<official-title>To amend titles 18 and 28 of the United States Code to provide incentives for the prompt payments of debts owed to the United States and the victims of crime by imposing surcharges on unpaid judgments owed to the United States and to the victims of crime, to provide for offsets on amounts collected by the Department of Justice for Federal agencies, and to increase the amount of special assessments imposed upon convicted persons; to establish an Enhanced Financial Recovery Fund to enhance, supplement and improve the debt collection activities of the Department of Justice; to amend title 5, United States Code, to provide to assistant United States attorneys the same retirement benefits as are afforded to Federal law enforcements officers, and for other purposes.</official-title>

<section id="H83C8701D1F084AC68E169CE16481D34" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhanced Financial Recovery and Equitable Retirement Treatment Act of 2007</short-title></quote>.</text></section> 
<title id="HD01B6804B3784F0082C3689BEB144030"><enum>I</enum><header>Enhanced financial recovery</header> 
<section id="H1648DAB5B470425B8547DB30BA761886"><enum>101.</enum><header>Imposition of criminal surcharge</header> 
<subsection id="H271D33E6CAE6445CB32B284818002190"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/3612">Section 3612</external-xref> of title 18, United States Code, is amended by striking subsection (g) and inserting the following:</text>

<subsection id="H43382FADE0A340A1007B60E13F990049"><enum>(g)</enum><header>Imposition of surcharge</header> 
<paragraph id="H48302C12C7D849DFBF21CCA990C385CD"><enum>(1)</enum><header>In general</header><text>A surcharge shall be imposed upon a defendant if there are any unpaid criminal monetary penalties as of the date specified in subsection (f)(1).</text></paragraph> 
<paragraph id="HA85FD3F6B0B94E53A669B67BE22C38DE"><enum>(2)</enum><header>Amount of surcharge</header><text>The surcharge imposed under paragraph (1) shall be—</text> 
<subparagraph id="H74AC5624E7224BCDB81DE0318BD881D8"><enum>(A)</enum><text>5 percent of the unpaid principal balance; or</text></subparagraph> 
<subparagraph id="H5BC7AA1C332D4EC589993475327E39B2"><enum>(B)</enum><text>$50, if the unpaid balance is less than $1,000.</text></subparagraph></paragraph> 
<paragraph id="H88D50A1FC04E425C82F72E21071F2D3F"><enum>(3)</enum><header>Allocation of payments</header> 
<subparagraph id="H2B1F2D3438CA4ABCADD6679692DE8F12"><enum>(A)</enum><header>Fine or special assessment</header><text>If a surcharge is imposed under paragraph (1) for a fine or special assessment—</text> 
<clause id="H71A741CDFFD94B19B4FF126B17FE8BD1"><enum>(i)</enum><text>an amount equal to 95 percent of each principal payment made by a defendant shall be credited to the Crime Victims Fund established under section 1402 of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/42/10601">42 U.S.C. 10601</external-xref>); and</text></clause> 
<clause commented="no" id="H89802D13E8D946D296D34C7B003FFF46"><enum>(ii)</enum><text>an amount equal to 5 percent of each principal payment shall be credited to the Department of Justice Enhanced Financial Recovery Fund established under section 104 of the <short-title>Enhanced Financial Recovery and Equitable Retirement Treatment Act of 2007</short-title>.</text></clause></subparagraph> 
<subparagraph id="H7CF1291C46BC4656BA23B46D76440D7"><enum>(B)</enum><header>Restitution</header><text>If a surcharge is imposed under paragraph (1) for a restitution obligation—</text> 
<clause id="H89FCC52098D74B33A31718D4B3D9A5B6"><enum>(i)</enum><text>an amount equal to 95 percent of each principal payment shall be paid to any victim identified by the court; and</text></clause> 
<clause id="HBFBAC5CE223746E6A5A617DD44D6007B"><enum>(ii)</enum><text>an amount equal to 5 percent of each principal payment shall be credited to the Department of Justice Enhanced Financial Recovery Fund established under section 104 of the <short-title>Enhanced Financial Recovery and Equitable Retirement Treatment Act of 2007</short-title>.</text></clause></subparagraph> 
<subparagraph id="HBC9A616C33444873AEB1084640BAD2CB"><enum>(C)</enum><header>Surcharges</header><text>For any payment made by a defendant after the full amount of a surcharge imposed under paragraph (1) has been satisfied, the full amount of such payment shall be credited to the principal amount due or accrued interest, as the case may be.</text></subparagraph></paragraph> 
<paragraph id="H50A634468C7841EB87E1B841CB09F91"><enum>(4)</enum><header>Definitions</header><text>In this section—</text> 
<subparagraph id="HFE505C045D824B4DA9175DF67C7AB2E"><enum>(A)</enum><text>the term <term>criminal monetary penalties</term> includes the principal amount of any amount imposed as a fine, restitution obligation, or special assessment, regardless of whether any payment schedule has been imposed; and</text></subparagraph> 
<subparagraph id="H558103698EE9405F8D23170040276EF6"><enum>(B)</enum><text>the term <term>principal payment</term> does not include any amount that is imposed as interest, penalty, or a surcharge.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H819AE6DC2CD94F3582FDEED82719E51C"><enum>(b)</enum><header>Conforming amendments</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3612">Section 3612</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H4A153DB7BBB240719BB804966D4E82CD"><enum>(1)</enum><text>by striking subsections (d) and (e); and</text></paragraph> 
<paragraph id="HFF4F0B6C8C144A12A38F3B487366039C"><enum>(2)</enum><text>by redesignating subsections (f) through (i), as amended by this Act, as subsections (d) through (g), respectively.</text></paragraph></subsection></section> 
<section id="H20DC9FC2D03742DDA57DDCAAC90E5A6"><enum>102.</enum><header>Imposition of civil surcharge</header> 
<subsection id="HF3D4276C3C2E4C3F86857B59A736762F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/28/3011">Section 3011</external-xref> of title 28, United States Code, is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H335609EE709E4FA69CF424EFEC61E00" style="USC"> 
<section id="HDC4CAC845C5E4EF4841C17F300751900"><enum>3011.</enum><header>Imposition of surcharge</header> 
<subsection id="HE2CF4BF2709C4C33B4A2424FCEDA00CC"><enum>(a)</enum><header>In general</header><text>A surcharge shall be imposed on a defendant if there is an unpaid balance due to the United States on any money judgment in a civil matter recovered in a district court as of—</text> 
<paragraph id="HD7B7B48437634AE7927B50991019DA80"><enum>(1)</enum><text>the fifteenth day after the date of the judgment; or</text></paragraph> 
<paragraph id="H2CC6585525D8484E936CDFBF03955BAF"><enum>(2)</enum><text>if the day described in paragraph (1) is a Saturday, Sunday, or legal public holiday, the next day that is not a Saturday, Sunday, or legal holiday.</text></paragraph></subsection> 
<subsection id="H198B45635B0847E5A1E8D16652A9968C"><enum>(b)</enum><header>Amount of surcharge</header><text>A surcharge imposed under subsection (a) shall be—</text> 
<paragraph id="H264B41925548427CA9F8141B3132E700"><enum>(1)</enum><text>5 percent of the unpaid principal balance; or</text></paragraph> 
<paragraph id="H50A218026B9F43E6824900797BBF503"><enum>(2)</enum><text>$50, if the unpaid balance is less than $1,000.</text></paragraph></subsection> 
<subsection id="H25BBB68D55BE4A7D9232174700A2AC00"><enum>(c)</enum><header>Allocation of payments</header><text>If a surcharge is imposed under subsection (a)—</text> 
<paragraph id="HE353767AE0FB4A9281345003DD8BD451"><enum>(1)</enum><text>an amount equal to 95 percent of each principal payment made by a defendant shall be credited as otherwise provided by law; and</text></paragraph> 
<paragraph id="H38A8AFBBAEC14526942787DCBD7A5F"><enum>(2)</enum><text>an amount equal to 5 percent of each principal payment shall be credited to the Department of Justice Enhanced Financial Recovery Fund established under section 104 of the <short-title>Enhanced Financial Recovery and Equitable Retirement Treatment Act of 2007</short-title>.</text></paragraph></subsection> 
<subsection id="HFD3CF9AA6DA84AB4928D2F68BE2BE700"><enum>(d)</enum><header>Surcharges</header><text>For any payment made by a defendant after the full amount of a surcharge imposed under subsection(a) has been satisfied, the full amount of such payment shall be credited to the principal amount due or accrued interest, as the case may be.</text></subsection> 
<subsection id="H6743483710AE4CDAA4C7A7A8659224D9"><enum>(e)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="H17D7D8E824ED4C39B9B7445381F362B1"><enum>(1)</enum><text>the term <term>principal payment</term> does not include any amount that is imposed as interest, penalty, or a surcharge; and</text></paragraph> 
<paragraph id="H4E0997691A0F4DF8B6AA8DD21D4DBD22"><enum>(2)</enum><text>the term <term>unpaid balance due to the United States</term> includes any unpaid balance due to a person that was represented by the Department of Justice in the civil matter in which the money judgment was entered.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H41554423FE4446A9B525D2881FB05FB1"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections at the beginning of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/176">chapter 176</external-xref> of title 28, United States Code, is amended by striking the item relating to section 3011 and inserting the following:</text>

<section id="H67DF2F8C9C8146DCB0B42174B79D570"><enum>103.</enum><header>Increase in the amount of special assessments</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/3013">Section 3013</external-xref> of title 18, United States Code, is amended by striking subsection (a) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H61B7944993454F5BB96CD5E717FC4060" style="USC"> 
<subsection id="HE9ED5BEB07D645A6959C9CC83B728FA2"><enum>(a)</enum><text>The court shall assess on any person convicted of an offense against the United States—</text> 
<paragraph id="H77F812D2B9D24882AA009DC870E5ACFB"><enum>(1)</enum><text>in the case of an infraction or a misdemeanor—</text> 
<subparagraph id="H60DA65B8A70F454CAF4FB1EBF4FDA6B"><enum>(A)</enum><text>if the defendant is an individual—</text> 
<clause id="H1B30BC96E4F2420F824CC5BB4EAA3326"><enum>(i)</enum><text>the amount of $10 in the case of an infraction or a class C misdemeanor;</text></clause> 
<clause id="H6F0A791EE11648E792AA59A1A1F2C9C7"><enum>(ii)</enum><text>the amount of $25 in the case of a class B misdemeanor; and</text></clause> 
<clause id="H0E2A2A3AFAC94A9A959164DAA25EA33E"><enum>(iii)</enum><text>the amount of $100 in the case of a class A misdemeanor; and</text></clause></subparagraph> 
<subparagraph id="H79A612A22E8648C69CE0DCD0524242CF"><enum>(B)</enum><text>if the defendant is a person other than an individual—</text> 
<clause id="HCBF1E442D77C4959B9F4BA25E2862D63"><enum>(i)</enum><text>the amount of $100 in the case of an infraction or a class C misdemeanor;</text></clause> 
<clause id="HC01861E7F78D4F4C9447B916A4EBB7E7"><enum>(ii)</enum><text>the amount of $200 in the case of a class B misdemeanor; and</text></clause> 
<clause id="HBAC3FE3A45C7457EB009DB99A2C4C193"><enum>(iii)</enum><text>the amount of $500 in the case of a class A misdemeanor; and</text></clause></subparagraph></paragraph> 
<paragraph id="H68F627EE6B0748C382E5DADADD00D0D5"><enum>(2)</enum><text>in the case of a felony—</text> 
<subparagraph id="H9BFE63B7E4E2422C96F071E4845695FB"><enum>(A)</enum><text>the amount of $200 if the defendant is an individual; and</text></subparagraph> 
<subparagraph id="H9590E3B0080F46FA9B065FF5D629E15B"><enum>(B)</enum><text>the amount of $1,000 if the defendant is a person other than an individual.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H57C833EA34DE412281062C9104790046"><enum>104.</enum><header>Enhanced financial recovery fund</header> 
<subsection id="H1EA145A0A69C446BA669B57B8BE7908B"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury a separate account known as the Department of Justice Enhanced Financial Recovery Fund (in this section referred to as the <quote>Fund</quote>).</text></subsection> 
<subsection id="H561D913A6711472383BFFBA6C77FA8E"><enum>(b)</enum><header>Deposits</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/3302">section 3302</external-xref> of title 31, United States Code, or any other law regarding the crediting of collections, there shall be credited as an offsetting collection to the Fund an amount equal to—</text> 
<paragraph id="H693EB0D2D9274ECEBB763CFC0092EFE2"><enum>(1)</enum><text>2 percent of any amount collected pursuant to civil debt collection litigation activities of the Department of Justice (in addition to any amount credited under section 11013 of the 21st Century Department of Justice Appropriations Authorization Act (<external-xref legal-doc="usc" parsable-cite="usc/28/527">28 U.S.C. 527</external-xref> note));</text></paragraph> 
<paragraph id="H09EEA2ED29554224A36C0289001C7486"><enum>(2)</enum><text>5 percent of all amounts collected as restitution due to the United States pursuant to the criminal debt collection litigation activities of the Department of Justice;</text></paragraph> 
<paragraph id="HDD26913A62E74D13BAF13D6B7BCE7CD8"><enum>(3)</enum><text>any surcharge collected under <external-xref legal-doc="usc" parsable-cite="usc/18/3612">section 3612(g)</external-xref> of title 18, United States Code, as amended by this Act, or <external-xref legal-doc="usc" parsable-cite="usc/28/3011">section 3011</external-xref> of title 28, United States Code, as amended by this Act; and</text></paragraph> 
<paragraph id="HAF28AF1542414F91964550A4F0B143C4"><enum>(4)</enum><text>50 percent of any special assessment collected under <external-xref legal-doc="usc" parsable-cite="usc/18/3013">section 3013(a)</external-xref> of title 18, United States Code, as amended by this Act.</text></paragraph></subsection> 
<subsection id="H6997095B7DCA46F4A4C37F491D82FB72"><enum>(c)</enum><header>Availability</header><text>The amounts credited to the Fund shall remain available until expended.</text></subsection> 
<subsection id="H3E131BFB3726431680B98E8BFB351B40"><enum>(d)</enum><header>Payments from the Fund</header> 
<paragraph id="H904D67FBD5904D9100BFF9FF7B5BD3FA"><enum>(1)</enum><header>Amount</header> 
<subparagraph id="H4AADAB52A44F46ECA71C5BADBB169C58"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Attorney General shall use not less than $20,000,000 of the Fund in each fiscal year, to the extent that funds are available, for the civil and criminal debt collection activities of the Department of Justice, including restitution judgments where the beneficiaries are the victims of crime.</text></subparagraph> 
<subparagraph id="H2B88CC1B0A054013ACE7B6103907D68E"><enum>(B)</enum><header>Exceptions</header> 
<clause id="H1E49FD47432D48AC97EDE5F80098A0E4"><enum>(i)</enum><header>Adjustment of amount</header><text>In each fiscal year following the first fiscal year in which deposits into the Fund are greater than $20,000,000, the amount to be used under paragraph (1) shall be increased by a percentage equal to the change in the Consumer Price Index for the calendar year preceding that fiscal year.</text></clause> 
<clause id="HA621E7116BF347B200BA7F37C1D8AE84"><enum>(ii)</enum><header>Limitation</header><text>In any fiscal year, amounts in the Fund shall be available to the extent that the amount appropriated in that fiscal year for the purposes described in subparagraph (A) is not less than an amount equal to the amount appropriated for such activities in fiscal year 2006, adjusted annually in the same proportion as increases reflected in the amount of aggregate level of appropriations for the Executive Office of United States Attorneys and United States Attorneys.</text></clause></subparagraph></paragraph> 
<paragraph id="H72A4A6096BDA484391F85702B35D00DC"><enum>(2)</enum><header>Use of funds</header> 
<subparagraph id="HE790900D189A453A994FDB524579AE47"><enum>(A)</enum><header>In general</header><text>Funds used under paragraph (1) shall be used to enhance, supplement, and improve civil and criminal debt collection litigation activities of the Department of Justice, primarily such activities by United States attorneys’ offices. A portion of such sums may be used by the Department of Justice to provide legal, investigative, accounting, and training support to the United States attorneys’ offices.</text></subparagraph> 
<subparagraph id="HE8A7FF082BFD4404B477DF416ED0C1CD"><enum>(B)</enum><header>Limitation on use</header><text>Funds used under paragraph (1) may not be used to determine whether a defendant is guilty of an offense or liability to the United States (except incidentally for the provision of assistance necessary or desirable in a case to ensure the preservation of assets or the imposition of a judgment which assists in the enforcement of a judgment or in a proceeding directly related to the failure of a defendant to satisfy the monetary portion of a judgment).</text></subparagraph></paragraph></subsection> 
<subsection id="HFD8A50D48C924BFD003C290000A608BD"><enum>(e)</enum><header>Other use of funds</header><text>After using funds under subsection (d), the Attorney General may use amounts remaining in the Fund for additional civil or criminal debt collection activities, for personnel expenses, for personnel benefit expenses incurred as a result of this Act or the amendments made by this Act, or for other prosecution and litigation expenses. The availability of amounts from the Fund shall have no effect on the implementation of title II or the amendments made by title II.</text></subsection> 
<subsection id="H23850299944F45769D5022A6B0DD519C"><enum>(f)</enum><header>Definition</header><text>In this section, the term <term>United States</term>—</text> 
<paragraph id="H245AF4F495EE4747A1C54BEF46E4CEE5"><enum>(1)</enum><text>includes—</text> 
<subparagraph id="HDD1DCBA29CEB46A6A36B0722D674653B"><enum>(A)</enum><text>the executive departments, the judicial and legislative branches, the military departments, and independent establishments of the United States; and</text></subparagraph> 
<subparagraph id="HC7A253937BEB483FAC2C5B5677FCF89B"><enum>(B)</enum><text>corporations primarily acting as instrumentalities or agencies of the United States; and</text></subparagraph></paragraph> 
<paragraph id="HFD28C21582CB43A1842194981500FD49"><enum>(2)</enum><text>except as provided in paragraph (1), does not include any contractor of the United States.</text></paragraph></subsection></section> 
<section id="H85097B57B628490FA3E0A9CAF7431EF2"><enum>105.</enum><header>Effective dates</header> 
<subsection id="H30B2FCD530D940A4B7B681B504772487"><enum>(a)</enum><header>In general</header><text>The amendments made by section 101 and section 103 shall apply to any offense committed on or after the date of enactment of this Act, including any offense involving conduct that continued on or after the date of enactment of this Act.</text></subsection> 
<subsection id="HBD9DDAEB015249A70013CC67A898076B"><enum>(b)</enum><header>Fund and surcharges</header> 
<paragraph id="HAA1D11D080CB4EF4A6411460F94E2C82"><enum>(1)</enum><header>In general</header><text>Section 104 and the amendments made by section 102 shall take effect 30 days after the date of enactment of this Act.</text></paragraph> 
<paragraph id="H9543EE5BCD3C4C5293CBE7AD5F287310"><enum>(2)</enum><header>Pending cases</header><text>The amendments made by section 102 shall apply to any case pending on or after the date of enactment of this Act.</text></paragraph></subsection></section></title> 
<title id="H30D9D69039BD4F939F17840076FF1104"><enum>II</enum><header>Equitable retirement treatment of assistant United States attorneys</header> 
<section id="HA8F58B3001F44CFE895DAF5D38ED0B2"><enum>201.</enum><header>Retirement treatment of assistant United States attorneys</header> 
<subsection id="HDA0DC9D918A9495E9C60DE7FB7A8B00"><enum>(a)</enum><header>Civil Service Retirement System</header> 
<paragraph id="H9C5527E0F70E400D9E6DF7B660D37D16"><enum>(1)</enum><header>Assistant United States attorney defined</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8331">Section 8331</external-xref> of title 5, United States Code, is amended—</text>

<section id="H91C104ED928E48FFB9C4D3B269C5AA52"><enum>202.</enum><header>Provisions relating to incumbents</header> 
<subsection id="H1FFC8405464A4D70BCC3D463A5F282A2"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="H097576F41C4347F0BA31EA0070B0ACC0"><enum>(1)</enum><text>the term <term>assistant United States attorney</term> means an assistant United States attorney appointed under <external-xref legal-doc="usc" parsable-cite="usc/28/542">section 542</external-xref> of title 28, United States Code; and</text></paragraph> 
<paragraph id="H114D33C3344A4D7EBFC3CE4B4B61C9A1"><enum>(2)</enum><text>the term <term>incumbent</term> means an individual who is serving as an assistant United States attorney on the 120th day after the date of enactment of this Act.</text></paragraph></subsection> 
<subsection id="H82037EF81A4743BD8DC8D8BE0136A182"><enum>(b)</enum><header>Notice requirement</header><text>Not later than 9 months after the date of enactment of this Act, the Department of Justice shall take measures reasonably designed to provide notice to incumbents on—</text> 
<paragraph id="H24BB7E23009B41DAA488D64094CDC00"><enum>(1)</enum><text>their election rights under this title; and</text></paragraph> 
<paragraph id="H01C1A2254B7F4E04A51E4EF6166C2039"><enum>(2)</enum><text>the effects of making or not making a timely election under this title.</text></paragraph></subsection> 
<subsection id="HAD4D81B77A234E1E82AA2058C29BB93E"><enum>(c)</enum><header>Election available to incumbents</header> 
<paragraph id="H7BF6A16E493643C699F9B9EFF0E05019"><enum>(1)</enum><header>In general</header><text>An incumbent may elect, for all purposes, to be treated—</text> 
<subparagraph id="H0CF7949C75674B13B7E649AFF509117"><enum>(A)</enum><text>in accordance with the amendments made by this title; or</text></subparagraph> 
<subparagraph id="H8568D4382D4945A583F4D4F6CB928DDF"><enum>(B)</enum><text>as if this title had never been enacted.</text></subparagraph></paragraph> 
<paragraph id="HFDBB193DF9824C6885E6C8F4C64D4376"><enum>(2)</enum><header>Failure to elect</header><text>Failure to make a timely election under this subsection shall be treated in the same way as an election under paragraph (1)(A), made on the last day allowable under paragraph (3).</text></paragraph> 
<paragraph id="HF232A0CBE2EB489C82158470F2A4D12D"><enum>(3)</enum><header>Time limitation</header><text>An election under this subsection shall not be effective unless the election is made not later than the earlier of—</text> 
<subparagraph id="HD15B178F51DF4A1E9714E1A2D6A63D8D"><enum>(A)</enum><text>120 days after the date on which the notice under subsection (b) is provided; or</text></subparagraph> 
<subparagraph id="HA0AA1A146E7748618F5200EB9E8860F1"><enum>(B)</enum><text>the date on which the incumbent involved separates from service.</text></subparagraph></paragraph></subsection> 
<subsection id="HD1328070B8EF4ECAA2519BC0AED5A96D"><enum>(d)</enum><header>Limited retroactive effect</header> 
<paragraph id="H52FB3BA9BD1E4E2388F48566BAF1ADD1"><enum>(1)</enum><header>Effect on retirement</header><text>In the case of an incumbent who elects (or is deemed to have elected) the option under subsection (c)(1)(A), all service performed by that individual as an assistant United States attorney shall—</text> 
<subparagraph id="H49C5958770D24F2988A0FB3BE2EE5DA"><enum>(A)</enum><text>to the extent performed on or after the effective date of that election, be treated in accordance with applicable provisions of subchapter III of chapter 83 or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, as amended by this title; and</text></subparagraph> 
<subparagraph id="HD60F906454044F8581A8AA39502F44AD"><enum>(B)</enum><text display-inline="yes-display-inline">to the extent performed before the effective date of that election, be treated in accordance with applicable provisions of subchapter III of chapter 83 or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, as if the amendments made by this title had then been in effect.</text></subparagraph><continuation-text continuation-text-level="paragraph">Any service performed by the incumbent pursuant to an appointment under section 515, 541, 543, or 546 of title 28, United States Code, shall, for purposes of subparagraph (B), be treated in the same manner as if performed as an assistant United States attorney; this sentence shall not be taken into account for purposes of determining whether or not an individual is an incumbent. </continuation-text></paragraph> 
<paragraph id="H3A23CA2FF913452D94E12FBC5B12F15E"><enum>(2)</enum><header>No other retroactive effect</header><text>Nothing in this title (including the amendments made by this title) shall affect any of the terms or conditions of an individual's employment (apart from those governed by subchapter III of chapter 83 or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code) with respect to any period of service preceding the date on which such individual's election under subsection (c) is made (or is deemed to have been made).</text></paragraph></subsection> 
<subsection id="HC7FDB85DE91A440B994328D0D5240202"><enum>(e)</enum><header>Individual contributions for prior service</header> 
<paragraph id="H983DE1374EFD4138AB7978F446195386"><enum>(1)</enum><header>In general</header><text>An individual who makes an election under subsection (c)(1)(A) shall, with respect to prior service performed by such individual, deposit, with interest, to the Civil Service Retirement and Disability Fund the difference between the individual contributions that were actually made for such service and the individual contributions that would have been made for such service if the amendments made by this title had then been in effect.</text></paragraph> 
<paragraph id="H2A0EF18E62524C29B7FDA2B72E034AC"><enum>(2)</enum><header>Effect of not contributing</header><text>If the deposit required under paragraph (1) is not paid, all prior service of the incumbent shall remain fully creditable as law enforcement officer service, but the resulting annuity shall be reduced in a manner similar to that described in <external-xref legal-doc="usc" parsable-cite="usc/5/8334">section 8334(d)(2)(B)</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="HD614DBA3F81D4C549B16BC00A26D93C0"><enum>(3)</enum><header>Prior service defined</header><text>In this subsection, the term <term>prior service</term> means, with respect to any individual who makes an election (or is deemed to have made an election) under subsection (c)(1)(A), all service performed as an assistant United States attorney, but not exceeding 20 years, performed by such individual before the date as of which applicable retirement deductions begin to be made in accordance with such election.</text></paragraph></subsection> 
<subsection id="H8147CD4713B049BFB046D28400E3B3F1"><enum>(f)</enum><header>Regulations</header><text>The Office of Personnel Management shall prescribe regulations necessary to carry out this title, including provisions under which any interest due on the amount described under subsection (e) shall be determined.</text></subsection></section> 
<section id="H6DCEA431CCC042C0B0F26FE7BA6F69CB"><enum>203.</enum><header>Effective date</header> <text display-inline="no-display-inline">The amendments made by section 201 shall take effect on the first day of the first applicable pay period beginning on or after the 120th day after the date of enactment of this Act.</text></section></title>
