			 purposes</header>
			<subsection id="H23932C250D0A4336ADCAF4CA7C27E057"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress makes the following
			 findings:</text>
				<paragraph id="HA7ABBAAE751548EEBB28B94EF04E6628"><enum>(1)</enum><text>The United Nations Food
			 and Agricultural Organization reports, that in 2006, an estimated 850,000,000
			 people in the world, with 824,000,000 in developing countries, were chronically
			 hungry.</text>
				</paragraph><paragraph id="H48C43362148C41759B88550924696862"><enum>(2)</enum><text display-inline="yes-display-inline">The largest concentrations of the
			 chronically hungry—an estimated 298,000,000 individuals—are in South Asia, with
			 most of those individuals concentrated in India, where there are an estimated
			 212,000,000 undernourished individuals, and in sub-Saharan Africa, where there
			 are an estimated 206,000,000 hungry people.</text>
				</paragraph><paragraph id="H7BFEEF81C05845DFA88488CF9E856353"><enum>(3)</enum><text>The number of food and
			 humanitarian emergencies has doubled from an average of about 15 per year in
			 the 1980s to more than 30 per year since 2000, due in large part to increasing
			 conflicts, poverty, and natural disasters around the world. Some emergencies
			 are exacerbated by multiple shocks, such as civil wars, recurring droughts, and
			 endemic disease, adding to their complexity and protracting the crises for many
			 years.</text>
				</paragraph><paragraph id="H9C2CDE57A36E48918F13E2798BC30044"><enum>(4)</enum><text>The United Nations
			 reports that progress is being made toward reaching the Millennium Development
			 Goal of reducing the proportion of hungry people in the world by half by 2015.
			 In 1990, the proportion of people in the developing countries living with
			 insufficient food was estimated to be 20 percent. By 2003, that percentage
			 declined to 17 percent. However, from 1996 to 2006, the absolute number of
			 hungry people increased from 790,000,000 to 850,000,000.</text>
				</paragraph><paragraph id="H34E32A46739547B68E79B83BFEA2B4BA"><enum>(5)</enum><text>The number of hungry
			 people in the most seriously affected regions of the world, namely South Asia
			 and sub-Saharan Africa, is increasing. In sub-Saharan Africa, in 1990, there
			 were an estimated 169,000,000 chronically-hungry people; in 2003, the number of
			 chronically-hungry people increased to 206,000,000.</text>
				</paragraph><paragraph id="H2EA28508503A447A935F593B303D81A9"><enum>(6)</enum><text>The major United States
			 Government response to reducing hunger in developing countries is to provide
			 United States agricultural commodities as food assistance. In fiscal year 2006,
			 the United States provided 3,000,000 metric tons of food valued at more than
			 $2,000,000,000 to meet emergency food needs and to support development projects
			 in developing countries.</text>
				</paragraph><paragraph id="HBAD769E90A2649B7915E6900C8899C6E"><enum>(7)</enum><text>In 2006, the United
			 States provided food assistance to 65 countries, more than half of which were
			 in sub-Saharan Africa. Approximately $1,200,000,000, or 60 percent of such
			 assistance, was provided as emergency food assistance. The United States Agency
			 for International Development estimates that 50,000,000 to 70,000,000 people
			 benefit from United States food assistance programs annually.</text>
				</paragraph><paragraph id="H794584F40E3E480394B630FE32C63285"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H1EB8229355CB4523AFDB4B7968D67255"><enum>(A)</enum><text>Food assistance
			 contributed by the United States Government has totaled more than
			 $73,000,000,000 since 1946. Over the last decade, the United States has been
			 the single largest donor of international food assistance, with a large
			 proportion of the assistance provided through the United Nations World Food
			 Program and most of that assistance is for emergencies.</text>
					</subparagraph><subparagraph changed="added" committee-id="HFA00" id="HB96BEE0DC12E46A5994B37472002188E" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>The United States
			 contributed more than 52,000,000 tons of food assistance between 1996 and 2005,
			 more than half of the nearly 100,000,000 tons of food assistance delivered
			 worldwide in this period. In 2006, the United States contributed $1,125,000,000
			 or about 40 percent of total donor contributions to the World Food Program in
			 that year.</text>
					</subparagraph></paragraph><paragraph id="H73BA4E6DC44F4FDFA421A007EB211FF"><enum>(9)</enum><text>Private voluntary
			 organizations and cooperatives are critical implementing partners in United
			 States food assistance programs. In addition to assisting people whose lives
			 and livelihoods are endangered due to crises, such organizations and
			 cooperatives help communities that suffer from chronic hunger, delivering
			 technical assistance and training and building local institutional
			 capacity.</text>
				</paragraph><paragraph id="HF6616591C83247618B78C56DBABAC39C"><enum>(10)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H371C681C8E9C4C2084B2959C96576446"><enum>(A)</enum><text>Although the Farm
			 Security and Rural Investment Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/171">Public Law 107–171</external-xref>) called for
			 increased levels of non-emergency food assistance in order to address chronic
			 hunger needs and to have lasting impacts on vulnerable communities, according
			 to the Government Accountability Office, by 2006, non-emergency food assistance
			 programs were reduced to 42 percent of their 2001 levels.</text>
					</subparagraph><subparagraph changed="added" committee-id="HFA00" id="H496D0BC53CB14458B0A3A8A01E97E5FB" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>Implementing partner
			 organizations report that due to these reductions, such organizations have been
			 forced to close operations in countries that are prone to emergencies and with
			 populations that suffer from chronic hunger. As a result of such reductions,
			 there is little opportunity to develop new programs that address food
			 insecurity in developing countries.</text>
					</subparagraph></paragraph><paragraph id="H7A531E9EB5554399A5CFB9ABB14913F6"><enum>(11)</enum><text>Food assistance experts,
			 advocates, and implementers have argued that distributing food commodities
			 alone will not reduce food insecurity. Food assistance needs to be combined
			 with other non-food resources, such as assistance to promote agricultural
			 development, economic growth, and assistance to support education, water, and
			 health programs, to ensure that food assistance has an impact on
			 chronically-hungry people.</text>
				</paragraph><paragraph id="HCCE8873D691C4CE4B346F56496503CD2"><enum>(12)</enum><text display-inline="yes-display-inline">Women play an essential role in promoting
			 food security and production throughout the world. According to the United
			 Nations Food and Agricultural Organization, rural women are responsible for
			 half of the world’s food production and produce between 60 and 80 percent of
			 the food in most developing countries.</text>
				</paragraph></subsection><subsection commented="no" id="H6D50A01867C84A29A253EA5CFBC100BE"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text>
				<paragraph commented="no" id="H1A7E8CB0E2894034B450A754FB3C99E"><enum>(1)</enum><text display-inline="yes-display-inline">to promote United States emergency and
			 non-emergency food and other assistance programs as described in title I of
			 this Act in an efficient and effective manner; and</text>
				</paragraph><paragraph commented="no" id="H774C5972D85843C29E82AD123F2CDE00"><enum>(2)</enum><text>to promote United States
			 agricultural export programs as described in title II of this Act in an
			 efficient and effective manner.</text>
				</paragraph></subsection></section><section commented="no" id="HFEDC283DE64743ED9CE41567BE00AC48"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" id="H987FE8511E544207BD0001214BD163DC"><enum>(1)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the United States
			 Agency for International Development.</text>
			</paragraph><paragraph commented="no" id="H075A7D94D07A43B084B0709B56E14391"><enum>(2)</enum><header>Appropriate
			 congressional committees</header><text>The term <term>appropriate congressional
			 committees</term> means—</text>
				<subparagraph commented="no" id="H987D00A3037F4BCCAAE4406EB3A1DDB4"><enum>(A)</enum><text>the Committee on Foreign
			 Affairs and the Committee on Agriculture of the House of Representatives;
			 and</text>
				</subparagraph><subparagraph commented="no" id="H28C162B8F9A1402D820732DCA08BA6B5"><enum>(B)</enum><text>the Committee on
			 Agriculture, Nutrition, and Forestry of the Senate.</text>
				</subparagraph></paragraph><paragraph commented="no" id="H39580D73A0A6475981BC568F3D781920"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture.</text>

			 and non-emergency food and other assistance programs</header>
			<subtitle id="H7DE386CCAA9C424B9223EAC04DFB54B"><enum>A</enum><header>Agricultural Trade
			 Development and Assistance Act of 1954</header>
				<section id="HE80FAA4B1B514BCB90EE84DBABD059B"><enum>101.</enum><header>United States
			 policy</header><text display-inline="no-display-inline">Section 2 of the
			 Agricultural Trade Development and Assistance Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/7/1691">7 U.S.C. 1691</external-xref>) is
			 amended—</text>
					<paragraph id="H3CB10D2E4A2E4EC2B32703E28F8CDC29"><enum>(1)</enum><text>in paragraph (1), by
			 inserting <quote>chronic</quote> before <quote>world</quote>.</text>
					</paragraph><paragraph id="HFD29DCD538414599A616C45B00942891"><enum>(2)</enum><text>in paragraph (5), by
			 striking <quote>and</quote> at the end;</text>

				and efficient food assistance program that incorporates adequate resources for
				both emergency and non-emergency food assistance programs; and</text>
							</paragraph><paragraph id="H712857C9934346869090838DEC458CEA"><enum>(9)</enum><text display-inline="yes-display-inline">provide adequate resources for
				non-emergency food assistance programs to address the causes of chronic hunger
				and food insecurity, to protect the livelihoods and health of vulnerable
				populations, to meet the nutritional needs of all members of the community
				(particularly children), to prevent future hunger related emergencies, and to
				promote participation in productive
				activities.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="H4BDC7E4AE55B4FCF97FDA86B7818B7DE"><enum>102.</enum><header>General
			 authority</header>
					<subsection id="H181F4E8DA451400D0023673E82F66D63"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 201 of the
			 Agricultural Trade Development and Assistance Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/7/1721">7 U.S.C. 1721</external-xref>) is
			 amended—</text>
						<paragraph id="H26A362F27D6B4F5DB6A24614DAB8C540"><enum>(1)</enum><text>in paragraph (1), to read
			 as follows:</text>

				efficiency of assistance provided under this title in order to maximize the
				impact of such assistance.</text>
								</paragraph><paragraph id="H8D819BE8D449409881261E7E554F29E3"><enum>(2)</enum><header>Report to
				congress</header><text display-inline="yes-display-inline">Not later than 180
				days after the date of enactment of Food Security and Agricultural Development
				Act of 2007, the Administrator shall submit to the appropriate congressional
				committees a report on efforts undertaken to implement paragraph (1).</text>
								</paragraph><paragraph id="H1656F296F36B4846989118D81DA418B3"><enum>(3)</enum><header>Government
				accountability office</header><text display-inline="yes-display-inline">Not
				later than 270 days after the date of the submission of the report under
				paragraph (2), the Comptroller General of the United States shall submit to the
				appropriate congressional committees a report that—</text>
									<subparagraph id="H72611D2A661A499BBFDA7E35193D66D5"><enum>(A)</enum><text>reviews and comments on
				the report under paragraph (2); and</text>

				regarding any additional actions necessary to improve the monitoring and
				evaluation of assistance provided under this title.</text>
									</subparagraph></paragraph><paragraph id="HF57C98BC498B458DAEC8477D5964A2BB"><enum>(4)</enum><header>Contracting
				authority</header><text>In carrying out this subsection, notwithstanding any
				other provision of law, the Administrator may contract with individuals for
				personal services, provided that such individuals shall not be regarded as
				employees of the United States Government for the purpose of any law
				administered by the Civil Service Commission.</text>
								</paragraph><paragraph commented="no" id="H13E643BEA0BE43338D75C56CB0F42022"><enum>(5)</enum><header>Appropriate

				made in accordance with the United Nations World Food Program’s rules and
				regulations for indirect cost rates. Prior to making a contribution to the
				United Nations World Food Program under this subsection, the Administrator
				shall submit to the appropriate congressional committees a report that contains
				the proposed level of the contribution and the reasons for such proposed
				level.</text>

							</paragraph><paragraph commented="no" id="H3A0E00F7252548E5A1E3299037C71BB8"><enum>(3)</enum><header>Reimbursement</header><text>For
				each of the fiscal years 2008 through 2012, there are authorized to be
				appropriated such sums as may be necessary to make payments to the Commodity
				Credit Corporation to the extent the Commodity Credit Corporation is not
				reimbursed under the programs under this Act for the actual costs incurred or
				to be incurred by such Corporation in carrying out such programs.</text>

			 Agricultural Trade Development and Assistance Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/7/1736g">7 U.S.C. 1736g</external-xref>) is

			 integrated with other United States foreign assistance programs, such as the
			 Millennium Challenge Account. Such assistance shall also be coordinated and
			 integrated with the overall development strategy of the recipient country,
			 including the poverty reduction strategy of the recipient country, and in the
			 recipient country with other donors, including international and regional
			 organizations and other donor countries.</quote>; and</text>
						</paragraph><paragraph id="HF523A4386479413D8BFEAF70467B58D"><enum>(2)</enum><text>by striking

			 and to distribute to a recipient country agricultural commodities
			 produced—</text>

			 fiscal year shall be made available for the purposes of famine prevention and
			 relief under such section.</text>
					</subsection></section><section id="H2C7210658F584D73A6F020B7A44E14B"><enum>124.</enum><header>Report on efforts to
			 improve procurement planning</header>
					<subsection id="H8515EADCEADB4BDC9FCF47D7EACFEF3"><enum>(a)</enum><header>Report
			 required</header><text>Not later than 90 days after the date of the enactment
			 of this Act, the Administrator and the Secretary shall submit to the
			 appropriate congressional committees a report on efforts taken by both the
			 United States Agency for International Development and the Department of
			 Agriculture to improve planning for food and transportation procurement,
			 including efforts to eliminate bunching of food purchases.</text>
					</subsection><subsection id="HC45010850C4A4CF0A970595571D6C987"><enum>(b)</enum><header>Contents</header><text>The
			 report required under subsection (a) should include, among other things, a
			 description of efforts taken to—</text>
						<paragraph id="H7503A53D022A4143A6E22EB966D890FD"><enum>(1)</enum><text>improve coordination of
			 food purchases by the United States Agency for International Development and
			 the Department of Agriculture;</text>
						</paragraph><paragraph id="H15FE20244EEE45BC8778D04C4E001689"><enum>(2)</enum><text>increase flexibility in
			 procurement schedules;</text>
						</paragraph><paragraph id="HC28370FD0489415986B5EFD716DF0608"><enum>(3)</enum><text>increase utilization of
			 historical analyses and forecasting; and</text>
						</paragraph><paragraph id="HE1D1B65D2AE746A5A5AD41312C94C667"><enum>(4)</enum><text>improve and streamline
			 legal claims processes for resolving transportation disputes.</text>

			 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/5651">7 U.S.C. 5651 et seq.</external-xref>) is amended by adding at the end the following new
			 section:</text>

				authorized</header><text>The Secretary is authorized to enter into contracts
				with technical experts and scientists, or provide grants to appropriate
				entities, as determined by the Secretary, to address sanitary, phytosanitary,
				and technical barriers to the export of United States agricultural commodities,
				including meat, poultry, and specialty crops, by—</text>
							<paragraph id="H0EC1DC92D77842B69FCB3CEF54BAE958"><enum>(1)</enum><text>contracting with
				technical experts and scientists outside of the Federal government to address
				sanitary and phytosanitary issues, and other issues regarding technical
				barriers, involving agricultural commodities and the products of such
				agricultural commodities; and</text>
							</paragraph><paragraph id="HA81C2BBF4B89492CAD9FFF1C858EFAE7"><enum>(2)</enum><text>commissioning targeted
				outside scientific reports on sanitary and phytosanitary issues, and other
				issues regarding technical barriers, involving agricultural commodities and the
				products of such agricultural commodities.</text>
							</paragraph></subsection><subsection id="HA3AAAB0381AC4FA2BB0772F302CEC308"><enum>(b)</enum><header>Targeted trade
				issues</header><text>Projects funded under this section may include projects
				relating to the acceptance by foreign markets of—</text>
							<paragraph id="H10C30645D2F74CA8A8B61B7727393B6B"><enum>(1)</enum><text>antimicrobial
				treatments;</text>
							</paragraph><paragraph id="H3967FF808AD44ADF9102AF828F087077"><enum>(2)</enum><text>wood-packaging
				material;</text>
							</paragraph><paragraph id="H94B623D7614244549D3B01E5A79BEBDA"><enum>(3)</enum><text>irradiation;</text>
							</paragraph><paragraph id="HBB86DEACFF504ED9A440FE00842E046C"><enum>(4)</enum><text>biotechnology;</text>
							</paragraph><paragraph id="HEBAE551CA7224913929114DE59321CFB"><enum>(5)</enum><text>science-based maximum
				residue level standards;</text>

			 and phytosanitary priorities of the United States within certain international
			 organizations</header>
				<subsection id="HE24D9195961D4BA6A53FD112AA51378C"><enum>(a)</enum><header>Support
			 authorized</header><text display-inline="yes-display-inline">The Secretary of
			 Agriculture is authorized to enhance United States support for international
			 organizations, including international organizations described in subsection
			 (b), that establish international standards regarding food, food safety,
			 plants, and animals by funding additional positions of associate professional
			 officers to address sanitary and phytosanitary priorities of the United States
			 within such international organizations. The Secretary shall carry out this
			 subsection pursuant to the authority of the Secretary under section 1458(a)(3)
			 of the Food and Agriculture Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3291">7 U.S.C. 3291(a)(3)</external-xref>).</text>
				</subsection><subsection id="H2161D43AFF8F46289BAF618B49EA22"><enum>(b)</enum><header>International
			 organizations described</header><text display-inline="yes-display-inline">The
			 international organizations referred to in subsection (a) are the Food and
			 Agriculture Organization, the Codex Alimentarius Commission, the International
			 Plant Protection Convention, and the World Organization for Animal
			 Health.</text>
				</subsection></section><section id="HDB39847E24D1426F9F315F14B23B9714"><enum>303.</enum><header>Technical assistance
			 for the resolution of trade disputes</header>
				<subsection id="H5D1F31D1A66640EBB95F46EE2348019"><enum>(a)</enum><header>Technical assistance
			 authorized</header><text>The Secretary of Agriculture is authorized to provide
			 monitoring, analytic support, and other technical assistance to
			 limited-resource persons and organizations associated with agricultural trade
			 (as determined by the Secretary) to address unfair trade practices of foreign
			 countries, including intellectual property right violations, and to reduce
			 trade barriers.</text>
				</subsection><subsection id="H8C0624E7555647F086E7CF28ED4FB065"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text>To carry out this section, there are authorized to
			 be appropriated to the Secretary such sums as may be necessary for each of the
			 fiscal years 2008 through 2012.</text>
				</subsection></section><section id="H47B30F04349B448BA640F056DEEFF4D"><enum>304.</enum><header>Sense of Congress
			 concerning the Global Crop Diversity Trust</header>
				<subsection id="HFD8B1D78F7204FD8A069CC1927BCD361"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
					<paragraph id="HFFE280C8C75A4E5EA3E96FC0E812B8BB"><enum>(1)</enum><text>Crop diversity—the
			 natural diversity exhibited in the array of varieties in every crop—is one of
			 the world’s least recognized, but most valuable resources. It provides the
			 genetic building blocks for adapting crops to constantly evolving pests,
			 diseases, and changing climates. Without crop diversity, agriculture cannot
			 retain current productivity levels and cannot meet anticipated future
			 challenges associated with population growth and global warming.</text>
					</paragraph><paragraph id="H88FF608174704285A091A28C27FD07A1"><enum>(2)</enum><text>Currently, much of the
			 world’s crop diversity is neither safely conserved, nor readily available to
			 scientists and farmers who rely on it to safeguard agricultural productivity.</text>
					</paragraph><paragraph id="H99A759C37760435183533D49B5839223"><enum>(3)</enum><text>The Global Crop Diversity
			 Trust, an independent organization created by the United Nations Food and
			 Agricultural Organization in conjunction with the 2001 International Treaty on
			 Plant Genetic Resources, is the only organization working globally to solve the
			 problem of protecting crop diversity. The Global Crop Diversity Trust became a
			 legal entity at the end of 2004, but has already raised $135,000,000 from a
			 broad alliance of partners, including developed and developing countries,
			 private corporations, and philanthropic foundations, including a joint
			 initiative with the United Nations Foundation funded by The Bill and Melinda
			 Gates Foundation.</text>
					</paragraph><paragraph id="H27C1C5D1F447432B82E42DA09D1862"><enum>(4)</enum><text>The United States was an
			 early supporter of the Global Crop Diversity Trust, and has so far contributed
			 $6,500,000 to the Global Crop Diversity Trust. Robust involvement of the United
			 States in the Global Crop Diversity Trust ensures significant benefits to
			 United States farmers.</text>
					</paragraph></subsection><subsection id="H995BB41D5BC14AE8B4BFD440F5620202"><enum>(b)</enum><header>Sense of
			 congress</header><text>It is the sense of Congress that the President should
			 provide significant United States financial resources to the Global Crop
			 Diversity Trust to ensure the conservation of crop diversity which can yield
			 significant benefits to United States farmers.</text>
				</subsection></section><section id="H51E1B1FF627A4B1E00DF778823D46910"><enum>305.</enum><header>Technical and
			 conforming amendments</header><text display-inline="no-display-inline">Subsection (a) of section 3206 of the Farm
			 Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/5603a">7 U.S.C. 5603a</external-xref>) is amended by
			 striking <quote>Committee on International Relations</quote> and inserting
			 <quote>Committee on Foreign Affairs</quote>.</text>
			</section><section id="HB207EE814C344B28A4BEE5738003300"><enum>306.</enum><header>Rule of
			 construction</header><text display-inline="no-display-inline">Nothing in this
			 Act or any amendment made by this Act shall be construed to supersede the
			 provisions of the Trade Sanctions Reform and Export Enhancement Act of 2000 (22
			 U.S.C. 7201 et seq.).</text>
