		<section id="H44F956AA5D1C4A35B2CC7BFD60510843" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Clean Air and Water Investment Act of
			 2007</short-title></quote>.</text>
		</section><section id="HD200B354842D4159BED22DA63ED2C25"><enum>2.</enum><header>Tax-exempt bonds
			 for air and water pollution control facilities</header>
			<subsection id="H087EB5F14AE24C83B831C7B561D48172"><enum>(a)</enum><header>In
			 general</header><text>Subsection (a) of section 142 of the Internal Revenue
			 Code of 1986 (defining exempt facility bonds) is amended by striking
			 <quote>or</quote> at the end of paragraph (14), by striking the period at the
			 end of paragraph (15) and inserting <quote>, or</quote>, and by adding at the
			 end the following new paragraph:</text>

					<paragraph id="H76891BA0C78949478CE2BAF8B1D0DE66"><enum>(16)</enum><text>air or water
				pollution control
				facilities.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9316980509BD48D186FEB6CCA8F1F61F"><enum>(b)</enum><header>Air or water
			 pollution control facilities</header><text>Section 142 of such Code is amended
			 by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HDD21152636334B5BBE7682DBEC80FD90" style="OLC">
					<subsection id="H27EE5D1ED86B488189DF49FF3A4648C"><enum>(n)</enum><header>Air or water
				pollution control facilities</header>
						<paragraph id="H883B9FD2C06540FCA3B04DE1675C10D3"><enum>(1)</enum><header>In
				general</header><text>For purposes of subsection (a)(16), the term <term>air or
				water pollution control facilities</term> means any property—</text>
							<subparagraph id="HFF8D9C8786AD410F8ECEF58846D2B4C9"><enum>(A)</enum><text display-inline="yes-display-inline">to be used, in whole or in part, to abate
				or control water or atmospheric pollution or contamination by removing,
				altering, disposing, or storing pollutants, contaminants, wastes, or
				heat,</text>
							</subparagraph><subparagraph id="HF3441F3EE2274E8BA3428981A7D751F"><enum>(B)</enum><text>which is
				either—</text>
								<clause id="H65C6A804352146D58314BC1AF181E19"><enum>(i)</enum><text>of
				a character subject to the allowance for depreciation under section 167,
				or</text>
								</clause><clause id="H4BBD2DB01D094F26AC234700E3FB3CFC"><enum>(ii)</enum><text>land, and</text>
								</clause></subparagraph><subparagraph id="H6F61A50D00614944AEC56C160015605C"><enum>(C)</enum><text>with respect to
				which either—</text>
								<clause id="HA7B422C8A6AD47E684280753FF9E795F"><enum>(i)</enum><text>a
				Federal, State, or local agency exercising jurisdiction has certified that the
				property, as designed, is in furtherance of the purpose of abating or
				controlling atmospheric pollutants or contaminants, or water pollution, as the
				case may be, or</text>
								</clause><clause id="HA646319EE3424C4F982FF43701963287"><enum>(ii)</enum><text>the property is
				designed to meet or exceed applicable Federal, State, and local requirements
				for the control of atmospheric pollutants or contaminants, or water pollution,
				as the case may be, in effect at the time the obligations, the proceeds of
				which are to be used to provide such facilities, are issued.</text>
								</clause></subparagraph></paragraph><paragraph id="H265915A8EDAF415A8DA49495337E949C"><enum>(2)</enum><header>Certain other
				property</header><text>In the case of property to be used to control water
				pollution, a water pollution control facility includes the necessary
				intercepting sewers, pumping, power, and other equipment, and their
				appurtenances.</text>
						</paragraph><paragraph id="H300A0F60B4DF4F4BB030873882D53659"><enum>(3)</enum><header>Costs taken into
				account</header>
							<subparagraph id="H08192213974642B6939E759D513FEC01"><enum>(A)</enum><header>Property with no
				significant purpose other than pollution control</header><text>In the case of
				property which is designed for no significant purpose other than the control of
				pollution, the total expenditure for such property shall be taken into account
				for purposes of this subsection.</text>
							</subparagraph><subparagraph id="HC7772A8948CE418EBB35B98CE4A8701D"><enum>(B)</enum><header>Incremental cost
				where significant purpose other than pollution control</header><text>In the
				case of property to be placed in service for the purpose of controlling
				pollution and for a significant purpose other than controlling pollution, only
				the incremental cost of such property shall be taken into account for purposes
				of this subsection. For purposes of the preceding sentence, the term
				<term>incremental cost</term> means the excess of the total cost of such
				property over the portion of such cost expended for a purpose other than the
				control of pollution.</text>
							</subparagraph><subparagraph id="HD329DF338F6D4E27A1A500C413C4F9B0"><enum>(C)</enum><header>Significant
				purpose</header><text>For purposes of this paragraph, an expenditure has a
				significant purpose other than the control of pollution if such expenditure
				results in an increase in production or capacity, or in a material extension of
				the useful life, of a manufacturing or production facility or a part
				thereof.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H85646201E1AC48199CAA55A52C858FCF"><enum>(c)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply to bonds
			 issued after December 31, 2006.</text>
