<official-title>To require providers of wireless telephone services to provide access to the universal emergency telephone number in subterranean subway stations located within their area of coverage.</official-title>

<section id="H6AB391ABBBEA48AE8140572D9E61F84" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Subway Cell Access Act</short-title></quote>.</text></section> 
<section id="HF24EBCD58DFE422BA8377074FDA9FB3D"><enum>2.</enum><header>Requirement to provide access to the universal emergency telephone number in subway stations</header> 
<subsection id="H8D56CD26A00E4DC8906083537902B062"><enum>(a)</enum><header>In general</header><text>Section 332(c) of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(c)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H49C6748BC0F84636A417B341DD956D1D"><enum>(9)</enum><header>Access to 911 service in subway stations</header> 
<subparagraph id="H735B4529E88E4EDAB9D8653C1300DC34"><enum>(A)</enum><header>In general</header><text>The Commission shall, by regulation, require that each commercial mobile service provide service for the universal emergency telephone number designated under section 251(e)(3) within each subterranean boarding station that is located within any geographic area in which such commercial mobile service provides service at ground level.</text></subparagraph> 
<subparagraph id="H96017CE040DD4F06B147E1B05091BB54"><enum>(B)</enum><header>Infrastructure sharing</header><text>Such regulations shall require commercial mobile services providing service described in subparagraph (A) within subterranean boarding stations—</text> 
<clause id="HA94D38A8EC304359BD4784C46629273D"><enum>(i)</enum><text>to make available to other commercial mobile services such infrastructure, technology, information, facilities, and functions as may be requested by such other service for the purpose of enabling such other service to provide such service; and</text></clause> 
<clause id="H86D5B5A68DDC4D58A82567AAAEE2F3A3"><enum>(ii)</enum><text>to use such infrastructure, technology, and facilities in providing such access that will facilitate sharing of such infrastructure, technology, and facilities under clause (i).</text></clause></subparagraph> 
<subparagraph id="H60BC2FEB2FAE42D3B6057BDE58FB11B4"><enum>(C)</enum><header>Definitions</header><text>For purposes of this paragraph:</text> 
<clause id="H469374EA9EC1430BB4E009BD49FF2BD0"><enum>(i)</enum><header>Covered subway system</header><text>The term <term>covered subway system</term> means a fixed guideway mass transportation facility that—</text> 
<subclause id="HE9B2FBADF6774017AC46F9FFDE557380"><enum>(I)</enum><text>is described in <external-xref legal-doc="usc" parsable-cite="usc/49/5302">section 5302(a)(4)(A)</external-xref> of title 49, United States Code; and</text></subclause> 
<subclause id="HF11AA961CC944160A2802F3446B9BADD"><enum>(II)</enum><text>operates as a common carrier.</text></subclause></clause> 
<clause id="H5A7E937BABA34E50BE6489CB986F42E7"><enum>(ii)</enum><header>Subterranean boarding station</header><text>The term <term>subterranean boarding station</term> means a location or station that—</text> 
<subclause id="H23A0AB8152CB4B950072847427C59FDD"><enum>(I)</enum><text>is located below ground level;</text></subclause> 
<subclause id="HBE4FAA433507448F891624C077462292"><enum>(II)</enum><text>is part of any covered subway system; and</text></subclause> 
<subclause id="H5C3DDEA5F77943F9A040F8241D84008F"><enum>(III)</enum><text>provides public access or boarding to the vehicles used in such covered subway system.</text></subclause></clause></subparagraph></paragraph><after-quoted-block></after-quoted-block></quoted-block></subsection> 
<subsection id="H79B6EB5F8F624F5BB41F3E00C092AA13"><enum>(b)</enum><header>Limitation on State regulation of placement of facilities</header><text>Section 332(c)(7)(B)(i)(II) of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(c)(7)(B)(i)(II)</external-xref> is amended by inserting before the period at the end the following: <quote>, including the provision of commercial mobile service in subterranean boarding stations to the extent necessary to provide service required under paragraph (9)</quote>.</text></subsection> 
<subsection id="HB0186CF25FD54FE28DC1B4ED5C31FB4E"><enum>(c)</enum><header>Rulemaking and applicability</header> 
<paragraph id="H2B156CF7C29948C99555AF6700EB4CBA"><enum>(1)</enum><header>Rulemaking proceeding</header><text>The Commission shall, within 60 days after the date of the enactment of this Act, initiate a rulemaking proceeding to prescribe regulations necessary to carry out the amendments under this Act.</text></paragraph> 
<paragraph id="H1E59FBBE67C34FA5AC613DA549519F20"><enum>(2)</enum><header>Applicability</header><text>This amendments made by this Act are made on the date of the enactment of this Act, but shall apply upon the expiration of the 2-year period beginning upon the issuance of final regulations to carry out the amendments made by this Act, except that the Federal Communications Commission may, by regulation, provide for earlier applicability of regulations issued pursuant to section 332(c)(9)(B) of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(c)(9)(B)</external-xref>), as added by subsection (a) of this section, to facilitate compliance with the requirement of section 332(c)(9)(A) of such Act.</text></paragraph></subsection></section>
