			 <quote><short-title>Rural Aviation Improvement
			 Act</short-title></quote>.</text>
		</section><section id="HF44A80AA61D44D808F63DE8FBF2B51E5"><enum>2.</enum><header>Repeal of
			 essential air service local participation program</header>
			<subsection id="H389781B3DA2C44809FDAC590076B700"><enum>(a)</enum><header>In
			 general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States
			 Code, is amended by striking section 41747, and such title 49 shall be applied
			 as if such section 41747 had not been enacted.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H349E411C78154372AD7C82BCD7D57BB1"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States
			 Code, is amended by striking the item relating to section 41747.</text>
			</subsection></section><section commented="no" id="H743B55F4E3C04FC587F33796B713188F"><enum>3.</enum><header>Per passenger
			 subsidy for essential air service</header>
			<subsection commented="no" id="HFF54AED1A5404D7FB9F8D12D4837168B"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/41742">Section 41742</external-xref> of title 49, United States Code, is amended
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H07DFF8EEDCBF4CD29BD3DB76B500291E" style="OLC">
					<subsection commented="no" id="HC64E961450A04B5C00E2A958B81FF73D"><enum>(c)</enum><header>Per passenger
				subsidy cap</header>
						<paragraph commented="no" id="H749EF503DA5846E6ADB1189C6EE3AD18"><enum>(1)</enum><header>In
				general</header><text>The Secretary of Transportation may not provide
				compensation to an air carrier to provide air transportation under this
				subchapter to an otherwise eligible place in the 48 contiguous States if the
				eligible place—</text>
							<subparagraph commented="no" id="HAB46D93EB89F4AC790F858F0C430835D"><enum>(A)</enum><text>is located fewer
				than 70 highway miles from the nearest large or medium hub airport; or</text>
							</subparagraph><subparagraph commented="no" id="HFFCF3CC9555C4DCA80DC87F20570DDC4"><enum>(B)</enum><text>is fewer than 210
				miles from the nearest large or medium hub airport and requires a per passenger
				subsidy in excess of the dollar amount described in paragraph (2).</text>
							</subparagraph></paragraph><paragraph commented="no" id="HF08F99899BB946179900B7FF79F2AFC9"><enum>(2)</enum><header>Dollar amount of
				per passenger subsidy</header>
							<subparagraph commented="no" id="HE83D0586C6C5467EA3BE53706CD62731"><enum>(A)</enum><header>In
				general</header><text>The dollar amount described in this paragraph is—</text>
								<clause commented="no" id="H5B71B944858C4B3AB0551D98CEA6DED2"><enum>(i)</enum><text>for calendar year
				2008, $200; and</text>
								</clause><clause commented="no" id="H423D48E66A5947CB976CF5D6AD303100"><enum>(ii)</enum><text>for each calendar
				year after calendar year 2008, $200 increased by an amount equal to—</text>
									<subclause commented="no" id="H905999343A434BFC924D4EA725520025"><enum>(I)</enum><text>$200, multiplied
				by</text>
									</subclause><subclause commented="no" id="H97D71DBA7F6B41E2A59488A27E24F8C0"><enum>(II)</enum><text>the percentage
				(if any) by which the CPI for the preceding calendar year exceeds the CPI for
				calendar year 2007.</text>
									</subclause></clause></subparagraph><subparagraph commented="no" id="HA9E49808FC804B1FB9066041CD8B2D26"><enum>(B)</enum><header>Rounding</header><text>Any
				increase under subparagraph (A)(ii) shall be rounded to the nearest
				dollar.</text>
							</subparagraph></paragraph><paragraph commented="no" id="HCECF74E819F540F38E932D10FE3C1617"><enum>(3)</enum><header>Definitions</header><text>In
				this subsection:</text>
							<subparagraph commented="no" id="HC2D68997D6954C7BAB531F7F85E8A900"><enum>(A)</enum><header>CPI for the
				preceding calendar year</header><text>The term <term>CPI for the preceding
				calendar year</term> means the average of the Consumer Price Index as of the
				close of the 12-month period ending on August 31 of such calendar year.</text>
							</subparagraph><subparagraph commented="no" id="HB2631236430A47309DE7B6CEAC9F3DBF"><enum>(B)</enum><header>Consumer Price
				Index</header><text>The term <term>Consumer Price Index</term> means the last
				Consumer Price Index for all-urban consumers published by the Department of
				Labor.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H70DDFAE80ABE4005BD14DEBD5E48F822"><enum>(b)</enum><header>Per passenger
			 subsidy defined</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/41731">Section 41731(a)</external-xref> of title 49, United States Code,
			 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HBDE9FA21D6B14A2B8394ACF00107E3AC" style="OLC">
					<paragraph commented="no" id="H6C7321E3724A4FCD910489ABE0A5661C"><enum>(3)</enum><text><term>per
				passenger subsidy</term> means—</text>
						<subparagraph commented="no" id="H5AAE83E061FC4585B5EFC64E53501F91"><enum>(A)</enum><text>the total
				compensation provided by the Secretary of Transportation to an air carrier
				under this subchapter that is necessary for the air carrier to provide air
				transportation to an eligible place, divided by</text>
						</subparagraph><subparagraph commented="no" id="H89437EAD0D514E1C84565BD9E403E48"><enum>(B)</enum><text>the total number of
				passengers using such air
				transportation.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H1718B2D93D9644028632E7733DA255A8"><enum>(c)</enum><header>Conforming
			 repeal</header><text>Section 332 of the Department of Transportation and
			 Related Agencies Appropriations Act, 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/69">Public Law 106–69</external-xref>; 49 U.S.C. 41731
			 note) is repealed.</text>
			</subsection></section><section commented="no" id="HB471F7951F714EF7B483DE481FDD34EC"><enum>4.</enum><header>Communities above
			 per passenger subsidy cap</header>
			<subsection commented="no" id="H01B4436448FB4481AB5D277D07C466F5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter II of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States Code, is amended by adding at the end
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H12E3946EBA6C4483AB53403D5DB6FFD7" style="USC">
					<section commented="no" id="H3A14F56DC36241D180679743EBF417D5" section-type="subsequent-section"><enum>41749.</enum><header>Essential air
				service for eligible places above per passenger subsidy cap</header>
						<subsection commented="no" id="H5A63C36C88A94E60BF0902F5B249A4B1"><enum>(a)</enum><header>Proposals</header><text>A
				State or local government may submit a proposal to the Secretary of
				Transportation for compensation for an air carrier to provide air
				transportation to a place described in subsection (b).</text>
						</subsection><subsection commented="no" id="HB18B0C55DE544EED84AE5567699E357B"><enum>(b)</enum><header>Place
				described</header><text>A place described in this subsection is a place—</text>
							<paragraph commented="no" id="HECD6D7D00A3C4E2E90EB0785A14452B3"><enum>(1)</enum><text>that is otherwise
				an eligible place; and</text>
							</paragraph><paragraph commented="no" id="H2886382349764936AF9BC54CA83D34E"><enum>(2)</enum><text>for which the per
				passenger subsidy exceeds the dollar amount allowable under section
				41742(c).</text>
							</paragraph></subsection><subsection commented="no" id="H9E99239AE10A402EAE203DEDC883007D"><enum>(c)</enum><header>Decisions</header><text>Not
				later than 90 days after receiving a proposal under subsection (a) for
				compensation for an air carrier to provide air transportation to a place
				described in subsection (b), the Secretary shall—</text>
							<paragraph commented="no" id="H3E65F2FEBE714A54AF1E695C65F0C342"><enum>(1)</enum><text>decide whether to
				provide compensation for the air carrier to provide air transportation to the
				place; and</text>
							</paragraph><paragraph commented="no" id="HAC4D27BAB98D4748BE22C6D885C41795"><enum>(2)</enum><text>approve the
				proposal if the State or local government or a person is willing and able to
				pay the difference between—</text>
								<subparagraph commented="no" id="HD80518BEB2EC4FE9942687B6052D6708"><enum>(A)</enum><text>the per passenger
				subsidy; and</text>
								</subparagraph><subparagraph commented="no" id="HF7C07A8349EB40D58DDEB46817E58528"><enum>(B)</enum><text>the dollar amount
				allowable for such subsidy under section 41742(c).</text>
								</subparagraph></paragraph></subsection><subsection commented="no" id="H5CB7CE4F97CE446199087EF2AEFA4E09"><enum>(d)</enum><header>Compensation
				payments</header>
							<paragraph commented="no" id="HFF35410179964B43A218F2C9A5F0DE63"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall pay compensation under this section
				at such time and in such manner as the Secretary determines is
				appropriate.</text>
							</paragraph><paragraph commented="no" id="H7E40009E1639472CA5EF5EC108B47B29"><enum>(2)</enum><header>Duration of
				payments</header><text>The Secretary shall continue to pay compensation under
				this section only as long as—</text>
								<subparagraph commented="no" id="H26F5442F20C2445F87A8CF2356F269C"><enum>(A)</enum><text>the State or local
				government or person agreeing to pay compensation under subsection (c)(2)
				continues to pay such compensation; and</text>
								</subparagraph><subparagraph commented="no" id="HBCC1748CC8FC407CBEDD21002FFC1898"><enum>(B)</enum><text>the Secretary
				decides the compensation is necessary to maintain air transportation to the
				place.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" id="H3B7AA045B1714E068400791B3BDC578D"><enum>(e)</enum><header>Review</header>
							<paragraph commented="no" id="HBF9A97BC751148E99E3F4FF2ACDECC4"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall periodically review the type and
				level of air service provided under this section.</text>
							</paragraph><paragraph commented="no" id="HFB2C1AE4E161431782C646C8DBD62AD"><enum>(2)</enum><header>Consultation</header><text>The
				Secretary may make appropriate adjustments in the type and level of air service
				to a place under this section based on the review under paragraph (1) and
				consultation with the affected community and the State or local government or
				person agreeing to pay compensation under subsection (c)(2).</text>
							</paragraph></subsection><subsection commented="no" id="HD63285D981E341C592638B4E4FF51918"><enum>(f)</enum><header>Ending,
				suspending, and reducing air transportation</header><text>An air carrier
				providing air transportation to a place under this section may end, suspend, or
				reduce such air transportation if, not later than 30 days before ending,
				suspending, or reducing such air transportation, the air carrier provides
				notice of the intent of the air carrier to end, suspend, or reduce such air
				transportation to—</text>
							<paragraph commented="no" id="H020AE026464348B49C183C2751D560B3"><enum>(1)</enum><text>the
				Secretary;</text>
							</paragraph><paragraph commented="no" id="H27F21C947339464BBE9B55C6CA89D346"><enum>(2)</enum><text>the affected
				community; and</text>
							</paragraph><paragraph commented="no" id="HCB58C7C735374352BCDE35DC6E91BAD7"><enum>(3)</enum><text>the State or local
				government or person agreeing to pay compensation under subsection
				(c)(2).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H616E677941C24151AEAC6B73842F62FE"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States
			 Code, is amended by adding after the item relating to section 41748 the
			 following new item:</text>

			</subsection></section><section commented="no" id="H99B28F3D33CD48B9A3DCC214C9CE14D"><enum>5.</enum><header>Preferred
			 essential air service</header>
			<subsection commented="no" id="HC39967186147496E9B2F66F29E486208"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter II of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States Code, as amended by section 4, is
			 further amended by adding after section 41749 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H4D490A50A34C40ECAE45297B76AD6E4E" style="USC">
					<section commented="no" id="H84B152174A2C458293C858A1A110D597"><enum>41750.</enum><header>Preferred
				essential air service</header>
						<subsection commented="no" id="H4020FC80B0394097BAC5B11EB8B3F339"><enum>(a)</enum><header>Proposals</header><text>A
				State or local government may submit a proposal to the Secretary of
				Transportation for compensation for a preferred air carrier described in
				subsection (b) to provide air transportation to an eligible place.</text>
						</subsection><subsection commented="no" id="HFAA18D651D154939A2EB56005D3CE14C"><enum>(b)</enum><header>Preferred air
				carrier described</header><text>A preferred air carrier described in this
				subsection is an air carrier that—</text>
							<paragraph commented="no" id="HA761225376454F0D8CAF0369D17D893C"><enum>(1)</enum><text>submits an
				application under section 41733(c) to provide air transportation to an eligible
				place;</text>
							</paragraph><paragraph commented="no" id="HCA7D5EC39C2245A9A53342D7880215EF"><enum>(2)</enum><text>is not the air
				carrier that submits the lowest cost bid to provide air transportation to the
				eligible place; and</text>
							</paragraph><paragraph commented="no" id="H50F137653B044383B9BD88CAFDC23262"><enum>(3)</enum><text>is an air carrier
				that the affected community prefers to provide air transportation to the
				eligible place instead of the air carrier that submits the lowest cost
				bid.</text>
							</paragraph></subsection><subsection commented="no" id="H7F47A7189ADF421CB317D0FBAD96202"><enum>(c)</enum><header>Decisions</header><text>Not
				later than 90 days after receiving a proposal under subsection (a) for
				compensation for a preferred air carrier described in subsection (b) to provide
				air transportation to an eligible place, the Secretary shall—</text>
							<paragraph commented="no" id="HBEA8956D6AFB411CA0B97F90CC004420"><enum>(1)</enum><text>decide whether to
				provide compensation for the preferred air carrier to provide air
				transportation to the eligible place; and</text>
							</paragraph><paragraph commented="no" id="H9824906F5F9E47D4BB8C446B56DEF5C8"><enum>(2)</enum><text>approve the
				proposal if the State or local government or a person is willing and able to
				pay the difference between—</text>
								<subparagraph commented="no" id="H8C9A43DFC15645FA9B168F9FCD1EDC53"><enum>(A)</enum><text>the rate of
				compensation the Secretary would provide to the preferred air carrier that
				submits the lowest cost bid to provide air transportation to the eligible
				place; and</text>
								</subparagraph><subparagraph commented="no" id="H064F4C1E6E1641669B52A39FAB3C634B"><enum>(B)</enum><text>the rate of
				compensation the preferred air carrier estimates to be necessary to provide air
				transportation to the eligible place.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" id="HBBC5B4C5FCA14DECB6BD4915F603EBF"><enum>(d)</enum><header>Compensation
				payments</header>
							<paragraph commented="no" id="H17F40287B533461F891BAECDAADCE90"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall pay compensation under this section
				at such time and in such manner as the Secretary determines is
				appropriate.</text>
							</paragraph><paragraph commented="no" id="HD6F22A73477141E000E523298688A08E"><enum>(2)</enum><header>Duration of
				payments</header><text>The Secretary shall continue to pay compensation under
				this section only as long as—</text>
								<subparagraph commented="no" id="H0EF85BFF85C444AC8555D6202CB9BF28"><enum>(A)</enum><text>the State or local
				government or person agreeing to pay compensation under subsection (c)(2)
				continues to pay such compensation; and</text>
								</subparagraph><subparagraph commented="no" id="H2385F924B1E44A4FB803FFC076D18C53"><enum>(B)</enum><text>the Secretary
				decides the compensation is necessary to maintain air transportation to the
				eligible place.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" id="HB67A267C1D5440A486F60858CB7600D5"><enum>(e)</enum><header>Review</header>
							<paragraph commented="no" id="H9942A26F4E35491AA4806BE1CA23BBA2"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall periodically review the type and
				level of air service provided under this section.</text>
							</paragraph><paragraph commented="no" id="HF85791E4A84A423A8312FD84CA950026"><enum>(2)</enum><header>Consultation</header><text>The
				Secretary may make appropriate adjustments in the type and level of air service
				to an eligible place under this section based on the review under paragraph (1)
				and consultation with the affected community and the State or local government
				or person agreeing to pay compensation under subsection (c)(2).</text>
							</paragraph></subsection><subsection commented="no" id="H6F4203857F484E44ACA23FC8B31ABBF"><enum>(f)</enum><header>Ending,
				suspending, and reducing air transportation</header><text>A preferred air
				carrier providing air transportation to an eligible place under this section
				may end, suspend, or reduce such air transportation if, not later than 30 days
				before ending, suspending, or reducing such air transportation, the preferred
				air carrier provides notice of the intent of the preferred air carrier to end,
				suspend, or reduce such air transportation to—</text>
							<paragraph commented="no" id="H4D7395DD19844083BCDEF261E884C1EC"><enum>(1)</enum><text>the
				Secretary;</text>
							</paragraph><paragraph commented="no" id="H193E7720FF1B40DEB03F980063053E2C"><enum>(2)</enum><text>the affected
				community; and</text>
							</paragraph><paragraph commented="no" id="H5FCE745D29314252AD4F16A2C9729EC6"><enum>(3)</enum><text>the State or local
				government or person agreeing to pay compensation under subsection
				(c)(2).</text>
							</paragraph></subsection><subsection display-inline="no-display-inline" id="HF0EC73AF8C7242EE827D22BDEC6FCA63"><enum>(g)</enum><header>Petition To
				terminate service</header><text display-inline="yes-display-inline">An affected
				community, State or local government, or person agreeing to pay compensation
				under subsection (c)(2) may petition the Secretary at anytime to terminate
				service from the preferred carrier if the carrier does not meet expectations
				within the preferred carrier agreement as determined by the Secretary, at which
				time the Secretary may terminate the existing service and accept new proposals
				from other carriers and allow a new preferred carrier to begin service within
				90 days of such
				termination.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HB5F4A57CFE3A48AB8745C33FD04F7383"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States
			 Code, as amended by section 4, is further amended by adding after the item
			 relating to section 41749 the following new item:</text>

						<toc-entry bold="off" level="section">41750. Preferred essential air
				service.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H20C3766E0C044234A752CBB85156975F"><enum>6.</enum><header>Restoration of
			 eligibility to a place determined by the Secretary to be ineligible for
			 subsidized essential air service</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/41733">Section 41733</external-xref> of title 49, United States
			 Code, is amended by adding at the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H5CC03F06BBBC46F5909BE240AF344632" style="OLC">
				<subsection id="H8B55203CB1E84B9BB2C635185FA8FF56"><enum>(f)</enum><header>Restoration of
				eligibility for subsidized essential air service</header>
					<paragraph id="H11E0FC0A2ADB47B6864DC9F14810C0DA"><enum>(1)</enum><header>In
				general</header><text>If the Secretary of Transportation terminates the
				eligibility of an otherwise eligible place to receive basic essential air
				service by an air carrier for compensation under subsection (c), a State or
				local government may submit to the Secretary a proposal for restoring such
				eligibility.</text>
					</paragraph><paragraph id="HF2E2593C559E447FBFBFB9888B86D14F"><enum>(2)</enum><header>Determination by
				Secretary</header><text>If the per passenger subsidy required by the proposal
				submitted by a State or local government under paragraph (1) does not exceed
				the per passenger subsidy cap provided under section 41742(c), the Secretary
				shall issue an order restoring the eligibility of the otherwise eligible place
				to receive basic essential air service by an air carrier for compensation under
				subsection
				(c).</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="H2EE4C5010EBF49F295F80089A2BA18E6" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Calculation of highway mileage to medium
			 and large hub airports</header>
			<subsection commented="no" display-inline="no-display-inline" id="H34C91EB474DC47499076F3260049BBD2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/41731">Section 41731</external-xref> of title 49, United States
			 Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H758852B5642743349101C0B957BAE27E" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="HDDAC933BB2974104844695FFA316E31"><enum>(c)</enum><header display-inline="yes-display-inline">Calculation of highway mileage to medium
				and large hub airports</header>
						<paragraph commented="no" display-inline="no-display-inline" id="H858D4CE99FA24513B2FF314603FF8075"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In any determination under this subchapter
				of compensation or eligibility for compensation for essential air service based
				on the highway mileage of an eligible place from the nearest medium hub airport
				or large hub airport, the highway mileage shall be that of the most commonly
				used route, as identified under paragraph (2).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H646BBA4290494724AAB4D15869D2F6C"><enum>(2)</enum><header display-inline="yes-display-inline">Most commonly used route</header><text display-inline="yes-display-inline">The Secretary of Transportation shall
				identify the most commonly used route between an eligible place and the nearest
				medium hub airport or large hub airport by—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="HF24DF1AFC75C43FFAF7D80838070D293"><enum>(A)</enum><text display-inline="yes-display-inline">consulting with the Governor or a designee
				of the Governor in the State in which the eligible place is located; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5C049881027C4E26B8657F7080CFDD6C"><enum>(B)</enum><text display-inline="yes-display-inline">considering the certification of the
				Governor or a designee of the Governor as to the most commonly used
				route.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H130237A78AAD499694990541D8828CB"><enum>(3)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">This subsection shall apply only to
				eligible places in the 48 contiguous States and the District of
				Columbia.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H9105E354D952473CBDF0594905E0A042"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 409 of Vision 100—Century of
			 Aviation Reauthorization Act (<external-xref legal-doc="public-law" parsable-cite="pl/108/176">Public Law 108–176</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/49/41731">49 U.S.C. 41731</external-xref> note) is
			 repealed.</text>
			</subsection></section><section id="H8C0832A94A0E44A6AA1935D70053132C"><enum>8.</enum><header>Office of Rural
			 Aviation</header>
			<subsection id="H8F297805EA2B46F0B061678219D1E65B"><enum>(a)</enum><header>Establishment</header><text>There
			 is established within the Office of the Secretary of Transportation the Office
			 of Rural Aviation (referred to in this section as the
			 <quote>Office</quote>).</text>
			</subsection><subsection id="HEBD3680BCAF9406E9E5F5F7688986D69"><enum>(b)</enum><header>Functions</header><text>The
			 functions of the Office are—</text>
				<paragraph id="H95479157A0D7461A9231301000AC9E72"><enum>(1)</enum><text>to develop a
			 uniform 4-year contract for air carriers providing essential air service to
			 communities under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States
			 Code;</text>
				</paragraph><paragraph id="H740C80DB67A04861926868E19B4E4B2B"><enum>(2)</enum><text>to develop a
			 mechanism for comparing applications submitted by air carriers under section
			 41733(c) to provide essential air service to communities, including
			 comparing—</text>
					<subparagraph id="HC30E29D09C0A4D108BA751683CE695"><enum>(A)</enum><text>estimates from air
			 carriers on—</text>
						<clause id="H0AC02CCD0CC14125916564557371FE38"><enum>(i)</enum><text>the
			 cost of providing essential air service; and</text>
						</clause><clause id="HF21ED139CFD84B579E02CFC3C60071B9"><enum>(ii)</enum><text>the
			 revenues air carriers expect to receive when providing essential air service;
			 and</text>
						</clause></subparagraph><subparagraph id="HA29AEB98570C4CA5A0DAAFB204F4F310"><enum>(B)</enum><text>estimated
			 schedules for air transportation; and</text>
					</subparagraph></paragraph><paragraph id="H52F303891C534372A462446E08869E94"><enum>(3)</enum><text>to select an air
			 carrier from among air carriers applying to provide essential air service,
			 based on the criteria described in paragraph (2).</text>
				</paragraph></subsection></section><section id="HAB05854DB57A463F856F1378F5F1AD66"><enum>9.</enum><header>Extension of
			 authority to make agreements under the essential air service
			 program</header><text display-inline="no-display-inline">Section 41743(e)(2) of
			 title 49, United States Code, is amended by striking <quote>2008</quote> and
			 inserting <quote>2011</quote>.</text>
		</section><section id="HC28FAF7A465247FCBE85B4D5005523AD"><enum>10.</enum><header>Adjustments to
			 compensation for significantly increased costs</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/41737">Section 41737</external-xref> of title 49, United States
			 Code, is amended—</text>
			<paragraph id="H995D0B5E40E048538F2480575FB9C500"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)—</text>
				<subparagraph id="H3ED4957E75F647C59308B4F1CB938666"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>;
			 and</quote> and inserting a semicolon;</text>
				</subparagraph><subparagraph id="H291E13A38C5E4AB4B4AE88A95D3355E1"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking the period
			 and inserting <quote>; and</quote>; and</text>
				</subparagraph><subparagraph id="H227EE9688C8A4C648BB1560195968075"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H596A76B45E9343A0B37EB78C5471BFA4" style="OLC">
						<subparagraph id="H0D52DBCCC6894379B8FF803CF1D76FCF"><enum>(D)</enum><text>provide for an
				adjustment in compensation to account for significant increases in fuel costs,
				in accordance with subsection (e).</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H2904EA9CFB704308AE286BD6E195A7BA"><enum>(2)</enum><text>in subsection
			 (e)—</text>
				<subparagraph id="HE6B757537CBD41F3A4D27FE90267CAA"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>may</quote> and inserting <quote>shall</quote>; and</text>
				</subparagraph><subparagraph id="H74AFE9315F9D4F5EA6E8466DA734EF66"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>may</quote> and inserting <quote>shall</quote>.</text>
				</subparagraph></paragraph></section><section id="HA33F53D141744C34AADA77897CE90030"><enum>11.</enum><header>Charter air
			 carrier passenger boardings</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
			 the Secretary of Transportation shall treat passenger boardings on aircraft
			 operated by charter air carriers at airports receiving essential air service
			 under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States Code, as
			 passenger boardings for purposes of section 47114(c)(1)(E) of such
			 title.</text>
		</section><section id="HD305B55892274EBC8C7B8300D7FAB1B1"><enum>12.</enum><header>Authorization of
			 appropriations for essential air service</header>
			<subsection id="H8E14A13346B942BFA9819105EB8913EB"><enum>(a)</enum><header>Adjustment to
			 authorization of appropriations</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/41742">Section 41742</external-xref> of title 49, United States
			 Code, is amended—</text>
				<paragraph id="H1F4449D0F5344C85BEC598BA46A756FF"><enum>(1)</enum><text>in subsection
			 (a)(2), by striking <quote>$77,000,000</quote> and inserting
			 <quote>$40,000,000</quote>; and</text>
				</paragraph><paragraph commented="no" id="H8ED85F0FD080400DA2E6C067E60A671"><enum>(2)</enum><text>in subsection (b),
			 by striking <quote>Notwithstanding section 47114</quote> and all that
			 follows.</text>
				</paragraph></subsection><subsection commented="no" id="HF12E9DB66F204D52BE99A5FE715FF700"><enum>(b)</enum><header>Funds from
			 Airport and Airway Trust Fund</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/41737">Section 41737(d)(2)</external-xref> of title 49,
			 United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HC47230A2F0664382977241333CF093D0" style="OLC">
					<paragraph commented="no" id="H4C5A9EF5437D455AA6D95D15AFC5778E"><enum>(2)</enum><text>In addition to
				amounts authorized to be appropriated under section 41742(a), not more than
				$50,000,000 shall be available to the Secretary out of the Fund for each of the
				fiscal years 2008 through 2011 to incur obligations under this section. Amounts
				made available under this section remain available until
				expended.</text>
