<section id="H717A78EC7A46447FB6F8E0167E72D3B6" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Wages for Americans with Disabilities Act</short-title></quote>. </text></section> 
<section id="HB74A83F04CD34BADA966F4D613454D00"><enum>2.</enum><header>Prevention of ineligibility for SSI benefits by reason of an increase in the Federal minimum wage</header> 
<subsection id="H3B2C51E3A4214D11AAEF8B63DB71BB00"><enum>(a)</enum><header>Earned income exclusion</header><text>Section 1612(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382a">42 U.S.C. 1382a(b)</external-xref>) is amended—</text> 
<paragraph id="H71147D7007A5413CB8F4A8A541A2C8D2"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (22);</text></paragraph> 
<paragraph id="H5ACD436E5EB644B4A467044DB838AA01"><enum>(2)</enum><text>by striking the period at the end of paragraph (23) and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H75ABC2687D734DB5AD9FDB006D00B200"><enum>(3)</enum><text>by adding at the end the following:</text>

<paragraph id="HA2F3DD6783A0409A8B6108625F38BA3"><enum>(24)</enum> 
<subparagraph id="H8C97F1D20CB74515A7792959622930E7" display-inline="yes-display-inline"><enum>(A)</enum><text>if such individual does not have an eligible spouse, the amount (if any) by which the minimum wage rate in effect for the month under section 6(a)(1) of the Fair Labor Standards Act of 1938 multiplied by the number of hours for which such individual is gainfully employed during the month exceeds the total amount of earned income of such individual excluded by the preceding provisions of this subsection for the month; or</text></subparagraph> 
<subparagraph id="H4DD547B5DD9E4AA687E10794A3446ED4" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">if such individual has an eligible spouse, the amount (if any) by which the minimum wage rate in effect for the month under section 6(a)(1) of the Fair Labor Standards Act of 1938 multiplied by the total number of hours for which such individual and such spouse are gainfully employed during the month exceeds the total amount of earned income of such individual and such spouse excluded by the preceding provisions of this subsection for the month.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HF9C4E956EBC244BCBBD95E33DCB9E4A2"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) of this section shall apply to benefits for months ending on or after the earliest date, after the date of the enactment of this Act, an increase in the Federal minimum wage rate under section 6(a)(1) of the Fair Labor Standards Act of 1938 takes effect.</text></subsection></section>
