</enum><header>Increase in
			 penalties</header><text>Section 6c(d)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/13a-1">7 U.S.C. 13a–1(d)(1)</external-xref>) is
			 amended by striking <quote>$100,000</quote> and inserting
			 <quote>$500,000</quote>.</text>
			</subsection><subsection id="H286868E91FCE40DEA741FE4D8EE27EC"><enum>(c)</enum><header>Criminal
			 penalties</header><text>Section 9(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/13">7 U.S.C. 13</external-xref>) is amended in
			 the matter preceding paragraph (1) by inserting after <quote>(or</quote> the
			 following: <quote>for any violation other than manipulation or attempted
			 manipulation of the price of any commodity in interstate commerce, or for
			 future delivery on or subject to the rules of any registered entity, or the
			 cornering or attempt to corner any such commodity or knowingly to deliver or
			 cause to be delivered for transmission through the mails or interstate commerce
			 by telegraph, telephone, wireless, or other means of communication false,
			 misleading, or knowingly inaccurate reports concerning crop or market
			 information or conditions that affect or tend to affect the price of any
			 commodity in interstate commerce</quote>.</text>
			</subsection></section></legis-body>
