		<official-title>To amend title XVIII of the Social Security Act to
		  provide a wage index floor for hospitals and home health agencies located in
		  certain areas under the Medicare Program.</official-title>

		<section id="HDD3C1349753C47E3A96C17DA6452B8EB" section-type="section-one"><enum>1.</enum><header>Floor on Medicare area wage
			 index for hospitals and home health agencies located in certain areas</header>
			<subsection id="H71E009F7EE4940ADAE02A9EB756BF1F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1886(d)(3)(E)
			 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(3)(E)</external-xref>) is amended by adding at
			 the end the following new clause:</text>
				<quoted-block display-inline="no-display-inline" id="H859F22DABF83469FB4403EF9FE7088E4" style="OLC">
					<clause id="H1A402B04990B4F70BE5F8C21E4E4BEEB" indent="up1"><enum>(iii)</enum><header>Fiscal year 2007 floor for
				certain areas</header>
						<subclause id="H2B52C2CDBE59493AA363BDEA7C45006"><enum>(I)</enum><header>In
				general</header><text>Notwithstanding clause (i), in no case shall the area
				wage index for a hospital located in an area described in subclause (II) for
				discharges occurring on or after October 1, 2007, be less than the area wage
				index applicable to such hospital during fiscal year 2007.</text>
						</subclause><subclause id="H213D39C7392742398C008C917DE13927"><enum>(II)</enum><header>Area described</header><text display-inline="yes-display-inline">An area described in this subclause is a
				rural area where at least 65 percent of the wages paid by all subsection (d)
				hospitals located in such area on October 1, 2006, not taking into account
				reclassifications or redesignations under paragraph (8) or (10), is
				attributable to wages paid by one hospital.</text>
						</subclause><subclause id="H95D22A9DB5B04FD9B8F0FC24DA01269F"><enum>(III)</enum><header>Treatment as reclassification for
				budget neutrality</header><text display-inline="yes-display-inline">Subclause
				(I) shall be treated as a decision of the Medicare Geographic Reclassification
				Review Board under paragraph
				(10).</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFF65812A5AC340A1B9C52DBD46244949"><enum>(b)</enum><header>Rural floor for
			 home health agencies located in urban areas</header>
				<paragraph id="H4500663E045B4B07AE31F6F977CCF96E"><enum>(1)</enum><header>In
			 general</header><text>Section 1895(b)(4)(C) of such Act (42 U.S.C.
			 1395fff(b)(4)(C)) is amended by adding at the end the following: <quote>In no
			 case shall the area wage index for a home health agency located in an urban
			 area in New Hampshire be less than the area wage index for a rural area in such
			 State.</quote>.</text>
				</paragraph><paragraph id="HBA34352CDCF745C28ED3883BD2E90080"><enum>(2)</enum><header>Effective
			 date</header><text>The amendment made by paragraph (1) shall apply to payment
			 for episodes and visits ending on or after January 1, 2008.</text>
