			 Management Accounts</header>
			<section id="H7217DA0A15BB4D9D8B8C418151C96F38"><enum>101.</enum><header>Adjusted gross
			 income limitation</header><text display-inline="no-display-inline">Section
			 1001D(b) of the Farm Security Act of 1985 is amended by adding at the end the
			 following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H76F728EA485941FB00107D18678E0042" style="OLC">
					<paragraph id="H6AAFAA764CA24368A022DA903CB7FAFD"><enum>(3)</enum><header>Further
				limitations on payments</header><text display-inline="yes-display-inline">After
				2007, notwithstanding any other provision of law, an individual or entity shall
				not be eligible to receive any direct, counter-cyclical or transition payment
				under any provision of law administered by the Department of Agriculture if the
				average adjusted gross income of the individual or entity exceeds $200,000. For
				purposes of this
				paragraph,</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HE8B53E6E06424772AC4E33B5B808687"><enum>102.</enum><header>Risk management
			 accounts</header>
				<subsection id="H7EF0BA8368EB4E9397329DB907DC9881"><enum>(a)</enum><header>Accounts
			 required</header><text>The Secretary shall offer to enter into a risk
			 management account contract with an operator of a farm.</text>
				</subsection><subsection id="HA50F066D038145539699CC29FDC0C9B1"><enum>(b)</enum><header>Operator</header><text>For
			 the purposes of this section, an operator means an individual or entity
			 that—</text>
					<paragraph id="HD61CCE642E554E34B741004489F1C7DC"><enum>(1)</enum><text display-inline="yes-display-inline">either—</text>
						<subparagraph id="H618EC4EBFE7543CA88C2D8DE9596FA65"><enum>(A)</enum><text>during each of the
			 preceding 5 taxable years, filed a schedule F of the Federal income tax returns
			 or a comparable tax form related to the agricultural operations of the
			 individual or entity, as approved by the Secretary; or</text>
						</subparagraph><subparagraph id="H931F33EFDBD24E5CA7996D452E042F9C"><enum>(B)</enum><text display-inline="yes-display-inline">is a beginning farmer or rancher, as
			 determined by the Secretary; and</text>
						</subparagraph></paragraph><paragraph id="HE575CDD09FD641C1BB278D8121E53D33"><enum>(2)</enum><text>earned—</text>
						<subparagraph id="HA90E37463F9D47B58F157F4FFF9B0092"><enum>(A)</enum><text>at least $10,000
			 in average adjusted gross revenue for the preceding 5 taxable years;</text>
						</subparagraph><subparagraph id="H9245E6CA3BCB4CF9B82DD1BA88952511"><enum>(B)</enum><text>less than such
			 amount, but is a limited resource farmer or rancher, as determined by the
			 Secretary; or</text>
						</subparagraph><subparagraph id="HDF6B11A3420F43189F4D1DB0ABC5EA79"><enum>(C)</enum><text display-inline="yes-display-inline">at least $10,000 in estimated income from
			 all agricultural operations for the applicable year, as determined by the
			 Secretary, and is a beginning farmer or rancher under paragraph (1)(B).</text>
						</subparagraph></paragraph></subsection><subsection id="HA66EA8EC1B214E71852BDD060960E31C"><enum>(c)</enum><header>Farm</header><text>For
			 the purposes of this section, a farm is land used for production of crops,
			 livestock and other agricultural products of which the operator has more than
			 de-minimis control or ownership.</text>
				</subsection><subsection id="HB94B7CF1FB6E4894BE5E989E109E7700"><enum>(d)</enum><header>Adjusted gross
			 revenue</header><text display-inline="yes-display-inline">In this section, the
			 term <term>adjusted gross revenue</term> means the adjusted gross income as
			 determined by the Secretary, from the sale of agricultural crops grown, dairy
			 products produced, and livestock raised as part of an agricultural
			 operation—</text>
					<paragraph id="H104CDBB35B814A788C27E0EE48987E66"><enum>(1)</enum><text>by taking into
			 account gross receipts from the sale of agricultural crops, eligible livestock
			 and dairy products on the agricultural operation, including insurance
			 indemnities;</text>
					</paragraph><paragraph id="H2DA3F84ECFD14F17BC5DA6421291F71"><enum>(2)</enum><text>by
			 including all farm payments paid by the Secretary or any other government
			 entity for the agricultural operation related to agricultural crops, eligible
			 livestock and dairy products;</text>
					</paragraph><paragraph id="HC53AC2AB1C354FA4B0B95763C4C5B2AA"><enum>(3)</enum><text>by deducting the
			 cost or basis of livestock or other items purchased for resale, such as feeder
			 livestock, on the agricultural operation;</text>
					</paragraph><paragraph id="H4E92B117192A44E7A7336D02BCDDC6B6"><enum>(4)</enum><text>by excluding
			 revenues that do not arise from the sale of crops grown, dairy products
			 produced or livestock raised on an agricultural operation, such as revenues
			 associated with the packaging, merchandising, marketing and reprocessing of the
			 agricultural product beyond that typically undertaken by a producer of the
			 crop, dairy products or livestock as determined by the Secretary;</text>
					</paragraph><paragraph id="HAB92923634264B2A8B87512E96593F6D"><enum>(5)</enum><text>by using with such
			 adjustments, additions and additional documentation as the Secretary determines
			 is appropriate, information presented on—</text>
						<subparagraph id="HADF778243DC84FBBABC3B13661C2BBAA"><enum>(A)</enum><text>a schedule F of
			 the Federal income tax returns of the producer; or</text>
						</subparagraph><subparagraph id="HC770C067DEAD4C198EE2013FB3BAFBE2"><enum>(B)</enum><text>a comparable tax
			 form related to the agricultural operations of the producer, as approved by the
			 Secretary.</text>
						</subparagraph></paragraph></subsection><subsection id="H3EC188DC8C6E4D14BC63656CB6F200D6"><enum>(e)</enum><header>Average adjusted
			 gross revenue</header><text display-inline="yes-display-inline">In this
			 section, the term <term>average adjusted gross revenue</term> means—</text>
					<paragraph id="H6C7CC275C25144D1BF4F839E09756828"><enum>(1)</enum><text>the rolling
			 average of the adjusted gross revenue of a producer for each of the preceding 5
			 taxable years; or</text>
					</paragraph><paragraph id="H6B412654DFC14BD4BFC374D64D1E96EE"><enum>(2)</enum><text>in the case of a
			 beginning farmer or rancher or other agricultural operation that does not have
			 adjusted gross revenue for each of the preceding 5 taxable years, the estimated
			 income of the agricultural operation for the applicable year, as determined by
			 the Secretary.</text>
					</paragraph></subsection><subsection id="H7B66A2BC8E824FD3AE3041BE8DBB87B8"><enum>(f)</enum><header>Establishment</header><text>Any
			 operator of a farm may establish a risk management account in the name of the
			 farm to be jointly administered by the Secretary and the Federal Retirement
			 Thrift Investment Board.</text>
				</subsection><subsection id="H7E9B507FB1E8414500622C956F01E003"><enum>(g)</enum><header>Voluntary
			 contributions</header><text>An operator of a farm may make voluntary
			 contributions up to the limits specified in section 219(b)(5)(A) of the
			 Internal Revenue Code of 1986.</text>
				</subsection><subsection id="H06CDD7FEDD3E44B58BC9EB00867153C3"><enum>(h)</enum><header>Withdrawals</header><text>An
			 operator who establishes an account may withdraw funds under following
			 conditions and amounts:</text>
					<paragraph id="H0EA8609DE09A4F5BBFF3BC02E93297F8"><enum>(1)</enum><text>In a year when the
			 farm’s adjusted gross revenue is less than 95 percent of the five-year average
			 adjusted gross revenue, the producer may withdraw funds up to the amount of the
			 difference.</text>
					</paragraph><paragraph id="HFD712F631E974A5FAF6D8F3995D8F5C7"><enum>(2)</enum><text>Up to 10 percent
			 of the account balance for investments in rural enterprises that contribute to
			 the agricultural economy, as defined by the Secretary, no more than once in any
			 five-year period.</text>
					</paragraph><paragraph id="HA953567D4D5C4A1986357BA611CB861B"><enum>(3)</enum><text>When withdrawals
			 are necessary to protect the solvency of the farm, as determined by the
			 Secretary.</text>
					</paragraph><paragraph id="HAB1A659A6E624E2FA42B6DF2ACDC76BE"><enum>(4)</enum><text>To purchase
			 revenue or crop insurance.</text>
					</paragraph></subsection><subsection id="H8B3D21F73A5F4AC4A3B4B164F3CEA6A3"><enum>(i)</enum><header>Limitation</header><text>Payments
			 to an account created under this section shall be made in the interest of the
			 farm.</text>
				</subsection><subsection id="H02FA91F4EEDD478EB6ED1742A4D95C24"><enum>(j)</enum><header>Tax
			 treatment</header><text>Contributions shall not be subject to Federal income
			 tax, except that withdrawals will be counted toward the gross income of the
			 producer in the year withdrawn.</text>
				</subsection><subsection id="HBAA901BA30B74345B329F871A9DAAE06"><enum>(k)</enum><header>Violations</header><text>If
			 an operator fails to meet the conditions established for a contribution to an
			 account, the operator shall refund to the Secretary an amount equal to the
			 contribution in any fiscal year in which a violation occurred.</text>
				</subsection><subsection id="H7CE6ED98B726410D00005EA9C747B795"><enum>(l)</enum><header>Sale or
			 transfer</header><text>If an operator sells or transfers a farm, the operator
			 may elect to—</text>
					<paragraph id="HE6B04DA05BC049C6882754993BF46729"><enum>(1)</enum><text>transfer all or a
			 portion of the account to another farm in which the operator has a controlling
			 ownership interest or acquires a controlling ownership interest within two
			 years of the sale or transfer of the original agricultural operation;</text>
					</paragraph><paragraph id="H5F38E403D4A14D5598E29B2275058137"><enum>(2)</enum><text>transfer the
			 account to the purchaser of the farm if the operator is not already a holder of
			 a account; or</text>
					</paragraph><paragraph id="H5D7528AE549A42D39C4649D1098446F2"><enum>(3)</enum><text>rollover the
			 account into an Individual Retirement Account pursuant to section 408 of the
			 Internal Revenue Code of 1986 of the operator, if the operator is a natural
			 person, or, if the operator is an entity, into the accounts of any natural
			 person who has a substantial beneficial interest in the farm that is the
			 subject of the account.</text>
					</paragraph></subsection><subsection id="HFB2C540EEE6344A4B2DA64DCA023D09C"><enum>(m)</enum><header>Conservation
			 compliance</header><text>Any operator and any holder of a beneficial interest
			 in a farm subject to an account shall—</text>
					<paragraph id="HAC59B499AACC4F85BC47FFB9D3384F36"><enum>(1)</enum><text>comply with
			 applicable conservation requirements under subtitle B of title XII of the Food
			 Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3811">16 U.S.C. 3811 et seq.</external-xref>); and</text>
					</paragraph><paragraph id="H8B0790CDDAD5424CA24302001E56C7E2"><enum>(2)</enum><text>comply with
			 applicable wetland conservation requirements under subtitle C of title XII of
			 that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3821">16 U.S.C. 3821 et seq.</external-xref>).</text>
					</paragraph></subsection></section><section id="HDED3DAA42E6C4ACEAABDC5951512CC19"><enum>103.</enum><header>Direct
			 payments</header>
				<subsection id="H20E0CADC62DC4815A46BBE43B8DD1E9B"><enum>(a)</enum><header>In
			 general</header><text>Section 1103 of the Farm Security and Rural Investment
			 Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/7913">7 U.S.C. 7913</external-xref>) is amended by striking <quote>2007</quote> each
			 place it appears and inserting <quote>2012</quote>.</text>
				</subsection><subsection id="H290C9D8DF71142CF004788421E9E3F15"><enum>(b)</enum><header>Reduction in
			 direct payment amounts</header><text display-inline="yes-display-inline">Notwithstanding subsection (c) of section
			 1103 of the Farm Security and Rural Investment Act of 2002, producers otherwise
			 eligible for direct payments under such section shall receive—</text>
					<paragraph id="HDC1A3564BF6B49A5B52033E19CA3B917"><enum>(1)</enum><text>65 percent of
			 their direct payment for fiscal year 2008;</text>
					</paragraph><paragraph id="H20ECB097F968476800C7081DDBF53D9F"><enum>(2)</enum><text display-inline="yes-display-inline">45 percent of their direct payment for
			 fiscal year 2009;</text>
					</paragraph><paragraph id="HC5C11AAA7EC44D0C938398E6935C6B00"><enum>(3)</enum><text display-inline="yes-display-inline">25 percent of their direct payment for
			 fiscal year 2010;</text>
					</paragraph><paragraph id="HA9A0BF711F044EB4B3CFD45068FCBC9C"><enum>(4)</enum><text display-inline="yes-display-inline">20 percent of their direct payment for
			 fiscal year 2011; and</text>
					</paragraph><paragraph id="H1B9F1AD50ED64F3DA2AD68F6FCF95180"><enum>(5)</enum><text display-inline="yes-display-inline">10 percent of their direct payment for
			 fiscal years 2012 through 2014.</text>
					</paragraph></subsection><subsection id="HE05C4D82B1BB474C9B6F0000302B37EC"><enum>(c)</enum><header>Payment
			 limit</header><text>Section 1001(b)(1) of the Food Security of 1985 (7 U.S.C.
			 1308) is amended by striking <quote>$40,000</quote> and insert
			 <quote>$30,000</quote>.</text>
				</subsection><subsection id="H2F0C3BEE51734E2D8CEE64FC13A9AA7B"><enum>(d)</enum><header>Planting
			 restrictions</header><text display-inline="yes-display-inline">Section
			 1105(a)(1)(C) and section 1106 of the Farm Security and Rural Investment Act of
			 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/7915">7 U.S.C. 7915(a)(1)(C)</external-xref>, 7916) are repealed.</text>
				</subsection><subsection id="HFD8C31802A1048E488B2A859B2B12333"><enum>(e)</enum><header>Additional
			 eligibility requirement</header><text display-inline="yes-display-inline">Section 1103(a) of the Farm Security and
			 Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/7913">7 U.S.C. 7913(a)</external-xref>) is amended by inserting at the
			 end the following new sentence: <quote>To be eligible to receive a direct
			 payment under this section, a producer must be actively engaged in agriculture
			 on the land for which the direct payment is paid, as determined by the
			 Secretary.</quote>.</text>
				</subsection><subsection id="H0CFDD7DE3D8B4477007BD92B0487CED9"><enum>(f)</enum><header>Contribution to
			 account</header><text>Section 1103 of the Farm Security and Rural Investment
			 Act of 2002 is amended by adding at the end the following new
			 subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HC5DE96E537514CA7806064CB59E3FCC" style="OLC">
						<subsection id="HD02BA11126D94FF6A1DC106DDB85A149"><enum>(d)</enum><header>Contributions to
				risk management account</header><text display-inline="yes-display-inline">50
				percent of the direct payments of a producer in fiscal years 2008 and 2009
				shall be deposited in the risk management account of the producer, 75 percent
				of the direct payments of a producer for fiscal years 2010 and 2011 shall be
				deposited in the risk management account of the producer, and 100 percent of
				the direct payments of a producer for fiscal year 2012 shall be deposited in
				the risk management account of the
				producer.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H9D6B87F8709A4876BDEAE3C1045CD300"><enum>(g)</enum><header>Stewardship</header><text>Section
			 1103 of Farm Security and Rural Investment Act of 2002 is amended by inserting
			 after subsection (d), as added by subsection (f), the following new
			 subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H24DA78A58A564EC8AA3D699D89291500" style="OLC">
						<subsection id="H20B7EC9461A74D7985005E284ED510AA"><enum>(e)</enum><header>Environmental
				stewardship</header><text>Direct payments shall be linked to environmental
				stewardship as follows:</text>
							<paragraph id="H2979AEE0639249BBB34000A6D500AFC3"><enum>(1)</enum><text>The Secretary,
				acting through the Chief of the Natural Resources Conservation Service, shall
				develop an index of environmental performance, to be linked to management
				intensity and significant resource concerns, for the each of the crops provided
				a direct payment under this section.</text>
							</paragraph><paragraph id="HF13B8CBF23F84B62B623A6E1D0870197"><enum>(2)</enum><text>To be eligible for
				a direct payment linked to stewardship, an individual or entity shall develop a
				plan that describes the level of stewardship to be achieved and the
				conversation practices or measures to be implemented. The individual or entity
				shall certify environmental performance through a qualified third-party.</text>
							</paragraph><paragraph id="H2D46667BBC4C4933A8EDDC0019A0B3B"><enum>(3)</enum><text>Subject to the
				percentage restrictions on direct payment amounts imposed by section 102(b) of
				the <short-title>Food and Agriculture Risk Management for
				the 21st Century Act of 2007</short-title>, 85 percent of the available direct
				payment shall be provided so long as the agricultural producer meets the
				conservation requirements of subtitles B and C of title XII of the Food
				Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3811">16 U.S.C. 3811 et seq.</external-xref>).</text>
							</paragraph><paragraph id="HDD456907C85F4596809322D106E91BB2"><enum>(4)</enum><text display-inline="yes-display-inline">Subject to the percentage restrictions on
				direct payment amounts imposed by section 102(b) of the
				<short-title>Food and Agriculture Risk Management for the
				21st Century Act of 2007</short-title>, 90 percent of the available direct
				payment shall be provided so long as the agricultural producers meet the first
				level of environmental performance, as determined by the index of environmental
				performance.</text>
							</paragraph><paragraph id="HE77437E6B41C432E936DAF2E47D113D2"><enum>(5)</enum><text display-inline="yes-display-inline">Subject to the percentage restrictions on
				direct payment amounts imposed by section 102(b) of the
				<short-title>Food and Agriculture Risk Management for the
				21st Century Act of 2007</short-title>, 95 percent of the available direct
				payment shall be provided so long as the agricultural producers meet the second
				level of environmental performance, as determined by the index of environmental
				performance.</text>
							</paragraph><paragraph id="H17513017D33D4563A34CA3D457CA0056"><enum>(6)</enum><text display-inline="yes-display-inline">Subject to the percentage restrictions on
				direct payment amounts imposed by section 102(b) of the
				<short-title>Food and Agriculture Risk Management for the
				21st Century Act of 2007</short-title>, 100 percent of the available direct
				payment shall be provided so long as the agricultural producers meet the third
				level of environmental performance, as determined by the index of environmental
				performance.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HACB04BB96E4346A68EBA1B5839A7E6A1"><enum>104.</enum><header>Counter-cyclical
			 payments</header>
				<subsection id="H474A8598C6FF4C8F9DD5002E52A87C1D"><enum>(a)</enum><header>One-year
			 extension</header><text display-inline="yes-display-inline">Section 1104 of the
			 Farm Security and Rural Investment Act of 2002 is amended by striking
			 <quote>2007</quote> each place it appears and inserting
			 <quote>2008</quote>.</text>
				</subsection><subsection id="H9B60A20769E2486990C8B84B42CE0026"><enum>(b)</enum><header>Relation to
			 other changes made by this Act</header><text display-inline="yes-display-inline">Counter-cyclical payments described in
			 section 1104 of the Farm Security and Rural Investment Act of 2002 for the 2007
			 and 2008 crop years are to be calculated under such section without regard to
			 the changes made by section 103 with regard to direct payments or the repeal of
			 other commodity programs under section 106. Under no circumstances may
			 counter-cyclical payments be made for the 2011 or subsequent crop years.</text>
				</subsection></section><section id="HFBC2FA54A2B14F39B98EDBC4E8CEEAAB"><enum>105.</enum><header>Dairy</header>
				<subsection id="H04BABE41F2C7432EB2FA8E947245F412"><enum>(a)</enum><header>Milk price
			 support program</header><text>Section 1501 of the Farm Security and Rural
			 Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/7981">7 U.S.C. 7981</external-xref>) is repealed.</text>
				</subsection><subsection id="H23A216CD1E524EFEAFC9B27F9B8C00CE"><enum>(b)</enum><header>MILC
			 program</header><text>Section 1502 of the Farm Security and Rural Investment
			 Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/7982">7 U.S.C. 7982</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H1466D58F3F2D4AC4B65361E86DD04527" style="OLC">
						<section id="HED78A2DE8C064EFDBC00AF6E5B6EBC77"><enum>1502.</enum><header>Support for
				milk producers</header><text display-inline="no-display-inline">Dairy operators
				shall receive equal annual payments in each of the fiscal years 2008 through
				2012, cumulatively equal to 90 percent of the milk income loss contract
				payments the operator received in fiscal years 2003 through 2007. One half of
				the annual payment shall be immediately available to the producer, and one half
				of the payment shall be placed in the risk management account of the
				operator</text>
						</section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HA414D223B8DB4F03AB2BFFE0BB3BE806"><enum>106.</enum><header>Repeal of other
			 commodity programs</header>
				<subsection id="HB1D8740C926149598E50E5553F25D8C8"><enum>(a)</enum><header>Repeal of
			 commodity programs</header><text display-inline="yes-display-inline">Except as
			 otherwise provided by this Act, all commodity programs set forth in subtitles
			 A, B, C, and D of title I of the Farm Security and Rural Investment Act of 2002
			 and sections 1501 and 1502 of such Act are repealed.</text>
				</subsection><subsection id="H2EFFCD177F7A4413A8EA50667881F3CE"><enum>(b)</enum><header>Repeal of
			 suspended authorities</header><text display-inline="yes-display-inline">The
			 provisions of law that were suspended by section 1602 of the Farm Security and
			 Rural Investment Act of 2002 pursuant to paragraphs (1), (2), (3), and (4) of
			 subsection (a), paragraphs (1) through (12) of subsection (b), and subsection
			 (c) are repealed.</text>
				</subsection><subsection id="H25B0FE2BE60844BE8CE81948F943177D"><enum>(c)</enum><header>Repeal of sugar
			 tariff rate quota</header><text display-inline="yes-display-inline">The
			 existing sugar tariff rate quota is repealed.</text>
				</subsection></section><section id="H11CED084A25B413089D0B5BD000347C8"><enum>107.</enum><header>Recourse loan
			 program</header><text display-inline="no-display-inline">The Secretary of
			 Agriculture shall establish a recourse loan program for all commodities,
			 including sugar, for which marketing loans were available under the terms of
			 title I of the Farm Security and Rural Investment Act of 2002 at a rate of
			 interest determined by the Secretary.</text>

				Guidelines</header>
								<paragraph id="H5DFC3BE436FF44F2B5ADC550EDFDCF91"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall establish criteria and guidelines for
				the submission, evaluation, and funding of proposed projects under the
				Program.</text>
								</paragraph><paragraph id="HFB388788F0284B49AEEDB408D4FC76D"><enum>(2)</enum><header>Priority</header><text>The
				Secretary shall prioritize the funding of projects that will support,
				encourage, or promote the transition to organic and other environmentally
				beneficial forms of agricultural production.</text>
								</paragraph></subsection><subsection id="H11C453D932FB41798021A6549DD609F4"><enum>(e)</enum><header>Funding</header><text>Of
				the funds of the Commodity Credit Corporation, the Secretary shall use
				$25,000,000 for each of the fiscal years 2008 through 2012 to carry out this
				section, of which $5,000,000 shall be used to support the use of electronic
				benefit transfers at farmers’
				markets.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" id="H28434A9933A84BA2A17F6E565E4400C7"><enum>(d)</enum><header>Fruit and
			 vegetable nutrition promotion program</header>
						<paragraph commented="no" id="H9126300F055442BB99CE2F166FC38C07"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Agriculture, acting through the
			 Administrator of the Agricultural Marketing Service, shall establish and carry
			 out a program to provide assistance to eligible trade organizations described
			 in paragraph (3) to increase the consumption of fruits and vegetables in the
			 United States to meet Federal health guidelines.</text>
						</paragraph><paragraph commented="no" id="H62C3C37F7D7D4A3DABCE36CCAA7596AB"><enum>(2)</enum><header>Requirements for
			 participation</header><text>To be eligible for assistance under this section,
			 an eligible trade organization shall—</text>
							<subparagraph commented="no" id="H570EDCE641404715A02FD7DCB09E62AE"><enum>(A)</enum><text>prepare and submit
			 a plan to increase the consumption of fruits and vegetables in the United
			 States to the Administrator of the Agricultural Marketing Service that meets
			 any guidelines governing such plans established by the Administrator;
			 and</text>
							</subparagraph><subparagraph commented="no" id="HA39DCD30F2BD493DBF98778C37E800FD"><enum>(B)</enum><text>meet any other
			 requirements established by the Administrator.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H4486B00A806B41B08B00A0FDCCC2009C"><enum>(3)</enum><header>Eligible trade
			 organizations</header><text>An eligible trade organization referred to in
			 paragraph (1) means any of the following:</text>
							<subparagraph commented="no" id="HBDB1F6D4FB094392AF7702C558C98235"><enum>(A)</enum><text>A nonprofit fruit
			 and vegetable trade organizations in the United States.</text>
							</subparagraph><subparagraph commented="no" id="HE79A33A3C49344C69497A9A761C159CC"><enum>(B)</enum><text>A nonprofit State
			 or regional fruit and vegetable organization.</text>
							</subparagraph><subparagraph commented="no" id="HDFF3E7DC03574422BCEF13A72CFE8986"><enum>(C)</enum><text>A fruit and
			 vegetable agricultural cooperative in the United States.</text>
							</subparagraph><subparagraph commented="no" id="HC91E9448BAEE47D7A4726C44C8CF407"><enum>(D)</enum><text>A commodity board
			 or commission in the United States.</text>
							</subparagraph><subparagraph commented="no" id="HC86D79F587FE428AABF606E2D06205F5"><enum>(E)</enum><text>A small business
			 engaged in the fruit and vegetable industry in the United States.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H55151890C7B44D288742AF8E7225BC1D"><enum>(4)</enum><header>Matching
			 funds</header><text>Assistance provided under this section shall not
			 exceed—</text>
							<subparagraph commented="no" id="H1FEDFE4E8B9E4E7895A632A5F3797D"><enum>(A)</enum><text>in the case of an
			 organization described in subparagraphs (A) through (D) of paragraph (3), 90
			 percent of the cost of the plan to increase the consumption of fruits and
			 vegetables in the United States submitted under paragraph (2)(A); and</text>
							</subparagraph><subparagraph commented="no" id="H57D5E9595EB84EB8B900A7BAC3B1D53"><enum>(B)</enum><text>in the case of an
			 organization described in paragraph (3)(E), 50 percent of the cost of the plan
			 to increase the consumption of fruits and vegetables in the United States
			 submitted under paragraph (2)(A).</text>
							</subparagraph></paragraph><paragraph commented="no" id="H4836E9ED876A40168D481C6E5400042F"><enum>(5)</enum><header>Funding</header><text>Of
			 the funds of the Commodity Credit Corporation, the Administrator of the
			 Agricultural Marketing Service shall use $10,000,000 in each of fiscal years
			 2008 through 2012 to carry out this section.</text>
						</paragraph></subsection></section></subtitle><subtitle id="HDC0C25A04637462090E8F993231D59"><enum>C</enum><header>McGovern-Dole</header>
				<section id="H4B37AE96969C4119B7E3DBF6B2F59BD7"><enum>231.</enum><header>Reauthorization
			 of McGovern-Dole International Food for Education and Child Nutrition
			 Program</header>
					<subsection id="HCBB9B757150643A4BF5758793840F773"><enum>(a)</enum><header>Administration
			 of program</header><text>Section 3107 of the Farm Security and Rural Investment

			 goals</header><text>Subsection (e)(2)(A) of such section is amended—</text>

			 <quote>and</quote> at the end of clause (i);</text>

			 Development</header>

			 development</header>
					<subsection id="HB03AA536149347309829093FD0C6872D"><enum>(a)</enum><header>Targeting of
			 rural development funding to low-income rural areas</header><text>Subtitle D of
			 the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1981">7 U.S.C. 1981–2008r</external-xref>) is
			 amended by inserting after section 364 the following:</text>
						<quoted-block display-inline="no-display-inline" id="HEC2994945C064820973F454428CDBC49" style="OLC">
							<section id="H35DF56B106114DF592B19F745CADB00"><enum>365.</enum><header>Criteria to be
				applied in considering applications for rural development
				projects</header><text display-inline="no-display-inline">The Secretary shall
				not approve an application which is submitted under any program authorized or
				modified by, or funded pursuant to, an amendment made by title VI of the Farm
				Security and Rural Investment Act of 2002, and which proposes to serve a rural
				area (as defined by the applicable law), unless—</text>
								<paragraph display-inline="no-display-inline" id="H36E31A62B9734B84898C6FE6C4012990"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE7D5DB407FEA40348495EA22894C632"><enum>(A)</enum><text>the median family income
				in the area is not more than 85 percent of the median household income in the
				State in which the area is located; and</text>
									</subparagraph><subparagraph id="HB3CBD4FE1EF94278BF3C7C5C4B7B296D" indent="up1"><enum>(B)</enum><text>the area is not—</text>
										<clause id="HCD6F27F5CDAD48969DB36EA8F0BBEBE0"><enum>(i)</enum><text display-inline="yes-display-inline">included within the boundaries of any city,
				town, borough, or village, whether incorporated or unincorporated, with a
				population of more than 20,000 inhabitants;</text>
										</clause><clause id="H1B5A335664EE48F8B00077A34BD8D81E"><enum>(ii)</enum><text display-inline="yes-display-inline">included within the boundaries of an
				urbanized area or urban cluster; or</text>
										</clause><clause id="HDA4DB89CADEB4D2BABD2A100417EA149"><enum>(iii)</enum><text display-inline="yes-display-inline">within 10 miles of the boundary of any such
				city, village, borough, town, urbanized area, or urban cluster;</text>
										</clause></subparagraph></paragraph><paragraph id="H50C30868F7664D0F969E6ED900224FC"><enum>(2)</enum><text display-inline="yes-display-inline">the area—</text>
									<subparagraph id="H81FB5C03D4DE435E906E2DD6FBC206FA"><enum>(A)</enum><text>is in a county
				designated as Non-metro by the Economic Research Service of the Department of
				Agriculture; and</text>
									</subparagraph><subparagraph id="HA50A4415BD124000B8AF1235AEA857AB"><enum>(B)</enum><text>has experienced
				net population out-migration over the last 5 years; or</text>
									</subparagraph></paragraph><paragraph id="HE1F0DFB6699449F69818E0A4DEDA088F"><enum>(3)</enum><text display-inline="yes-display-inline">the area is in a county designated a
				Non-metro Persistent Poverty County by the Economic Research Service of the
				Department of
				Agriculture.</text>
								</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H1EB13E48006D418D9200008E64823192"><enum>(b)</enum><header>Value-added
			 producer grant program</header><text display-inline="yes-display-inline">Section 231(b) of the Agricultural Risk
			 Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/224">Public Law 106–224</external-xref>) is

							<subsection commented="no" display-inline="no-display-inline" id="HAD19C86635E74382B853972243814B00"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="H52AF22EF5CA24CA8ABA170983588C7B6"><enum>(1)</enum><header display-inline="yes-display-inline">Economically disadvantaged
				microentrepreneur</header><text display-inline="yes-display-inline">The term
				<term>economically disadvantaged microentrepreneur</term> means an owner,
				majority owner, or developer of a microenterprise that has the ability to
				compete in the private sector but has been impaired because of diminished
				capital and credit opportunities, as compared to other microentrepreneurs in
				the industry.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2528CE0BD82B4AE68398EE91EAD4D4E0"><enum>(2)</enum><header display-inline="yes-display-inline">Indian tribe</header><text display-inline="yes-display-inline">The term <term>Indian tribe</term> has the
				meaning given the term in section 4 of the Indian Self-Determination and
				Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5D234639607B44C1A200445FF5914760"><enum>(3)</enum><header display-inline="yes-display-inline">Intermediary</header><text display-inline="yes-display-inline">The term <term>intermediary</term> means a
				private, nonprofit entity that provides assistance—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H3FE913AB0BC047D7AD426778C9003BA7"><enum>(A)</enum><text display-inline="yes-display-inline">to a microenterprise development
				organization; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBE6FA0B6AB0441519EEDD0CD6EC568F6"><enum>(B)</enum><text display-inline="yes-display-inline">for a microenterprise development
				program.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF3FCBFDB436F4690BC9DD5802697B019"><enum>(4)</enum><header display-inline="yes-display-inline">Low-income individual</header><text display-inline="yes-display-inline">The term low-income individual means an
				individual with an income (adjusted for family size) of not more than the
				greatest of—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H8BEF11DAF11B4BCFA9C560F78679843E"><enum>(A)</enum><text display-inline="yes-display-inline">80 percent of median income of an
				area;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAD56BA37A6C24E91BC3FDD7D20654E58"><enum>(B)</enum><text display-inline="yes-display-inline">80 percent of the statewide
				non-metropolitan area median income; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA48FE6D762684F98A181BF6DB798009"><enum>(C)</enum><text display-inline="yes-display-inline">80 percent of the national median
				income.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H36D1B9B756D046B08D4C45157977BCC2"><enum>(5)</enum><header display-inline="yes-display-inline">Microcredit</header><text display-inline="yes-display-inline">The term <term>microcredit</term> means a
				business loan or loan guarantee of not more than $50,000 that is provided to a
				rural entrepreneur.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA177C9E6B5DB4D92A25B3240AB0074AC"><enum>(6)</enum><header display-inline="yes-display-inline">Microenterprise</header><text display-inline="yes-display-inline">The term <term>microenterprise</term>
				means—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HDAF3AEE32F8C4C0D885965BA0013C8F1"><enum>(A)</enum><text display-inline="yes-display-inline">a sole proprietorship; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H640EA768498F436E923228B69BEFA785"><enum>(B)</enum><text display-inline="yes-display-inline">a business entity with not more than 10
				full-time-equivalent employees.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1A6B5C2A86D54043B0C1839CB31C862D"><enum>(7)</enum><header display-inline="yes-display-inline">Microenterprise development
				organization</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="HBDD8FF3CC3354D8CB380390001BCC808"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>microenterprise development
				organization</term> means a private, nonprofit entity that—</text>
										<clause commented="no" display-inline="no-display-inline" id="HB093C641BA3448689EA00761B28C9736"><enum>(i)</enum><text display-inline="yes-display-inline">provides training and technical assistance
				to rural entrepreneurs; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H1DCCCAB1AD564DD7AA0365B28D2E91FE"><enum>(ii)</enum><text display-inline="yes-display-inline">facilitates access to capital or another
				service described in subsection (b) for rural entrepreneurs.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H69ABCD34B5094EE2B078A7BCA6006654"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <term>microenterprise development
				organization</term> includes an organization described in subparagraph (A) with
				a demonstrated record of delivering services to economically disadvantaged
				microentrepreneurs, or an effective plan to develop a program to deliver
				microenterprise services to rural entrepreneurs effectively, as determined by
				the Secretary.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFC5ED0BF2B55454F9D97001D02DFB78"><enum>(8)</enum><header display-inline="yes-display-inline">Microenterprise development
				program</header><text display-inline="yes-display-inline">The term
				<term>microenterprise development organization</term> means a program
				administered by an organization serving a rural area.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEDC39485DD8E4B4E81BAE808CE3FF57C"><enum>(9)</enum><header display-inline="yes-display-inline">Microentrepreneur</header><text display-inline="yes-display-inline">The term <term>microentrepreneur</term>
				means the owner, operator, or developer of a microenterprise.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4C4B9D7D926B452991E1FE112B48FE8D"><enum>(10)</enum><header display-inline="yes-display-inline">Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the
				rural entrepreneur and microenterprise program established under subsection
				(b)(1).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7ACCB0FFAAE6429491D780ED2D7CB55E"><enum>(11)</enum><header display-inline="yes-display-inline">Qualified organization</header><text display-inline="yes-display-inline">The term <term>qualified
				organization</term> means—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HD9B11FFCF9E84007A424DBFD007BBF95"><enum>(A)</enum><text display-inline="yes-display-inline">a microenterprise development organization
				or microenterprise development program that has a demonstrated record of
				delivering microenterprise services to rural entrepreneurs, or an effective
				plan to develop a program to deliver microenterprise services to rural
				entrepreneurs effectively, as determined by the Secretary.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA969F903455A4CEAB132AC47486DABA6"><enum>(B)</enum><text display-inline="yes-display-inline">an intermediary that has a demonstrated
				record of delivery assistance to microenterprise development organizations or
				microenterprise development programs;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2AAA8C3A4FDC48BC9E2B46103045D4AB"><enum>(C)</enum><text display-inline="yes-display-inline">a microenterprise development organization
				or microenterprise development program that serves rural entrepreneurs;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2C6C341C5FFB400AB9D906512E58D871"><enum>(D)</enum><text display-inline="yes-display-inline">an Indian tribe, the tribal government of
				which certifies to the Secretary that no microenterprise development
				organization or microenterprise development program exists under the
				jurisdiction of the Indian tribe;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H29786F6D49654948A6C1CC19652304F5"><enum>(E)</enum><text display-inline="yes-display-inline">a group of 2 or more organizations or
				Indian tribes described in any of subparagraphs (A) through (D) that agree to
				act jointly as a qualified organization under this section; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H34A3A9A09C164CEB9D6C08F65DDDD67"><enum>(F)</enum><text display-inline="yes-display-inline">for purposes of subsection (b), a public
				college or university.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H55821B21809A41B8A9DF20CBB8E036E3"><enum>(12)</enum><header display-inline="yes-display-inline">Rural area</header><text display-inline="yes-display-inline">The term <term>rural area</term> means any
				community that is rural in character and has a population of not more than
				25,000 individuals.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE1DC7427BD994F27A283EA658BD60002"><enum>(13)</enum><header display-inline="yes-display-inline">Rural capacity building
				service</header><text display-inline="yes-display-inline">The term <term>rural
				capacity building service</term> means a service provided to an organization
				that—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HF421A6173E7B4490B5A9E68382A15466"><enum>(A)</enum><text display-inline="yes-display-inline">is, or is in the process of becoming, a
				microenterprise development organization or microenterprise development
				program; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H98DF67179EB947D1A9CB277638F540EC"><enum>(B)</enum><text display-inline="yes-display-inline">serves rural areas for the purpose of
				enhancing the ability of the organization to provide training, technical
				assistance, and other related services to rural entrepreneurs.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H949E5CFD6F494107870000C57808DCD5"><enum>(14)</enum><header display-inline="yes-display-inline">Rural entrepreneur</header><text display-inline="yes-display-inline">The term <term>rural entrepreneur</term>
				means a microentrepreneur, or prospective microentrepreneur—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HDF06E29A7E0F4738BC6E6D288D188D68"><enum>(A)</enum><text display-inline="yes-display-inline">the principal place of business of which is
				in a rural area; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6F41025D7A9C478FB5A0393DE7FF4EE9"><enum>(B)</enum><text display-inline="yes-display-inline">that is unable to obtain sufficient
				training, technical assistance, or microcredit elsewhere, as determined by the
				Secretary.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEEA4721CD5FF4E96ADDEE2CB9B53F1DF"><enum>(15)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
				Secretary of Agriculture, acting through the Rural Business-Cooperative
				Service.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9F195ECD5BD842D1B700F1346D88B532"><enum>(16)</enum><header display-inline="yes-display-inline">Tribal government</header><text display-inline="yes-display-inline">The term <term>tribal government</term>
				means the governing body of an Indian tribe.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5BB09396693C4DFD9BEC047EDDEF48B8"><enum>(b)</enum><header display-inline="yes-display-inline">Rural Entrepreneurship and Microenterprise
				Program</header>
								<paragraph commented="no" display-inline="no-display-inline" id="H029F96237E5C4E61A6D7DE7C1D9D00EA"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a rural
				entrepreneurship and microenterprise program.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDF8E033192B04360B114F44632C22BF"><enum>(2)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of the program shall be to
				provide low-income individuals and moderate-income individuals with—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H1584970B044341A6BE796D68095F92F3"><enum>(A)</enum><text display-inline="yes-display-inline">the skills necessary to establish new small
				businesses in rural areas; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD6F8E4BC50B446D8BF5C4C5C00D81180"><enum>(B)</enum><text display-inline="yes-display-inline">continuing technical and financial
				assistance as individuals and business starting or operating small
				businesses.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1D4F957E2E134802A3222C48B76769D1"><enum>(3)</enum><header display-inline="yes-display-inline">Grants</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="HD34615E1AE364AC3A335335E67A2D217"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may make a grant under the
				program to a qualified organization—</text>
										<clause commented="no" display-inline="no-display-inline" id="H5D58F48A95664F91ACE0F2E0FF243D2E"><enum>(i)</enum><text display-inline="yes-display-inline">to provide training, operational support,
				or a rural capacity building service to a qualified organization to assist the
				qualified organization in developing microenterprise training, technical
				assistance, market development assistance, and other related services,
				primarily for business with 5 or fewer full-time-equivalent employees;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HAC4FDC955B4248DC978B7B43AAE9E919"><enum>(ii)</enum><text display-inline="yes-display-inline">to assist in researching and developing the
				best practices in delivering training, technical assistance, and microcredit to
				rural entrepreneurs; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H3C672240631F4DF49F75E463016D19DA"><enum>(iii)</enum><text display-inline="yes-display-inline">to carry out such other projects and
				activities as the Secretary determines to be consistent with the purposes of
				this section.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5CBB76455DC6499FA55B79269C55FA90"><enum>(B)</enum><header display-inline="yes-display-inline">Subgrants</header><text display-inline="yes-display-inline">Subject to such regulations as the
				Secretary may promulgate, a qualified organization that receives a grant under
				this paragraph may use the grant to provide assistance to other qualified
				organizations, such as small or emerging qualified organizations.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDF23B23521DD467FA9815C6EA62959DA"><enum>(C)</enum><header display-inline="yes-display-inline">Diversity</header><text display-inline="yes-display-inline">In making grants under this paragraph, the
				Secretary shall ensure, to the maximum extent practicable, that grant
				recipients include qualified organizations—</text>
										<clause commented="no" display-inline="no-display-inline" id="HE9823147DAC947ED84659EB1C35D8C34"><enum>(i)</enum><text display-inline="yes-display-inline">of varying sizes; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H1339BEBF00644D7B827C495F28313439"><enum>(ii)</enum><text display-inline="yes-display-inline">that serve racially- and ethnically-diverse
				populations.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF799BC3F75074E17BEFE678E52B2545E"><enum>(D)</enum><header display-inline="yes-display-inline">Cost sharing</header>
										<clause commented="no" display-inline="no-display-inline" id="HD3C7F9BB366247AA93B9F6300AA503F"><enum>(i)</enum><header display-inline="yes-display-inline">Federal share</header><text display-inline="yes-display-inline">The Federal share of the cost of a project
				carried out using funds from a grant made under this paragraph shall be 75
				percent.</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HCF5E88A9BD5548F982B007F6CDF2174"><enum>(ii)</enum><header display-inline="yes-display-inline">Form of non-Federal share</header><text display-inline="yes-display-inline">The non-Federal share of the cost of a
				project described in clause (i) may be provided—</text>
											<subclause commented="no" display-inline="no-display-inline" id="H78544472DA624151B2D683E58015CC09"><enum>(I)</enum><text display-inline="yes-display-inline">in cash (including through fees, grants
				(including community development block grants), and gifts); or</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="HF1A6E98102DF4A92A8C26C438C7EA4F"><enum>(II)</enum><text display-inline="yes-display-inline">in kind.</text>
											</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H028CC8259A114C1C9D939400008C52DE"><enum>(4)</enum><header display-inline="yes-display-inline">Rural Microloan Program</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="H8265CF5C171145D9A70089C9DE51C538"><enum>(A)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">In carrying out the program, the Secretary
				may carry out a rural microloan program.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBCE2E711F5B642320039546B25F31964"><enum>(B)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of the rural microloan program
				shall be to provide technical and financial assistance to sole proprietorships
				and small businesses located in rural areas with a particular focus on those
				businesses with 5 or fewer full-time equivalent employees.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1B1F39F74918440BA62F4719F58E6CBC"><enum>(C)</enum><header display-inline="yes-display-inline">Authority of secretary</header><text display-inline="yes-display-inline">In carrying out the rural microloan
				program, the Secretary may—</text>
										<clause commented="no" display-inline="no-display-inline" id="H7A0FED2A70B949338209F32715D2DE7"><enum>(i)</enum><text display-inline="yes-display-inline">make direct loans to qualified
				organizations for the purpose of making short-term, fixed interest rate
				microloans to startup, newly established, and growing rural microbusiness
				concerns; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H32DF4658A4CC4AF796172B9D0100948E"><enum>(ii)</enum><text display-inline="yes-display-inline">in conjunction with those loans, provide
				grants in accordance with subparagraph (E) to those qualified organizations for
				the purpose of providing intensive marketing, management, and technical
				assistance to small business concerns that are borrowers under this
				paragraph.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H882B6E27C74848EBA842B7D7F1CAC00"><enum>(D)</enum><header display-inline="yes-display-inline">Loan duration; interest rates;
				conditions</header>
										<clause commented="no" display-inline="no-display-inline" id="H169ED4E79F484E10BD237612DD850016"><enum>(i)</enum><header display-inline="yes-display-inline">Loan duration</header><text display-inline="yes-display-inline">A loan made by the Secretary under this
				paragraph shall be for a term of 20 years.</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H4EB4B7F6418B4FF4974601271446C0A9"><enum>(ii)</enum><header display-inline="yes-display-inline">Applicable interest rates</header><text display-inline="yes-display-inline">A loan made by the Secretary under this
				paragraph to a qualified organization shall bear an annual interest rate of at
				least 1 percent.</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H2FE7E8F1960E4BAC9B7E8FD6CC4FCC"><enum>(iii)</enum><header display-inline="yes-display-inline">Deferral of interest and
				principal</header><text display-inline="yes-display-inline">The Secretary may
				permit the deferral of payments, for principal and interest, on a loan made
				under this paragraph for a period of not more than 2 years, beginning on the
				date on which the loan was made.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H439C3CC199454EEA9526D27200C65B2D"><enum>(E)</enum><header display-inline="yes-display-inline">Grant amounts</header>
										<clause commented="no" display-inline="no-display-inline" id="HB089207A37394FD5A2C839E42090FDB2"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this
				section, each qualified organization that receives a loan under this paragraph
				shall be eligible to receive a grant to provide marketing, management, and
				technical assistance to small business concerns that are borrowers or potential
				borrowers under this subsection.</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H421F8B5B18C248569CF19BB8C784A506"><enum>(ii)</enum><header display-inline="yes-display-inline">Maximum amount of grant for microenterprise
				development organizations</header><text display-inline="yes-display-inline">Each microenterprise development
				organization that receives a loan under this paragraph shall receive an annual
				grant in an amount equal to not more than 25 percent of the total outstanding
				balance of loans made to the microenterprise development organization under
				this paragraph, as of the date of provision of the grant.</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H3CFAC7BAFEEF4EDBA4BE63EDFFE75305"><enum>(iii)</enum><header display-inline="yes-display-inline">Matching Requirement</header>
											<subclause commented="no" display-inline="no-display-inline" id="H158DA56101AB4C09A04E5EB5E5EE9BF7"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As a condition of any grant made to a
				qualified organization under this subparagraph, the Secretary shall require the
				qualified organization to match not less than 15 percent of the total amount of
				the grant.</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="H2CA59586C40242E4813BB870A961BADF"><enum>(II)</enum><header display-inline="yes-display-inline">Sources</header><text display-inline="yes-display-inline">In addition to cash from non-Federal
				sources, a matching share provided by the qualified organization may include
				indirect costs or in-kind contributions funded under non-Federal
				programs.</text>
											</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE549D69A3F584B67B9951CEA1C809791"><enum>(c)</enum><header display-inline="yes-display-inline">Administrative expenses</header><text display-inline="yes-display-inline">Not more than 10 percent of assistance
				received by a qualified organization for a fiscal year under this section may
				be used to pay administrative expenses.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H6F6726B8B94448C18280691B97103C00"><enum>(d)</enum><header display-inline="yes-display-inline">Funding</header>
								<paragraph commented="no" display-inline="no-display-inline" id="HC70E3C55B2274733B9CDC946B5F41FB4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of
				enactment of this Act, and on October 1, 2008, and each October 1 thereafter
				through October 1, 2012, out of any funds in the Treasury not otherwise
				appropriated, the Secretary of the Treasury shall transfer to the Secretary to
				carry out this section $50,000,000, to remain available until expended.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4D3F83490C2743F195A8BE7BCE5BAB6"><enum>(2)</enum><header display-inline="yes-display-inline">Allocation of funds</header><text display-inline="yes-display-inline">Of the amount made available by paragraph
				(1) for each fiscal year—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HF73E5AE5BE6B468DB388A61CFE1FF7B0"><enum>(A)</enum><text display-inline="yes-display-inline">not less than $30,000,000 shall be
				available for use in carrying out subsection (b)(3); and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H557177E3718D42A48170EF5056BDC456"><enum>(B)</enum><text display-inline="yes-display-inline">not less than $20,000,000 shall be
				available for use in carrying out subsection (b)(4), of which not more than
				$7,000,000 shall be used to support direct loans.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H43334B1B988147C1849E9C66FD796FB3"><enum>(C)</enum><header display-inline="yes-display-inline">Receipt and acceptance</header><text display-inline="yes-display-inline">The Secretary shall be entitled to receive,
				shall accept, and shall use to carry out this section the funds transferred
				under paragraph (1), without further
				appropriation.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section display-inline="no-display-inline" id="H14F4373F484545BB80E68941CA785400"><enum>253.</enum><header>Enhancing rural
			 infrastructure</header>
					<subsection id="H4736870F839C483D96D0051B44004D49"><enum>(a)</enum><header>Use of
			 funds</header><text>The Secretary of Agriculture shall use funds made available
			 under subsection (d) to provide funds for applications that are pending on the
			 date of enactment of this Act for—</text>
						<paragraph id="H9FADFFE54F984E0F9D22C53800004362"><enum>(1)</enum><text>water or waste
			 disposal grants or direct loans under paragraph (1) or (2) of section 306(a) of
			 the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926">7 U.S.C. 1926(a)</external-xref>);</text>
						</paragraph><paragraph id="HA849C4E33D30472680C5F87980255682"><enum>(2)</enum><text>emergency
			 community water assistance grants under section 306A of that Act (7 U.S.C.
			 1926a);</text>
						</paragraph><paragraph id="H85379E0075C6466581005BF6691613E7"><enum>(3)</enum><text>community
			 facilities grants and direct loans under paragraphs (1), (19), (20), (21) of
			 section 306(a) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926">7 U.S.C. 1926(a)</external-xref>) that support projects that assist
			 rural first responders, as defined by the Secretary of Agriculture;</text>
						</paragraph><paragraph id="HC914FB17AEB7452CACF6EB60081F418"><enum>(4)</enum><text>broadband access
			 loans under title VI of the Rural Electrification Act (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb et seq.</external-xref>);
			 and</text>
						</paragraph><paragraph id="H6329C7C8C2D642D69569E0582F73C432"><enum>(5)</enum><text>distance learning
			 and telemedicine grants under chapter 1 of subtitle D of title XXII of the
			 Food, Agriculture, Conservation, and Trade Act of 1990 (7 U.S.C. 950aaa et
			 seq.).</text>
						</paragraph></subsection><subsection id="HD3A1F230E474469889DDAA3C82A8AAF"><enum>(b)</enum><header>Limitations</header>
						<paragraph id="HD8628CCB14D94AFD90512BA01F09E206"><enum>(1)</enum><header>Appropriated
			 amounts</header><text>Funds made available under this section shall be
			 available to the Secretary of Agriculture to provide funds for applications for
			 loans and grants described in subsection (a) that are pending on the date of
			 enactment of this Act only to the extent that funds for the loans and grants
			 appropriated in the annual appropriations Act for fiscal years 2008 and 2009,
			 as appropriate, have been exhausted.</text>
						</paragraph><paragraph id="H28993B555688472B8200B60098E42D36"><enum>(2)</enum><header>Program
			 requirements</header><text>The Secretary of Agriculture may use funds made
			 available under this section to provide funds for a pending application for a
			 loan or grant described in subsection (a) only if the Secretary of Agriculture
			 processes, reviews, and approves the application in accordance with regulations
			 in effect on the date of enactment of this Act.</text>
						</paragraph></subsection><subsection id="HFA09205938B2447196D262C1D7E3709D"><enum>(c)</enum><header>Exclusion of
			 certain pending applications</header><text>In this section, the term
			 <term>application</term> does not include an application for a loan or grant
			 that, as of the date of enactment of this Act, is in the preapplication phase
			 of consideration under regulations of the Secretary of Agriculture in effect on
			 the date of enactment of this Act.</text>
					</subsection><subsection id="H0A9536D6CFD145CFAD40E7A9DEE83330"><enum>(d)</enum><header>Funding</header><text display-inline="yes-display-inline">Of the funds of the Commodity Credit
			 Corporation, the Secretary of Agriculture shall make available to carry out
			 this section $50,000,000 in fiscal year 2008, $75,000,000 in fiscal year 2009,
			 $100,000,000 in fiscal years 2010 and 2011, and $75,000,000 in fiscal year
			 2012.</text>
					</subsection></section></subtitle><subtitle id="H7279BB6EE0D544C5A4C04413E3808B83"><enum>F</enum><header>Nutrition</header>
				<section id="H8BECAB5F7CB24815BD8648F77DC8A073"><enum>261.</enum><header>Exclusion of
			 combat-related military pay from countable income</header><text display-inline="no-display-inline">Section 5(d) of the food stamp act of 2007
			 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(d)</external-xref>) is amended—</text>
					<paragraph id="HE207D56B4F504500A1F5F8D8F740004B"><enum>(1)</enum><text>by striking
			 <quote>and (18)</quote> and inserting <quote>(18)</quote>; and</text>

					</paragraph></section><section id="H6A014E98D86D4B59B7349D4310EE4F13"><enum>262.</enum><header>Strengthening
			 the food purchasing power of low-income Americans</header><text display-inline="no-display-inline">Section 5(e)(1) of the Food Stamp Act of
			 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(e)(1)</external-xref>) is amended—</text>
					<paragraph id="HD0CB075352A84A758F28E3C51D72BE2"><enum>(1)</enum><text>in
			 subparagraph (A)(ii) by striking <quote>not less than $134</quote> and all that
			 follows to the end of the clause and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H19A3BEA84DD844F397D3955598A6DD36" style="OLC">
							<quoted-block-continuation-text quoted-block-continuation-text-level="clause">not less than
				$149, $255, $210, and $131, respectively. For October 1, 2008 and each fiscal

				consumers published by the Bureau of Labor Statistics, for items other than
				food, for the twelve months ending the preceding June

			 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(e)(3)(A)</external-xref>) is amended by striking <quote>, the maximum
			 allowable level of which shall be $200 per month for each dependent child under
			 2 years of age and $175 per month for each other dependent,</quote>.</text>
				</section><section display-inline="no-display-inline" id="H349C51CB1BF74AFEAAA4E8F6343512CB"><enum>264.</enum><header>Increasing the
			 minimum benefit</header><text display-inline="no-display-inline">Section 8(a)
			 of the Food Stamp Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/2017">7 U.S.C. 2017(a)</external-xref>) is amended by striking
			 <quote>$10 per month.</quote> and inserting—</text>
					<quoted-block id="H64C54E4BECE74786B56BE485F29C7FE4" style="OLC">
						<paragraph id="H9E1D0A3163F4420AA65E00E8A17C96D9"><enum>(1)</enum><text>for fiscal year
				2008 through 2011, 10 percent of the thrifty food plan for a household
				containing one member, as determined by the Secretary under section
				3(o);</text>
						</paragraph><paragraph id="H492E787FF3BA471AA4BEFF577E8BF3D8"><enum>(2)</enum><text>for fiscal year
				2012 and each fiscal year thereafter, 15 percent of the thrifty food plan for a
				household containing one member, as determined by the Secretary under section

				</section><section display-inline="no-display-inline" id="H36460AF014A8495EA2FEC495F48BF49D"><enum>265.</enum><header>Exclusion of
			 retirement accounts from countable financial resources</header>
					<subsection id="H398104F39D2243A6B1AD7007B169620"><enum>(a)</enum><header>Accounts</header><text>Section
			 5(g)(2)(B)(v) of the Food Stamp Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(g)(2)(B)(v)</external-xref>) is
			 amended by striking <quote>or retirement account (including an individual
			 account)</quote> and inserting <quote>account</quote>.</text>
					</subsection><subsection id="H3D9B5DA05C9446AE841FEB6F6D34C481"><enum>(b)</enum><header>Mandatory and
			 discretionary exclusions</header><text>Section 5(g) of the Food Stamp Act of

				ending the preceding June

								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section display-inline="no-display-inline" id="HE9A7AF03CECE4CD09442AA538EA41FD6" section-type="subsequent-section"><enum>269.</enum><header>Funds to States for
			 improving and innovating program access and integrity</header><text display-inline="no-display-inline">Section 16 of the Food Stamp Act of 2007 (7
			 U.S.C. 2025), as amended by <inline-comment display="yes">section
			 304,</inline-comment> is amended by adding at the end the following:</text>
					<quoted-block id="H9D660CB2855640278EDA867C94D74D8E">
						<subsection id="HAB730283D997405B825BB458267CFEE2"><enum>(m)</enum><header>Funds to States
				for improving and innovating program access and integrity</header>
							<paragraph id="H8FA14EA47F1F42F098A440C4F8FFF0ED"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraphs (2) and (3), the Secretary shall
				provide that with respect to administrative expenditures described in paragraph
				(2) the percent specified in (a) shall be increased to such percentage as the
				Secretary specifies.</text>
							</paragraph><paragraph id="H99DFC0FED3344900806FDEEB96DE367C"><enum>(2)</enum><header>Administrative
				expenditures described</header><text>The administrative expenditures described
				in this paragraph are expenditures described in (a) that a State demonstrates
				to the satisfaction of the Secretary are attributable to a program innovation
				that—</text>
								<subparagraph id="H979C2638AF96428FA4C3DC159E09152D"><enum>(A)</enum><text>improves access to
				the food stamp program;</text>
								</subparagraph><subparagraph id="HEC440DAE08204DD58E9E8BC5812F15B7"><enum>(B)</enum><text>improves the
				efficiency and effectiveness of program operations; or</text>
								</subparagraph><subparagraph id="H5B6A551EC5CD40BBB480D86CC2842B4"><enum>(C)</enum><text>improves program
				integrity.</text>
								</subparagraph></paragraph><paragraph id="HEEE3DDC297794F88A000F523036DFED6"><enum>(3)</enum><header>Limitations</header><text>The
				total amount of additional Federal funds that are made available under this
				subsection shall not exceed $10,000,000 in each of the fiscal years 2008
				through 2012. In applying this paragraph, the Secretary shall use discretion in
				determining the State innovations that have the greatest likelihood of meeting
				the goals described in paragraph (2). The Secretary shall only make funds
				available under paragraph (2) that will result in new activities or
				operations.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section display-inline="no-display-inline" id="H3B8D51CB8AB64BADB87B2940D12728A7"><enum>270.</enum><header>Supporting
			 State efforts during natural disasters</header><text display-inline="no-display-inline">Section 5(h) of the Food Stamp Act of 1977
			 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(h)</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block id="HC85962D935E04C08B43CCCC0E15C9251" style="OLC">
						<paragraph id="H197C0E7D88E643ED9394A4E8C0930F7" indent="up1"><enum>(4)</enum><text>In lieu of the payments section 16(a)
				would otherwise require, the Secretary shall pay each State agency an amount
				equal to 90 percent of administrative costs allowable under section 16(a) for
				costs related to planning and operating disaster food stamp programs under this
				subsection.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H93098DAC477048DFBE00A8442326A318"><enum>271.</enum><header>Community food
			 grants</header><text display-inline="no-display-inline">Section 25(b) of the
			 Food Stamp Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/2034">7 U.S.C. 2034(b)</external-xref>) is amended—</text>
					<paragraph id="H71FAD1FBB2D942B2B11E16501DDA4B89"><enum>(1)</enum><text>in paragraph (1)
			 by striking <quote>From amounts made available to carry out this Act, the
			 Secretary may</quote> and inserting <quote>The Secretary shall</quote>;
			 and</text>
					</paragraph><paragraph id="HB1C9E5B989B149299258521763B2034C"><enum>(2)</enum><text>by striking
			 paragraph (2) and inserting the following:</text>
						<quoted-block id="H89DEF49A9F30467494DE8F738B2FB78F" style="OLC">
							<paragraph id="H1BA3FF902A874BF3BD990695EED75C59"><enum>(2)</enum><header>Funding
				amounts</header><text>From amounts made available to carry out this Act, the
				Secretary shall use $25,000,000 for fiscal year 2008, and $30 million for each
				of the fiscal years 2009 through 2012, to make grants under this
				section.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section display-inline="no-display-inline" id="H6FAFA37393CD43E2B07C07BC7D4B29AE" section-type="subsequent-section"><enum>272.</enum><header>Expanding the use of
			 food stamps at farmers’ markets</header><text display-inline="no-display-inline">Section 25 of the Food Stamp Act of 1977 (7
			 U.S.C. 2034) is amended by adding at the end:</text>
					<quoted-block id="H349F9389736E4ADB837F00737FB3C482">
						<subsection id="H3B81662D7C0D45ED96678D2B27ABD288"><enum>(i)</enum><header>Grants to expand
				the number of farmers’ markets that accept food stamp benefits</header>
							<paragraph id="H36EC1519FE2745BA81BA14F800235BB5"><enum>(1)</enum><header>In
				general</header><text>For fiscal year 2008, the Secretary shall use not more
				than $5 million of funds made available under section 18(a)(1) to make grants
				to pay 100 percent of the costs of eligible entities approved by the Secretary
				to carry out projects to expand the number of farmer’ markets that accept food
				stamp benefits by—</text>
								<subparagraph id="H0BDB84EE228E4E4CBFC392B1252B93A6"><enum>(A)</enum><text>providing
				equipment and training necessary for markets to accept food stamp
				benefits;</text>
								</subparagraph><subparagraph id="H34265A60E68A4876B6176C73CB830060"><enum>(B)</enum><text>educating and
				providing technical assistance to farmers and farmers’ market operators about
				the process and benefits of accepting food stamp benefits; or</text>
								</subparagraph><subparagraph id="H81D2A359F88B474EB1392654A8CEBF14"><enum>(C)</enum><text>other activities
				deemed appropriate by the Secretary.</text>
								</subparagraph></paragraph><paragraph id="HB995702F9E364310B7F72EC3AA17B9ED"><enum>(2)</enum><header>Limitation</header><text>A
				grant made under this subsection shall not be made for the cost of the on-going
				cost of carrying out any project.</text>
							</paragraph><paragraph id="HA5CDB2C7ABBF4EDCAABB5E8135BAF5F"><enum>(3)</enum><header>Eligible
				entities</header><text>To be eligible to receive a grant under this subsection,
				an entity shall be—</text>
								<subparagraph id="HC744A4E838BD4B789BA1DAB9D61B78C"><enum>(A)</enum><text>a State agency
				administering the food stamp program;</text>
								</subparagraph><subparagraph id="H27A8C29F41A84547B774118890617200"><enum>(B)</enum><text>a State or local
				government; or</text>
								</subparagraph><subparagraph id="H20E0E737FCAF4D8B813D7627A504DBAF"><enum>(C)</enum><text>a private
				nonprofit entity that coordinates farmers’ markets in or within a State and
				that operates in cooperation with State or local government.</text>
								</subparagraph></paragraph><paragraph id="H3452C25B16C24CA3867008EEFC467F67"><enum>(4)</enum><header>Selection of
				eligible entities</header><text>The Secretary—</text>
								<subparagraph id="H5BE1DE9897024882B8F68D7DD2391E95"><enum>(A)</enum><text>shall develop
				criteria for the selection of eligible entities to receive grants under this
				subsection; and</text>
								</subparagraph><subparagraph id="HF51C53C5BBCA46C2BC18CCB3743FF700"><enum>(B)</enum><text>may give
				preference to any eligible entity that consists of a partnership between a
				government entity and a nongovernmental
				entity.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="HD8F7D42EF404493F9E56A45CA678E246"><enum>273.</enum><header>Commodities for
			 the emergency food assistance program</header><text display-inline="no-display-inline">Section 27(a) of the Food Stamp Act of 1977
			 (<external-xref legal-doc="usc" parsable-cite="usc/7/2036">7 U.S.C. 2036(a)</external-xref>) is amended—</text>
					<paragraph id="HE0A0305E0AEB484B8ECFF958C3F628CE"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(a) purchase of
			 commodities</quote> and all that follows through <quote>2007</quote> and
			 inserting the following:</text>

								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section display-inline="no-display-inline" id="HA2E18C373A024602A271DF1E01439532" section-type="subsequent-section"><enum>274.</enum><header>Community food
			 assistance and food bank infrastructure grants under the Food Stamp
			 Act</header><text display-inline="no-display-inline">The Food Stamp Act of 1977
			 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block id="H793FB602121E4344ACC500646688EC64">
						<section id="HF07AF88C383E4032B8C7541CDBA0AAE7"><enum>28.</enum><header>Community food
				assistance and food bank infrastructure competitive grants</header>
							<subsection id="H1BAF290C44D24354A52F05F5A8E5E376"><enum>(a)</enum><header>Definition of
				eligible entity</header><text>In this section, the term <term>eligible
				entity</term> means an emergency feeding organization (as defined in section
				201A(4) of the Emergency Food Assistance Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/7/7501">7 U.S.C. 7501(4)</external-xref>).</text>
							</subsection><subsection id="H016A1D0D77454F90AB0094153952E4D"><enum>(b)</enum><header>Program
				authorized</header><text display-inline="yes-display-inline">To carry out this
				section, there are authorized to be appropriated $5,000,000 for each of fiscal
				years 2008 through 2012.</text>
							</subsection><subsection id="H2CE3589C36044E509992292E8B4985EF"><enum>(c)</enum><header>Application</header>
								<paragraph id="H4CA5A7B5186C468EB6557406006454B"><enum>(1)</enum><header>In
				general</header><text>To receive a grant under this section, an eligible entity
				shall submit an application to the Secretary at the time and manner and
				accompanied by any information the Secretary may require.</text>
								</paragraph><paragraph id="HEE7893B13943410E81AE66F9F944F29D"><enum>(2)</enum><header>Contents</header><text>Each
				application submitted under paragraph (1) shall—</text>
									<subparagraph id="HBABEA79CDED742AFAD00CEF913E049E3"><enum>(A)</enum><text>identify the
				activity described in subsection (d) that the grant will be used to fund;
				and</text>
									</subparagraph><subparagraph id="H9312E7DFFAF540F9BD51E612886E8515"><enum>(B)</enum><text>describe the means
				by which an activity identified under subparagraph (A) will reduce hunger in
				the community or support the efforts of food banks or other nonprofit emergency
				feeding organizations as defined in subsection (a) to reduce hunger or food
				insecurity in their communities.</text>
									</subparagraph></paragraph><paragraph id="H0FAEA4BAB9B140E6A2B4400F4791683"><enum>(3)</enum><header>Priority</header><text>In
				making grants under this section, the Secretary shall give priority to eligible
				entities the applications of which demonstrate 2 of the following
				criteria:</text>
									<subparagraph id="H98F64A6C4B314B738489C6918F3460DC"><enum>(A)</enum><text>The eligible
				entity serves a predominantly rural and geographically underserved area.</text>
									</subparagraph><subparagraph id="H33C33241948B443291BC5F4160B2787B"><enum>(B)</enum><text>The eligible
				entity serves a community in which the rates of food insecurity, very low food
				insecurity, hunger, poverty, or unemployment are demonstrably higher than
				national average rates.</text>
									</subparagraph><subparagraph id="HEB7A9031A43E4CC6A26C2C001FDD600"><enum>(C)</enum><text>The eligible entity
				serves a community that provides demonstrable public support for the efforts of
				the eligible entity through the direct provision of private sector food
				assistance to low-income individuals.</text>
									</subparagraph><subparagraph id="H92614A45E28045BD87E2551CAF47E300"><enum>(D)</enum><text>The eligible
				entity can show that the grant will assist in the support of rural communities,
				small or mid-size farms, and the consumption of locally produced agricultural
				products by low-income people in need of temporary food assistance.</text>
									</subparagraph></paragraph></subsection><subsection id="H0AD206AC7B0742029006DFC26C996C18"><enum>(d)</enum><header>Use of
				funds</header><text>An eligible entity shall use a grant received under this
				section for fiscal year to carry out activities of the eligible entity,
				including—</text>
								<paragraph id="H3DD2710F8F7241E8B559001776646600"><enum>(1)</enum><text>constructing,
				expanding, or repairing a facility or equipment to support hunger relief
				agencies in the community;</text>
								</paragraph><paragraph id="H1B74D6D0F3234FFB92F32D881895F7F1"><enum>(2)</enum><text>assisting an
				emergency feeding organization in the community in obtaining locally-grown or
				raised produce, dairy or protein products; and</text>
								</paragraph><paragraph id="H5033B534C6E64F368CFA376B85BC197"><enum>(3)</enum><text>assisting an
				emergency feeding organization in the community for the procurement, storage,
				handling and distribution of locally produced agricultural
				products.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section display-inline="no-display-inline" id="HBF6BAB3838A746C3AACAFAD7975392A0"><enum>275.</enum><header>Food for the
			 hungry transportation grant program</header>
					<subsection id="H8295DD7A327E4525BDBFD7D2DDF4AC24"><enum>(a)</enum><header>Purposes</header><text>The
			 purposes of this section are—</text>
						<paragraph id="H255BE0CFC2194CC8AB79D304E7AED628"><enum>(1)</enum><text>to authorize the
			 creation of the National Food For the Hungry Transportation, Self-Help, and Job
			 Training Fund to facilitate the procurement and transportation of highly
			 perishable, healthy food to low-income individuals in the United States;</text>
						</paragraph><paragraph id="H7A96FA6DAC134BD385876D389C702CB8"><enum>(2)</enum><text>to establish a
			 competitive mechanism in the Department of Agriculture by which appropriations
			 made available from the Fund would be allocated;</text>
						</paragraph><paragraph id="H29A134D451834D85A32E421DE6721E7C"><enum>(3)</enum><text>to ensure the
			 direct involvement of the private carrier trucking fleet of the United States
			 in carrying out this section;</text>
						</paragraph><paragraph id="HB9FFAE87EAE64582A023731CB06B5BA"><enum>(4)</enum><text>to
			 increase the quantity of nutritious food available to low-income individuals in
			 the United States by supporting the procurement and distribution of highly
			 perishable food, such as fresh produce and protein products, to the low-income
			 individuals;</text>
						</paragraph><paragraph id="H6AA53E81E27D46378100DFC1ED00461F"><enum>(5)</enum><text>to offer job
			 training and employment opportunities in the food transportation and
			 distribution systems;</text>
						</paragraph><paragraph id="H0DC190D7014D4D4D9BD14B2928E22C8C"><enum>(6)</enum><text>to better identify
			 potential providers of donated foods and enhance the nonprofit food donation
			 system; and</text>
						</paragraph><paragraph id="H7A145EC3EDAC4B57B25F8FB0B3EA6B13"><enum>(7)</enum><text>to provide
			 adequate funding to carry out this section.</text>
						</paragraph></subsection><subsection id="H8872EF46BACD451AB4D720C827120524"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
						<paragraph id="H2DFBE989A8AE4984AA4000FD3173CA54"><enum>(1)</enum><header>Fund</header><text>The
			 term <term>Fund</term> means the National Food For the Hungry Transportation,
			 Self-Help, and Job Training Fund established under subsection (c).</text>
						</paragraph><paragraph id="HB16815FBC43A4262B2A3CEC32CFFEF00"><enum>(2)</enum><header>Nongovernmental
			 organization</header><text>The term <term>nongovernmental organization</term>
			 means a national nonprofit charitable organization that—</text>
							<subparagraph id="HE6C86CF70B38403C89182F91C4EEE0E6"><enum>(A)</enum><text>is described in
			 <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986;</text>
							</subparagraph><subparagraph id="H48FCFAF82225497A00F8DA6680CF20B"><enum>(B)</enum><text>is capable of, and
			 has at least 10 years experience in, procuring donated food and other services
			 from major domestic food manufacturers and processors, grocery wholesalers and
			 retailers, food warehouse operations, agricultural producer organizations,
			 fishing interests commercial transport providers (such as trucking companies),
			 and Federal and State food assistance agencies;</text>
							</subparagraph><subparagraph id="H5B13E42AB8A44168B710D1028033DCA7"><enum>(C)</enum><text>is capable of, and
			 has shown proficiency in, the national distribution of highly perishable food
			 through contracts with member emergency feeding organizations (as defined in
			 section 201A of the Emergency Food Assistance Act of 1983 (7 U.S.C.
			 7501));</text>
							</subparagraph><subparagraph id="H5E8BCA3C1FB345BB948EFB002CEA37DB"><enum>(D)</enum><text>has at least 10
			 years experience in procuring commercial freight for the distribution of
			 time-sensitive food products through a network of emergency food assistance
			 organizations;</text>
							</subparagraph><subparagraph id="H76AD3B4D15EA40AFBA00DB35D23F7743"><enum>(E)</enum><text>has at least 10
			 years experience in working with transport providers in creating, coordinating,
			 and maintaining transfer systems designed to assist, at the national level, the
			 delivery of time-sensitive food products, for distribution to emergency food
			 assistance organizations in all 50 States and the District of Columbia;</text>
							</subparagraph><subparagraph id="H63F2B34673DD4072BED42FEB27DCE0DA"><enum>(F)</enum><text>does not operate
			 any commercial, private, or public subsidiary trucking or freight operations
			 for the purposes of transporting food; and</text>
							</subparagraph><subparagraph id="H873BEBAE734643B5B85B6832D54B0514"><enum>(G)</enum><text>agrees—</text>
								<clause id="H1E1C3A94C5774EF88EEA3564BFDBB9B"><enum>(i)</enum><text>to
			 contribute in-kind resources to help carry out this section;</text>
								</clause><clause id="HDA4C2D6BFFF34BB2A99673E5C1233785"><enum>(ii)</enum><text>to
			 provide to eligible emergency food assistance organizations services and
			 information free of charge; and</text>
								</clause><clause id="HB7A2AB7BB4294F4884C2DB27513EB23F"><enum>(iii)</enum><text>to
			 regularly certify and inspect any member emergency feeding organization with
			 which the nongovernmental organization entered into a contract to carry out an
			 activity described in subparagraph (B).</text>
								</clause></subparagraph></paragraph><paragraph id="H5004A0229B9947779F1D983D1F26A523"><enum>(3)</enum><header>Primary
			 nongovernmental organization</header><text>The term <term>primary
			 nongovernmental organization</term> means a nongovernmental organization
			 selected by the Secretary on a competitive basis from among nongovernmental
			 organizations.</text>
						</paragraph><paragraph id="HC39D247A75E34132ACA023A43D29B27C"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Transportation.</text>
						</paragraph><paragraph id="HA54D20CDB41C438080929B8D66649CC0"><enum>(5)</enum><header>Time-sensitive
			 food product</header>
							<subparagraph id="H007510F2C2554F35AD2DE8D4FE176382"><enum>(A)</enum><header>In
			 general</header><text>The term <term>time-sensitive food product</term> means a
			 fresh, raw, or processed food with a short time limitation for safe and
			 acceptable consumption, as determined by the Secretary.</text>
							</subparagraph><subparagraph id="H3EB734D63AF14CD9A286368D587042F4"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>time-sensitive food product</term> includes fruits, vegetables,
			 dairy products, meat, fish, and poultry.</text>
							</subparagraph></paragraph></subsection><subsection id="H8C7207FD4C284FCAAF6DA2248868C15F"><enum>(c)</enum><header>National food
			 for the hungry transportation fund</header><text>The Secretary shall offer to
			 enter into a contract or grant agreement with a primary nongovernmental
			 organization to establish the National Food for the Hungry Transportation Fund
			 to track, collect, and deliver time-sensitive food products.</text>
					</subsection><subsection id="H53C5BD078E0947F4BDAFDE5F748EAA7B"><enum>(d)</enum><header>Program
			 requirements</header><text>The Secretary shall ensure that funds made available
			 under this Act are used for</text>
						<paragraph id="H5DE52E8C1B0A40CBB5CE1EA7121D0B3"><enum>(1)</enum><text>the development and
			 maintenance of a computerized system for the tracking of time-sensitive food
			 products;</text>
						</paragraph><paragraph id="H7919763488E84F3E84DAD5151DD522F7"><enum>(2)</enum><text>capital and
			 operating costs associated with the collection and transportation of
			 time-sensitive food products;</text>
						</paragraph><paragraph id="H169D2D05374141AC97D222CCCB4B5815"><enum>(3)</enum><text>capital and
			 operating costs associated with the storage and distribution of time-sensitive
			 food products;</text>
						</paragraph><paragraph id="HD8D7DF23D38C42E68D5061F9A7B2B760"><enum>(4)</enum><text>job training
			 opportunities in trucking, food handling, food recovery, and related
			 industries;</text>
						</paragraph><paragraph id="HD14F43D6857547D2988CF5D9169700E3"><enum>(5)</enum><text>improving the
			 security and diversity of the food distribution and recovery systems of the
			 United States with the use of—</text>
							<subparagraph id="H1237839DE9D54473A33DBA60827F2E24"><enum>(A)</enum><text>family-sized
			 farms; and</text>
							</subparagraph><subparagraph id="H8D19AB6C40694FBEBE59CCD855B4FC88"><enum>(B)</enum><text>donations from
			 entities of food products to persons in need;</text>
							</subparagraph></paragraph><paragraph id="H2B873C92308C47CBBA5CD32023AD59B6"><enum>(6)</enum><text>providing
			 recovered healthy foods to non-profit emergency food providers to reduce hunger
			 in the United States; and</text>
						</paragraph><paragraph id="H2765E91C691A47019BB8B3C105CDADF"><enum>(7)</enum><text>improving the
			 identification of—</text>
							<subparagraph id="H46F29266844346E0AB1D4E159D8269EA"><enum>(A)</enum><text>potential
			 providers of donated foods;</text>
							</subparagraph><subparagraph id="H1D67D405CFC84A64AEF6AA8C522455DB"><enum>(B)</enum><text>potential
			 nonprofit emergency food providers; and</text>
							</subparagraph><subparagraph id="H38F6F50B286C4EE4913D1C186C7B1156"><enum>(C)</enum><text>persons in need of
			 emergency food assistance throughout the United States.</text>
							</subparagraph></paragraph></subsection><subsection id="H8053F0077A754C0EBE4B143F875CA2F5"><enum>(e)</enum><header>Additional
			 nongovernmental organizations</header>
						<paragraph id="HBD93862E570B45BDACDD6B5B2CF3BDAE"><enum>(1)</enum><header>In
			 general</header><text>The primary nongovernmental organization may enter into 1
			 or more contracts with, and provide funds to, not more than 2 additional
			 nongovernmental organizations that the Secretary determines meet the
			 requirements in paragraph (2) to carry out some of the functions required by
			 this section.</text>
						</paragraph><paragraph id="HE6881B0391BE4715BDAE0780DB2EEB5E"><enum>(2)</enum><header>Requirements</header><text>An
			 additional nongovernmental organization selected under paragraph (1)
			 shall—</text>
							<subparagraph id="H4BFD77678B9147699943A800A89B8C6"><enum>(A)</enum><text>have expertise in
			 operating for several years a national information clearinghouse relating to
			 anti-hunger activities;</text>
							</subparagraph><subparagraph id="HA9ADC7667B0F486795ABB426AE00CD9D"><enum>(B)</enum><text>have extensive
			 experience in working with other anti-hunger organizations throughout the
			 United States;</text>
							</subparagraph><subparagraph id="HC83AA0276CB24C27003BF6E388CD4E36"><enum>(C)</enum><text>have significant
			 experience in working with the Department of Agriculture; and</text>
							</subparagraph><subparagraph id="HFD5AF412BBEE44E188B46100CBD818D2"><enum>(D)</enum><text>operate, at a
			 national level, a hotline to provide information about—</text>
								<clause id="H09795670DF32460B910098FBA8531BE0"><enum>(i)</enum><text>access to food for
			 low-income families;</text>
								</clause><clause id="HC6CA0F2B129749ACB9C001F98837E84F"><enum>(ii)</enum><text>programs in
			 existence on the date of enactment of this Act that transport fresh produce to
			 food pantries, homeless shelters, and soup kitchens that could serve as
			 national models for replication in other areas; and</text>
								</clause><clause id="HF64E849C2C7D424A8C91BFE232456E17"><enum>(iii)</enum><text>ways low-income
			 individuals and families may become self-reliant.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="HCFDAB85AE21F42308654B7F4005BFD8D"><enum>(f)</enum><header>Audits</header><text>The
			 Secretary shall establish fair and reasonable procedures to audit the
			 expenditure of funds made available to carry out this section.</text>
					</subsection><subsection id="H6A14DBE793BA42AFBD3D6C7DBDA228A0"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated,
			 $5,000,000 for fiscal year 2008 and for each of fiscal years 2009 through 2012,
			 the amount available in the immediately preceding fiscal year adjusted to
			 reflect changes in the Consumer Price Index for All Urban Consumers published
			 by the Bureau of Labor Statistics for the twelve months ending the preceding
			 June 30.</text>
					</subsection></section></subtitle><subtitle id="HF1153CB0009A49F28842D13C2255CAF7"><enum>G</enum><header>Deficit
			 Reduction</header>
				<section id="HEBF784BDE2164AC080BDA1C49B6D17CA"><enum>281.</enum><header>Deficit
			 reduction</header><text display-inline="no-display-inline">Notwithstanding any
			 other provisions of law, savings resulting from provisions of this Act, when
			 compared with the Congressional Budget Office March 2008 baseline estimate, are
			 to be applied direct towards deficit reduction and are not available for
			 offsetting additional spending unrelated to this Act.</text>
