		<official-title>To amend title XVIII of the Social Security Act to
		  provide for a technical correction to the amendments made by section 422 of the
		  Medicare Prescription Drug, Improvement, and Modernization Act of

		<section commented="no" display-inline="no-display-inline" id="H99F356319A0F4E3C811DAAF134300DF" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicare Residency Program Technical
			 Correction Act of 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H76F6D706E1BA4CA79008E9CB823FA207" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Reinstatement of full-time equivalent
			 resident slots that were erroneously eliminated</header>
			<subsection commented="no" display-inline="no-display-inline" id="H2AE769FBD348460EB5E7B8F2DA2C2E5C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1886(h)(7) of the Social Security
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(h)(7)</external-xref>) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H60E5180EFA1F43A882AD3B4490868707"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (D) as
			 subparagraph (E); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB6A9E2D380314BACB8A58B3D895832"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (C) the
			 following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HCE47B436273D431AA89315442C90B0B0" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="HE2CCF5B9C0054C3EADBE011DE69F7377"><enum>(D)</enum><header display-inline="yes-display-inline">Adjustment based on settled cost
				report</header><text display-inline="yes-display-inline">In the case of a
				hospital for which—</text>
							<clause commented="no" display-inline="no-display-inline" id="H769DFEF51B9F4CCF95A717B2982B7186"><enum>(i)</enum><text display-inline="yes-display-inline">the otherwise applicable resident limit was
				reduced under subparagraph (A)(i)(I); and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HF9751F29848E4FC1ACACE7DBAD3DB1E"><enum>(ii)</enum><text display-inline="yes-display-inline">such reduction was based on a reference
				resident level that was determined using a cost report that was subsequently
				settled, whether as a result of an appeal or otherwise, and the reference
				resident level under such settled cost report is higher than the level used for
				the reduction under subparagraph (A)(i)(I);</text>
							</clause><continuation-text commented="no" continuation-text-level="subparagraph">the Secretary shall apply
				subparagraph (A)(i)(I) using the higher resident reference level and make any
				necessary adjustments to such reduction. Any such necessary adjustments shall
				be effective for portions of cost reporting periods occurring on or after July
				1,
				2005.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H591B28F95D66402DB92B3E6B7D76779F"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect as if included in the enactment of section 422
			 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003
			 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>).</text>
