		<official-title>To encourage States to report to the Attorney General
		  certain information regarding the deaths of individuals in the custody of law
		  enforcement agencies.</official-title>

	<legis-body id="H84D6D1BAF9764AC9976D17F83BDEBE11" style="OLC">
		<section display-inline="no-display-inline" id="H1E5475C02FCF4D869FF80779BE8EEDDA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Death in
			 Custody Reporting Act of 2007</quote>.</text>
		</section><section id="H4DDF1A19B23D4D13B960672CA14D511B"><enum>2.</enum><header>Information
			 regarding individuals who die in the custody of law enforcement</header>
			<subsection id="H9630E1ED030047B59B4FA1D32DD72562"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">For each fiscal year
			 after the expiration of the period specified in
			 <internal-xref idref="HE397439D1B004B4FADD535ED34B93190" legis-path="3.(b)(1)">subsection (b)(1)</internal-xref> in which a State
			 receives funds for a program referred to in
			 <internal-xref idref="HC0E3594921D541288C48D29F2011F836" legis-path="3.(b)(2)">subsection (b)(2)</internal-xref>, the State shall report
			 to the Attorney General, on a quarterly basis and pursuant to guidelines
			 established by the Attorney General, information regarding the death of any
			 person who is in the process of arrest, is en route to be incarcerated, or is
			 incarcerated at a municipal or county jail, State prison, or other local or
			 State correctional facility (including any juvenile facility) that, at a
			 minimum, includes—</text>
				<paragraph id="H4CDFC370EFF54ECD91A5B696F3A600FD"><enum>(1)</enum><text>the name, gender,
			 race, ethnicity, and age of the deceased;</text>
				</paragraph><paragraph id="HE869FA9865C3419A876D4E06FAFFDAAA"><enum>(2)</enum><text>the date, time,
			 and location of death; and</text>
				</paragraph><paragraph id="H60CBDF77D9CB4060B57E64DA545B5F92"><enum>(3)</enum><text>a
			 brief description of the circumstances surrounding the death.</text>
				</paragraph></subsection><subsection id="H0AA961CFA1944D6CBC1257607C978C07"><enum>(b)</enum><header>Compliance and
			 Ineligibility</header>
				<paragraph id="HE397439D1B004B4FADD535ED34B93190"><enum>(1)</enum><header>Compliance
			 date</header><text>Each State shall have not more than 30 days from the date of
			 enactment of this Act to comply with
			 <internal-xref idref="H9630E1ED030047B59B4FA1D32DD72562" legis-path="3.(a)">subsection (a)</internal-xref>, except that—</text>
					<subparagraph commented="no" id="HA3BBF97D0A1B487B98191C22EF23C375"><enum>(A)</enum><text>the Attorney
			 General may grant an additional 30 days to a State that is making good faith
			 efforts to comply with such subsection; and</text>
					</subparagraph><subparagraph id="H15B63665A3E4431000A84372DD94EB95"><enum>(B)</enum><text display-inline="yes-display-inline">the Attorney General shall waive the
			 requirements of
			 <internal-xref idref="H9630E1ED030047B59B4FA1D32DD72562" legis-path="3.(a)">subsection (a)</internal-xref> if compliance with such
			 subsection by a State would be unconstitutional under the constitution of such
			 State.</text>
					</subparagraph></paragraph><paragraph id="HC0E3594921D541288C48D29F2011F836"><enum>(2)</enum><header>Ineligibility
			 for funds</header><text display-inline="yes-display-inline">For any fiscal year
			 after the expiration of the period specified in
			 <internal-xref idref="HE397439D1B004B4FADD535ED34B93190" legis-path="3.(b)(1)">paragraph (1)</internal-xref>, a State that fails to
			 comply with
			 <internal-xref idref="H9630E1ED030047B59B4FA1D32DD72562" legis-path="3.(a)">subsection (a)</internal-xref> shall not receive 10 percent
			 of the funds that would otherwise be allocated for that fiscal year to the
			 State under subpart 1 of part E of title I of the Omnibus Crime Control and
			 Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3750">42 U.S.C. 3750 et seq.</external-xref>), whether characterized as the
			 Edward Byrne Memorial State and Local Law Enforcement Assistance Programs, the
			 Local Government Law Enforcement Block Grants Program, the Edward Byrne
			 Memorial Justice Assistance Grant Program, or otherwise.</text>
				</paragraph></subsection><subsection id="HA70ED7E29482405E86B3843C3B4BC0DA"><enum>(c)</enum><header>Reallocation</header><text display-inline="yes-display-inline">Amounts not allocated under a program
			 referred to in
			 <internal-xref idref="HC0E3594921D541288C48D29F2011F836" legis-path="3.(b)(2)">subsection (b)(2)</internal-xref> to a State for failure
			 to fully comply with
			 <internal-xref idref="H9630E1ED030047B59B4FA1D32DD72562" legis-path="3.(a)">subsection (a)</internal-xref> shall be reallocated under
			 that program to States that have not failed to comply with such
			 subsection.</text>
