<section section-type="section-one" id="H81F8F94B6BF54F6B8BDB8075852BA0ED" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Notch Baby Health Care Relief Act of 2007</short-title></quote>.</text></section>
<section id="HCF2BE6DAE292488B997EA17416C6DF87"><enum>2.</enum><header>Premiums paid by certain senior citizens for Medicare Part <enum-in-header>B</enum-in-header></header>
<subsection id="H96FF553AEB154735BB6C891079A9F4E"><enum>(a)</enum><header>In general</header><text>Subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to refundable credits) is amended by redesignating section 36 as section 37 and by inserting after section 35 the following new section:</text>

<section id="H700A18D2B6844A9DA674E497DB52D62"><enum>36.</enum><header>Premiums paid by certain senior citizens for Medicare Part <enum-in-header>B</enum-in-header></header>
<subsection id="HC1A558204AFB42C7B5E95C7162AB552C"><enum>(a)</enum><header>Allowance of credit</header><text>In the case of an eligible individual, there shall be allowed as a credit against the tax imposed by this subtitle for the taxable year an amount equal to the aggregate premiums paid under section 1840 of the <act-name parsable-cite="SSA">Social Security Act</act-name> by the taxpayer during the taxable year for enrollment of the eligible individual under part B of title XVIII of such Act.</text></subsection>
<subsection id="HBAF8B065EAE049519840E28F7EFEB35"><enum>(b)</enum><header>Eligible individual</header><text>For purposes of subsection (a), the term <term>eligible individual</term> means—</text>
<paragraph id="H00EDFF09F66B4C52AEB33BE4102CED39"><enum>(1)</enum><text>an individual born after 1916 and before 1927 who had wages or self-employment income credited for one or more years prior to 1979 and who was not eligible for an old-age or disability insurance benefit, and did not die, prior to January 1979,</text></paragraph>
<paragraph id="H42CD4CA4B9B4461AB65628CAEFC93BC8"><enum>(2)</enum><text>the spouse (as determined under section 7703) of an individual described in paragraph (1), and</text></paragraph>
<paragraph id="HBE1A6502CE2E42BC8EC1E6E0CFEED2BA"><enum>(3)</enum><text>the widow or widower, as the case may be, of an individual described in paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H3D0370C82CAC4A78952FA05400201B33"><enum>(b)</enum><header>Technical amendments</header>
<paragraph id="H66A02C2923CB462099426C67E8E2E62E"><enum>(1)</enum><text>Paragraph (2) of <external-xref legal-doc="usc" parsable-cite="usc/31/1324">section 1324(b)</external-xref> of title 31, United States Code, is amended by striking <quote>or enacted</quote> and inserting <quote>enacted</quote> and by inserting before the period <quote>, or from section 36 of such Code</quote>.</text></paragraph>
<paragraph id="H19646999847042FDB512FC497D175BAD"><enum>(2)</enum><text>The table of sections for subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by striking the last item and inserting the following new items:</text>

<subsection id="H997957FE8D3C4B7BB280D45D236FEB85"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to premiums paid after the date of enactment of this Act.</text></subsection></section>
