<official-title display="yes">To amend the Employee Retirement Income Security Act of 1974, the Public Health Service Act, and the Internal Revenue Code of 1986 to ensure that dependent students who take a medically necessary leave of absence do not lose health insurance coverage, and for other purposes.</official-title>

<section display-inline="no-display-inline" id="HEEAC6816F8054137906438742000A85E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Michelle's Law</short-title></quote>.</text></section> 
<section id="H44810F549CA1416883288224E7C71EA"><enum>2.</enum><header>Coverage of dependent students on medically necessary leave of absence</header> 
<subsection id="HC08863ED8D6C4514869FF9879F2CFE00"><enum>(a)</enum><header>Amendments of ERISA</header> 
<paragraph id="H5F7D4BAA03614580A6B08C331DF6E8BF"><enum>(1)</enum><header>In general</header><text>Subpart B of part 7 of title I of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185">29 U.S.C. 1185 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H2742759C18B14C3AB24FD501BE2579AE" style="OLC">
<section id="HC07B8D15FD184384A3AA74C0EBE5A797" display-inline="no-display-inline" section-type="subsequent-section"><enum>714.</enum><header>Coverage of dependent students on medically necessary leave of absence</header> 
<subsection id="H3470F7E6269C46AC8259C7006BEF43FE"><enum>(a)</enum><header>Medically necessary leave of absence</header><text>In this section, the term <term>medically necessary leave of absence</term> means, with respect to a dependent child described in subsection (b)(2) in connection with a group health plan or health insurance coverage offered in connection with such plan, a leave of absence of such child from a postsecondary educational institution (including an institution of higher education as defined in section 102 of the Higher Education Act of 1965), or any other change in enrollment of such child at such an institution, that—</text> 
<paragraph id="H1EAF9A97FF9340809F1F2821E108F6A5"><enum>(1)</enum><text>commences while such child is suffering from a serious illness or injury;</text> </paragraph> 
<paragraph id="H8FCFFB5424BF433180CBD8C2E964FCC"><enum>(2)</enum><text>is medically necessary; and</text> </paragraph> 
<paragraph id="H3463B379B8344EB1AEE0E14638457745"><enum>(3)</enum><text>causes such child to lose student status for purposes of coverage under the terms of the plan or coverage.</text> </paragraph></subsection> 
<subsection id="H74A04F6119404031BE61F3E550F32DF3"><enum>(b)</enum><header>Requirement To continue coverage</header> 
<paragraph id="H901B13ABB0004A3E982353DD7FE56D60"><enum>(1)</enum><header>In general</header><text>In the case of a dependent child described in paragraph (2), a group health plan, or a health insurance issuer that provides health insurance coverage in connection with a group health plan, shall not terminate coverage of such child under such plan or health insurance coverage due to a medically necessary leave of absence before the date that is the earlier of—</text> 
<subparagraph id="HA3DF4DF0D7C143A1A6C283DEE8462600"><enum>(A)</enum><text>the date that is 1 year after the first day of the medically necessary leave of absence; or</text> </subparagraph> 
<subparagraph id="HC4739C8362C44FF19353C82B35781BAD"><enum>(B)</enum><text>the date on which such coverage would otherwise terminate under the terms of the plan or health insurance coverage.</text> </subparagraph></paragraph> 
<paragraph id="HE34B9AAAE74C457F0019AF5066A38C82"><enum>(2)</enum><header>Dependent child described</header><text>A dependent child described in this paragraph is, with respect to a group health plan or health insurance coverage offered in connection with the plan, a beneficiary under the plan who—</text> 
<subparagraph id="HB1EC8C1DD95B4F588D44A71086DDF7F"><enum>(A)</enum><text>is a dependent child, under the terms of the plan or coverage, of a participant or beneficiary under the plan or coverage; and</text> </subparagraph> 
<subparagraph id="HA9C80D18A36D4709B100D667CA1BF31D"><enum>(B)</enum><text display-inline="yes-display-inline">was enrolled in the plan or coverage, on the basis of being a student at a postsecondary educational institution (as described in subsection (a)), immediately before the first day of the medically necessary leave of absence involved.</text> </subparagraph> </paragraph> 
<paragraph id="H4B28D259D7E747E5A9325D8EC504696C"><enum>(3)</enum><header>Certification by physician</header><text>Paragraph (1) shall apply to a group health plan or health insurance coverage offered by an issuer in connection with such plan only if the plan or issuer of the coverage has received written certification by a treating physician of the dependent child which states that the child is suffering from a serious illness or injury and that the leave of absence (or other change of enrollment) described in subsection (a) is medically necessary.</text> </paragraph></subsection> 
<subsection id="HB28A77644A4F496183BAB9946E223636"><enum>(c)</enum><header>Notice</header><text display-inline="yes-display-inline">A group health plan, and a health insurance issuer providing health insurance coverage in connection with a group health plan, shall include, with any notice regarding a requirement for certification of student status for coverage under the plan or coverage, a description of the terms of this section for continued coverage during medically necessary leaves of absence. Such description shall be in language which is understandable to the typical plan participant.</text> </subsection> 
<subsection id="HC5D947A9AA494858940093DBC25379B"><enum>(d)</enum><header>No change in benefits</header><text>A dependent child whose benefits are continued under this section shall be entitled to the same benefits as if (during the medically necessary leave of absence) the child continued to be a covered student at the institution of higher education and was not on a medically necessary leave of absence.</text></subsection> 
<subsection id="H297B4BA51C714E2EB600F803CFC1B553" display-inline="no-display-inline"><enum>(e)</enum><header>Continued application in case of changed coverage</header><text display-inline="yes-display-inline">If—</text> 
<paragraph id="HFE7E67AC531E4FCCBE18B45306F12B86"><enum>(1)</enum><text>a dependent child of a participant or beneficiary is in a period of coverage under a group health plan or health insurance coverage offered in connection with such a plan, pursuant to a medically necessary leave of absence of the child described in subsection (b);</text></paragraph> 
<paragraph id="H85313B3794C14CF89DEE8D1E20AA34D1"><enum>(2)</enum><text>the manner in which the participant or beneficiary is covered under the plan changes, whether through a change in health insurance coverage or health insurance issuer, a change between health insurance coverage and self-insured coverage, or otherwise; and</text></paragraph> 
<paragraph id="H478F8F4D7B2B44D69BD44EA94C1877FD"><enum>(3)</enum><text>the coverage as so changed continues to provide coverage of beneficiaries as dependent children,</text></paragraph><continuation-text continuation-text-level="subsection">this section shall apply to coverage of the child under the changed coverage for the remainder of the period of the medically necessary leave of absence of the dependent child under the plan in the same manner as it would have applied if the changed coverage had been the previous coverage.</continuation-text></subsection> </section> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H4E01F4FF5D60492098DA6EB531595000"><enum>(2)</enum><header>Conforming amendment</header><text>The table of contents in section 1 of such Act is amended by inserting after the item relating to section 713 the following new item:</text>

<subsection id="H707DF990BC564F9AA9BE028C37631F73" display-inline="no-display-inline"><enum>(b)</enum><header>Amendments to the Public Health Service Act</header> 
<paragraph id="HCF9E6D4EA3A24833BFF80824599C79AA"><enum>(1)</enum><header>Group markets</header><text>Subpart 2 of part A of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-4">42 U.S.C. 300gg–4 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="HC64CC14AC6A0478AACD08CA8407DE4E7"><enum>2707.</enum><header>Coverage of dependent students on medically necessary leave of absence</header> 
<subsection id="H63864053711A40468E4520445F275301"><enum>(a)</enum><header>Medically necessary leave of absence</header><text>In this section, the term <term>medically necessary leave of absence</term> means, with respect to a dependent child described in subsection (b)(2) in connection with a group health plan or health insurance coverage offered in connection with such plan, a leave of absence of such child from a postsecondary educational institution (including an institution of higher education as defined in section 102 of the Higher Education Act of 1965), or any other change in enrollment of such child at such an institution, that—</text> 
<paragraph id="HE24F59CDFE5241E6AA0698008D9CA6B0"><enum>(1)</enum><text>commences while such child is suffering from a serious illness or injury;</text> </paragraph> 
<paragraph id="HF184554D8A414C949E9229EA2BE6CF5C"><enum>(2)</enum><text>is medically necessary; and</text> </paragraph> 
<paragraph id="HC7B5268717A54909902200AA3E832D90"><enum>(3)</enum><text>causes such child to lose student status for purposes of coverage under the terms of the plan or coverage.</text> </paragraph></subsection> 
<subsection id="H0A801F56111345E1B8E1539BE831ACE9"><enum>(b)</enum><header>Requirement To continue coverage</header> 
<paragraph id="H504B801BFB38482F9BD4F301F0BEBA9C"><enum>(1)</enum><header>In general</header><text>In the case of a dependent child described in paragraph (2), a group health plan, or a health insurance issuer that provides health insurance coverage in connection with a group health plan, shall not terminate coverage of such child under such plan or health insurance coverage due to a medically necessary leave of absence before the date that is the earlier of—</text> 
<subparagraph id="H36E42F7974F047EBA7B5F61F4984B00"><enum>(A)</enum><text>the date that is 1 year after the first day of the medically necessary leave of absence; or</text> </subparagraph> 
<subparagraph id="HAD518FD43452483D8EAC2CA8DAF240F1"><enum>(B)</enum><text>the date on which such coverage would otherwise terminate under the terms of the plan or health insurance coverage.</text> </subparagraph></paragraph> 
<paragraph id="HFB103140164041A3BF51467B9F0097A0"><enum>(2)</enum><header>Dependent child described</header><text>A dependent child described in this paragraph is, with respect to a group health plan or health insurance coverage offered in connection with the plan, a beneficiary under the plan who—</text> 
<subparagraph id="HEE85C62E231F4105BC5D390698092EC0"><enum>(A)</enum><text>is a dependent child, under the terms of the plan or coverage, of a participant or beneficiary under the plan or coverage; and</text> </subparagraph> 
<subparagraph id="HD6ADFC86CB244526838CD8FBAA5BAFC"><enum>(B)</enum><text display-inline="yes-display-inline">was enrolled in the plan or coverage, on the basis of being a student at a postsecondary educational institution (as described in subsection (a)), immediately before the first day of the medically necessary leave of absence involved.</text> </subparagraph> </paragraph> 
<paragraph id="HB9CBEFEFD0D943819C6420FEB640FDC8"><enum>(3)</enum><header>Certification by physician</header><text>Paragraph (1) shall apply to a group health plan or health insurance coverage offered by an issuer in connection with such plan only if the plan or issuer of the coverage has received written certification by a treating physician of the dependent child which states that the child is suffering from a serious illness or injury and that the leave of absence (or other change of enrollment) described in subsection (a) is medically necessary.</text> </paragraph></subsection> 
<subsection id="HF39FED73C73A47C7B7184C812BD94072"><enum>(c)</enum><header>Notice</header><text display-inline="yes-display-inline">A group health plan, and a health insurance issuer providing health insurance coverage in connection with a group health plan, shall include, with any notice regarding a requirement for certification of student status for coverage under the plan or coverage, a description of the terms of this section for continued coverage during medically necessary leaves of absence. Such description shall be in language which is understandable to the typical plan participant.</text> </subsection> 
<subsection id="H2F642B7755754E36B96C14C7D8262854"><enum>(d)</enum><header>No change in benefits</header><text>A dependent child whose benefits are continued under this section shall be entitled to the same benefits as if (during the medically necessary leave of absence) the child continued to be a covered student at the institution of higher education and was not on a medically necessary leave of absence.</text></subsection> 
<subsection id="H7C5A2E52DD5A4221869024C8F7531B9F" display-inline="no-display-inline"><enum>(e)</enum><header>Continued application in case of changed coverage</header><text display-inline="yes-display-inline">If—</text> 
<paragraph id="H7BC12AD8D2294C0D84EEB8AF6AF9635"><enum>(1)</enum><text>a dependent child of a participant or beneficiary is in a period of coverage under a group health plan or health insurance coverage offered in connection with such a plan, pursuant to a medically necessary leave of absence of the child described in subsection (b);</text></paragraph> 
<paragraph id="H0F443056568042939336643034D85725"><enum>(2)</enum><text>the manner in which the participant or beneficiary is covered under the plan changes, whether through a change in health insurance coverage or health insurance issuer, a change between health insurance coverage and self-insured coverage, or otherwise; and</text></paragraph> 
<paragraph id="H3FDA0DAFF7574E4FA479E6BA63334BB2"><enum>(3)</enum><text>the coverage as so changed continues to provide coverage of beneficiaries as dependent children,</text></paragraph><continuation-text continuation-text-level="subsection">this section shall apply to coverage of the child under the changed coverage for the remainder of the period of the medically necessary leave of absence of the dependent child under the plan in the same manner as it would have applied if the changed coverage had been the previous coverage.</continuation-text></subsection> </section> <after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="H6EA7CEC9F76D48D5A54E8D7E5915C7A8"><enum>(2)</enum><header>Individual market</header><text>Subpart 3 of part B of title XXVII of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-51">42 U.S.C. 300gg–51 et seq.</external-xref>) is amended by adding at the end the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="HB00DD3589AA6413EA15370CAF18348D9" style="OLC">
<section id="HE2EC3AB78E2242848E6FE76C7C2FF5F"><enum>2753.</enum><header>Coverage of dependent students on medically necessary leave of absence</header><text display-inline="no-display-inline">The provisions of section 2707 shall apply to health insurance coverage offered by a health insurance issuer in the individual market in the same manner as they apply to health insurance coverage offered by a health insurance issuer in connection with a group health plan in the small or large group market.</text> </section> <after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="H856CF8EED49646CEB570AAC12B771DE8"><enum>(c)</enum><header>Amendments to the Internal Revenue Code</header> 
<paragraph id="H261A0FD20F3C43E399FC843D51006422"><enum>(1)</enum><header>In general</header><text>Subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986 (relating to other group health plan requirements) is amended by inserting after section 9812 the following new section:</text>

<section id="H4E84E620A64249BB949F4B036D4BECDD" display-inline="no-display-inline" section-type="subsequent-section"><enum>9813.</enum><header>Coverage of dependent students on medically necessary leave of absence</header> 
<subsection id="H5B1C2D8EBEA44BCCA100223219952D9E"><enum>(a)</enum><header>Medically necessary leave of absence</header><text>In this section, the term <term>medically necessary leave of absence</term> means, with respect to a dependent child described in subsection (b)(2) in connection with a group health plan, a leave of absence of such child from a postsecondary educational institution (including an institution of higher education as defined in section 102 of the Higher Education Act of 1965), or any other change in enrollment of such child at such an institution, that—</text> 
<paragraph id="H5C78760703D44AB5BB28E00052C581B"><enum>(1)</enum><text>commences while such child is suffering from a serious illness or injury;</text> </paragraph> 
<paragraph id="HD2BA64D5B2B54278B128E269E778004F"><enum>(2)</enum><text>is medically necessary; and</text> </paragraph> 
<paragraph id="H15952B471362426AB204AA7DE798AD68"><enum>(3)</enum><text>causes such child to lose student status for purposes of coverage under the terms of the plan or coverage.</text> </paragraph></subsection> 
<subsection id="H7E596C5C9EF04C87A2AF52FB48D28528"><enum>(b)</enum><header>Requirement to continue coverage</header> 
<paragraph id="H7F32821413944034B7C3BF75EA8D9C87"><enum>(1)</enum><header>In general</header><text>In the case of a dependent child described in paragraph (2), a group health plan shall not terminate coverage of such child under such plan due to a medically necessary leave of absence before the date that is the earlier of—</text> 
<subparagraph id="H9DD19239228142F2B9FE5D13CEDF182B"><enum>(A)</enum><text>the date that is 1 year after the first day of the medically necessary leave of absence; or</text> </subparagraph> 
<subparagraph id="HE240D575F07E4AD39472AE56424D963E"><enum>(B)</enum><text>the date on which such coverage would otherwise terminate under the terms of the plan.</text> </subparagraph></paragraph> 
<paragraph id="HFEB6A7C82819426C9ECA4E5FAB7C613F"><enum>(2)</enum><header>Dependent child described</header><text>A dependent child described in this paragraph is, with respect to a group health plan, a beneficiary under the plan who—</text> 
<subparagraph id="HB6382505BE024BF2859D053910B4D376"><enum>(A)</enum><text>is a dependent child, under the terms of the plan, of a participant or beneficiary under the plan; and</text> </subparagraph> 
<subparagraph id="HDC3D20AB4E71400A95D6EDF2EFFD9505"><enum>(B)</enum><text display-inline="yes-display-inline">was enrolled in the plan, on the basis of being a student at a postsecondary educational institution (as described in subsection (a)), immediately before the first day of the medically necessary leave of absence involved.</text> </subparagraph> </paragraph> 
<paragraph id="H64CD1D3F832246F3AAAD2218ECBC0003"><enum>(3)</enum><header>Certification by physician</header><text>Paragraph (1) shall apply to a group health plan only if the plan, or the issuer of health insurance coverage offered in connection with the plan, has received written certification by a treating physician of the dependent child which states that the child is suffering from a serious illness or injury and that the leave of absence (or other change of enrollment) described in subsection (a) is medically necessary.</text> </paragraph></subsection> 
<subsection id="H1F9DE76A888749FFB24E53C7CE23AE4C" commented="no"><enum>(c)</enum><header>Notice</header><text display-inline="yes-display-inline">A group health plan shall include, with any notice regarding a requirement for certification of student status for coverage under the plan, a description of the terms of this section for continued coverage during medically necessary leaves of absence. <subsection id="H3762C21E3E604BA8999182D5C4B3C900"><enum>(d)</enum><header>No change in benefits</header><text>A dependent child whose benefits are continued under this section shall be entitled to the same benefits as if (during the medically necessary leave of absence) the child continued to be a covered student at the institution of higher education and was not on a medically necessary leave of absence.</text></subsection> 
<subsection id="HF276F5E686C64D52A5DC318122748F42" display-inline="no-display-inline"><enum>(e)</enum><header>Continued application in case of changed coverage</header><text display-inline="yes-display-inline">If—</text> 
<paragraph id="H817BCDED3DDF427386680858DF7ECB80"><enum>(1)</enum><text>a dependent child of a participant or beneficiary is in a period of coverage under a group health plan, pursuant to a medically necessary leave of absence of the child described in subsection (b);</text></paragraph> 
<paragraph id="H7E2559B0034A45D58786D9B53D89FD1B"><enum>(2)</enum><text>the manner in which the participant or beneficiary is covered under the plan changes, whether through a change in health insurance coverage or health insurance issuer, a change between health insurance coverage and self-insured coverage, or otherwise; and</text></paragraph> 
<paragraph id="H3671E18E04FD44B0B51E7259E689D3D7"><enum>(3)</enum><text>the coverage as so changed continues to provide coverage of beneficiaries as dependent children,</text></paragraph><continuation-text continuation-text-level="subsection">this section shall apply to coverage of the child under the changed coverage for the remainder of the period of the medically necessary leave of absence of the dependent child under the plan in the same manner as it would have applied if the changed coverage had been the previous coverage.</continuation-text></subsection> </section> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HFB3A102D6A3B4DF0BD9CB600EB62C466"><enum>(2)</enum><header>Conforming amendment</header><text>The table of sections for subchapter B of chapter 100 of such Code is amended by inserting after the item relating to section 9812 the following new item:</text>

<subsection id="HEE8CB27B39524D74A5DD6C2FAA08E65B"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this Act shall apply with respect to plan years beginning on or after the date that is one year after the date of the enactment of this Act and to medically necessary leaves of absence beginning during such plan years.</text></subsection></section>
