		<official-title>To amend title 39, United States Code, to make cigarettes
		  and certain other tobacco products nonmailable, and for other

		<section display-inline="no-display-inline" id="H2D6EC40931D24A68B19044EFFECAC8B8" section-type="section-one"><enum>1.</enum><header>Nonmailability of certain
			 tobacco products</header>
			<subsection id="H5BCFECD06E5E40EDB91648A8F30194DB"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/30">Chapter 30</external-xref> of title 39, United States Code, is amended by
			 inserting after section 3002a the following:</text>
				<quoted-block display-inline="no-display-inline" id="H84D436F933084002A2B289C950C16F42" style="USC">
					<section id="H0AD372AD624345DBB861A0937C80BBB8"><enum>3002b.</enum><header>Nonmailability
				of certain tobacco products</header>
						<subsection id="H799BE0A6B4A74BE6A901167B2EE59787"><enum>(a)</enum><header>In
				general</header><text>Cigarettes, smokeless tobacco, and
				roll-your-own-tobacco—</text>
							<paragraph id="HE48B85A0FAA049089E3170645D3B3C07"><enum>(1)</enum><text>are nonmailable
				matter;</text>
							</paragraph><paragraph id="H4426699E7B4B48F8B641B0C2195BE513"><enum>(2)</enum><text>shall not
				be—</text>
								<subparagraph id="HF5250CB7D2A04C9E8BAE4C8FAFDBFB"><enum>(A)</enum><text>deposited in the
				mails; or</text>
								</subparagraph><subparagraph id="H7EC5FEAF907B469D007591ACACA590"><enum>(B)</enum><text>carried or delivered
				through the mails; and</text>
								</subparagraph></paragraph><paragraph id="H17DD341DD0264CBBA236B9789710675E"><enum>(3)</enum><text>shall be disposed
				of as the Postal Service directs.</text>
							</paragraph></subsection><subsection id="HE5F6E517704C45038FAE63CD96EE5C9C"><enum>(b)</enum><header>Civil
				Penalty</header>
							<paragraph id="H9E6C0FD022FB45C289D5BF3F49FEE9C2"><enum>(1)</enum><header>In
				general</header><text>Any person who violates subsection (a)(2)(A) shall be
				liable to the United States for a civil penalty in an amount not to exceed
				$100,000 for each violation.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H9E88DEBFBE694862930472D64CDBD076"><enum>(2)</enum><header>Hearings</header>
								<subparagraph id="H95D547BC6B624B47BE08194805F70044"><enum>(A)</enum><header>In
				general</header><text>The Postal Service may determine that a person has
				violated subsection (a)(2)(A) only after notice and an opportunity for a
				hearing. Proceedings under this paragraph shall be conducted in accordance with
				section 3001(m).</text>
								</subparagraph><subparagraph id="HA3663AAD16844797BDE941B437AE577"><enum>(B)</enum><header>Penalty
				considerations</header><text>In determining the amount of a civil penalty under
				this paragraph, the Postal Service shall consider—</text>
									<clause id="H57E61A9AEAD648168C6558B026F30297"><enum>(i)</enum><text>the nature,
				circumstances, extent, and gravity of the violation;</text>
									</clause><clause id="H3AA8AD2EE8644A8C9E664CA299F0BD5C"><enum>(ii)</enum><text>with respect to
				the violator, the degree of culpability, ability to pay, and any history of
				prior violations; and</text>
									</clause><clause id="H44931B94E47545B2977CBA5CD9FF213E"><enum>(iii)</enum><text>such other
				matters as justice may require.</text>
									</clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H9E9BA290837A468082CB9937D4007B4E"><enum>(3)</enum><header>Civil actions to
				collect</header><text display-inline="yes-display-inline">A civil action may,
				in accordance with section 409(g)(2), be brought in an appropriate district
				court of the United States to collect a civil penalty assessed under paragraph
				(2).</text>
							</paragraph><paragraph id="H41C6889C4FA445979147794E9BE39154"><enum>(4)</enum><header>Disposition of
				amounts</header><text>Amounts received in payment of any civil penalties under
				this subsection shall be deposited as miscellaneous receipts in the Treasury of
				the United States.</text>
							</paragraph></subsection><subsection id="H86F19A559E5D40FA85295E03A9D935F"><enum>(c)</enum><header>Detention of mail
				for temporary periods</header>
							<paragraph id="H9A3E40148320435E974B792B4473B610"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In preparation for or
				during the pendency of proceedings under subsection (b), the Postal Service
				may, under the provisions of section 409(g)(2), apply to the district court in
				any district in which the defendant is found or in any district in which is
				sent or received any mail deposited in the mails allegedly in violation of
				subsection (a)(2)(A), for a temporary restraining order and preliminary
				injunction under the procedural requirements of rule 65 of the Federal Rules of
				Civil Procedure.</text>
							</paragraph><paragraph id="HD3B5384B16374357A3ABD1A7B5357EED"><enum>(2)</enum><header>Requirements</header>
								<subparagraph id="H3455B6AAA26E4C9EB96EDBC93BD7B1EE"><enum>(A)</enum><header>Court
				orders</header><text>Upon a proper showing, the court shall enter an order
				which shall—</text>
									<clause id="H4EE959D20B1B4EF0A893EA5CB948268B"><enum>(i)</enum><text>remain in effect
				during the pendency of the statutory proceedings or any judicial review of such
				proceedings; and</text>
									</clause><clause id="HF07D7F2284794CCE882602CD00645454"><enum>(ii)</enum><text>direct the
				detention by the postmaster, in any and all districts, of the defendant’s
				incoming mail and outgoing mail, which is the subject of the proceedings under
				subsection (b).</text>
									</clause></subparagraph><subparagraph id="H53AC5865390A420D8D4721761CA7D800"><enum>(B)</enum><header>Proof
				required</header><text>A proper showing under this paragraph shall require
				proof of a likelihood of success on the merits of the proceedings under
				subsection (b).</text>
								</subparagraph></paragraph><paragraph id="H8EC5AE9C104441BF889B58975310DD3"><enum>(3)</enum><header>Disposition of
				unrelated mail</header><text>Mail detained under paragraph (2) shall—</text>
								<subparagraph id="H217CDE7D08DB49B8B916BF3EB716A43E"><enum>(A)</enum><text>be made available
				at the post office of mailing or delivery for examination by the defendant in
				the presence of a postal employee; and</text>
								</subparagraph><subparagraph id="HF176923C3ADC45E98ED196B5AFAA64B7"><enum>(B)</enum><text>be delivered as
				addressed if such mail is not clearly shown to be the subject of proceedings
				under subsection (b).</text>
								</subparagraph></paragraph></subsection><subsection id="H3DCDB0BD52EA4FA6B1800059CA8253C3"><enum>(d)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
							<paragraph id="H94834CA8A6234398817278320029C46D"><enum>(1)</enum><text>the terms
				<term>cigarette</term> and <term>roll-your-own-tobacco</term> have the meanings
				given them by <external-xref legal-doc="usc" parsable-cite="usc/26/5702">section 5702</external-xref> of the Internal Revenue Code of 1986; and</text>
							</paragraph><paragraph commented="no" id="H1E3B8A864ED84C8BBD01A286AD2988D5"><enum>(2)</enum><text>the term
				<term>smokeless tobacco</term> has the meaning given such term by section 2341
				of title
				18.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H01EEAD266A9B430EBB6247304BC42D55"><enum>(b)</enum><header>Administrative
			 subpoenas</header><text><external-xref legal-doc="usc" parsable-cite="usc/39/3016">Section 3016(a)</external-xref> of title 39, United States Code, is
			 amended in paragraphs (1)(A) and (2) by inserting <quote>3002b(b) or</quote>
			 before <quote>3005(a)</quote>.</text>
			</subsection><subsection commented="no" id="H4409039A74E04CFDA522261FF5AEDEF1"><enum>(c)</enum><header>Semiannual
			 reports</header><text><external-xref legal-doc="usc" parsable-cite="usc/39/3013">Section 3013</external-xref> of title 39, United States Code, is
			 amended—</text>
				<paragraph commented="no" id="H9D9A80D1BA794FB0966DE9318843D818"><enum>(1)</enum><text>in paragraph (1),
			 by inserting <quote>3002b(b) or</quote> before <quote>3005</quote>; and</text>
				</paragraph><paragraph commented="no" id="HFC857F41499640E980664591D1E0F3C7"><enum>(2)</enum><text>in paragraph (3),
			 by striking <quote>section 3007 of this title</quote> and inserting
			 <quote>section 3002b(c) or section 3007, respectively,</quote>.</text>
				</paragraph></subsection><subsection commented="no" id="H821283DC6B9442A18209B746B178E2FC"><enum>(d)</enum><header>Amendments to
			 Tariff Act of <enum-in-header>1930</enum-in-header></header><text>Section
			 583(c)(1) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1583">19 U.S.C. 1583(c)(1)</external-xref>) is amended—</text>
				<paragraph id="H59964128DCF24FD4879F568E00B6CB6"><enum>(1)</enum><text>by
			 redesignating subparagraph (K) as subparagraph (L); and</text>
				</paragraph><paragraph id="HF7A28458A6354763BFA4B1A2C7ED741E"><enum>(2)</enum><text>by inserting after
			 subparagraph (J) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HBB4752152B25413FA9883336955828D8" style="OLC">
						<subparagraph commented="no" id="H16E5404426894EF884E3B286B44167CB"><enum>(K)</enum><text>Cigarettes,
				smokeless tobacco, or roll-your-own tobacco (as those terms are defined in
				<external-xref legal-doc="usc" parsable-cite="usc/39/3002b">section 3002b</external-xref> of title 39, United States
				Code).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H38ED7A05E4514B92B9A3B7DA21F56CB7"><enum>(e)</enum><header>Clerical
			 amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/39/30">chapter 30</external-xref> of title 39,
			 United States Code, is amended by inserting after the item relating to section
			 3002a the following:</text>
				<quoted-block display-inline="no-display-inline" id="H1AE102D123BD491700385B8F813C3375" style="USC">
					<toc regeneration="no-regeneration">
						<toc-entry level="section">3002b. Nonmailability of certain tobacco
				products.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="H4D66A4C750054249BBBAFE1FFCE84DF4"><enum>(f)</enum><header>Effective
			 dates</header>
				<paragraph commented="no" id="H95A95B669F624A819BB54BE13F26A16D"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the amendments made
			 by this section shall take effect on the 60th day after the date of the
			 enactment of this Act, and shall apply with respect to any mail matter mailed
			 on or after such 60th day.</text>
				</paragraph><paragraph commented="no" id="HDC49C602F7064DD7AA279B60FA75BDC9"><enum>(2)</enum><header>Semiannual
			 reports</header><text>The amendments made by subsection (c) shall apply with
			 respect to reports submitted for reporting periods (as referred to in section
			 3013 of title 39, United States Code) beginning with the reporting period in
			 which occurs the 60th day after the date of the enactment of this Act.</text>
				</paragraph></subsection></section><section id="HD7E15045BAC04DE284D79500446FBAF"><enum>2.</enum><header>Technical
			 correction</header>
			<subsection id="H28E09B7E8F3B47CF0041E7C7A77E4944"><enum>(a)</enum><header>In
			 general</header><text>Sections 3007(a)(1), 3012(b)(1), and 3018(f)(1) of title
			 39, United States Code, are amended by striking <quote>409(d)</quote> and
			 inserting <quote>409(g)(2)</quote>.</text>
			</subsection><subsection id="H217B0121BAE44E5DAF43BEB2F8BBB757"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall take effect as
			 if included in the enactment of the Postal Accountability and Enhancement Act
			 (<external-xref legal-doc="public-law" parsable-cite="pl/109/435">Public Law 109–435</external-xref>).</text>
