		<official-title>To amend title 18, United States Code, to improve the
		  provisions relating to the carrying of concealed weapons by law enforcement
		  officers, and for other purposes.</official-title>

		<section id="H21C60BEA53B94EEDAADE475CBF264168" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Law Enforcement Officers Safety Act of
			 2007</short-title></quote>.</text>
		</section><section id="H2FBC933E5992418AB19F4F75EBE8D3DB"><enum>2.</enum><header>Amendments to law
			 enforcement officer safety provisions of title 18</header>
			<subsection id="H50BD5917518141AE8FD676C406D79733"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/926B">Section 926B</external-xref> of title 18, United States Code, is
			 amended—</text>
				<paragraph id="H20775D02C3F049AE00DE469F4127B420"><enum>(1)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="H77819E0F590041158E003DFA4FBEAA00"><enum>(A)</enum><text>in paragraph (1),
			 by inserting <quote>(or apprehension)</quote> after <quote>arrest</quote>;
			 and</text>
					</subparagraph><subparagraph id="HAFEE7E9C4E4743E0A3B9C59B75C3EF47"><enum>(B)</enum><text>in paragraph (3),
			 by inserting <quote>which could result in suspension or loss of police
			 powers</quote> before the semicolon;</text>
					</subparagraph></paragraph><paragraph id="HA88BDF9DCE5245F1B0E39694C03716B6"><enum>(2)</enum><text>by striking
			 subsection (e) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC19E1B5F3C994860AB9FA12530AB00A8" style="OLC">
						<subsection id="H0C0638C8AD8B48E086D2F3FFDE1E045"><enum>(e)</enum><text display-inline="yes-display-inline">As used in this section, the term ‘firearm’
				has the same meaning as defined in section 921 of this title and is deemed to
				include ammunition and accessories the possession of which is not expressly
				prohibited by Federal law, or which are not subject to the provisions of the
				National Firearms Act, but does not include—</text>
							<paragraph id="H84121C029D77423D90171734ABB34B48"><enum>(1)</enum><text display-inline="yes-display-inline">any machinegun (as defined in section 5845
				of the National Firearms Act);</text>
							</paragraph><paragraph id="HC1249B161FC841EBA5A900E02BA85ED3"><enum>(2)</enum><text display-inline="yes-display-inline">any firearm silencer (as defined in section
				921 of this title); or</text>
							</paragraph><paragraph id="H1CB4E638602F40F782E5EC8900EDC15C"><enum>(3)</enum><text display-inline="yes-display-inline">any destructive device (as defined in
				section 921 of this title).</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HC7568BEB65E64508B59EC12F0300A3E5"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HCFB924A167E24A7284A8B491AFAE4032" style="OLC">
						<subsection id="H3738E4936DDF4B66A454FB5E75D0BDF8"><enum>(f)</enum><text>For purposes of
				this section, a law enforcement officer of the Amtrak Police Department or a
				law enforcement or police officer of the executive branch of the Federal
				Government qualifies as an employee of a governmental agency who is authorized
				by law to engage in or supervise the prevention, detection, investigation, or
				prosecution of, or the incarceration of any person for, any violation of law,
				and has statutory powers of arrest (or
				apprehension).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H982095BDBB6743A6AE00D9EAED8D5EF9"><enum>(b)</enum><header>Retired law
			 enforcement officers</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/926C">Section 926C</external-xref> of title 18, United States
			 Code, is amended—</text>
				<paragraph id="H68CCAB14A27947BA8E93E6C4438EB1E3"><enum>(1)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="H08B14C8E595B4EAF8577641334AA05BE"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>retired in good standing from service with a public
			 agency</quote> and inserting <quote>departed in good standing from service with
			 a public agency after completing an aggregate of at least 15 years of service
			 with the agency</quote>;</text>
					</subparagraph><subparagraph id="H855797F8AA594196BCF5FED72FF69ED"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text>
						<clause id="HC10F5BAD5E114AEB99C6D0E429291F"><enum>(i)</enum><text>by
			 striking <quote>retirement</quote> and inserting <quote>departure</quote> ;
			 and</text>
						</clause><clause id="H5C51D435BFA74E138D7731D95E55CAD"><enum>(ii)</enum><text>by
			 inserting <quote>(or apprehension)</quote> after <quote>arrest</quote>;</text>
						</clause></subparagraph><subparagraph id="H091B2D7777794F62B1B279363E2CFD0"><enum>(C)</enum><text>by striking
			 paragraphs (4) and (5) and inserting the following:</text>
						<quoted-block id="HFC62B827F9A04383001F3613A937A945" style="OLC">
							<paragraph id="H9798E44208714363B2FDB8466C24B2C"><enum>(4)</enum><text>during the most
				recent 12-month period, has met, at the expense of the individual, the
				standards for qualification in firearms training for active law enforcement
				officers as set by the officer’s former agency, the State in which the officer
				resides or a law enforcement agency within the State in which the officer
				resides;</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H56E12F7DADF34959AEE8DD6509BA00C6"><enum>(D)</enum><text>by redesignating
			 paragraphs (6) and (7) as paragraphs (5) and (6), respectively;</text>
					</subparagraph></paragraph><paragraph id="H042F91D3DF4E4CD09164D057F0140362"><enum>(2)</enum><text>in subsection
			 (d)—</text>
					<subparagraph id="HB87178C8D665480DA294025575302F71"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>to meet the standards established by the agency for training
			 and qualification for active law enforcement officers to carry a firearm of the
			 same type as the concealed firearm; or</quote> and inserting <quote>to meet the
			 active duty standards for qualification in firearms training as established by
			 the agency to carry a firearm of the same type as the concealed firearm
			 or</quote>; and</text>
					</subparagraph><subparagraph id="H0F92158AAABD4DFDA609F07B6969F1F3"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)(B), by striking
			 <quote>otherwise found by the State to meet the standards established by the
			 State for training and qualification for active law enforcement officers to
			 carry a firearm of the same type as the concealed firearm.</quote> and
			 inserting</text>
						<quoted-block display-inline="yes-display-inline" id="H5B4BA647F3F64F899F467540939EDB30" style="OLC">
							<text>otherwise found by the State or a
			 certified firearms instructor that is qualified to conduct a firearms
			 qualification test for active duty officers within that State to have
			 met—</text><clause id="H52A9E724A1494B3BA453811EBAFF7DE8" indent="up2"><enum>(i)</enum><text>the active duty standards for
				qualification in firearms training as established by the State to carry a
				firearm of the same type as the concealed firearm; or</text>
							</clause><clause id="H36FC50E7BFED490CA1D040A33208641B" indent="up2"><enum>(ii)</enum><text>if the State has not established such
				standards, standards set by any law enforcement agency within that State to
				carry a firearm of the same type as the concealed
				firearm.</text>
							</clause><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H9C152375CE2C4FA48307C9284299DD43"><enum>(3)</enum><text>by striking
			 subsection (e) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HD96D70B0496F4F64B1EBAC1B397CC8F9" style="OLC">
						<subsection id="H9090AA8305644ACFA9BDA0FD9CDAEDF7"><enum>(e)</enum><text>As used in this
				section, the term ‘firearm’ has the same meaning as defined in section 921 of
				this title and is deemed to include ammunition and accessories the possession
				of which is not expressly prohibited by Federal law, or which are not subject
				to the provisions of the National Firearms Act, but does not include—</text>
							<paragraph id="H96FCB4AF2335422A8ED000B77E88F5C3"><enum>(1)</enum><text display-inline="yes-display-inline">any machinegun (as defined in section 5845
				of the National Firearms Act);</text>
							</paragraph><paragraph id="H49BBBEEC5E3C4BF5B17371E15E6C089C"><enum>(2)</enum><text display-inline="yes-display-inline">any firearm silencer (as defined in section
				921 of this title); or</text>
							</paragraph><paragraph id="H03532A5E12C04DB4AFCCE6048E0D98E"><enum>(3)</enum><text display-inline="yes-display-inline">any destructive device (as defined in
				section 921 of this title).</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HC64400D35FE54A438C00893D296B1B00"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H64180EC1C4D64A1C9E00002590F52B41" style="OLC">
						<subsection id="H52D41BAA0E6943E7A8A77399A0C8E04B"><enum>(f)</enum><text>In this section,
				the term <term>service with a public agency as a law enforcement officer</term>
				includes service as a law enforcement officer of the Amtrak Police Department
				or as a law enforcement or police officer of the executive branch of the
				Federal
				Government.</text>
