		  Retirement Income Security Act of 1974 to require that group and individual
		  health insurance coverage and group health plans provide coverage for qualified
		  individuals for bone mass measurement (bone density testing) to prevent
		  fractures associated with osteoporosis.</official-title>

		<section id="HCB1E1D18FE26407DA7DD5F0396ECC729" section-type="section-one"><enum>1.</enum><header>Short title;
			 findings</header>
			<subsection id="H7CCCBA4AFF04413E88576205365C6E13"><enum>(a)</enum><header>Short
			 Title</header><text>This Act may be cited as the <quote><short-title>Osteoporosis Early Detection and Prevention Act of
			 2007</short-title></quote>.</text>
			</subsection><subsection id="HC1292255EB4342C995CD5827CBA854DA"><enum>(b)</enum><header>Findings</header><text>Congress
			 makes the following findings:</text>
				<paragraph id="H24A8592C007E4BBB87B4D0D0E8ED179C"><enum>(1)</enum><header>Nature of
			 osteoporosis</header>
					<subparagraph id="HD5DA5DFC9E254AA480BECC4BA5C1BD38"><enum>(A)</enum><text>Osteoporosis is a
			 disease characterized by low bone mass and structural deterioration of bone
			 tissue leading to bone fragility and increased susceptibility to fractures of
			 the hip, spine, and wrist.</text>
					</subparagraph><subparagraph id="H7C9530A6F4E646A59672A9771498F1E8"><enum>(B)</enum><text>Osteoporosis has
			 no symptoms and typically remains undiagnosed until a fracture occurs.</text>
					</subparagraph><subparagraph id="H6E8C6010BD2E403DB09DF85EA19FDFFE"><enum>(C)</enum><text>Once a fracture
			 occurs, the condition has usually advanced to the stage where the likelihood is
			 high that another fracture will occur.</text>
					</subparagraph><subparagraph id="H11A88618C0B44E5F805DEA8D3B113DFC"><enum>(D)</enum><text>There is no cure
			 for osteoporosis, but drug therapy has been shown to reduce new hip and spine
			 fractures by 50 percent and other treatments, such as nutrition therapy, have
			 also proven effective.</text>
					</subparagraph></paragraph><paragraph id="HD88598253F1E4992B52F7E387D56A6FD"><enum>(2)</enum><header>Incidence of
			 osteoporosis</header><text>Osteoporosis is a common condition:</text>
					<subparagraph id="H698485B0FE0D44FCA2ABA9F6BAD14A9"><enum>(A)</enum><text>Of the 44 million
			 Americans who have (or are at risk for) osteoporosis, 80 percent are
			 women.</text>
					</subparagraph><subparagraph id="H96647C872F124A99A34641D50415AFDC"><enum>(B)</enum><text>Annually there are
			 1.5 million bone fractures attributable to osteoporosis.</text>
					</subparagraph><subparagraph id="HE096ADBEB59E465BA9D6CBE9D32D72C"><enum>(C)</enum><text>Half of all women,
			 and one-fourth of all men, age 50 or older will have a bone fracture due to
			 osteoporosis.</text>
					</subparagraph></paragraph><paragraph id="H187EB2DA5F30415D8B824D9C179C9762"><enum>(3)</enum><header>Impact of
			 osteoporosis</header><text>The cost of treating osteoporosis is
			 significant:</text>
					<subparagraph id="HB27B9989844343A887E49F00C06E7D17"><enum>(A)</enum><text>The annual cost of
			 osteoporosis in the United States was $17 billion in 2001.</text>
					</subparagraph><subparagraph id="H21FA163871644B9897712CF5EB00D77B"><enum>(B)</enum><text>The average cost
			 in the United States of repairing a hip fracture due to osteoporosis is
			 $37,000, while the average cost of an osteoporosis screening test ranges from
			 $59 to $300.</text>
					</subparagraph><subparagraph id="HA94BDEF363884D68A8386D6E65E14D30"><enum>(C)</enum><text>Fractures due to
			 osteoporosis frequently result in disability and institutionalization of
			 individuals.</text>
					</subparagraph><subparagraph id="HBA46E20242354F4FAC4C5447BAC53167"><enum>(D)</enum><text>Because
			 osteoporosis is a progressive condition causing fractures primarily in aging
			 individuals, preventing fractures particularly in post menopausal women before
			 they become eligible for Medicare, has a significant potential of reducing
			 osteoporosis-related costs under the Medicare program.</text>
					</subparagraph></paragraph><paragraph id="HC9EB8786C8E64D4892CAE4E83616B2DC"><enum>(4)</enum><header>Use of bone mass
			 measurement</header>
					<subparagraph id="H1D9A08B3BA2747F3BFAA708372CE98C"><enum>(A)</enum><text>Bone mass
			 measurement is a non-invasive, painless, and reliable way to diagnose
			 osteoporosis before costly fractures occur.</text>
					</subparagraph><subparagraph id="H471536F1A04A4CB7BB85ECD34B218C57"><enum>(B)</enum><text>Low bone mass is
			 as predictive of future fractures as is high cholesterol or high blood pressure
			 of heart disease or stroke.</text>
					</subparagraph><subparagraph id="HB43163C0CADE4F92BDB5FC35BE9BF561"><enum>(C)</enum><text>Bone mass
			 measurement is the only reliable method of detecting osteoporosis at an early
			 stage.</text>
					</subparagraph><subparagraph id="H050CBFEAB60E4E868783DEBE831F7E5"><enum>(D)</enum><text>Under section 4106
			 of the Balanced Budget Act of 1997, Medicare provides coverage, effective July
			 1, 1998, for bone mass measurement for qualified individuals who are at risk of
			 developing osteoporosis.</text>
					</subparagraph></paragraph></subsection></section><section id="HC96B77BEF6294CA9BBFA009EBCCD11F"><enum>2.</enum><header>Requiring coverage
			 of bone mass measurement under health plans</header>
			<subsection id="H9BD762F5DB75458AAEAA47BBCF0024A3"><enum>(a)</enum><header>Group Health
			 Plans</header>
				<paragraph id="H7D5BB3AE13E54BB1A089D994542F2F30"><enum>(1)</enum><header>Public Health
			 Service Act amendments</header><subparagraph commented="no" display-inline="yes-display-inline" id="H77CE73752D33486E83F861627619CA36"><enum>(A)</enum><text>Subpart 2 of part A of
			 title XXVII of the Public Health Service Act is amended by adding at the end
			 the following new section:</text>
						<quoted-block id="HCA0E39D1F44F4BDA8FD66AA001FAEF7" style="OLC">
							<section id="HB009BD4E372B4ACEB9486558649FC9AC"><enum>2707.</enum><header>Standards
				relating to benefits for bone mass measurement</header>
								<subsection id="HC930969A3ED0411CB61510FC97125600"><enum>(a)</enum><header>Requirements for
				Coverage of Bone Mass Measurement</header><text>A group health plan, and a
				health insurance issuer offering group health insurance coverage, shall include
				(consistent with this section) coverage for bone mass measurement for
				beneficiaries and participants who are qualified individuals.</text>
								</subsection><subsection id="H4BD9B518F4A14DBDBFB8F2E13F346501"><enum>(b)</enum><header>Definitions
				Relating to Coverage</header><text>In this section:</text>
									<paragraph id="H684DAE81AA63435483CC5088ADCC0000"><enum>(1)</enum><header>Bone mass
				measurement</header><text>The term <term>bone mass measurement</term> means a
				radiologic or radioisotopic procedure or other procedure approved by the Food
				and Drug Administration performed on an individual for the purpose of
				identifying bone mass or detecting bone loss or determining bone quality, and
				includes a physician’s interpretation of the results of the procedure. Nothing
				in this paragraph shall be construed as requiring a bone mass measurement to be
				conducted in a particular type of facility or to prevent such a measurement
				from being conducted through the use of mobile facilities that are otherwise
				qualified.</text>
									</paragraph><paragraph id="HB85C16EF3E1F4039AF83FF42EA1EA3C0"><enum>(2)</enum><header>Qualified
				individual</header><text>The term <term>qualified individual</term> means an
				individual who—</text>
										<subparagraph id="H83DE93BBF1B64FC0AB54CB5C5282FA83"><enum>(A)</enum><text>is at clinical
				risk for osteoporosis, including an estrogen-deficient woman;</text>
										</subparagraph><subparagraph id="H552C2FABB8334C33A01E1D975C005DBE"><enum>(B)</enum><text>has vertebral
				abnormalities;</text>
										</subparagraph><subparagraph id="H87D72AB3FBE444AD812CA500484D3272"><enum>(C)</enum><text>is receiving
				chemotherapy or long-term gluococorticoid (steroid) therapy;</text>
										</subparagraph><subparagraph id="H76AAAD0833484B458DF6349EFCA3F4F2"><enum>(D)</enum><text>has primary
				hyperparathyroidism, hyperthyroidism, or excess thyroid replacement; or</text>
										</subparagraph><subparagraph id="HCDCFC1FD3B324B40875210491965C566"><enum>(E)</enum><text>is being monitored
				to assess the response to or efficacy of approved osteoporosis drug
				therapy.</text>
										</subparagraph></paragraph></subsection><subsection id="H35F9A21A8D194C599C0063D6461500EB"><enum>(c)</enum><header>Limitation on
				Frequency Required</header><text>Taking into account the standards established
				under section 1861(rr)(3) of the Social Security Act, the Secretary shall
				establish standards regarding the frequency with which a qualified individual
				shall be eligible to be provided benefits for bone mass measurement under this
				section. The Secretary may vary such standards based on the clinical and
				risk-related characteristics of qualified individuals.</text>
								</subsection><subsection id="H1D64744444904BE58ED2CCDD00758F30"><enum>(d)</enum><header>Restrictions on
				Cost-Sharing</header>
									<paragraph id="H08C5E3A178944380A8EFA503A60511E6"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), nothing in this section shall
				be construed as preventing a group health plan or issuer from imposing
				deductibles, coinsurance, or other cost-sharing in relation to bone mass
				measurement under the plan (or health insurance coverage offered in connection
				with a plan).</text>
									</paragraph><paragraph id="HBEA12164A0B34F340036B1E64848C1E7"><enum>(2)</enum><header>Limitation</header><text>Deductibles,
				coinsurance, and other cost-sharing or other limitations for bone mass
				measurement may not be imposed under paragraph (1) to the extent they exceed
				the deductibles, coinsurance, and limitations that are applied to similar
				services under the group health plan or health insurance coverage.</text>
									</paragraph></subsection><subsection id="HC559317B602A4360AA0058D552F99BC"><enum>(e)</enum><header>Prohibitions</header><text>A
				group health plan, and a health insurance issuer offering group health
				insurance coverage in connection with a group health plan, may not—</text>
									<paragraph id="HCF9BD158EE514B80B170CB9982097303"><enum>(1)</enum><text>deny to an
				individual eligibility, or continued eligibility, to enroll or to renew
				coverage under the terms of the plan, solely for the purpose of avoiding the
				requirements of this section;</text>
									</paragraph><paragraph id="H74C37EF1BC274DC39B1902CDDAF39F7D"><enum>(2)</enum><text>provide incentives
				(monetary or otherwise) to individuals to encourage such individuals not to be
				provided bone mass measurements to which they are entitled under this section
				or to providers to induce such providers not to provide such measurements to
				qualified individuals;</text>
									</paragraph><paragraph id="H08296FB49A5F4F228B1E496E8103DA2C"><enum>(3)</enum><text>prohibit a
				provider from discussing with a patient osteoporosis preventive techniques or
				medical treatment options relating to this section; or</text>
									</paragraph><paragraph id="H70371620141245C8B8AEF9B700BB6D00"><enum>(4)</enum><text>penalize or
				otherwise reduce or limit the reimbursement of a provider because such provider
				provided bone mass measurements to a qualified individual in accordance with
				this section.</text>
									</paragraph></subsection><subsection id="H23A5F7FA8DE54114B98C2FE1481FBC4F"><enum>(f)</enum><header>Rule of
				Construction</header><text>Nothing in this section shall be construed to
				require an individual who is a participant or beneficiary to undergo bone mass
				measurement.</text>
								</subsection><subsection id="H6F5F90837ABB48A4A7C93BCC40884C9E"><enum>(g)</enum><header>Notice</header><text>A
				group health plan under this part shall comply with the notice requirement
				under section 714(g) of the Employee Retirement Income Security Act of 1974
				with respect to the requirements of this section as if such section applied to
				such plan.</text>
								</subsection><subsection id="H7299091886934D148627435CC6B067B6"><enum>(h)</enum><header>Level and Type
				of Reimbursements</header><text>Nothing in this section shall be construed to
				prevent a group health plan or a health insurance issuer offering group health
				insurance coverage from negotiating the level and type of reimbursement with a
				provider for care provided in accordance with this section.</text>
								</subsection><subsection id="H59D7C568F89449E7AF8711BDE2F64115"><enum>(i)</enum><header>Preemption</header>
									<paragraph id="H75CD9D8AC0C04E92AC0368A6853B5F00"><enum>(1)</enum><header>In
				general</header><text>The provisions of this section do not preempt State law
				relating to health insurance coverage to the extent such State law provides
				greater benefits with respect to osteoporosis detection or prevention.</text>
									</paragraph><paragraph id="H783FBE00237D44CB9EB7BB07E923334"><enum>(2)</enum><header>Construction</header><text>Section
				2723(a)(1) shall not be construed as superseding a State law described in
				paragraph
				(1).</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H94F7ECD7425B4509B7469BFAA095F4D" indent="up1"><enum>(B)</enum><text>Section 2723(c) of such Act (42 U.S.C.
			 300gg–23(c)) is amended by striking <quote>section 2704</quote> and inserting
			 <quote>sections 2704 and 2707</quote>.</text>
					</subparagraph></paragraph><paragraph id="HBA06DD3ABD0F40458D92A09EF32C5F76"><enum>(2)</enum><header>Erisa
			 amendments</header><subparagraph commented="no" display-inline="yes-display-inline" id="H252D4AB327C540CC9D6CF332F8F56800"><enum>(A)</enum><text>Subpart B of part 7 of
			 subtitle B of title I of the Employee Retirement Income Security Act of 1974 is
			 amended by adding at the end the following new section:</text>
						<quoted-block id="HFEF454E4D3E54E43B0A8D3E228CF4000" style="OLC">
							<section id="H56CB12627B04426D9DB941BDAD6B2F2E"><enum>714.</enum><header>Standards
				relating to benefits for bone mass measurement</header>
								<subsection id="H1F0D9D75390B44F68C18B1FFE2127600"><enum>(a)</enum><header>Requirements for
				Coverage of Bone Mass Measurement</header><text>A group health plan, and a
				health insurance issuer offering group health insurance coverage, shall include
				(consistent with this section) coverage for bone mass measurement for
				beneficiaries and participants who are qualified individuals.</text>
								</subsection><subsection id="H878D435B0F4C439E944B0024AB34C9A2"><enum>(b)</enum><header>Definitions
				Relating to Coverage</header><text>In this section:</text>
									<paragraph id="H592517D0F1124A75AE8033679C65AAFC"><enum>(1)</enum><header>Bone mass
				measurement</header><text>The term <term>bone mass measurement</term> means a
				radiologic or radioisotopic procedure or other procedure approved by the Food
				and Drug Administration performed on an individual for the purpose of
				identifying bone mass or detecting bone loss or determining bone quality, and

										</subparagraph><subparagraph id="H4CC18BFB0FD94B2CBE8FD2FB58009600"><enum>(B)</enum><text>has vertebral
				abnormalities;</text>
										</subparagraph><subparagraph id="H2363B93C8563446D91BFC1FF2D82572"><enum>(C)</enum><text>is receiving
				chemotherapy or long-term gluococorticoid (steroid) therapy;</text>
										</subparagraph><subparagraph id="HAF4F1E84902942BE816F23DB1EE7DA5D"><enum>(D)</enum><text>has primary
				hyperparathyroidism, hyperthyroidism, or excess thyroid replacement; or</text>
										</subparagraph><subparagraph id="H63EB781DB54A47968679E95B1A5A4F6"><enum>(E)</enum><text>is being monitored
				to assess the response to or efficacy of approved osteoporosis drug
				therapy.</text>
										</subparagraph></paragraph></subsection><subsection id="HEA05375C9DB44DFBB8B900892C04F5AC"><enum>(c)</enum><header>Limitation on
				Frequency Required</header><text>The standards established under section
				2707(c) of the Public Health Service Act shall apply to benefits provided under
				this section in the same manner as they apply to benefits provided under
				section 2707 of such Act.</text>
								</subsection><subsection id="HD616404612B14BAE8DBB149C5CFF155F"><enum>(d)</enum><header>Restrictions on
				Cost-Sharing</header>
									<paragraph id="H40755CC5F78F4465848B33C5797F4D1F"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), nothing in this section shall
				be construed as preventing a group health plan or issuer from imposing
				deductibles, coinsurance, or other cost-sharing in relation to bone mass
				measurement under the plan (or health insurance coverage offered in connection
				with a plan).</text>
									</paragraph><paragraph id="H05DA67DEA8C14EBAA605847F7F013CE4"><enum>(2)</enum><header>Limitation</header><text>Deductibles,
				coinsurance, and other cost-sharing or other limitations for bone mass
				measurement may not be imposed under paragraph (1) to the extent they exceed
				the deductibles, coinsurance, and limitations that are applied to similar
				services under the group health plan or health insurance coverage.</text>
									</paragraph></subsection><subsection id="HCC1634495B4A4BEDB5598652AEF38BA2"><enum>(e)</enum><header>Prohibitions</header><text>A
				group health plan, and a health insurance issuer offering group health
				insurance coverage in connection with a group health plan, may not—</text>
									<paragraph id="HA5E0322D0BF04770A5DE03A5611510CE"><enum>(1)</enum><text>deny to an
				individual eligibility, or continued eligibility, to enroll or to renew
				coverage under the terms of the plan, solely for the purpose of avoiding the
				requirements of this section;</text>
									</paragraph><paragraph id="HA0711261AF1B4980BEDE006FE6B77DEC"><enum>(2)</enum><text>provide incentives
				(monetary or otherwise) to individuals to encourage such individuals not to be
				provided bone mass measurements to which they are entitled under this section
				or to providers to induce such providers not to provide such measurements to
				qualified individuals;</text>
									</paragraph><paragraph id="H441C32434ACA48A7B1AD77FD21413903"><enum>(3)</enum><text>prohibit a
				provider from discussing with a patient osteoporosis preventive techniques or
				medical treatment options relating to this section; or</text>
									</paragraph><paragraph id="HF98424356EAF4979912D84D7863F8622"><enum>(4)</enum><text>penalize or
				otherwise reduce or limit the reimbursement of a provider because such provider
				provided bone mass measurements to a qualified individual in accordance with
				this section.</text>
									</paragraph></subsection><subsection id="H27F071030CA341C48000D600FBE00B8"><enum>(f)</enum><header>Rule of
				Construction</header><text>Nothing in this section shall be construed to
				require an individual who is a participant or beneficiary to undergo bone mass
				measurement.</text>
								</subsection><subsection id="H4CA1926D84754C9700B05317F600E694"><enum>(g)</enum><header>Notice Under
				Group Health Plan</header><text>The imposition of the requirements of this
				section shall be treated as a material modification in the terms of the plan
				described in section 102(a), for purposes of assuring notice of such
				requirements under the plan; except that the summary description required to be
				provided under the fourth sentence of section 104(b)(1) with respect to such
				modification shall be provided by not later than 60 days after the first day of
				the first plan year in which such requirements apply.</text>
								</subsection><subsection id="H1E80DF558A654175B1CFB902921A17"><enum>(h)</enum><header>Preemption</header>
									<paragraph id="HE23B0C3F2987450D90679999DD6818BA"><enum>(1)</enum><header>In
				general</header><text>The provisions of this section do not preempt State law
				relating to health insurance coverage to the extent such State law provides
				greater benefits with respect to osteoporosis detection or prevention.</text>
									</paragraph><paragraph id="HC54FA920D3024996AFE4B7DABDD23068"><enum>(2)</enum><header>Construction</header><text>Section
				731(a)(1) shall not be construed as superseding a State law described in
				paragraph
				(1).</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H398857E632A94D3E8C429523EFF96400"><enum>(B)</enum><text>Section 731(c) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1191">29 U.S.C. 1191(c)</external-xref>) is amended by striking <quote>section 711</quote>
			 and inserting <quote>sections 711 and 714</quote>.</text>
					</subparagraph><subparagraph id="HB6176F8080374E71B578A2324E90B9C0"><enum>(C)</enum><text>Section 732(a) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1191a">29 U.S.C. 1191a(a)</external-xref>) is amended by striking <quote>section 711</quote>
			 and inserting <quote>sections 711 and 714</quote>.</text>
					</subparagraph><subparagraph id="H72DFDF73E4ED462AA960FDAB5872F8E4"><enum>(D)</enum><text>The table of
			 contents in section 1 of such Act is amended by inserting after the item
			 relating to section 713 the following new item:</text>

			 Health Insurance</header><paragraph commented="no" display-inline="yes-display-inline" id="HABD92F5C11A24629BCA270B4495782CE"><enum>(1)</enum><text display-inline="yes-display-inline">Part B of title XXVII of the Public Health
			 Service Act is amended by inserting after section 2752 the following new
			 section:</text>
					<quoted-block id="H6DBF6C9728CC40C188AEC78824ED8757" style="OLC">
						<section id="HFDF59E335E264AE5BA4220FFCCEB9F19"><enum>2753.</enum><header>Standards
				relating to benefits for bone mass measurement</header>
							<subsection id="HEF91DDD035F24CEC87CC007FA0006D1E"><enum>(a)</enum><header>In
				General</header><text>The provisions of section 2707 (other than subsection
				(g)) shall apply to health insurance coverage offered by a health insurance
				issuer in the individual market in the same manner as it applies to health
				insurance coverage offered by a health insurance issuer in connection with a
				group health plan in the small or large group market.</text>
							</subsection><subsection id="H12BF6222D0614C92861C6EBDEBC0367E"><enum>(b)</enum><header>Notice</header><text>A
				health insurance issuer under this part shall comply with the notice
				requirement under section 714(g) of the Employee Retirement Income Security Act
				of 1974 with respect to the requirements referred to in subsection (a) as if
				such section applied to such issuer and such issuer were a group health
				plan.</text>
							</subsection><subsection id="H0E944AE291F441409D1787B0385F2BDF"><enum>(c)</enum><header>Preemption</header>
								<paragraph id="HB9A7C194C9264700B238651C4C0929CA"><enum>(1)</enum><header>In
				general</header><text>The provisions of this section do not preempt State law
				relating to health insurance coverage to the extent such State law provides
				greater benefits with respect to osteoporosis detection or prevention.</text>
								</paragraph><paragraph id="HF433ABBF8B2D45DBA1121309C5691CE"><enum>(2)</enum><header>Construction</header><text>Section
				2762(a) shall not be construed as superseding a State law described in
				paragraph
				(1).</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H7E3F68FC110D47089FF0647C3F321FB1" indent="up1"><enum>(2)</enum><text>Section 2762(b)(2) of such Act (42
			 U.S.C. 300gg-62(b)(2)) is amended by striking <quote>section 2751</quote> and
			 inserting <quote>sections 2751 and 2753</quote>.</text>
				</paragraph></subsection><subsection id="HDAB3946F60C94C318493ED6243154F8D"><enum>(c)</enum><header>Effective
			 Dates</header><paragraph commented="no" display-inline="yes-display-inline" id="H493E4676C5414934A25F2FA165D20429"><enum>(1)</enum><text>The
			 amendments made by subsection (a) shall apply with respect to group health
			 plans for plan years beginning on or after January 1, 2008.</text>
				</paragraph><paragraph id="H75E750025D084CC896E36F22C6458988" indent="up1"><enum>(2)</enum><text>The amendments made by subsection (b)
			 shall apply with respect to health insurance coverage offered, sold, issued,
			 renewed, in effect, or operated in the individual market on or after such
			 date.</text>
