		<legis-type>A BILL</legis-type>
		<official-title>To authorize funds to prevent housing discrimination
		  through the use of nationwide testing, to increase funds for the Fair Housing
		  Initiatives Program, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H43CF5C3BF9544FE7A9B528CFC65D374C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Housing Fairness Act of
			 2007</short-title></quote>.</text>
		</section><section id="HDD902D1DAC5042369DD4007200B51A0"><enum>2.</enum><header>Testing for
			 discrimination</header>
			<subsection id="HCE8C140C500D4928AA62913CFAB906B6"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Housing and Urban Development shall
			 conduct a nationwide program of testing to—</text>
				<paragraph id="H5DAE73AD469C41C2A594A7FAF1CADDCE"><enum>(1)</enum><text>detect and
			 document differences in the treatment of persons seeking to rent or purchase
			 housing or obtain or refinance a home mortgage loan, and measure patterns of
			 adverse treatment because of the race, color, religion, sex, familial status,
			 disability status, or national origin of a renter, home buyer, or borrower;
			 and</text>
				</paragraph><paragraph id="H70611B02728C4DC5989BE6EC03FD1E9"><enum>(2)</enum><text>measure the
			 prevalence of such discriminatory practices across the housing and mortgage
			 lending markets as a whole.</text>
				</paragraph></subsection><subsection id="H71C0D17D7E104F949EF5556C2E2228C2"><enum>(b)</enum><header>Administration</header><text>The
			 Secretary of Housing and Urban Development shall enter into agreements with
			 qualified fair housing enforcement organizations, as such organizations are
			 defined under subsection (h) of section 561 of the Housing and Community
			 Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a(h)</external-xref>), for the purpose of conducting the
			 testing required under subsection (a).</text>
			</subsection><subsection id="HE9889F15EB5D4E18B439D86BA859FA1"><enum>(c)</enum><header>Report</header><text>The
			 Secretary of Housing and Urban Development shall report to Congress—</text>
				<paragraph id="H140B6BA172E74B19B4B400444EF2B7E7"><enum>(1)</enum><text>on a biennial
			 basis, the results of each round of testing required under subsection (a) along
			 with any recommendations or proposals for legislative or administrative action
			 to address any issues raised by such testing; and</text>
				</paragraph><paragraph id="HDF66281BDD774AF3BB5959EEB2F0D6B1"><enum>(2)</enum><text>on an annual
			 basis, a detailed summary of the calls received by the Fair Housing
			 Administration's 24-hour toll-free telephone hotline.</text>
				</paragraph></subsection><subsection id="HBC81C923470247649421877BFBB600D4"><enum>(d)</enum><header>Use of
			 results</header><text>The results of any testing required under subsection (a)
			 may be used as the basis for the Secretary, or any State or local government or
			 agency, public or private nonprofit organization or institution, or other
			 public or private entity that the Secretary has entered into a contract or
			 cooperative agreement with under section 561 of the Housing and Community
			 Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a</external-xref>) to commence, undertake, or pursue any
			 investigation or enforcement action to remedy any discrimination uncovered as a
			 result of such testing.</text>
			</subsection><subsection id="H21EC1D9E2CD74271958B40A1A0C9485E"><enum>(e)</enum><header>Definitions</header><text>As
			 used in this section:</text>
				<paragraph id="HFC56C04364B84860A0318138AA848455"><enum>(1)</enum><header>Disability
			 status</header><text>The term <quote>disability status</quote> has the same
			 meaning given the term <quote>handicap</quote> in section 802 of the Civil
			 Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3602">42 U.S.C. 3602</external-xref>).</text>
				</paragraph><paragraph id="HA1019898287845D1AF0248FA955BA7A0"><enum>(2)</enum><header>Familial
			 status</header><text>The term <quote>familial status</quote> has the same
			 meaning given that term in section 802 of the Civil Rights Act of 1968 (42
			 U.S.C. 3602).</text>
				</paragraph></subsection><subsection id="H374C2CA49A2B42FD80CFCC42A78E5400"><enum>(f)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to carry
			 out the provisions of this section $20,000,000 for fiscal year 2008 and each
			 fiscal year thereafter.</text>
			</subsection></section><section id="H4769D6896BC34DDE92BB3BD935FE34E"><enum>3.</enum><header>Increase in
			 funding for the Fair Housing Initiatives Program</header><text display-inline="no-display-inline">Section 561 of the Housing and Community
			 Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a</external-xref>) is amended—</text>
			<paragraph id="HF2EACE797F6F46D6AE2C09F638ADF3A8"><enum>(1)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="H208EB7CBC54A4C3FB51F4B4717B3BF88"><enum>(A)</enum><text>in paragraph (1),
			 by inserting <quote>qualified</quote> before <quote>private nonprofit fair
			 housing enforcement organizations,</quote>; and</text>
				</subparagraph><subparagraph id="H490F5F3F680E49A0BEF4E232C899A9D"><enum>(B)</enum><text>in paragraph (2),
			 by inserting <quote>qualified</quote> before <quote>private nonprofit fair
			 housing enforcement organizations,</quote>;</text>
				</subparagraph></paragraph><paragraph id="H26FF4925948E4D2BA96529F278774001"><enum>(2)</enum><text>by striking
			 subsection (g) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H06B368403FAB42E5869712BE02545DD" style="OLC">
					<subsection id="H64917744540D4126B11400F50913FAB9"><enum>(g)</enum><header>Authorization of
				appropriations</header>
						<paragraph id="H6C688D433E1043158290EB94D3ACA3E"><enum>(1)</enum><header>In
				general</header><text>There are authorized to be appropriated to carry out the
				provisions of this section $52,000,000 for each of fiscal years 2008 through
				2012, of which—</text>
							<subparagraph id="HE63F16CE6DB8448F93D9EDEEFD3D49DF"><enum>(A)</enum><text>not less than 75
				percent of such amounts shall be for private enforcement initiatives authorized
				under subsection (b);</text>
							</subparagraph><subparagraph id="H88EDE9ECF61B4E87952C29ADE3391121"><enum>(B)</enum><text>not more than 10
				percent of such amounts shall be for education and outreach programs under
				subsection (d); and</text>
							</subparagraph><subparagraph id="H1BC46C3149AA45F5961B6CE6625D07B7"><enum>(C)</enum><text>any remaining
				amounts shall be used for program activities authorized under this
				section.</text>
							</subparagraph></paragraph><paragraph id="H2BEE43260F0343CE99F374C8D1794347"><enum>(2)</enum><header>Availability</header><text>Any
				amount appropriated under this section shall remain available until
				expended.</text>
						</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H413CAE45638A4FA9AAEFB92AA80B4F8"><enum>(3)</enum><text>in
			 subsection (h), in the matter following subparagraph (C), by inserting
			 <quote>and meets the criteria described in subparagraphs (A) and (C)</quote>
			 after <quote>subparagraph (B)</quote>; and</text>
			</paragraph><paragraph id="H7FE80FBA5242485B96ABDF4CA3B5004B"><enum>(4)</enum><text>in subsection
			 (d)—</text>
				<subparagraph id="HECAD4F398C3342C1A84D88F589F99CC6"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
					<clause id="HF666DF03C29E4F57B159F5B57465D949"><enum>(i)</enum><text>in
			 subparagraph (C), by striking <quote>and</quote> at the end;</text>
					</clause><clause id="H1A5857DB3B204F828CB0AB3B894CE808"><enum>(ii)</enum><text>in
			 subparagraph (D), by striking the period and inserting <quote>; and</quote>;
			 and</text>
					</clause><clause id="H3813832F22BE4EAA975FFF3082982838"><enum>(iii)</enum><text>by
			 adding inserting after subparagraph (D) the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H793C3B4F495E4ABDB410FEE2D911C7F4" style="OLC">
							<subparagraph id="H4D8EB9C4BB104A3680EA06F39EFE249E"><enum>(E)</enum><text>websites and other
				media
				outlets.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</clause></subparagraph><subparagraph id="H9A90C7E3B42F4927A1C1AFA31346BF17"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>or other public or private entities</quote> and inserting
			 <quote>or other public or private nonprofit entities</quote>; and</text>
				</subparagraph><subparagraph id="H3348C4C3CBA044BCA44849E031F8A7E"><enum>(C)</enum><text>in paragraph (3),
			 by striking <quote>or other public or private entities</quote> and inserting
			 <quote>or other public or private nonprofit entities</quote>.</text>
				</subparagraph></paragraph></section><section id="H25B739CD4EAA4133BF2DEDD0B17FE137"><enum>4.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 Congress that the Secretary of Housing and Urban Development should—</text>
			<paragraph id="H27700506AA3B4C8397DD155C84796907"><enum>(1)</enum><text display-inline="yes-display-inline">fully comply with the requirements of
			 section 561(d) of the Housing and Community Development Act of 1987 (42 U.S.C.
			 3616a(d)) to establish, design, and maintain a national education and outreach
			 program to provide a centralized, coordinated effort for the development and
			 dissemination of the fair housing rights of individuals who seek to rent,
			 purchase, sell, or facilitate the sale of a home;</text>
			</paragraph><paragraph id="H8B4C49A417284533B93700693693B0D3"><enum>(2)</enum><text display-inline="yes-display-inline">utilize all amounts appropriated for such
			 education and outreach program under section 561(g) of such Act; and</text>
			</paragraph><paragraph id="HDA74E6C03B2E462EAAD8E16F4D86F8C3"><enum>(3)</enum><text display-inline="yes-display-inline">promulgate regulations regarding the fair
			 housing obligations of each recipient of Federal housing funds to affirmatively
			 further fair housing, as that term is defined under title VIII of the Civil
			 Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>).</text>
			</paragraph></section><section id="H59FF70C288E140F08513D87D003676C4"><enum>5.</enum><header>Grants to private
			 entities to study housing discrimination</header>
			<subsection id="H855B8D356D60496A82AC1EA50030A4C7"><enum>(a)</enum><header>Grant
			 program</header><text>The Secretary of Housing and Urban Development shall
			 carry out a competitive matching grant program to assist private nonprofit
			 organizations in—</text>
				<paragraph id="HA901048CE7134480B312EDF0E3A29F2D"><enum>(1)</enum><text>conducting
			 comprehensive studies that examine—</text>
					<subparagraph id="H3166728B2E9A48DCAB7322FABE303CCF"><enum>(A)</enum><text>the causes of
			 housing discrimination and segregation; and</text>
					</subparagraph><subparagraph id="H962E69622E734E47B9A8934BEDA781F0"><enum>(B)</enum><text>the effects of
			 housing discrimination and segregation on education, poverty, and economic
			 development; and</text>
					</subparagraph></paragraph><paragraph id="HA4F314C9177C460B946041FB2F1197DD"><enum>(2)</enum><text>implementing pilot
			 projects that test solutions that will help prevent or alleviate housing
			 discrimination and segregation.</text>
				</paragraph></subsection><subsection id="H99EA10CE4B3D4FD0A7A5A0EFB13FED28"><enum>(b)</enum><header>Eligibility</header><text>To
			 be eligible to receive a grant under this section, a private nonprofit
			 organization shall—</text>
				<paragraph id="HDCE51D457A3F4C2CB39CA8B800A3BCE6"><enum>(1)</enum><text>submit an
			 application to the Secretary of Housing and Urban Development, containing such
			 information as the Secretary shall require; and</text>
				</paragraph><paragraph id="H5FF434531A0D4CE19EAE95DB5298D151"><enum>(2)</enum><text>agree to provide
			 matching non-Federal funds for 25 percent of the total amount of the grant,
			 which matching funds may include items donated on an in-kind contribution
			 basis.</text>
				</paragraph></subsection><subsection id="HA3ADB58F5FBC4518AA02E97E49C4925B"><enum>(c)</enum><header>Preference</header><text>In
			 awarding any grant under this section, the Secretary of Housing and Urban
			 Development shall give preference to any applicant who is—</text>
				<paragraph id="H68D1276A9B1B43668B00DF80ABD8D909"><enum>(1)</enum><text>a
			 qualified fair housing enforcement organization, as such organization is
			 defined under subsection (h) of section 561 of the Housing and Community
			 Development Act of 1987 (<external-xref legal-doc="usc" parsable-cite="usc/42/3616a">42 U.S.C. 3616a(h)</external-xref>); or</text>
				</paragraph><paragraph id="HA0E12535E5FB4C0EADFE5411FD20CAE0"><enum>(2)</enum><text>a
			 partner of any such organization.</text>
				</paragraph></subsection><subsection id="H5DD4E99BDE7349E782A3766D11246FD8"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to carry
			 out the provisions of this section $5,000,000 for each of fiscal years 2008
			 through 2012.</text>
