		<official-title>To amend the Internal Revenue Code of 1986 to provide a
		  credit for the conversion of hybrid motor vehicles to plug-in hybrid motor
		  vehicles.</official-title>

		<section display-inline="no-display-inline" id="H2A4AFF5B6A86471690CE756100F6D186" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Plug-in Hybrid Opportunity Act of
			 2007</short-title></quote>.</text>
		</section><section id="HCAB92125930F4596883321E839423933"><enum>2.</enum><header>Credit for
			 conversion of hybrid motor vehicles to plug-in hybrid motor vehicles</header>
			<subsection id="H4B472E6784A94459A8B6B427C8CA96B9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (a) of
			 <external-xref legal-doc="usc" parsable-cite="usc/26/30B">section 30B</external-xref> of the Internal Revenue Code of 1986 (relating to the alternative
			 motor vehicle credit) is amended by striking <quote>and</quote> at the end of
			 paragraph (3), by striking the period at the end of paragraph (4) and inserting
			 <quote>, and</quote>, and by adding at the end the following new
			 paragraph:</text>

					<paragraph id="HF271B49658184516827036A82661146F"><enum>(5)</enum><text>the plug-in
				battery module conversion credit determined under subsection
				(f).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H48918D44AD8A4FAB87C2769EB03B3FBB"><enum>(b)</enum><header>Plug-in battery
			 module conversion credit</header><text>Section 30B of such Code is amended by
			 redesignating subsections (f) through (j) as subsections (g) through (k),
			 respectively, and by inserting after subsection (e) the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H8BF82EE8E7974CAEBEDCEAD912B800E7" style="OLC">
					<subsection id="H339F542296F04FB2A6A2ABD251806D57"><enum>(f)</enum><header>Plug-in battery
				module conversion credit</header>
						<paragraph id="HBE22F7D9CF7C4D129B46E10972F3C24F"><enum>(1)</enum><header>In
				general</header><text>For purposes of subsection (a), the plug-in battery
				module conversion credit determined under this subsection with respect to any
				qualified plug-in battery module placed in service by the taxpayer during the
				taxable year is 35 percent of the cost of such module (including reasonable
				labor costs for installation).</text>
						</paragraph><paragraph id="H8EDADF1A3A5A4A0A85F409DE18E237E9"><enum>(2)</enum><header>Limitation</header><text>The
				amount of the credit allowed under this subsection shall not exceed $4,000 with
				respect to any qualified plug-in battery module.</text>
						</paragraph><paragraph id="HA9AA89386A344FF68617A0517CDB9CA6"><enum>(3)</enum><header>Definitions and
				special rules</header><text>For purposes of this subsection—</text>
							<subparagraph id="HA210219383F44A6397003F163846B81"><enum>(A)</enum><header>Qualified plug-in
				battery module</header><text>The term <term>qualified plug-in battery
				module</term> means any plug-in battery module—</text>
								<clause id="H8A8E4E7D83EC481EAE54665D00006B72"><enum>(i)</enum><text>the original use
				of which commences with the taxpayer,</text>
								</clause><clause id="H90FA1595BDC44C74A23B6B78DDA0E08"><enum>(ii)</enum><text>which is acquired
				for use or lease by the taxpayer and not for resale, and</text>
								</clause><clause id="H7F4E14AC75BF4AFC9F06745862884D49"><enum>(iii)</enum><text>which is
				installed in a new qualified hybrid motor vehicle (as defined in subsection
				(d), determined without regard to subparagraph (A)(v) thereof) of the taxpayer,
				but only if such vehicle was not equipped with a plug-in battery module at any
				time prior to such installation.</text>
								</clause></subparagraph><subparagraph id="H878794397ECC46F4BA7439E377E030EE"><enum>(B)</enum><header>Plug-in battery
				module</header><text>The term <term>plug-in battery module</term> means, with
				respect to any new qualified hybrid motor vehicle, an electro-chemical storage
				device of a standardized, mass-produced design of a battery manufacturer,
				which—</text>
								<clause id="HB7E76932B66D49C8AE689FA18D935453"><enum>(i)</enum><text>has a traction
				battery capacity of not less than 2.5 kilowatt hours,</text>
								</clause><clause id="HF5033B5782AE4361B5FB769C84A5C8CA"><enum>(ii)</enum><text>can be energized
				and recharged by plugging into an external 120 volt source of electric
				power,</text>
								</clause><clause id="H929F57D1E9914A66856FBB77A6B9D2DC"><enum>(iii)</enum><text>has been tested,
				as installed in a new qualified hybrid motor vehicle of the same make and model
				year, by the National Highway Transportation Safety Administration, and
				determined by such Administration to be in compliance with motor vehicle and
				motor vehicle equipment safety standards applicable to that make and model year
				vehicle when installed in such motor vehicle by a mechanic with standardized
				training in protocols established by the battery manufacturer as part of a
				nationwide distribution program,</text>
								</clause><clause id="HED1F71248F37457FB09DD450371B77C2"><enum>(iv)</enum><text display-inline="yes-display-inline">has been tested, as installed in a new
				qualified hybrid motor vehicle of the same make and model year, by a testing
				laboratory approved the Environmental Protection Agency, and such testing
				confirmed no effect on compliance with the emission standards applicable to
				such vehicle, and</text>
								</clause><clause id="HBB3525FC0B624DD5B1EF86C65ED7DC38"><enum>(v)</enum><text>is
				certified by a battery manufacturer as meeting the requirements of clauses (i)
				through
				(iv).</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5A5FADC9605A49F68DEAD2F1CCAB05D"><enum>(c)</enum><header>No recapture for
			 vehicles converted to qualified conversion hybrid
			 vehicles</header><text>Paragraph (8) of section 30B(i) of such Code, as
			 redesignated by this section, is amended by adding at the end the following:
			 “For purposes of the preceding sentence, a new qualified hybrid motor vehicle
			 shall not be treated as ceasing to be eligible for the credit allowable under
			 subsection (a) solely by reason of the installation of a qualified plug-in
			 battery module described in subsection (f).”.</text>
			</subsection><subsection id="HBDED153B903148E69EB173EF0310AA56"><enum>(d)</enum><header>Termination</header><text>Subsection
			 (k) of section 30A of such Code, as redesignated by this section, is amended by
			 striking <quote>and</quote> at the end of paragraph (3), by striking the period
			 at the end of paragraph (4) and inserting <quote>, and</quote>, and by adding
			 at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H69CFE9438D6B4BE9B6C45E4D4D48F579" style="OLC">
					<paragraph id="HAC8D38D8FC3C4579B1B33F90CA1BA65E"><enum>(5)</enum><text>in the case of a
				qualified plug-in battery module (as described in subsection (f)), December 31,
				2010.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB8EF8B53318944FE9E938CB21C7B1D1E"><enum>(e)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2007.</text>
