<official-title>To provide for the establishment of energy performance standards for new Federal or federally supported buildings, and major renovations of Federal or federally supported buildings, and for other purposes.</official-title>

<section id="H77C6EEC70C49408097F5EB8B234EF51" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energy Efficient Buildings Promotion Act</short-title></quote>.</text> </section> 
<section id="H21E14DEA12154D93A74F00AFDFC324F"><enum>2.</enum><header>Federal building energy performance standards</header> 
<subsection id="H02B6FB489F1F43E9B6D761CD007471FA"><enum>(a)</enum><header>Standards</header><text display-inline="yes-display-inline">Section 305(a)(3) of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6834">42 U.S.C. 6834(a)(3)</external-xref>) is amended by striking <quote>(3)(A)</quote> and all that follows through the end of subparagraph (B) and inserting the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="H658A67AE4F0C42EAA1DE070119FE86A0" indent="up1"><enum>(3)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H9FD4DF605C234A0495DBAA57F4384E58"><enum>(A)</enum><text>Not later than 1 year after the date of enactment of the <short-title>Energy Efficient Buildings Promotion Act</short-title>, the Secretary shall establish, by rule, revised Federal building energy performance standards that require that, for new Federal buildings and Federal buildings undergoing major renovations:</text> 
<clause id="HBEC8A1F2157A48C6A2007726AF9D89CF" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">Each building shall be designed to meet the United States Green Building Council’s Leadership in Energy and Environmental Design (LEED) silver level standard, or an equivalent standard approved by the Administrator of the Environmental Protection Agency.</text> </clause> 
<clause id="HDB64F6C2164748BF823563C56F68D0F6" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">Each building shall be designed to achieve at least a 60 percent reduction compared to the regional average energy consumption (measured as site use intensity) for that building type, calculated according to regional 2003 Commercial Building Energy Consumption Survey data for commercial buildings (or Energy Information Administration national averages where such Commercial Building Energy Consumption Survey data is not available), and 2003 Energy Information Administration data for residential buildings.</text> </clause> 
<clause id="HB4148B4DB56A44C6B6027B2F90562292" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">The buildings shall be designed so that the average fossil fuel energy consumption of the buildings of each Federal agency is reduced, as compared to such energy consumption by similar buildings, calculated according to regional 2003 Commercial Building Energy Consumption Survey data for commercial buildings (or Energy Information Administration national averages where Commercial Building Energy Consumption Survey data is not available), and 2003 Energy Information Administration data for residential buildings, by the percentage specified in the following table:</text>

<clause id="HD15E627C36B84F4FAD294DFABBB62D58" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">Each building shall be designed to apply sustainable design principles to siting, design, and construction, and employ renewable energy strategies and technologies.</text> </clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H9517B79C31104789B9B4244D779837C" indent="up1"><enum>(B)</enum><text>Not later than 1 year after the date of enactment of the <short-title>Energy Efficient Buildings Promotion Act</short-title>, the Secretary shall establish, by rule, revised Federal building energy performance standards that require that, for new buildings, with respect to which 10 percent or more of construction funding is provided by the Federal Government, and for such buildings undergoing major renovations:</text> 
<clause id="H43739224F08A4AB0A08CAE8651FB9C7"><enum>(i)</enum><text display-inline="yes-display-inline">Each building shall be designed to achieve at least a 50 percent reduction compared to the regional average energy consumption (measured as site use intensity) for that building type, calculated according to regional 2003 Commercial Building Energy Consumption Survey data for commercial buildings (or Energy Information Administration national averages where such Commercial Building Energy Consumption Survey data is not available), and 2003 Energy Information Administration data for residential buildings.</text> </clause> 
<clause id="HD7ED6D8BB89D497B9EA458F1C6F1AB95"><enum>(ii)</enum><text display-inline="yes-display-inline">Each building shall be designed so that the fossil fuel energy consumption of such building, as compared to such energy consumption by similar buildings, calculated according to regional 2003 Commercial Building Energy Consumption Survey data for commercial buildings (or Energy Information Administration national averages where Commercial Building Energy Consumption Survey data is not available), and 2003 Energy Information Administration data for residential buildings, represents a reduction of:</text>

<subsection id="HDC5011176EEA4D3DADB7EA008D7309E"><enum>(b)</enum><header>Definition</header><text>Section 303 of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6832">42 U.S.C. 6832</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H70004330A00847469F56C4303D4B14E6"><enum>(17)</enum><text display-inline="yes-display-inline">The term <term>major renovation</term> means the upgrade or replacement of two of the three major systems of a building (lighting, plumbing, and heating, ventilation, and air conditioning).</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>

<subsection id="HCBFE8E8713D2461F86326BF354ADE4F4"><enum>(a)</enum><header>Nonbusiness energy property</header> 
<paragraph id="H0358C3F5DD074D80B652ABFE461D218"><enum>(1)</enum><header>In general</header> 
<subparagraph commented="no" id="H7EDA33706F2A48D7ABDB15CB50AC524"><enum>(A)</enum><header>Increase in lifetime limitation</header><text>Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/26/25C">section 25C(b)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>$500</quote> and inserting <quote>$1,000</quote>.</text> </subparagraph> 
<subparagraph id="H052B4DCE7FF14379BAB38E3DA63700A5"><enum>(B)</enum><header>Increase in limitations for certain residential energy property</header><text>Paragraph (3) of section 25C(b) of such Code is amended—</text> 
<clause id="H682E064BD5444E1CA349513CAB9C1B00"><enum>(i)</enum><text>by striking <quote>$50</quote> in subparagraph (A) and inserting <quote>$100</quote>,</text> </clause> 
<clause id="HBDA030BA907744B788007693433E1708"><enum>(ii)</enum><text>by striking <quote>$150</quote> in subparagraph (B) and inserting <quote>$300</quote>, and</text> </clause> 
<clause id="H758317565797469D8891215C7381F3B1"><enum>(iii)</enum><text>by striking <quote>$300</quote> in subparagraph (C) and inserting <quote>$600</quote>.</text> </clause></subparagraph> 
<subparagraph id="HACCA2125642C4A5C995650A8EE40C754"><enum>(C)</enum><header>Extension</header><text>Subsection (g) of section 25C of such Code is amended by striking <quote>2007</quote> and inserting <quote>2013</quote>.</text> </subparagraph></paragraph> 
<paragraph id="H0C6D8756C2324E9DB1D952AA843B3673"><enum>(2)</enum><header>Effective date</header><text>The amendment made by this section shall apply to property installed after the date of the enactment of this Act.</text> </paragraph></subsection> 
<subsection id="H428CD70CA87F4B67B0D76B13BF058830"><enum>(b)</enum><header>New energy efficient home credit</header> 
<paragraph id="H84CF1D65944849A793A74EE4F32BC9E"><enum>(1)</enum><header>In general</header> 
<subparagraph id="H1493BF1BB88C4E948C22C286AC42D95"><enum>(A)</enum><header>Increase in applicable amount</header><text>Subparagraph (A) of section 45L(a)(2) of such Code is amended by striking <quote>$2,000</quote> and inserting <quote>$4,500</quote>.</text> </subparagraph> 
<subparagraph id="H270B12112A0F4FC9A9E9E3660E85FB1"><enum>(B)</enum><header>Extension</header><text>Subsection (g) of section 45L of such Code is amended by striking <quote>2008</quote> and inserting <quote>2013</quote>.</text> </subparagraph></paragraph> 
<paragraph id="H24FEA0F516B34415952B2D6714A0005"><enum>(2)</enum><header>Effective date</header><text>The amendments made by this section shall apply to property acquired after the date of the enactment of this Act.</text> </paragraph></subsection>

<subparagraph id="HC28ABCF435F640BAACCC8E3684005850"><enum>(A)</enum><header>Increase in per square footage dollar amount</header><text>Subparagraph (A) of section 179D(b)(1) of such Code is amended by striking <quote>$1.80</quote> and inserting <quote>$2.75</quote>.</text> </subparagraph> 
<subparagraph id="HC597E8BDEF0A4A7A9BE5FE165CC414E"><enum>(B)</enum><header>Extension</header><text>Subsection (h) of section 179D of such Code is amended by striking <quote>2008</quote> and inserting <quote>2013</quote>.</text> </subparagraph></paragraph> 
<paragraph id="HAB4A856688614907B5C98257FD844735"><enum>(2)</enum><header>Effective date</header><text>The amendments made by this section shall apply to property placed in service after the date of the enactment of this Act.</text> </paragraph></subsection></section> 
<section id="H796AD6030B5444E09ECE33C97FDA65A2"><enum>4.</enum><header>Study</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Energy shall conduct a study and make recommendations to Congress on whether to conform the incentives provided by the Internal Revenue Code of 1986, as provided in the Energy Policy Act of 2005, to the building energy performance goal contained in section 305(a)(3) of the Energy Conservation and Production Act, as amended by section 2(a) of this Act.</text> </section>
