		<official-title>To amend <external-xref legal-doc="usc" parsable-cite="usc/17/122">section 122</external-xref> of title 17, United States Code, and
		  the Communications Act of 1934 to permit satellite carriers and cable operators
		  to retransmit the signals of local television broadcast stations to their
		  adjacent markets, and for other purposes.</official-title>

		<section id="HEC8ECC97AB454D5FB1BA69643E002798" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Television Freedom Act of
			 2007</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HC45D127B6AA241A8B7B2171976E76700"><enum>2.</enum><header>Secondary
			 transmissions by satellite carriers within local markets</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/17/122">Section 122</external-xref> of title 17, United States Code,
			 is amended—</text>
			<paragraph id="H56891685A0734E568F72DB10A6404176"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="HF8DB7BEDA1F943529E47E7711B48AE36"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1), by inserting <quote>or adjacent market</quote> after
			 <quote>station’s local market</quote>;</text>
				</subparagraph><subparagraph id="H0810AC2AF3B54CDD9C693762AC780931"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>and</quote> after the semicolon;</text>
				</subparagraph><subparagraph id="H563ED60654894D4985A432026961DF22"><enum>(C)</enum><text>in paragraph (3),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</subparagraph><subparagraph id="HE9273EC746944B16B879CAE3588215C1"><enum>(D)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H0FD8210F435140B2B8B41EB74ED9EC8E" style="OLC">
						<paragraph id="H3CFB65B3978B495A80E1B1DEBCD87BB3"><enum>(4)</enum><text display-inline="yes-display-inline">in the case of a satellite carrier that
				makes secondary transmissions into a television broadcast station’s adjacent
				market, the satellite carrier also makes secondary transmissions into that
				market of the signals of the television broadcast stations located in that
				market.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H17584CD01D3E4F83BBF0861691F5F01"><enum>(2)</enum><text display-inline="yes-display-inline">in subsections (d) an (e), by inserting
			 <quote>or adjacent market</quote> after <quote>into the local
			 market</quote>;</text>
			</paragraph><paragraph id="H84F8562B71404A54AB55785BC64DAF35"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (f), by inserting <quote>or
			 adjacent market</quote> after <quote>station’s local market</quote> in
			 paragraphs (1) and (2);</text>
			</paragraph><paragraph id="H72CF4CE953354729AB7C005000B83419"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (g), by inserting <quote>or
			 adjacent market</quote> after <quote>station’s local market</quote>; and</text>
			</paragraph><paragraph id="HEB591CB7E1F04BB2BE713817D1CD4CA7"><enum>(5)</enum><text>in subsection (j),
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H74B3599C1C524744BD344F47FBDED045" style="OLC">
					<paragraph id="HFCFE8D4ABBA54B22BF47C789B1D03119"><enum>(6)</enum><header>Adjacent
				market</header><text display-inline="yes-display-inline">The term
				<term>adjacent market</term>, in the case of both commercial and noncommercial
				television broadcast stations, means any designated market area adjacent to,
				and at least partially in the same State as, the designated market area in
				which the station is located.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HD454AEE5E4734FAEA761C24F43003529"><enum>3.</enum><header>Amendments to the
			 Communications Act of 1934</header>
			<subsection id="H1B81621988F74119979ECA7C71072FE0"><enum>(a)</enum><header>Retransmission
			 consent</header><text display-inline="yes-display-inline">Section 325(b)(2) of
			 the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/325">47 U.S.C. 325(b)(2)</external-xref>) is amended—</text>
				<paragraph id="H7496AD40A5D741888B5EF1274B00A1EC"><enum>(1)</enum><text>by striking
			 <quote>or</quote> at the end of subparagraph (D);</text>
				</paragraph><paragraph id="HAC15D98875D74F21BB923C86C3C2C6AC"><enum>(2)</enum><text>by striking the
			 period at the end of subparagraph (E) and inserting <quote>; or</quote>;
			 and</text>
				</paragraph><paragraph id="H5802D159A45C4E0FBFAC1CDD9957BCE"><enum>(3)</enum><text>by
			 inserting after subparagraph (E) the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H6FF89037B4404B1EBFC97D00EE96BF22" style="OLC">
						<subparagraph id="H1CC3838FB0394DF6A5198BB2ED27EDC3"><enum>(F)</enum><text display-inline="yes-display-inline">to retransmission of the signals of a
				television broadcast station to a subscriber located in the station’s adjacent
				market—</text>
							<clause id="H30AFB47225EF47AE85B530D31FE8BE18"><enum>(i)</enum><text>by
				a satellite carrier directly to the satellite antenna of the subscriber under
				<external-xref legal-doc="usc" parsable-cite="usc/17/122">section 122</external-xref> of title 17, United States Code, or</text>
							</clause><clause id="H63A550313AD44C689428C32C492C2CB"><enum>(ii)</enum><text>by
				a cable operator or other multichannel video programmer, other than a satellite
				carrier, to the subscriber.</text>
							</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HA7E7482189B042BFA55BF560F02D36CB"><enum>(4)</enum><text>in the last
			 sentence, by striking <quote>the term <term>local market</term> has the meaning
			 that term</quote> and inserting <quote>the terms <term>local market</term> and
			 <term>adjacent market</term> have the meanings given such terms</quote>.</text>
				</paragraph></subsection><subsection id="H8E717F015A804CB8BE5DEFB22575848C"><enum>(b)</enum><header>Carriage of
			 Distant Signals</header><text>Section 339(a)(1)(B) of such Act (47 U.S.C.
			 339(a)(1)(B)) is amended by inserting <quote>or adjacent market</quote> after
			 <quote>local market</quote>.</text>
			</subsection><subsection id="H15C01D9F96414D4AAEBEAC654048FD50"><enum>(c)</enum><header>Waiver of
			 duplication rules</header>
				<paragraph id="HDC12B332FA424F639095D559BDD597C4"><enum>(1)</enum><header>Waiver
			 required</header><text display-inline="yes-display-inline">Within 90 days after
			 the date of enactment of this Act, the Federal Communications Commission shall
			 commence a proceeding to revise the regulations concerning network
			 nonduplication protection, syndicated exclusivity protection, and sports
			 blackout protection (47 CFR part 76) against the retransmission by a cable
			 operator or by a satellite carrier of signals of network stations to
			 subscribers to permit such retransmission if the subscriber receiving the
			 signals is located in the station’s adjacent market (as such term is defined in
			 <external-xref legal-doc="usc" parsable-cite="usc/17/122">section 122(j)(6)</external-xref> of title 17, United States Code).</text>
				</paragraph><paragraph id="HCF2B1E3D01E74AB69F06A074999417EA"><enum>(2)</enum><header>Deadline for
			 action</header><text>The Commission shall complete all actions necessary to
			 prescribe the revised regulations required by
			 <internal-xref idref="HDC12B332FA424F639095D559BDD597C4" legis-path="2.(c)(1)">paragraph (1)</internal-xref> within 180 days after the
			 date of enactment of this Act.</text>
				</paragraph></subsection></section></legis-body>
