		<official-title>To require the Federal Communications Commission to adopt
		  regulations to protect subscribers to Internet protocol telephone services
		  concerning the use of such services with alarm, security, and personal
		  emergency response systems.</official-title>

		<section id="H813675CB358646DC8D5D28F60030ACAF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Alarm Customer VOIP Notification Act
			 of 2007</short-title></quote>.</text>
		</section><section id="H5CC9A597E8D44B998B4C5390E3D43098"><enum>2.</enum><header>Regulations
			 required</header>
			<subsection id="H531264FAAC924618ADFE39A9F42D9EA5"><enum>(a)</enum><header>Commission
			 Proceeding Required</header><text display-inline="yes-display-inline">Within 45
			 days after the date of enactment of this Act, the Federal Communications
			 Commission shall commence a rulemaking to adopt regulations that will protect
			 subscribers to VOIP services who utilize alarm, security, or personal emergency
			 response systems in conjunction with VOIP services.</text>
			</subsection><subsection id="H54AC4B23651B445FB8228771CF56A1D9"><enum>(b)</enum><header>Minimum Contents
			 of Regulations</header><text display-inline="yes-display-inline">The rules
			 required by this section shall ensure that subscribers to VOIP service are
			 informed by clear and conspicuous disclosure by a VOIP service provider and by
			 a manufacturer of VOIP equipment in all sales and instructional materials, and
			 again before installation or number activation, of the steps the subscribers
			 need to take to maintain the proper functioning of any alarm, security, or
			 personal emergency response system that the subscriber intends to utilize in
			 conjunction with VOIP service to provide monitoring services. Such steps shall
			 include that each such customer should—</text>
				<paragraph id="H4A7446AC8CD340DEA30080A7D23BB74F"><enum>(1)</enum><text>arrange with his
			 or her emergency response system provider, if any, to test such system after
			 installation;</text>
				</paragraph><paragraph id="H65CF7BD4EEDA4AE399231B388E0330A5"><enum>(2)</enum><text>notify his or her
			 emergency response system provider as soon as the VOIP service is installed;
			 and</text>
				</paragraph><paragraph id="H39E1DE5893154D9EB1B23CE89811DB89"><enum>(3)</enum><text>maintain a 24-hour
			 battery backup for customer premises equipment installed in connection with the
			 VOIP service in order for the signaling of such system to function in the event
			 of a power outage.</text>
				</paragraph></subsection><subsection id="H69827775FE9E4F4681DC0200B718477C"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section:</text>
				<paragraph id="HC7E1BCB7D54342DBB3E71529C223CE6"><enum>(1)</enum><header>VOIP
			 service</header><text>The term <term>VOIP service</term> means a service
			 that—</text>
					<subparagraph id="H8C013F17502941C200329D1B76ACEDB2"><enum>(A)</enum><text>provides real-time
			 voice communications transmitted through end user equipment using Internet
			 protocol, or a successor protocol, for a fee or without a fee;</text>
					</subparagraph><subparagraph id="H677E12F8A2754BAAAB1370DE82F6CB28"><enum>(B)</enum><text>is offered to the
			 public, or such classes of users as to be effectively available to the public
			 (whether part of a bundle of services or separately); and</text>
					</subparagraph><subparagraph id="H6016D8E3F26546F4B59446683ED11911"><enum>(C)</enum><text>has the capability
			 to originate traffic to, or terminate traffic from, the public switched
			 telephone network.</text>
					</subparagraph></paragraph><paragraph id="HC6A2D7F182704733AE2437D0F5A5B486"><enum>(2)</enum><header>Emergency
			 response system</header><text display-inline="yes-display-inline">The term
			 <term>emergency response system</term> means an alarm or security system, or
			 personal security or medical monitoring system, that is connected to an
			 emergency response center by means of a telecommunications carrier or VOIP
			 service provider.</text>
				</paragraph><paragraph id="H2019B66C015E47B5B83742A64841F4E5"><enum>(3)</enum><header>Emergency
			 response center</header><text display-inline="yes-display-inline">The term
			 <term>emergency response center</term> means an entity that monitors
			 transmissions from an emergency response system.</text>
				</paragraph></subsection></section></legis-body>
