<legis-type>AN ACT</legis-type> 
<official-title display="yes">To transfer certain land in Riverside County, California, and San Diego County, California, from the Bureau of Land Management to the United States to be held in trust for the Pechanga Band of Luiseno Mission Indians, and for other purposes.</official-title> 
</form>

<section display-inline="no-display-inline" id="HC0FFBB14CA044133A6CC6434FC0000D4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pechanga Band of Luiseno Mission Indians Land Transfer Act of 2007</short-title></quote>.</text> </section>
<section id="H0313DFBEA03F47A2989FB646B9B371E"><enum>2.</enum><header>Transfer of land in trust for pechanga band of luiseno mission indians</header> 
<subsection id="H8E6497E4DC954982817CDC78935BFCA8"><enum>(a)</enum><header>Transfer and administration</header> 
<paragraph id="H7AD7D77B417A485794BD23627E66C154"><enum>(1)</enum><header>Transfer</header><text>Effective on the date of the enactment of this Act and subject to valid existing rights, all right, title, and interest of the United States in and to the Federal lands described in subsection (b) (including all improvements thereon, appurtenances thereto, and rights to all minerals thereon or therein, including oil and gas, water, and related resources) shall be held by the United States in trust for the Pechanga Band of Luiseno Mission Indians, a federally recognized Indian tribe. Such transfer shall not include the 12.82 acres of lands more or less, including the facilities, improvements, and appurtenances associated with the existing 230 kV transmission line in San Diego County and its 300 foot corridor, more particularly described as a portion of sec. 6, T. 9 S., R. 2 W., San Bernardino Base and Meridian, which shall be sold by the Bureau of Land Management for fair market value to San Diego Gas &amp; Electric Company not later than 30 days after the completion of the cadastral survey described in subsection (c) and the appraisal described in subsection (d).</text> </paragraph>
<paragraph id="H93B64EE81C524CA3B0949441A83BBB00"><enum>(2)</enum><header>Administration</header><text>The land transferred under paragraph (1) shall be part of the Pechanga Indian Reservation and administered in accordance with—</text> 
<subparagraph id="H77236DBD5A8B477AAA1C3B00B6B6D25E"><enum>(A)</enum><text>the laws and regulations generally applicable to property held in trust by the United States for an Indian tribe; and</text> </subparagraph>
<subparagraph id="HE4BAAAC2F5084CF5B020302CB7BD0168"><enum>(B)</enum><text display-inline="yes-display-inline">a memorandum of understanding entered into between the Pechanga Band of Luiseno Mission Indians the Bureau of Land Management, and the United States Fish and Wildlife Service on November 11, 2005, which shall remain in effect until the date on which the Western Riverside County Multiple Species Habitat Conservation Plan expires.</text> </subparagraph></paragraph>
<paragraph id="HB55C1EB50276412D9B6F642DF7091300" display-inline="no-display-inline"><enum>(3)</enum><header>Notification</header><text>At least 45 days before terminating the memorandum of understanding entered into under paragraph (2)(B), the Director of the Bureau of Land Management, the Director of the United States Fish and Wildlife Service, or the Pechanga Band of Luiseno Mission Indians, as applicable, shall submit notice of the termination to—</text> 
<subparagraph id="HBDC025F2B79A4481AF54C0277B00F75D"><enum>(A)</enum><text>the Committee on Natural Resources of the House of Representatives;</text> </subparagraph>
<subparagraph id="HBE2567F6CA35401B866CC4D00488759"><enum>(B)</enum><text>the Committee on Indian Affairs of the Senate;</text> </subparagraph>
<subparagraph id="H4E247DCF111247248F13DF76E053C00"><enum>(C)</enum><text>the Assistant Secretary for Indian Affairs; and</text> </subparagraph>
<subparagraph id="H6D4A29DCF9314F5C9EA11DC427370B4"><enum>(D)</enum><text>the members of Congress representing the area subject to the memorandum of understanding.</text> </subparagraph></paragraph>
<paragraph id="H44A5C350A0F146B8ADACF303A3EFA44E" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Termination or violation of the Memorandum of Understanding</header><text>The Director of the Bureau of Land Management and the Pechanga Band of Luiseno Mission Indians shall submit to Congress notice of the termination or a violation of the memorandum of understanding entered into under paragraph (2)(B) unless the purpose for the termination or violation is the expiration or cancellation of the Western Riverside County Multiple Species Habitat Conservation Plan. <added-phrase reported-display-style="italic"></added-phrase></text> </paragraph></subsection>
<subsection id="H7F2E0ECFCA9845BAA0F007629C2000E7"><enum>(b)</enum><header>Description of land</header><text display-inline="yes-display-inline">The lands referred to in subsection (a) consist of approximately 1,178 acres in Riverside County, California, and San Diego County, California, as referenced on the map titled, <quote>H.R. 28, the Pechanga Land Transfer Act</quote> and dated May 2, 2007, 2007, which, before the transfer under such subsection, were administered by the Bureau of Land Management and are more particularly described as follows:</text> 
<paragraph id="H1FD446870F9F4ADDB289E42CB310CE6E"><enum>(1)</enum><text>Sections 24, 29, 31, and 32 of township 8 south, range 2 west, San Bernardino base and meridian.</text> </paragraph>
<paragraph id="H91C084140DFB45298CBD266EE5A559C3"><enum>(2)</enum><text>Section 6 of township 9 south, range 2 west, lots 2, 3, 5 and 6, San Bernardino Base and Meridian.</text> </paragraph>
<paragraph id="HCDDF3BC15ECB486581C16EF98F522E6B"><enum>(3)</enum><text>Mineral Survey 3540, section 22 of township 5 south, range 4 west, San Bernardino base and meridian.</text> </paragraph></subsection>
<subsection id="HA175CE05E9D84B589E5B7FF6E870091F"><enum>(c)</enum><header>Survey</header><text>Not later than 180 days after the date of the enactment of this Act, the Office of Cadastral Survey of the Bureau of Land Management shall complete a survey of the lands transferred and to be sold under subsection (a) for the purpose of establishing the boundaries of the lands.</text> </subsection>
<subsection id="H2BCDBEDC3D0149BBAD355B208878B39D"><enum>(d)</enum><header>Conveyance of utility corridor</header> 
<paragraph id="H8134BC3DD6424B88A663009948B0CDB4"><enum>(1)</enum><header>In general</header><text>The Secretary shall convey to the San Diego Gas &amp; Electric Company all right, title, and interest of the United States in and to the utility corridor upon—</text> 
<subparagraph id="H79770ABCAC63425600856191C98FD659"><enum>(A)</enum><text>the completion of the survey required under subsection (c);</text> </subparagraph>
<subparagraph id="H70C9D160A6D648EDA4C2005E8F78002B"><enum>(B)</enum><text>the receipt by the Secretary of all rents and other fees that may be due to the United States for use of the utility corridor, if any; and</text> </subparagraph>
<subparagraph id="HABD26B07BFBA46439627F38168393219"><enum>(C)</enum><text>the receipt of payment by United States from the San Diego Gas &amp; Electric Company of consideration in an amount equal to the fair market value of the utility corridor, as determined by an appraisal conducted under paragraph (2).</text> </subparagraph></paragraph>
<paragraph id="HD2AB660C88474714BA4B00A679B20270"><enum>(2)</enum><header>Appraisal</header> 
<subparagraph id="H6C5FE91E3CBE428FA4A9E174EDA2B300"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the date on which the survey of the utility corridor is completed under subsection (c), the Secretary shall complete an appraisal of the utility corridor.</text> </subparagraph>
<subparagraph id="H39E0919AB8874F839F11709477D0C210"><enum>(B)</enum><header>Applicable law</header><text>The appraisal under subparagraph (A) shall be conducted in accordance with—</text> 
<clause id="HC0B22C9545F74571ADAE9600BD91DB11"><enum>(i)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and</text> </clause>
<clause id="H605D1D9652F348669869E8C052FE327"><enum>(ii)</enum><text>the Uniform Standards of Professional Appraisal Practice.</text> </clause></subparagraph></paragraph>
<paragraph id="H81A7D58222D84D5D8947A4ACE173CD28"><enum>(3)</enum><header>Costs</header><text>The San Diego Gas &amp; Electric Company shall pay the costs of carrying out the conveyance of the utility corridor under paragraph (1), including any associated survey and appraisal costs.</text> </paragraph>
<paragraph id="HB7C11CE3955140810080A5BDEDF6775E"><enum>(4)</enum><header>Disposition of proceeds</header><text>The Secretary shall deposit any amounts received under paragraph (1)(C) of this section in the Federal Land Disposal Account established under section 206(a) of the Federal Land Transaction Facilitation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/2305">43 U.S.C. 2305(a)</external-xref>).</text> </paragraph></subsection>
<subsection id="H769AF8EE56594E409DB8BADE9F38165"><enum>(e)</enum><header>Map on file</header><text>The map referred to in subsection (b) shall be on file in the appropriate offices of the Bureau of Land Management.</text> </subsection>
<subsection id="H33054DDE3CE54FEC813EA1836C808405"><enum>(f)</enum><header>Legal descriptions</header> 
<paragraph id="H6791C443698840A5972B7C7186F34062"><enum>(1)</enum><header>Publication</header><text>On approval of the survey completed under subsection (c) by the duly elected tribal council of the Pechanga Band of Luiseno Mission Indians, the Secretary of the Interior shall publish in the Federal Register—</text> 
<subparagraph id="H9EDDED4289E042B68292C8A1283BCBB8"><enum>(A)</enum><text>a legal description of the boundary lines; and</text> </subparagraph>
<subparagraph id="H90CA7501FC324E16B2724BE12EEAE3D6"><enum>(B)</enum><text>legal description of the lands transferred under subsection (a).</text> </subparagraph></paragraph>
<paragraph id="H6B1BCBD03EEF42408F9F12501E0047A3"><enum>(2)</enum><header>Effect</header><text>Beginning on the date on which the legal descriptions are published under paragraph (1), such legal descriptions shall be the official legal descriptions of the boundary lines and the lands transferred under subsection (a).</text> </paragraph></subsection>
<subsection id="H8FE051A0CCBC4A05B94B4100447825A3"><enum>(g)</enum><header>Rules of construction</header><text>Nothing in this Act shall—</text> 
<paragraph id="H841227614B0D49ED9F042DE6B49A09F"><enum>(1)</enum><text>enlarge, impair, or otherwise affect any right or claim of the Pechanga Band of Luiseno Mission Indians to any land or interest in land that is in existence before the date of the enactment of this Act;</text> </paragraph>
<paragraph id="H4934EEF45F9545A5B6C74309225E9FD"><enum>(2)</enum><text>affect any water right of the Pechanga Band of Luiseno Mission Indians in existence before the date of the enactment of this Act; or</text> </paragraph>
<paragraph id="HB778E5B0A66542BAB2FB8C722F43B99"><enum>(3)</enum><text>terminate any right-of-way or right-of-use issued, granted, or permitted before the date of enactment of this Act.</text> </paragraph></subsection>
<subsection id="HE7FAEA03EDE44DB89745FFB64B00005" indent="left-margin"><enum>(h)</enum><header>Restricted use of transferred lands</header> 
<paragraph id="HCC53697BF24D433EA4C8657E7C2D55AE"><enum>(1)</enum><header>In general</header><text>The lands transferred under subsection (a) may be used only as open space and for the protection, preservation, and maintenance of the archaeological, cultural, and wildlife resources thereon.</text> </paragraph>
<paragraph id="H17F0C72BEBBC40EC84B1C7F5117D9341"><enum>(2)</enum><header>No roads</header><text display-inline="yes-display-inline">There shall be no roads other than for maintenance purposes constructed on the lands transferred under subsection (a).</text> </paragraph>
<paragraph id="H6C05E76614B84F17808534FD96908F60" changed="added"><enum>(3)</enum><header>Development prohibited</header> 
<subparagraph id="H82512E293B0A458AA522BCA621DBCBF"><enum>(A)</enum><header>In general</header><text>There shall be no development of infrastructure or buildings on the land transferred under subsection (a).</text> </subparagraph>
<subparagraph id="HD8BF05BBE20245D18180AAB732A7CFC0"><enum>(B)</enum><header>Open space</header><text>The land transferred under subsection (a) shall be—</text> 
<clause id="H89DA52389195489BA977A51BA90FF00"><enum>(i)</enum><text>maintained as open space; and</text> </clause>
<clause id="HBFFD17E6719047BE8FFE355D93FD1649"><enum>(ii)</enum><text>used only for—</text> 
<subclause id="H5325FADF52A84B1B00D719ADCEFF496"><enum>(I)</enum><text>purposes consistent with the maintenance of the land as open space; and</text> </subclause>
<subclause id="H059799416B57485999E44D08ECCFB69F"><enum>(II)</enum><text>the protection, preservation, and maintenance of the archaeological, cultural, and wildlife resources on the land transferred.</text> </subclause></clause></subparagraph>
<subparagraph id="HAA9B3880C0744719A5049935F6DDB085"><enum>(C)</enum><header>Effect</header><text>Nothing in this paragraph prohibits the construction or maintenance of utilities or structures that are—</text> 
<clause id="H412A03E8E9414822B3578471A76CF6CB"><enum>(i)</enum><text>consistent with the maintenance of the land transferred under subsection (a) as open space; and</text> </clause>
<clause id="HA67283DCA1C5403AB737876CD1E25D7C"><enum>(ii)</enum><text>constructed for the protection, preservation, and maintenance of the archaeological, cultural, and wildlife resources on the land transferred.</text> </clause></subparagraph></paragraph>
<paragraph id="HD7F8F1C47FDB4C49AC6E572E33056E52" changed="added" display-inline="no-display-inline"><enum>(4)</enum><header>Gaming prohibited</header><text>The Pechanga Band of Luiseno Mission Indians may not conduct, on any land acquired by the Pechanga Band of Luiseno Mission Indians pursuant to this Act, gaming activities or activities conducted in conjunction with the operation of a casino—</text> 
<subparagraph id="H6E3F20F0FE554512A225224211CAE80"><enum>(A)</enum><text>as a matter of claimed inherent authority; or</text> </subparagraph>
<subparagraph id="H1B1C1F7557B04FDF9D0783CDBE1227B4"><enum>(B)</enum><text>under any Federal law (including the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2701">25 U.S.C. 2701 et seq.</external-xref>) (including any regulations promulgated by the Secretary or the National Indian Gaming Commission under that Act)).</text> </subparagraph></paragraph></subsection></section>
