<legis-type>AN ACT</legis-type> 
<official-title display="yes">To improve the use of a grant of a parcel of land to the State of Idaho for use as an agricultural college, and for other purposes.</official-title>

<section display-inline="no-display-inline" id="HF5B5383C3CF949A9B20007CB67F3A240" section-type="section-one"><enum>1.</enum><header>Agricultural college land grant</header> 
<subsection id="HC6A96E175AA74999BFFCBA0000A66BBD"><enum>(a)</enum><header>In general</header><text>Section 10 of the Act of July 3, 1890 (26 Stat. 215, chapter 656) is amended—</text> 
<paragraph id="HAD451BA7680B4297BAABE27D64A822A2"><enum>(1)</enum><text>by inserting <quote>(a)</quote> after <quote><header-in-text level="subsection" style="OLC">Sec.</header-in-text> 10.</quote>; and</text> </paragraph>
<paragraph id="HAFF0C43835A64BEA00B66260F52F54B3"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="H035144B3A84B47D8A79EEB5F53BE589F"><enum>(b)</enum><text>Notwithstanding sections 3 through 5 of the Act of July 2, 1862 (commonly known as the <quote>First Morrill Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/7/303">7 U.S.C. 303 et seq.</external-xref>), the State of Idaho may—</text> 
<paragraph id="HF497508263734FD6971F228F1E229224"><enum>(1)</enum><text>invest and manage earnings and proceeds derived from land granted to the State of Idaho pursuant to subsection (a), in accordance with the standards applicable to a trustee under Idaho law;</text> </paragraph>
<paragraph id="H850546CFC1964760A14B2268D7732EEA"><enum>(2)</enum><text>deduct from earnings and proceeds generated from granted land any expenses that a trustee is authorized to deduct pursuant to Idaho law; and</text> </paragraph>
<paragraph id="H5696F9BFDCFF49D780ACF000DBDF6E09"><enum>(3)</enum><text>use earnings and proceeds generated by the granted land for any uses and purposes described in that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301 et seq.</external-xref>) without regard to the limitations set out in section 5 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/305">7 U.S.C. 305</external-xref>) that prohibit the State from exceeding 10 per centum on the purchase of land and prohibit the State from purchasing, erecting, preserving, or repairing of any building or buildings.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="H2F5B46FF100749E996E620D5CF672645"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on October 27, 1998.</text> </subsection></section>
