<official-title display="yes">To amend the Family and Medical Leave Act of 1993 to clarify the eligibility requirements with respect to airline flight crews.</official-title>

<section id="HC9E364AA6B564480AA12CE334EFF14D1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Airline Flight Crew Technical Corrections Act</short-title></quote>.</text> </section> 
<section id="H274A35E45A59476FBD7EEE207F9532CA"><enum>2.</enum><header>Leave requirement for airline flight crews</header> 
<subsection id="H0D1EA17CB7814E040006CD5100CEF12C"><enum>(a)</enum><header>Inclusion of Airline flight crews</header><text display-inline="yes-display-inline">Section 101(2) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(2)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H72DC8C8167834E4C8BF140D24B34D0BE" display-inline="no-display-inline"> 
<subparagraph id="H959EA08B31A04F95863920075FAEF8D"><enum>(D)</enum><header>Airline Flight Crews</header> 
<clause id="HCBFAF499D78A4B9DB220B27B728047E8"><enum>(i)</enum><header>Determination</header><text display-inline="yes-display-inline"> For purposes of determining whether an employee who is a flight attendant or flight crewmember (as such terms are defined in regulations of the Federal Aviation Administration) meets the hours of service requirement specified in subparagraph (A)(ii), the employee will be considered to be eligible if—</text> 
<subclause id="HC91717ED854A43A0BF360000C1D5FE25"><enum>(I)</enum><text>the employee has worked or been paid for 60 percent of the applicable monthly guarantee, or the equivalent annualized over the preceding 12-month period; and </text></subclause> 
<subclause id="HCFCBEB9B05A04230BAA4DAAB928122CC" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">the employee has worked or been paid for a minimum of 504 hours during the preceding 12-month period.</text></subclause></clause> 
<clause id="HDC7C2EDF79A24DAAA890233030DA73FB"><enum>(ii)</enum><header>Definition</header><text>As used in this subparagraph, the term <quote>applicable monthly guarantee</quote> means—</text> 
<subclause id="H2146CBCB932D4C0C90006C04562619D9"><enum>(I)</enum><text display-inline="yes-display-inline">for employees described in clause (i) other than employees on reserve status, the minimum number of hours for which an employer has agreed to schedule such employees for any given month; and</text></subclause> 
<subclause id="H4A24B5E7665841DA87891BD989810150"><enum>(II)</enum><text display-inline="yes-display-inline">for employees described in clause (i) who are on reserve status, the number of hours for which an employer has agreed to pay such employees on reserve status for any given month,</text></subclause><continuation-text continuation-text-level="clause">as established in the collective bargaining agreement, or if none exists in the employer's policies. Each employer of an employee described in clause (i) shall maintain on file with the Secretary (in accordance with regulations the Secretary may prescribe) the applicable monthly guarantee with respect to each category of employee to which such guarantee applies.</continuation-text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H81A235DBC16D4EA8BD9FEAC6F79970CC" commented="no"><enum>(b)</enum><header>Calculation of leave for airline flight crews</header><text display-inline="yes-display-inline">Section 102(a) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="HA6D0C6DBC3414123A8EC65E0FD5BE3A1" commented="no"><enum>(5)</enum><header>Calculation of leave for airline flight crews</header><text display-inline="yes-display-inline">The Secretary may provide, by regulation, a method for calculating the leave described in paragraph (1) with respect to employees described in section 101(2)(D).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
