		<official-title>To amend the Family and Medical Leave Act of 1993 to
		  permit leave to care for a same-sex spouse, domestic partner, parent-in-law,
		  adult child, sibling, or grandparent who has a serious health

		<section id="HFAB6781ADD154F10928E6B681BDCC402" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Family and Medical Leave Inclusion
			 Act</short-title></quote>.</text>
		</section><section id="H8BF427DB95D2489691052CAB5114D8BE"><enum>2.</enum><header>Leave to care for
			 a domestic partner, parent-in-law, adult child, sibling, or
			 grandparent</header>
			<subsection id="H9BDDB2899AB849D5BAB4485747A63BD6"><enum>(a)</enum><header>Definitions</header>
				<paragraph id="H66D044CB207643AB921EB62F8CA53E27"><enum>(1)</enum><header>Inclusion of
			 same-sex spouses</header><text display-inline="yes-display-inline">Section
			 101(13) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(13)</external-xref>) is
			 amended, by inserting <quote>, and includes a same-sex spouse as determined
			 under applicable State law</quote> before the period.</text>
				</paragraph><paragraph id="H744115D26D054DEA9DDA00D7A2CD7064"><enum>(2)</enum><header>Inclusion of
			 adult children</header><text display-inline="yes-display-inline">Section
			 101(12) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(12)</external-xref>) is amended by striking <quote>who
			 is—</quote> and all that follows and inserting <quote>and includes an adult
			 child</quote>.</text>
				</paragraph><paragraph id="HC19B8D4136664096A142BAC73EA30047"><enum>(3)</enum><header>Inclusion of
			 grandparents, parents-in-law, siblings, and domestic
			 partners</header><text>Section 101 of such Act is further amended—</text>
					<subparagraph id="H87942309EF30455E84F0EB072C9EEFC3"><enum>(A)</enum><text>by redesignating
			 paragraphs (2) through (13) as paragraphs (3), (4), (5), (6), (8), (9), (11),
			 (12), (13), (15), (16), and (17), respectively;</text>
					</subparagraph><subparagraph id="H51C07B1A558040518B7115ED0049AF36"><enum>(B)</enum><text>by inserting after
			 paragraph (1) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H6AB454B857804C1AB708DFB7F3C4DE1" style="OLC">
							<paragraph commented="no" id="HBC63FABFBA7E48B5A51CB8DB667C4ECB"><enum>(2)</enum><header>Domestic
				partner</header><text display-inline="yes-display-inline">The term
				<term>domestic partner</term> means—</text>
								<subparagraph commented="no" id="H1B29C0A01217489C8B286B25D1BACD52"><enum>(A)</enum><text>the person
				recognized as the domestic partner of the employee under any domestic partner
				registry or civil union laws of the State or political subdivision of a State
				where the employee resides; or</text>
								</subparagraph><subparagraph commented="no" id="H44A737A6C7814CDCA000D36FBAA1F564"><enum>(B)</enum><text>in the case of an
				unmarried employee who lives in a State where a person cannot marry a person of
				the same sex under the laws of the State, a single, unmarried adult person of
				the same sex as the employee who is in a committed, intimate relationship with
				the employee, is not a domestic partner to any other person, and who is
				designated to the employer by such employee as that employee’s domestic
				partner.</text>
								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H60C3D039DC0047FC81A285903598FFBF"><enum>(C)</enum><text>by inserting after
			 paragraph (6) (as so redesignated) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H195854C19F5C48C499BC6AD97AB114B" style="OLC">
							<paragraph id="H32B6001E55FE40629389E93E2715BF47"><enum>(7)</enum><header>Grandparent</header><text>The
				term <term>grandparent</term> means a parent of a parent of an
				employee.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H046F8D0BD6834266866EDB4DEFD52252"><enum>(D)</enum><text>by inserting after
			 paragraph (9) (as so redesignated) the following:</text>
						<quoted-block display-inline="no-display-inline" id="HF36D4F29507C4D8AAB58008D207C0118" style="OLC">
							<paragraph id="H556FDA8DC3CF4F66B998501C7278F2DE"><enum>(10)</enum><header>Parent-in-law</header><text>The
				term <term>parent-in-law</term> means a parent of the spouse or domestic
				partner of an employee.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HE2CFA8604D1A4A3F91692589DA79EAEB"><enum>(E)</enum><text>by inserting after
			 paragraph (13) (as so redesignated) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H1CA0D3938692426695E3E8B65E5300C6" style="OLC">
							<paragraph id="H0700E942FFBF408B90656122177BABF0"><enum>(14)</enum><header>Sibling</header><text display-inline="yes-display-inline">The term <term>sibling</term> means any
				person who is a son or daughter of an employee’s
				parent.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H07B59C6B7C144A43A12DEF85478D1100"><enum>(b)</enum><header>Leave
			 Requirement</header><text>Section 102 of the Family and Medical Leave Act of
			 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612</external-xref>) is amended—</text>
				<paragraph id="H159D8D680A92453394CB01C30190DF24"><enum>(1)</enum><text>in subsection
			 (a)(1)(C), by striking <quote>spouse, or a son, daughter, or parent of the
			 employee, if such spouse, son, daughter, or parent</quote> and inserting
			 <quote>spouse or domestic partner, or a son, daughter, parent, parent-in-law,
			 grandparent, or sibling, of the employee if such spouse, domestic partner, son,
			 daughter, parent, parent-in-law, grandparent, or sibling</quote>; and</text>
				</paragraph><paragraph id="HB80D2E5947C24EA6B1C5BAC646B9E400"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e)(2)(A), by striking
			 <quote>spouse, or parent</quote> and inserting <quote>spouse, domestic partner,
			 parent, parent-in-law, grandparent, or sibling</quote>.</text>
				</paragraph></subsection><subsection id="HC45AE3DCBBDF440C81108D242C9F0093"><enum>(c)</enum><header>Certification</header><text>Section
			 103 of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2613">29 U.S.C. 2613</external-xref>) is
			 amended—</text>
				<paragraph id="HADD04929CC504FAC8D35C24D04007118"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>spouse, or parent</quote> and inserting <quote>spouse,
			 domestic partner, parent, parent-in-law, grandparent, or
			 sibling</quote>;</text>
				</paragraph><paragraph id="HC5B576965F8A4AD9901EC9C3FE27C4CE"><enum>(2)</enum><text>in subsection
			 (b)(4)(A), by striking <quote>spouse, or parent and an estimate of the amount
			 of time that such employee is needed to care for the son, daughter, spouse, or
			 parent</quote> and inserting <quote>spouse, domestic partner, parent,
			 parent-in-law, grandparent, or sibling and an estimate of the amount of time
			 that such employee is needed to care for such son, daughter, spouse, domestic
			 partner, parent, parent-in-law, grandparent, or sibling</quote>; and</text>
				</paragraph><paragraph id="H337100F6A03E4D74B5984425271CA743"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (b)(7), by striking
			 <quote>parent, or spouse</quote> and inserting <quote>spouse, domestic partner,
			 parent, parent-in-law, grandparent, or sibling</quote>.</text>
				</paragraph></subsection><subsection id="H65E52D1F19B346A89C532C84B56295AC"><enum>(d)</enum><header>Employment and
			 Benefits Protection</header><text>Section 104(c)(3) of the Family and Medical
			 Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2614">29 U.S.C. 2614(c)(3)</external-xref>) is amended—</text>
				<paragraph id="H6693B68CD5F24F27865350AF9252E91C"><enum>(1)</enum><text>in subparagraph
			 (A)(i), by striking <quote>spouse, or parent</quote> and inserting
			 <quote>spouse, domestic partner, parent, parent-in-law, grandparent, or
			 sibling</quote> ; and</text>
				</paragraph><paragraph id="H1C2E86B82A9941758746A19B3BEF8F00"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C)(ii), by striking
			 <quote>spouse, or parent</quote> and inserting <quote>spouse, domestic partner,
			 parent, parent-in-law, grandparent, or sibling</quote>.</text>
				</paragraph></subsection></section><section id="H81841C53D0EB40B785EEDC0614D14F01"><enum>3.</enum><header>Federal
			 employees</header>
			<subsection id="H4239F939453849B58D01E9C8E33C6208"><enum>(a)</enum><header>Definitions</header>
				<paragraph id="H450603F944AA46E9B3823500BFF5DA09"><enum>(1)</enum><header>Inclusion of
			 adult children</header><text display-inline="yes-display-inline">Section
			 6381(6) of title 5, United States Code, is amended by striking <quote>who
			 is—</quote> and all that follows and inserting <quote>and includes an adult
			 child</quote>.</text>
				</paragraph><paragraph id="H583B95A68130454EADA8895DC95259E"><enum>(2)</enum><header>Inclusion of
			 grandparents, parents-in-law, siblings, and domestic partners</header><text display-inline="yes-display-inline">Section 6381 of such title is further
			 amended—</text>
					<subparagraph id="H7E89EF1B126448A09D522DCB76868754"><enum>(A)</enum><text>by redesignating
			 paragraphs (3) through (6) as paragraphs (4), (7), (8), (9), and (10),
			 respectively;</text>
					</subparagraph><subparagraph id="HC5CD5C9EBED94730AC9C1DBAE0C21C48"><enum>(B)</enum><text>by inserting after
			 paragraph (2) the following:</text>
						<quoted-block display-inline="no-display-inline" id="HD42EE76C76E64A569DDC8568B8E9085F" style="OLC">
							<paragraph commented="no" id="H3B305E2DFFFD4A4FB69C4BB13B6037E"><enum>(3)</enum><header>Domestic
				partner</header><text display-inline="yes-display-inline">The term
				<term>domestic partner</term> means—</text>
								<subparagraph commented="no" id="H26E2CDA7520044FBB72C8F34025F10D"><enum>(A)</enum><text>the person
				recognized as the domestic partner of the employee under any domestic partner
				registry or civil union laws of the State or political subdivision of a State
				where the employee resides; or</text>
								</subparagraph><subparagraph commented="no" id="HA71E65738A794298975FC994EBC22433"><enum>(B)</enum><text>in the case of an
				unmarried employee who lives in a State where a person cannot marry a person of
				the same sex under the laws of the State, a single, unmarried adult person of
				the same sex as the employee who is in a committed, intimate relationship with
				the employee, is not a domestic partner to any other person, and who is
				designated to the employer by such employee as that employee’s domestic

								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H873B07663F314F8E83FE8FFA79DF6439"><enum>(C)</enum><text>by inserting after
			 paragraph (4) (as so redesignated) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H33DCC1616FBC4FF491F76D2D7CC5C34" style="OLC">
							<paragraph id="H312F82F268D44084A9C77EBB00CEDD1"><enum>(5)</enum><header>Parent-in-law</header><text>The
				term <term>parent-in-law</term> means a parent of the spouse or domestic
				partner of an employee.</text>
							</paragraph><paragraph id="H8AF67276D4E3450C8D633FAFBD79A43C"><enum>(6)</enum><header>Grandparent</header><text>The
				term <term>grandparent</term> means a parent of a parent of an
				employee.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H37BFABD26B874A73B7373B139315817F"><enum>(D)</enum><text>by inserting after
			 paragraph (8) (as so redesignated) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H7D928850016B44B18509118774D95666" style="OLC">
							<paragraph id="HD5355B4B39794F28A1DA9E8F3292DD00"><enum>(9)</enum><header>Sibling</header><text display-inline="yes-display-inline">The term <term>sibling</term> means any
				person who is a son or daughter of an employee’s
				parent.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H1DD73BBCB6804A3EA42139006190FD1C"><enum>(3)</enum><header>Inclusion of
			 same-sex spouses</header><text display-inline="yes-display-inline">Section
			 6381of such title, as amended by this subsection, is further amended by adding
			 at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H85CB8140B03844D6A3EBEFF552B70F8" style="USC">
						<paragraph id="HA27A562A65C74679AEA0F9A9DB1CC91"><enum>(11)</enum><header>Spouse</header><text display-inline="yes-display-inline">The term <term>spouse</term> includes a
				same-sex spouse as determined under applicable State
				law.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC712C72E59FD4E5B00EE6C10072FDB7"><enum>(b)</enum><header>Leave
			 Requirement</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/6382">Section 6382</external-xref> of title 5, United States Code, is
			 amended—</text>
				<paragraph id="H335D346C7E3A4C7BBBDE4C72F9F3CC13"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)(C), by striking
			 <quote>spouse, or a son, daughter, or parent of the employee, if such spouse,
			 son, daughter, or parent</quote> and inserting <quote>spouse, or domestic
			 partner, or a son, daughter, parent, parent-in-law, grandparent, or sibling, of
			 the employee if such spouse, domestic partner, son, daughter, parent,
			 parent-in-law, grandparent, or sibling</quote>; and</text>
				</paragraph><paragraph id="HBED453FDDD32440E9725AB89476900C"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e)(2)(A), by striking
			 <quote>spouse, or parent</quote> and inserting <quote>spouse, domestic partner,
			 parent, parent-in-law, grandparent, or sibling</quote>.</text>
				</paragraph></subsection><subsection id="HA2C412604C914EF08D7148BF81E71B73"><enum>(c)</enum><header>Certification</header><text>Section
			 6383 of title 5, United States Code, is amended—</text>
				<paragraph id="H14ED058CB2E7405BAFA466D4A29E11F2"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking
			 <quote>spouse, or parent</quote> and inserting <quote>spouse, domestic partner,
			 parent, parent-in-law, grandparent, or sibling</quote>; and</text>
				</paragraph><paragraph id="H5029B2316D2448CCB9AD855EC824CCBD"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(4)(A), by striking
			 <quote>spouse, or parent, and an estimate of the amount of time that such
			 employee is needed to care for such son, daughter, spouse, or parent</quote>
			 and inserting <quote>spouse, domestic partner, parent, parent-in-law,
			 grandparent, or sibling and an estimate of the amount of time that such
