		<legis-type>A BILL</legis-type>
		<official-title>To amend the Acts popularly known as the Duck Stamp Act
		  and the Wetland Loan Act to reauthorize appropriations to promote the
		  conservation of migratory waterfowl and to offset or prevent the serious loss
		  of important wetlands and other waterfowl habitat essential to the preservation
		  of such waterfowl, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H001A97B8E84C444D9F57005EB8E01829" section-type="section-one"><enum>1.</enum><header>Authorization of funds for
			 conservation of migratory waterfowl and habitat</header><text display-inline="no-display-inline">The first section of <external-xref legal-doc="public-law" parsable-cite="pl/87/383">Public Law 87–383</external-xref> (16
			 U.S.C. 715k–3), popularly known as the Wetlands Loan Act, is amended—</text>
			<paragraph id="H88232D9115AE4EC7B83C76DF9E00D43"><enum>(1)</enum><text>by
			 striking <quote>for the period</quote> and all that follows through the end of
			 the sentence and inserting <quote>$40,000,000 for each of fiscal years 2009
			 through 2018.</quote>; and</text>
			</paragraph><paragraph id="H20756E7C7CAC47E1941393E2846EAF7E"><enum>(2)</enum><text>by adding at the
			 end the following: <quote>Funds appropriated pursuant to this Act shall be
			 treated as an advance, without interest, to the migratory bird conservation
			 fund. Such appropriated funds, beginning on July 1, 2010, shall be repaid to
			 the Treasury out of the migratory bird conservation fund. Such repayment shall
			 be made in annual amounts comprising the moneys accruing annually to such fund
			 that are attributable to the portion of the price of migratory bird hunting
			 stamps sold that year that is in excess of $15 per stamp.</quote>.</text>
			</paragraph></section><section id="HA16248B90C474776861CCE8CEF83BBC6"><enum>2.</enum><header>Price of duck
			 stamp</header>
			<subsection id="H1C4A316202B446DFB814B0B451F9753B"><enum>(a)</enum><header>Price of
			 stamp</header><text>Section 2(b) of the Act of March 16, 1934 (chapter 71; 16
			 U.S.C. 718b(b)), popularly known as the Duck Stamp Act, is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="H88F4DAFC292A4C81B6FBD9B25EDF40BA" style="OLC">
					<subsection id="H4D7FA1E6DA0F4FE6B97724FDE05603FF"><enum>(b)</enum><header>Price of
				stamp</header><text>A person authorized to sell stamps under this section shall
				collect, for each stamp sold—</text>
						<paragraph id="H7322DE0A764E4201A96B04C401AF8762"><enum>(1)</enum><text>$25 for a stamp
				for any of hunting years 2009 through 2016; and</text>
						</paragraph><paragraph id="H389CC1CE7FB24672AEEBE7D658C1C463"><enum>(2)</enum><text>$35 for a stamp
				for each hunting year after hunting year
				2016.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H16B196F47C9C4E378CDB74615E307EC0"><enum>(b)</enum><header>Limitation on
			 application</header><text display-inline="yes-display-inline">This section
			 shall not affect the application of section 2 of such Act before July 1,
			 2009.</text>
			</subsection></section><section id="H212E828095F3411DBD8648F2051EDFB"><enum>3.</enum><header>Use
			 of funding</header>
			<subsection id="HC09D8603E4EF4F33BE2D0146F23CBD5D"><enum>(a)</enum><header>Acquisition of
			 lands only upon recommendation of Migratory Bird Conservation
			 Commission</header><text display-inline="yes-display-inline">Amounts
			 appropriated after the date of the enactment of this Act under the first
			 section of <external-xref legal-doc="public-law" parsable-cite="pl/87/383">Public Law 87–383</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/715k-3">16 U.S.C. 715k–3</external-xref>), popularly known as the
			 Wetlands Loan Act, as amended by this Act, or from the migratory bird
			 conservation fund, shall be available to acquire land only if the acquisition
			 is recommended by the Migratory Bird Conservation Commission.</text>
			</subsection><subsection id="HEA72201286064FBCBBE614C1C7702CC"><enum>(b)</enum><header>Designation of
			 authorized priority general public uses</header><text>Not later than one year
			 after the acquisition of land with amounts referred to in subsection (a) that
			 will be included in the National Wildlife Refuge System, the Secretary of the
			 Interior, acting through the Director of the United States Fish and Wildlife
			 Service, shall designate the priority general public uses (as that term is used
			 in section 4(a)(3) of the National Wildlife Refuge System Administration Act of
			 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd(a)(3)</external-xref>)) that will be authorized on such land, and the
			 first date on which each designated use will be allowed.</text>
			</subsection></section><section id="HBBB7F52E8EAF440B93C20057B0FC4D5"><enum>4.</enum><header>Sense of Congress
			 regarding the expenditures of funds</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
			<paragraph id="H2FEB08FAF6C24E4FB4F9727F954CAAC7"><enum>(1)</enum><text>the funds provided
			 pursuant to the amendments made by this Act—</text>
				<subparagraph id="H01C99B75027A4534B79CEA2907472F9C"><enum>(A)</enum><text>should be used for
			 preserving and increasing waterfowl populations in accordance with the goals
			 and objectives of the North American Waterfowl Management Plan; and</text>
				</subparagraph><subparagraph id="H2955867244D742B78DDC1EF583A975CF"><enum>(B)</enum><text>to that end,
			 should be used to supplement and not replace current conservation funding,
			 including funding for other Federal and State habitat conservation programs;
			 and</text>
				</subparagraph></paragraph><paragraph id="H21F4FEB97C88456BBF1394BE2DDB866"><enum>(2)</enum><text>this Act should be
			 implemented in a manner that helps private landowners achieve their long-term
			 land use objectives in ways that enhance the conservation of wetlands and
			 wildlife habitat.</text>
