		<section display-inline="no-display-inline" id="HDA35C65F800F4A329DDBE0FB00D3F2A1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>MEJA Expansion and Enforcement Act of
			 2007</short-title></quote>.</text>
		</section><section id="HE09C11F95B8F4CE7BEB98523D7224EC1"><enum>2.</enum><header>Legal status of
			 contract personnel</header>
			<subsection id="HE5623E7DAC444359BC99AD9CC70159EE"><enum>(a)</enum><header>Clarification of
			 the Military Extraterritorial Jurisdiction Act</header>
				<paragraph id="H40831BB965DA4E3B97BA899DA0098D7"><enum>(1)</enum><header>Inclusion of
			 contractors</header><text>Subsection (a) of
			 section
			 3261 of title 18, United States Code, is amended—</text>
					<subparagraph id="H73ECF8BA253341ABACEA98D4AEC98740"><enum>(A)</enum><text>by striking
			 <quote>or</quote> at the end of paragraph (1);</text>
					</subparagraph><subparagraph id="HD626CD310D28422F9453ABBD05961DEC"><enum>(B)</enum><text>by striking the
			 comma at the end of paragraph (2) and inserting <quote>; or</quote>; and</text>
					</subparagraph><subparagraph id="H78A7FDDD19434B65A769F983EEFD7C8C"><enum>(C)</enum><text>by inserting after
			 paragraph (2) the following:</text>
						<quoted-block id="HC97ACE74CFDF4CD1AF6280001B86B42C" style="OLC">
							<paragraph id="H39291E63512241A691BB2CF6D9E0C600"><enum>(3)</enum><text display-inline="yes-display-inline">while employed under a contract (or
				subcontract at any tier) awarded by any department or agency of the United
				States, where the work under such contract is carried out in an area, or in
				close proximity to an area (as designated by the Department of Defense), where
				the Armed Forces is conducting a contingency
				operation,</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HB176FC3A0C064D3C991C253B846FF064"><enum>(2)</enum><header>Definition</header><text>Section
			 3267 of title 18, United States Code, is amended by adding at the end the
			 following:</text>
					<quoted-block id="H4F9A41F9A7C64C78822401182FB1CCCF" style="OLC">
						<paragraph id="H6CAD585F21264F010006788000A8204C"><enum>(5)</enum><text>The term
				<term>contingency operation</term> has the meaning given such term in section
				101(a)(13) of title
				10.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H1662926569B1414F998800CCB901BAD0"><enum>(b)</enum><header>Department of
			 Justice Inspector General Report</header>
				<paragraph id="HD4A0DAC9937C44ADBC48F5789B6842A3"><enum>(1)</enum><header>Report
			 required</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Inspector General of the Department of Justice shall submit to
			 Congress a report in accordance with this subsection.</text>
				</paragraph><paragraph id="HF7AB79DCBA074EB99B6434678FB756DF"><enum>(2)</enum><header>Content of
			 report</header><text>The report under
			 <internal-xref idref="HD4A0DAC9937C44ADBC48F5789B6842A3" legis-path="2.(b)(1)">paragraph (1)</internal-xref> shall include—</text>
					<subparagraph id="H4236FB32CB66421300F29437C22C001B"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the status of Department
			 of Justice investigations of alleged violations of
			 section
			 3261 of title 18, United States Code, to have been committed by
			 contract personnel, which shall include—</text>
						<clause id="H478B6D2D86F643DBB61B8F94C014C097"><enum>(i)</enum><text>the
			 number of complaints received by the Department of Justice;</text>
						</clause><clause id="H00F2BA6306624AD8B661C2870784CF23"><enum>(ii)</enum><text>the
			 number of investigations into complaints opened by the Department of
			 Justice;</text>
						</clause><clause id="H683B27C2A8EB47D29FF29EB0F6707F12"><enum>(iii)</enum><text>the number of
			 criminal cases opened by the Department of Justice; and</text>
						</clause><clause id="HFBF7E774A14B422B86483C4449DC00"><enum>(iv)</enum><text>the
			 number and result of criminal cases closed by the Department of Justice;</text>
						</clause></subparagraph><subparagraph id="HE35CBC437D0F4EB7A5D91D00298FC0D1"><enum>(B)</enum><text display-inline="yes-display-inline">findings and recommendations about the
			 number of criminal cases prosecuted by the Department of Justice involving
			 violations of <external-xref legal-doc="usc" parsable-cite="usc/18/3261">section 3261</external-xref> of title 18, United
			 States Code; and</text>
					</subparagraph><subparagraph id="H18EC720F052748F4B8006835BE5DB36D"><enum>(C)</enum><text display-inline="yes-display-inline">with respect to covered contracts where the
			 work under such contracts is carried out in Iraq or Afghanistan—</text>
						<clause id="H47F3F91EFA2E4143BEE12636E948C70"><enum>(i)</enum><text>a
			 list of each charge brought against contractors or contract personnel
			 performing work under such a covered contract, including—</text>
							<subclause id="H963BF0C566BE4D9381006F2EB366A4DE"><enum>(I)</enum><text display-inline="yes-display-inline">a description of the offense with which a
			 contractor or contract personnel were charged; and</text>
							</subclause><subclause id="H38DBDBCE2B96453EB3C4B13B1F2BBECD"><enum>(II)</enum><text>the disposition
			 of such charge; and</text>
							</subclause></clause><clause id="H204CAD76A2FA47F7AF1D06AE760031A3"><enum>(ii)</enum><text display-inline="yes-display-inline">a description of any legal actions taken by
			 the United States Government against contractors or contract personnel as a
			 result of—</text>
							<subclause id="H6ACC95538C9340E8883EA12635EC7F26"><enum>(I)</enum><text>a
			 criminal charge brought against such contractors or contract personnel;
			 or</text>
							</subclause><subclause id="HF4520DF7554A40819E2BACE76DFA9FC"><enum>(II)</enum><text>a
			 complaint received regarding the activities of such contractors or contract
			 personnel.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="HACC60F779CDB449495A8BCC041D7818"><enum>(3)</enum><header>Format of
			 report</header><text>The report under
			 <internal-xref idref="HD4A0DAC9937C44ADBC48F5789B6842A3" legis-path="2.(b)(1)">paragraph (1)</internal-xref> shall be submitted in
			 unclassified format, but may contain a classified annex as appropriate.</text>
				</paragraph></subsection></section><section id="H3AF2144AFE014760852B303737CF8D16"><enum>3.</enum><header>Federal Bureau of
			 Investigation investigative unit for contingency operations</header>
			<subsection display-inline="no-display-inline" id="HFC9B25F40E484BFF8832C55358FDF11E"><enum>(a)</enum><header>Establishment of
			 Theater Investigative Unit</header><text display-inline="yes-display-inline">The Director of the Federal Bureau of
			 Investigation shall ensure that there are adequate personnel through the
			 creation of Theater Investigative Units to investigate allegations of criminal
			 violations of <external-xref legal-doc="usc" parsable-cite="usc/18/3261">section 3261</external-xref> of title 18, United
			 States Code, by contract personnel.</text>
			</subsection><subsection id="H12C7C1EA498C4BC482C2599056EDA6CE"><enum>(b)</enum><header>Responsibilities
			 of Theater Investigative Unit</header><text display-inline="yes-display-inline">The Theater Investigative Unit established
			 for a theater of operations shall—</text>
				<paragraph id="H7C6C04D7C2E8410E83F41C90821E0794"><enum>(1)</enum><text>investigate
			 reports that raise reasonable suspicion of criminal misconduct by contract
			 personnel;</text>
				</paragraph><paragraph id="HCDB9C187BC2544BE8DAFBCE9BC978665"><enum>(2)</enum><text display-inline="yes-display-inline">investigate reports of fatalities resulting
			 from the potentially unlawful use of force by contract personnel; and</text>
				</paragraph><paragraph id="H62AC1BA9A1274E339B431FC7B86E4B01"><enum>(3)</enum><text>upon conclusion of
			 an investigation of alleged criminal misconduct, refer the case to the Attorney
			 General of the United States for further action, as appropriate in the
			 discretion of the Attorney General.</text>
				</paragraph></subsection><subsection id="H9CB9DB0A0D404DE896E8AB870362E621"><enum>(c)</enum><header>Responsibilities
			 of Federal Bureau of Investigation</header>
				<paragraph id="HE85A73CED25F4886A8E01D2001503AE"><enum>(1)</enum><header>Resources</header><text display-inline="yes-display-inline">The Director of the Federal Bureau of
			 Investigation shall ensure that each Theater Investigative Unit has adequate
			 resources and personnel to carry out its responsibilities.</text>
				</paragraph><paragraph id="H9616078CAF2C4B0EB3F3077E0039F284"><enum>(2)</enum><header>Notification</header><text display-inline="yes-display-inline">The Director of the Federal Bureau of
			 Investigation shall notify Congress whenever a Theater Investigative Unit is
			 established or terminated in accordance with this section.</text>
				</paragraph><paragraph id="H7FF1772FB70D41C6BDA162A65AD873"><enum>(3)</enum><header>Security</header><text display-inline="yes-display-inline">The Director of the Federal Bureau of
			 Investigation shall request security assistance from the Secretary of Defense
			 in any case in which a Theater Investigative Unit does not have the resources
			 or is otherwise unable to provide adequate security to ensure the safety of
			 such Unit. The Director may not request or provide for security for a Theater
			 Investigate Unit from any individual or entity other than the Federal Bureau of
			 Investigation or the Secretary of Defense.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HD9EE25349C5C429EBF91E1953DB86734"><enum>(d)</enum><header>Assistance on
			 request of Attorney General</header><text>In consultation with the Director of
			 the Federal Bureau of Investigation, the Attorney General may request
			 assistance from the Secretary of State, the Secretary of Defense, the Secretary
			 of Homeland Security, or the head of any other Executive agency,
			 notwithstanding any statute, rule, or regulation to the contrary, including the
			 assignment of additional personnel and resources to a Theater Investigative
			 Unit.</text>
			</subsection><subsection id="HE760F2FB1C06447182894E4BAAA98077"><enum>(e)</enum><header>Annual
			 report</header><text display-inline="yes-display-inline">Not later than one
			 year after the date on which the Director of the Federal Bureau of
			 Investigation ensures compliance with the provisions of this Act pursuant to
			 section 5(c), and annually thereafter, the Director of the Federal Bureau of
			 Investigation shall submit to Congress a report containing—</text>
				<paragraph id="H4A371F589B9C4CA690C362F5CC539347"><enum>(1)</enum><text display-inline="yes-display-inline">the number of reports received by Theater
			 Investigative Units relating to suspected criminal misconduct by contractors or
			 contract personnel;</text>
				</paragraph><paragraph id="H2D0AC4BFB25D4E90929BA1E3B54E51F"><enum>(2)</enum><text>the number of
			 reports received by Theater Investigative Units relating to fatalities
			 resulting from the use of force by contractors or contract personnel;</text>
				</paragraph><paragraph id="H0B7965022B6A4157965136009061ACC8"><enum>(3)</enum><text>the number of
			 cases referred by Theater Investigative Units to the Attorney General for
			 further investigation or other action; and</text>
				</paragraph><paragraph id="HE07AAA076E774E96A221BBB868E97E6"><enum>(4)</enum><text>any recommended
			 changes to Federal law that the Director considers necessary to perform the
			 duties of the Director under this Act.</text>
				</paragraph></subsection></section><section id="H623967B222E1430BBB494371D26619D8"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H564756565225476E96E5AD007598E8E6"><enum>(1)</enum><header>Covered
			 contract</header><text>The term <term>covered contract</term> means an
			 agreement—</text>
				<subparagraph id="HBC738C50FDBD4266AF1C42A1A47CE34F"><enum>(A)</enum><text display-inline="yes-display-inline">that is—</text>
					<clause id="H0CA32B77A6E74DD59FDAB7D875E207A4"><enum>(i)</enum><text>a
			 prime contract awarded by an agency;</text>
					</clause><clause id="HC82CB268891E49ACB9BB0B214B20009"><enum>(ii)</enum><text display-inline="yes-display-inline">a subcontract at any tier under any prime
			 contract awarded by an agency; or</text>
					</clause><clause id="HBD09DF47916841B9B93CC390788134D"><enum>(iii)</enum><text display-inline="yes-display-inline">a task order issued under a task or
			 delivery order contract entered into by an agency; and</text>
					</clause></subparagraph><subparagraph id="HAADF983CE6DD480C97CB90F207A93AD"><enum>(B)</enum><text display-inline="yes-display-inline">according to which the work under such
			 contract, subcontract, or task order is carried out in a region outside the
			 United States in which the Armed Forces are conducting a contingency
			 operation.</text>
				</subparagraph></paragraph><paragraph id="H4E46A93618FE4053A1CFA67B4342F451"><enum>(2)</enum><header>Agency</header><text>The
			 term <term>agency</term> has the meaning given the term <term>Executive
			 agency</term> in <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5, United States
			 Code.</text>
			</paragraph><paragraph id="H361218E534DD49EAB26E68FA1603B21"><enum>(3)</enum><header>Contingency
			 operation</header><text>The term <term>contingency operation</term> has the
			 meaning given the term
			 section
			 101(13) of title 10, United States Code.</text>
			</paragraph><paragraph id="HA81BE97B3C3D4787822BF7FF7394E8D"><enum>(4)</enum><header>Contractor</header><text>The
			 term <term>contractor</term> means an entity performing a covered
			 contract.</text>
			</paragraph><paragraph id="H3356277D3600468FBFBB7E86CA9CB63B"><enum>(5)</enum><header>Contract
			 personnel</header><text>The term <term>contract personnel</term> means persons
			 assigned by a contractor (including subcontractors at any tier) to perform work
			 under a covered contract.</text>
			</paragraph></section><section id="H3AA4F5BF4B27424FA7CAC7DA5A71416"><enum>5.</enum><header>Effective
			 date</header>
			<subsection id="H86CAECF1BD5948EEA50007767D748736"><enum>(a)</enum><header>Applicability</header><text display-inline="yes-display-inline">The provisions of this Act shall apply to
			 all covered contracts and all covered contract personnel in which the work
			 under the contract is carried out in an area, or in close proximity to an area
			 (as designated by the Department of Defense), where the Armed Forces is
			 conducting a contingency operation on or after the date of the enactment of
			 this Act.</text>
			</subsection><subsection id="HCFFE01876E7C4CD383B64032DAA9E3BB"><enum>(b)</enum><header>Immediate
			 effectiveness</header><text>The provisions of this Act shall enter into effect
			 immediately upon the enactment of this Act.</text>
			</subsection><subsection id="H05ED953758964AEDA6DB994B94E54085"><enum>(c)</enum><header>Implementation</header><text>With
			 respect to covered contracts and covered contract personnel discussed in
			 subsection (a)(1), the Director of the Federal Bureau of Investigation, and the
			 head of any other agency to which this Act applies, shall have 90 days after
			 the date of the enactment of this Act to ensure compliance with the provisions
			 of this Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="HA608F6299C674388A3C6D6E414424B2E" section-type="subsequent-section"><enum>6.</enum><header>Rule of
			 construction</header><text display-inline="no-display-inline">Nothing in this
			 Act shall be construed to affect intelligence activities that are otherwise
			 permissible prior to the enactment of this Act.</text>
