<official-title>To amend the Rural Electrification Act of 1936 to improve the application process for the rural broadband program of the Department of Agriculture.</official-title>

<section id="HC727A41875D145500066DDED683313CE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Broadband Access Enhancement Act</short-title></quote>. </text></section> 
<section id="H33498448F3D24DEDB700D0BF5987D912"><enum>2.</enum><header>Definition of eligible rural community</header><text display-inline="no-display-inline">Section 601(b)(2) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb(b)(2)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="HA263E7B4C41545F08639A7C4AE552BE8" display-inline="no-display-inline"> 
<paragraph id="HA64B0D2206F04834B26F72636608EAD5"><enum>(2)</enum><header>Eligible rural community</header><text display-inline="yes-display-inline">The term <term>eligible rural community</term> means any area of the United States—</text> 
<subparagraph id="H518EA8322E5D40439C34B800A89E886C"><enum>(A)</enum><text display-inline="yes-display-inline">which is not included within the boundaries of any city, town, borough, or village, whether incorporated or unincorporated, with a population of more than 20,000 inhabitants;</text></subparagraph> 
<subparagraph id="H73954F1509B044359945519390C420E2"><enum>(B)</enum><text display-inline="yes-display-inline">which is not in the urbanized area contiguous and adjacent to such a city, town, borough, or village; and</text></subparagraph> 
<subparagraph id="H8325969B97E7476DBC386230A3EEA18"><enum>(C)</enum><text display-inline="yes-display-inline">the average median household income of which is not more than 80 percent of the national average median household income.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HB2A933E9E25145B1B687750879966653"><enum>3.</enum><header>Improvements to application process</header> 
<subsection id="H95DA4891500348D9A99BD8009200D7C9"><enum>(a)</enum><header>Equity requirements</header><text>Section 601(c) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb(c)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HF8282FF13710465B80B43D45DBE8D1F2" display-inline="no-display-inline"> 
<paragraph id="H1E11531A2FE743869DD400A42299BCBD"><enum>(3)</enum><header>Equity requirements</header><text display-inline="yes-display-inline">The Secretary shall not approve an application submitted pursuant to this section to serve—</text> 
<subparagraph id="H12376C73498741B0A2E312272DD4FC8D"><enum>(A)</enum><text>an area in which at least 40 percent of the population does not have access to broadband service, unless the value of the assets of the applicant not pledged or hypothecated for any other purpose equals at least 10 percent of the principal amount of the loan which is the subject of the application; or</text></subparagraph> 
<subparagraph id="H8259288718C1468E88F2C5C617F42CCD"><enum>(B)</enum><text>any other area, unless value of the assets referred to in subparagraph (A) equals at least 15 percent of the principal amount of the loan involved.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF0C97DC2636648E882E005517707B78"><enum>(b)</enum><header>Reduction in application paperwork</header><text display-inline="yes-display-inline">Section 601(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb(c)</external-xref>), as amended by subsection (a) of this section, is amended by adding at the end the following:</text>

<paragraph id="HC2FAD7E9221A4885B0FAB604C9191B22"><enum>(4)</enum><header>Paperwork reduction</header><text display-inline="yes-display-inline">The Secretary shall take such steps as are necessary to reduce the paperwork required of applicants under this section.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HCE45D901BE124E82B8BD15955B00D8DE"><enum>(c)</enum><header>Outreach</header><text>Section 601 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb</external-xref>) is amended by redesignating subsections (i) through (k) as subsection (j) through (l), respectively, and inserting after subsection (h) the following:</text>

<subsection id="HF86F408EB7564784A650FED638E955F"><enum>(i)</enum><header>Outreach</header><text>The Secretary shall conduct outreach designed to inform the population of areas in which there is no or limited broadband service of the program carried out under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HF9D6B1E24DC9449796A895748FD17407"><enum>4.</enum><header>Ban on loan or loan guarantee for new broadband service in community with several service providers</header><text display-inline="no-display-inline">Section 601(c) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb(c)</external-xref>), as amended by section 3 of this Act, is amended by adding at the end the following:</text>

<paragraph id="H2506A1BAD60A49078594CC70550104BA"><enum>(5)</enum><header>Ban on loan or loan guarantee for new broadband service in community with 3 or more service providers</header><text>The Secreary shall not approve an application for a loan or loan guarantee under this section for the provision of new broadband service to an eligible rural community in which the service is provided by 3 or more entities.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H48C3ADF6E80847F4ACE7BDE100C11532"><enum>5.</enum><header>Elimination of limitation on eligibility based on number of subscriber lines</header> 
<subsection id="HE70EC125D2044E1A8D3F34B5BAF85BA3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 601(d) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb(d)</external-xref>) is amended by striking paragraph (3).</text></subsection> 
<subsection id="H72E7BAAEE6D64874BC7C9FF3655B461B"><enum>(b)</enum><header>Limitations on amounts made available for entities with various shares of installed telephone suscriber lines</header><text display-inline="yes-display-inline">Section 601(k) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb(k)</external-xref>), as so redesignated by section 3(c) of this Act, is amended by adding at the end the following:</text>

<paragraph id="H8B54852EA70F48C28282FC62C52BB8B4"><enum>(5)</enum><header>Limitations on amounts made available for entities with various shares of installed telephone suscriber lines</header> 
<subparagraph id="HC3C0CAC7EAAB447EA3347012BF00D0AB"><enum>(A)</enum><text display-inline="yes-display-inline">Not more than 10 percent of the amounts made available for each fiscal year under this subsection may be used to provide loans or loan guarantees to entities with more than 10 percent of the telephone subscriber lines installed in the aggregate in the United States.</text></subparagraph> 
<subparagraph id="H589CE74BD25748B38D6BFFD699EB338F"><enum>(B)</enum><text>Not more than 40 percent of the amounts made available for each fiscal year under this subsection may be used to provide loans or loan guarantees to entities with not less than 2 percent and not more than 10 percent of the telephone subscriber lines installed in the aggregate in the United States.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H5D9D862DCAFC4F83BB8887CC42C2BCD"><enum>6.</enum><header>Limitation on term of loans and loan guarantees</header><text display-inline="no-display-inline">Section 601(g)(2) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb(g)(2)</external-xref>) is amended by striking <quote>the useful life of the assets constructed, improved, or acquired with the proceeds of the loan or extension of credit</quote> and inserting <quote>35 years</quote>. </text></section> 
<section id="HC9F0B766C3114BE9A7F2563ED8E6B2B4"><enum>7.</enum><header>Reporting requirements</header><text display-inline="no-display-inline">Section 601 of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb</external-xref>), as amended by section 3(c) of this Act, is amended by redesignating subsections (k) and (l) as subsection (l) and (m), respectively, and inserting after subsection (j) the following:</text> 
<quoted-block style="OLC" id="HF92120F608B0488D9EEC29ED00F3E870" display-inline="no-display-inline"> 
<subsection id="HB9D4FAA7052244F593CC7F1B72034F00"><enum>(k)</enum><header>Annual reports</header><text>Not later than October 1 of each year, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report on the status of the program under this section, which shall include, with respect to the period covered by the report—</text> 
<paragraph id="HC33CA7E3F6174D8F802CFC29F000509C"><enum>(1)</enum><text>the number of applications submitted pursuant to this section;</text></paragraph> 
<paragraph id="HE455F42CF92C4E0EAB04BEEC017E9762"><enum>(2)</enum><text>the number of the applications that were approved;</text></paragraph> 
<paragraph id="H4A9AEB1272D7488085BD7D02C000294"><enum>(3)</enum><text>the identity of the communities served by the applicants with approved applications;</text></paragraph> 
<paragraph id="H41DB7C376507482484BE572879F67A9"><enum>(4)</enum><text>the type of services offered by applicants for, and recipients of, loans or loan guarantees under this section;</text></paragraph> 
<paragraph id="H14FED0B043C540079BE01FD892190321"><enum>(5)</enum><text>the speed of the broadband service offered by the applicants and recipients;</text></paragraph> 
<paragraph id="HAD3270A7195E4C0B87EE948639A6F677"><enum>(6)</enum><text display-inline="yes-display-inline">how long it took to respond to the applicants; and</text></paragraph> 
<paragraph id="H1D9134488D194792B201BA05881F77CE"><enum>(7)</enum><text>the outreach efforts conducted by the Secretary under subsection (i).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
