<subsection id="HB1FE4D0928154F5AB4497E0010C6DC35"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text> 
<paragraph id="H0EF4883AC7AF4CA1A8D830AD29D760AF"><enum>(1)</enum><text display-inline="yes-display-inline">Evidence that atmospheric warming and climate change are occurring is unequivocal.</text></paragraph> 
<paragraph id="HA783924166E8425286A9CA79BFB992EB"><enum>(2)</enum><text>Observed and anticipated impacts of climate change can result in economic harm and environmental damage to the United States and the world.</text></paragraph> 
<paragraph id="H4B8A0B4F6C17478D8756C231B16973F"><enum>(3)</enum><text>The Nation’s water resources, ecosystems, and infrastructure will be under increasing stress and pressure in coming decades, particularly due to climate change.</text></paragraph> 
<paragraph id="H38878603BCC145D2B82E3B6F09051851"><enum>(4)</enum><text>Greenhouse gases, such as carbon dioxide, methane, and nitrous oxides, can lead to atmospheric warming and climate change.</text></paragraph> 
<paragraph id="H4989C50FF4774398AC5D73CEB261FC25"><enum>(5)</enum><text>Transportation and buildings are among the leading sources of greenhouse gas emissions.</text></paragraph> 
<paragraph id="H40F150A5D62F4EBBA0DC6B21EB1C313C"><enum>(6)</enum><text>Increased reliance on energy efficient and renewable energy transportation and public buildings can strengthen our Nation’s energy security and mitigate the effects of climate change by cutting greenhouse gas emissions.</text></paragraph> 
<paragraph id="H547A826EA93542D3B71561E461135FE3"><enum>(7)</enum><text>The Federal Government can strengthen our Nation’s energy security and mitigate the effects of climate change by promoting energy efficient transportation and public buildings, creating incentives for the use of alternative fuel vehicles and renewable energy, and ensuring sound water resource and natural disaster preparedness planning.</text></paragraph></subsection> 
<subsection id="H4F572286D9984C0E863F2E5951BAD19"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are to strengthen our Nation’s energy security and mitigate the effects of climate change by promoting energy efficient transportation and public buildings, creating incentives for the use of alternative fuel vehicles and renewable energy, and ensuring sound water resource and natural disaster preparedness planning.</text></subsection></section> 
<title id="HBD38EDA24E0242A0B658321F359C55AE"><enum>I</enum><header>Department of Transportation</header> 
<section id="HDBC62EEEACC94B1B80C467AEBB748722"><enum>101.</enum><header>Center for climate change and environment</header> 
<subsection id="H94918809AFA14C7FA4DD65F2A24B2780"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/102">Section 102</external-xref> of title 49, United States Code, is amended—</text> 
<paragraph id="H0CFBFD45B6E74642A6EDB42D0057F142"><enum>(1)</enum><text>by redesignating subsection (g) as subsection (h); and</text></paragraph> 
<paragraph id="H2A555055A7C54CB08D497BBA7821C757"><enum>(2)</enum><text>by adding after subsection (f) the following:</text>

<subsection id="H8D8AB2D2CD03455C959DD5A60029D3F9"><enum>(g)</enum><header>Center for climate change and environment</header> 
<paragraph id="H8F0BFA22269C4670AA5C7D93453F0154"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Department a Center for Climate Change and Environment to plan, coordinate, and implement—</text> 
<subparagraph id="HAD541A0EAC9949ACB7665D91BB1B9352"><enum>(A)</enum><text>department-wide research, strategies, and actions to reduce transportation-related energy use and mitigate the effects of climate change; and</text></subparagraph> 
<subparagraph id="HF5A152A364FE48C8B068BCB291AAA5C"><enum>(B)</enum><text>department-wide research strategies and action to address the impacts of climate change on transportation systems and infrastructure.</text></subparagraph></paragraph> 
<paragraph id="H113E67BE40004B2289653DF2BFC3F40"><enum>(2)</enum><header>Clearinghouse</header><text display-inline="yes-display-inline">The Center shall establish a clearinghouse of low-cost solutions to reduce congestion and transportation-related energy use and mitigate the effects of climate change.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H95BE5AEAA1504FB18D8065725E1DA9C8"><enum>(b)</enum><header>Low-cost congestion solutions</header> 
<paragraph id="HBC2C57EFFB3E41D48866ED41309FCCE1"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Center for Climate Change and Environment of the Department of Transportation shall conduct a study to examine fuel efficiency savings and clean air impacts of major transportation projects, to identify low-cost solutions to reduce congestion and transportation-related energy use and mitigate the effects of climate change, and to alleviate such problems as railroad pricing that may force freight off the more fuel efficient railroads and onto less fuel efficient trucks.</text></paragraph> 
<paragraph id="H73202C53BA1F452598953366976DCF1E"><enum>(2)</enum><header>Report</header><text>Not later than one year after the date of enactment of this Act, the Secretary of Transportation shall transmit to the Committee on Transportation and Infrastructure of the House of Representatives a report on low-cost solutions to reducing congestion and transportation-related energy use and mitigating the effects of climate change.</text></paragraph></subsection> 
<subsection id="H8A6B9767DB5942FBAA61BE7814B650F1"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary for the Center to carry out its duties under <external-xref legal-doc="usc" parsable-cite="usc/49/102">section 102(g)</external-xref> of title 49, United States Code, such sums as may be necessary for fiscal years 2008 through 2011.</text></subsection></section></title>

<subtitle id="H0783B814523B469EB5C4E77DBC31C7"><enum>A</enum><header>Public Transportation</header> 
<section id="H5DE0E6DFEF2A4086B415DF8BAF7715E3"><enum>201.</enum><header>Grants to improve public transportation services</header> 
<subsection id="H116EFBA46ACF4DBAB315E0AE68D18C8D"><enum>(a)</enum><header>Authorizations of Appropriations</header> 
<paragraph id="H470A90743F7F48E2BFD1129793DF6FFD"><enum>(1)</enum><header>Urbanized area formula grants</header><text>In addition to amounts allocated under <external-xref legal-doc="usc" parsable-cite="usc/49/5338">section 5338(b)(2)(B)</external-xref> of title 49, United States Code, to carry out section 5307 of such title, there is authorized to be appropriated $750,000,000 for each of fiscal years 2008 and 2009 to carry out such section 5307. Such funds shall be apportioned in accordance with section 5336 (other than subsections (i)(1) and (j)) of such title but may not be combined or commingled with any other funds apportioned under such section 5336.</text></paragraph> 
<paragraph id="H8D39045C35F144CB95DFB03CF92D36D8"><enum>(2)</enum><header>Formula grants for other than urbanized areas</header><text display-inline="yes-display-inline">In addition to amounts allocated under <external-xref legal-doc="usc" parsable-cite="usc/49/5338">section 5338(b)(2)(G)</external-xref> of title 49, United States Code, to carry out section 5311 of such title, there is authorized to be appropriated $100,000,000 for each of fiscal years 2008 and 2009 to carry out such section 5311. Such funds shall be apportioned in accordance with such section 5311 but may not be combined or commingled with any other funds apportioned under such section 5311.</text></paragraph></subsection> 
<subsection id="H120A01F17B77405E8E3C435500F5FA03"><enum>(b)</enum><header>Use of funds</header><text>Notwithstanding sections <external-xref legal-doc="usc" parsable-cite="usc/49/5307">5307</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/49/5311">5311</external-xref> of title 49, United States Code, the Secretary of Transportation may make grants under such sections from amounts appropriated under subsection (a) only for one or more of the following:</text> 
<paragraph id="H3FE8ADC072A544EB8D8FFBCDD978C6CD" commented="no"><enum>(1)</enum><text>If the recipient of the grant is reducing, or certifies to the Secretary that, during the term of the grant, the recipient will reduce one or more fares the recipient charges for public transportation, those operating costs of equipment and facilities being used to provide the public transportation that the recipient is no longer able to pay from the revenues derived from such fare or fares as a result of such reduction.</text></paragraph> 
<paragraph id="H73ADD936F3D04C0898BD652443C960CC" commented="no"><enum>(2)</enum><text>If the recipient of the grant is expanding, or certifies to the Secretary that, during the term of the grant, the recipient will expand public transportation service, those operating and capital costs of equipment and facilities being used to provide the public transportation service that the recipient incurs as a result of the expansion of such service.</text></paragraph></subsection> 
<subsection commented="no" id="HBF1FE1DA0B9B4A85813437CE73CC071E"><enum>(c)</enum><header>Federal Share</header><text>Notwithstanding any other provision of law, the Federal share of the costs for which a grant is made under this section shall be 100 percent.</text></subsection> 
<subsection id="H12F2DFE427534816B84D26BDE9B5A824"><enum>(d)</enum><header>Period of availability</header><text>Funds appropriated under this section shall remain available for a period of 2 fiscal years.</text></subsection></section> 
<section display-inline="no-display-inline" id="H5DCE896ACCE14D4C99E5065EAEC5E2A4" section-type="subsequent-section"><enum>202.</enum><header>Increased Federal share for Clean Air Act compliance</header><text display-inline="no-display-inline">Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/49/5323">section 5323(i)(1)</external-xref> of title 49, United States Code, a grant for a project to be assisted under chapter 53 of such title during fiscal years 2008 and 2009 that involves acquiring clean fuel or alternative fuel vehicle-related equipment or facilities for the purposes of complying with or maintaining compliance with the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) shall be for 100 percent of the net project cost of the equipment or facility attributable to compliance with that Act.</text></section>

<section id="H340ECB7FEE7E435697EA5E7F2EFFEA26"><enum>28501.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter—</text> 
<paragraph id="H881D448C72904CA8A571C29265C913A1"><enum>(1)</enum><text>the term <quote>Board</quote> means the Surface Transportation Board;</text></paragraph> 
<paragraph id="HC37239E534044027A2A1CEBC32B2EB4F"><enum>(2)</enum><text>the term <quote>capital work</quote> means maintenance, restoration, reconstruction, capacity enhancement, or rehabilitation work on trackage that would be treated, in accordance with generally accepted accounting principles, as a capital item rather than an expense;</text></paragraph> 
<paragraph id="H641B040182E9464CA1A5ACBFC4394FE4"><enum>(3)</enum><text>the term <quote>fixed guideway transportation</quote> means public transportation (as defined in section 5302(a)(10)) provided on, by, or using a fixed guideway (as defined in section 5302(a)(4));</text></paragraph> 
<paragraph id="HDD242369EA7E4BFDA0A2474BBCA0009F"><enum>(4)</enum><text>the term <quote>public transportation authority</quote> means a local governmental authority (as defined in section 5302(a)(6)) established to provide, or make a contract providing for, fixed guideway transportation;</text></paragraph> 
<paragraph commented="no" id="H46B0B31A21C24891BE802774D72087B5"><enum>(5)</enum><text>the term <quote>rail carrier</quote> means a person, other than a governmental authority, providing common carrier railroad transportation for compensation subject to the jurisdiction of the Board under chapter 105;</text></paragraph> 
<paragraph id="H5547580739DB4E4C8851EE257CC679AA"><enum>(6)</enum><text>the term <quote>segregated fixed guideway facility</quote> means a fixed guideway facility constructed within the railroad right-of-way of a rail carrier but physically separate from trackage, including relocated trackage, within the right-of-way used by a rail carrier for freight transportation purposes; and</text></paragraph> 
<paragraph id="H04A310161BC143D2A291F1002174BE69"><enum>(7)</enum><text>the term <quote>trackage</quote> means a railroad line of a rail carrier, including a spur, industrial, team, switching, side, yard, or station track, and a facility of a rail carrier.</text></paragraph></section> 
<section id="HA1F42957F7304FC19448281EA610CCBC"><enum>28502.</enum><header>Surface Transportation Board mediation of trackage use requests</header><text display-inline="no-display-inline">If, after a reasonable period of negotiation, a public transportation authority cannot reach agreement with a rail carrier to use trackage of, and have related services provided by, the rail carrier for purposes of fixed guideway transportation, the public transportation authority or the rail carrier may apply to the Board for nonbinding mediation. The Board shall conduct the nonbinding mediation in accordance with the mediation process of <external-xref legal-doc="regulation" parsable-cite="cfr/49/1109.4">section 1109.4</external-xref> of title 49, Code of Federal Regulations, as in effect on the date of enactment of this section. </text></section> 
<section id="H2DEEE5925AC64F699BF2268D007E8019"><enum>28503.</enum><header>Surface Transportation Board mediation of rights-of-way use requests</header><text display-inline="no-display-inline">If, after a reasonable period of negotiation, a public transportation authority cannot reach agreement with a rail carrier to acquire an interest in a railroad right-of-way for the construction and operation of a segregated fixed guideway facility, the public transportation authority or the rail carrier may apply to the Board for nonbinding mediation. The Board shall conduct the nonbinding mediation in accordance with the mediation process of <external-xref legal-doc="regulation" parsable-cite="cfr/49/1109.4">section 1109.4</external-xref> of title 49, Code of Federal Regulations, as in effect on the date of enactment of this section.</text></section> 
<section id="H989B083B713F42B6985E93F42E2D88B1"><enum>28504.</enum><header>Applicability of other laws</header><text display-inline="no-display-inline">Nothing in this chapter shall be construed to limit a rail transportation provider’s right under section 28103(b) to enter into contracts that allocate financial responsibility for claims.</text></section> 
<section id="H7041B40CB4E644E39FFBCC4FF28B864B"><enum>28505.</enum><header>Rules and regulations</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this section, the Board shall issue such rules and regulations as may be necessary to carry out this chapter.</text></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection commented="no" id="H88254DC1D47D46BBA1F3DD67CDA15D4E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any unobligated balances of amounts that are appropriated from the Highway Trust Fund for a fiscal year, and apportioned under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, before, on, or after the date of enactment of this Act and that are rescinded after such date of enactment shall be distributed within each State (as defined in section 101 of such title) among all programs for which funds are apportioned under such chapter for such fiscal year, to the extent sufficient funds remain available for obligation, in the ratio that the amount of funds apportioned for each program under such chapter for such fiscal year, bears to the amount of funds apportioned for all such programs under such chapter for such fiscal year.</text></subsection> 
<subsection commented="no" id="H98B07004A67A4CE696F05EB2C2E9D3EC"><enum>(b)</enum><header>Treatment of transportation enhancement set-aside and funds suballocated to substate areas</header><text>Funds set aside under sections <external-xref legal-doc="usc" parsable-cite="usc/23/133">133(d)(2)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/23/133">133(d)(3)</external-xref> of title 23, United States Code, shall be treated as being apportioned under chapter 1 of such title for purposes of subsection (a).</text></subsection></section> 
<section commented="no" id="HAC1E828FADF74ED2B2631206E11DDBE1"><enum>253.</enum><header>Sense of Congress regarding use of complete streets design techniques</header><text display-inline="no-display-inline">It is the sense of Congress that in constructing new roadways or rehabilitating existing facilities, State and local governments should employ policies designed to accommodate all users, including motorists, pedestrians, cyclists, transit riders, and people of all ages and abilities, in order to—</text> 
<paragraph commented="no" id="HA641562F261E4C839D80F7949B1E4B"><enum>(1)</enum><text>serve all surface transportation users by creating a more interconnected and intermodal system;</text></paragraph> 
<paragraph commented="no" id="HEA9AC2B164234C808B1ECE72F8D79417"><enum>(2)</enum><text>create more viable transportation options; and</text></paragraph> 
<paragraph commented="no" id="HED84906C59C04D07A024F1ECCB7D47E"><enum>(3)</enum><text>facilitate the use of environmentally friendly options, such as public transportation, walking, and bicycling.</text></paragraph></section></subtitle></title> 
<title id="HB1CAE7664FE14D178660021CE9996802"><enum>III</enum><header>Railroad and Pipeline Transportation</header> 
<subtitle id="HE499D42B46D04479BB1C472090226FC2"><enum>A</enum><header>Railroads</header> 
<section id="HE9EE3290BAED4DE1AADD465C93178834"><enum>301.</enum><header>Green locomotive grant program</header> 
<subsection id="HAA3A79EE87104BA8B2A1263F9192279E"><enum>(a)</enum><header>In general</header><text>The Secretary of Transportation shall establish a program for making grants to railroad carriers and State and local governments for assistance in purchasing qualified locomotives.</text></subsection> 
<subsection id="H88A26FEFC57748A8B813BFB5CE10EE86"><enum>(b)</enum><header>Railroad carrier defined</header><text>The term <quote>railroad carrier</quote> has the meaning that the term has in <external-xref legal-doc="usc" parsable-cite="usc/49/20102">section 20102</external-xref> of title 49, United States Code.</text></subsection> 
<subsection id="H323B90186A394E96B576E57630432DF"><enum>(c)</enum><header>Use of funds</header><text>—</text> 
<paragraph id="HA83EE4880296468EAF14B8E13BB6205E"><enum>(1)</enum><header>Grants</header><text>The Secretary may make a grant to a railroad carrier or a State or local government—</text> 
<subparagraph id="H817B50E11D4E477CAA3DDAFE6D933B7"><enum>(A)</enum><text>to purchase locomotives, including switch locomotives, that exceed the Environmental Protection Agency’s emission standards for locomotives and locomotive engines; or</text></subparagraph> 
<subparagraph id="H6263346EA8774CA1895163081D654E83"><enum>(B)</enum><text>to recondition locomotives, including switch locomotives, to ensure that such locomotives meet or exceed the Environmental Protection Agency’s emission standards for locomotives and locomotive engines.</text></subparagraph></paragraph> 
<paragraph id="HA1D8240C03A54DB0BB88EBB0AA4C94BB"><enum>(2)</enum><header>Limitation</header><text>Notwithstanding paragraph (1), no grant under this section may be used to fund the costs of emission reductions that are mandated under Federal, State, or local law.</text></paragraph></subsection> 
<subsection id="HA89281B9CD604D50B155D39CAB5057AE"><enum>(d)</enum><header>Grant criteria</header><text>In selecting applicants for grants under this section, the Secretary shall consider—</text> 
<paragraph id="H4F58766D7C6140389C22DE38B706F99C"><enum>(1)</enum><text>the identified need for locomotives that exceed the Environmental Protection Agency’s emission standards for locomotives or locomotive engines in the areas served by the applicant;</text></paragraph> 
<paragraph id="H4B8AE2BFCE8B48DF8E36D42FE766D7C8"><enum>(2)</enum><text>the benefits of the emissions reductions of the proposed project; and</text></paragraph> 
<paragraph id="HE54DDC918E8E45118900B16D75C6949F"><enum>(3)</enum><text>the extent to which the applicant demonstrates innovative strategies and a financial commitment to increasing energy efficiency and reducing greenhouse gas emissions of its railroad operations.</text></paragraph></subsection> 
<subsection id="HD8726C4DC2544285AB7BC35C74483D47"><enum>(e)</enum><header>Competitive grant selection</header><text>The Secretary shall conduct a national solicitation for applications for grants under this section and shall select grantees on a competitive basis.</text></subsection> 
<subsection id="HF7CFE38E1EB5405B830034F718359173"><enum>(f)</enum><header>Federal share</header><text>The Federal share of the costs for a project under this section shall not exceed 90 percent of the project cost.</text></subsection> 
<subsection id="HE52D8C62011F421082198BD73BF24C91"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary $50,000,000 for each of the fiscal years 2008 through 2011 to carry out this section. Such funds shall remain available until expended.</text></subsection></section>

<subsection id="HB9FADE34674C43D09346794BF3DBF04D"><enum>(a)</enum><header>Establishment of program</header> 
<paragraph id="H1DAAEDF2F8CD45409EBC113071A4B42"><enum>(1)</enum><header>Establishment</header><text>The Secretary of Transportation shall establish a program of capital grants for the rehabilitation, preservation, or improvement of railroad track (including roadbed, bridges, and related track structures) of class II and class III railroads. Such grants shall be for rehabilitating, preserving, or improving track used primarily for freight transportation to a standard ensuring that the track can be operated safely and efficiently, including grants for rehabilitating, preserving, or improving track to handle 286,000 pound railcars. Grants may be provided under this chapter—</text> 
<subparagraph id="H192BC3EA65C34DD1BBFF00665FD5E586"><enum>(A)</enum><text>directly to the class II or class III railroad; or</text></subparagraph> 
<subparagraph id="HC10E544F8DDC45A4AA378DFB67FD10F0"><enum>(B)</enum><text>with the concurrence of the class II or class III railroad, to a State or local government.</text></subparagraph></paragraph> 
<paragraph id="H888F2CA99B324BDBB12128DE8BBCAC13"><enum>(2)</enum><header>State cooperation</header><text>Class II and class III railroad applicants for a grant under this chapter are encouraged to utilize the expertise and assistance of State transportation agencies in applying for and administering such grants. State transportation agencies are encouraged to provide such expertise and assistance to such railroads.</text></paragraph> 
<paragraph id="H29ED1109E2EC4D3CB38893AF52F05554"><enum>(3)</enum><header>Interim regulations</header><text>Not later than December 31, 2007, the Secretary shall issue temporary regulations to implement the program under this section. Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5 does not apply to a temporary regulation issued under this paragraph or to an amendment to such a temporary regulation.</text></paragraph> 
<paragraph id="H03759FF28F0F442BBC2146A158232041"><enum>(4)</enum><header>Final regulations</header><text>Not later than October 1, 2008, the Secretary shall issue final regulations to implement the program under this section.</text></paragraph></subsection> 
<subsection id="H42765A42A8814061ABCB27E002346415"><enum>(b)</enum><header>Maximum Federal share</header><text>The maximum Federal share for carrying out a project under this section shall be 80 percent of the project cost. The non-Federal share may be provided by any non-Federal source in cash, equipment, or supplies. Other in-kind contributions may be approved by the Secretary on a case-by-case basis consistent with this chapter.</text></subsection> 
<subsection id="H7D71EB03874D49C30070313F3D02B2F4"><enum>(c)</enum><header>Project eligibility</header><text>For a project to be eligible for assistance under this section the track must have been operated or owned by a class II or class III railroad as of the date of the enactment of this chapter.</text></subsection> 
<subsection id="H23DE54251B0F4C7CB6AE302B7F002998"><enum>(d)</enum><header>Use of funds</header><text>Grants provided under this section shall be used to implement track capital projects as soon as possible. In no event shall grant funds be contractually obligated for a project later than the end of the third Federal fiscal year following the year in which the grant was awarded. Any funds not so obligated by the end of such fiscal year shall be returned to the Secretary for reallocation.</text></subsection> 
<subsection id="H09ECAF975D9744D39BA9F95D51FA2404"><enum>(e)</enum><header>Employee protection</header><text>The Secretary shall require as a condition of any grant made under this section that the recipient railroad provide a fair arrangement at least as protective of the interests of employees who are affected by the project to be funded with the grant as the terms imposed under section 11326(a), as in effect on the date of the enactment of this chapter.</text></subsection> 
<subsection id="H2758239F7B044E72BFBF478A3CBDC3"><enum>(f)</enum><header>Labor standards</header> 
<paragraph id="H8DB156071EAF40D4BBD56EC6599215E0"><enum>(1)</enum><header>Prevailing wages</header><text>The Secretary shall ensure that laborers and mechanics employed by contractors and subcontractors in construction work financed by a grant made under this section will be paid wages not less than those prevailing on similar construction in the locality, as determined by the Secretary of Labor under subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40 (commonly known as the <quote>Davis-Bacon Act</quote>). The Secretary shall make a grant under this section only after being assured that required labor standards will be maintained on the construction work.</text></paragraph> 
<paragraph id="H5550EC2DDA3B48ADA6107DF207A6BC9"><enum>(2)</enum><header>Wage rates</header><text>Wage rates in a collective bargaining agreement negotiated under the Railway Labor Act (<external-xref legal-doc="usc" parsable-cite="usc/45/151">45 U.S.C. 151 et seq.</external-xref>) are deemed for purposes of this subsection to comply with the subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40.</text></paragraph></subsection> 
<subsection id="H57C7C3287D19403DB1A96F7E601EF992"><enum>(g)</enum><header>Study</header><text>The Secretary shall conduct a study of the projects carried out with grant assistance under this section to determine the public interest benefits associated with the light density railroad networks in the States and their contribution to a multimodal transportation system. Not later than March 31, 2009, the Secretary shall report to Congress any recommendations the Secretary considers appropriate regarding the eligibility of light density rail networks for Federal infrastructure financing.</text></subsection> 
<subsection id="H52384E8E394C460680741B5625957530"><enum>(h)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of Transportation $250,000,000 for each of fiscal years 2008 through 2011 for carrying out this section.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="H82119BF27D794C8B9FE879034114175C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Energy, in coordination with the Secretary of Transportation, shall conduct feasibility studies for the construction of pipelines dedicated to the transportation of ethanol.</text></subsection> 
<subsection id="HBD63E92ECBED42AEB709C5C2737CB04E"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Energy shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on such feasibility studies.</text></subsection> 
<subsection id="H493F4DEEBEDE43A89514DDC4B0E3AD57"><enum>(c)</enum><header>Study Factors</header><text>Feasibility studies funded under this subtitle shall include consideration of—</text> 
<paragraph id="HE38769394EFE44AAB213279D2D63264E"><enum>(1)</enum><text>existing or potential barriers to the construction of pipelines dedicated to the transportation of ethanol, including technical, siting, financing, and regulatory barriers;</text></paragraph> 
<paragraph id="HAD5DE419E66142F6A4ED00A89D325C14"><enum>(2)</enum><text>market risk, including throughput risk;</text></paragraph> 
<paragraph id="H27C0D6AC7A164392904920B9E951A10"><enum>(3)</enum><text>regulatory, financing, and siting options that would mitigate such risk and help ensure the construction of pipelines dedicated to the transportation of ethanol;</text></paragraph> 
<paragraph id="H1116243A6F2A4562B7409923BFCC2F1D"><enum>(4)</enum><text>ensuring the safe transportation of ethanol and preventive measures to ensure pipeline integrity; and</text></paragraph> 
<paragraph id="H81D7C31A811F47CE8B69049687B93DFA"><enum>(5)</enum><text>such other factors as the Secretary of Energy considers appropriate.</text></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="HD0DE6878674C41DDA488DBC99BA24B11"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of Energy to carry out this section $1,000,000 for each of the fiscal years 2008 and 2009, to remain available until expended.</text></subsection></section></subtitle></title>

<section id="H0645EC4C7A3F49868548A1CC683C99A2"><enum>55601.</enum><header>Short sea transportation program</header> 
<subsection id="HC5D90AF2A4D74A33932146396EC500CC"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Transportation shall establish a short sea transportation program and designate short sea transportation projects to be conducted under the program to mitigate landside congestion.</text></subsection> 
<subsection id="H5ABB5639CA1D4271A2F700EB454B42A5"><enum>(b)</enum><header>Program elements</header><text>The program shall encourage the use of short sea transportation through the development and expansion of—</text> 
<paragraph id="H08F68E7522F04A21B4A4510089C71944"><enum>(1)</enum><text>documented vessels;</text></paragraph> 
<paragraph id="H7554F00EEC7D483D95F45DF625F0B8BE"><enum>(2)</enum><text>shipper utilization;</text></paragraph> 
<paragraph id="HEA1A4740DDB343A3BD64BC1FD68D8F66"><enum>(3)</enum><text>port and landside infrastructure; and</text></paragraph> 
<paragraph id="HA4FDE906F3EC4E15BD8469CBD1A35120"><enum>(4)</enum><text>marine transportation strategies by State and local governments.</text></paragraph></subsection> 
<subsection id="H9AEF8DEC0D734B65B6A5BDDBA271129"><enum>(c)</enum><header>Short sea transportation routes</header><text>The Secretary shall designate short sea transportation routes as extensions of the surface transportation system to focus public and private efforts to use the waterways to relieve landside congestion along coastal corridors. The Secretary may collect and disseminate data for the designation and delineation of short sea transportation routes.</text></subsection> 
<subsection id="H5AF31BB9F0D7473D946687B1233E75E3"><enum>(d)</enum><header>Project designation</header><text>The Secretary may designate a project to be a short sea transportation project if the Secretary determines that the project may—</text> 
<paragraph id="H0001EF496D624EA2BC5DCB4E8156DCFE"><enum>(1)</enum><text>offer a waterborne alternative to available landside transportation services using documented vessels; and</text></paragraph> 
<paragraph id="H9BF590B02DE14CEF9EF96D803B00E2E9"><enum>(2)</enum><text>provide transportation services for passengers or freight (or both) that may reduce congestion on landside infrastructure using documented vessels.</text></paragraph></subsection> 
<subsection id="H70D8B55A8A774E8E86BBF209353E1D28"><enum>(e)</enum><header>Elements of program</header><text>For a short sea transportation project designated under this section, the Secretary of Transportation may—</text> 
<paragraph id="H4537B8CF013C4326003F62A60017204E"><enum>(1)</enum><text>promote the development of short sea transportation services;</text></paragraph> 
<paragraph id="H5F5D769297B24BBC92A315F2F050A499"><enum>(2)</enum><text>coordinate, with ports, State departments of transportation, localities, other public agencies, and the private sector and on the development of landside facilities and infrastructure to support short sea transportation services; and</text></paragraph> 
<paragraph id="H4F7F327858CD4DA5008257DFA44272C3"><enum>(3)</enum><text>develop performance measures for the short sea transportation program.</text></paragraph></subsection> 
<subsection id="HFDA8DEC114664E4F8806E93BDD894D00"><enum>(f)</enum><header>Multistate, State and regional transportation planning</header><text>The Secretary, in consultation with Federal entities and State and local governments, shall develop strategies to encourage the use of short sea transportation for transportation of passengers and cargo. The Secretary shall—</text> 
<paragraph id="H557A355636644AA486BAA04D349245D"><enum>(1)</enum><text>assess the extent to which States and local governments include short sea transportation and other marine transportation solutions in their transportation planning;</text></paragraph> 
<paragraph id="H51DA5228543E46A8987EF5C125F45624"><enum>(2)</enum><text>encourage State departments of transportation to develop strategies, where appropriate, to incorporate short sea transportation, ferries, and other marine transportation solutions for regional and interstate transport of freight and passengers in their transportation planning; and</text></paragraph> 
<paragraph id="HDD96AF9193464D36BE5EB8572B7B96A"><enum>(3)</enum><text>encourage groups of States and multi-State transportation entities to determine how short sea transportation can address congestion, bottlenecks, and other interstate transportation challenges.</text></paragraph></subsection></section> 
<section id="HF72E52BE451A429A83192B449E3FF792"><enum>55602.</enum><header>Cargo and shippers</header> 
<subsection id="H6BC8B9A4BC4243828DDBCA500636B8D"><enum>(a)</enum><header>Memorandums of agreement</header><text>The Secretary of Transportation shall enter into memorandums of understanding with the heads of other Federal entities to transport federally owned or generated cargo using a short sea transportation project designated under section 55601 when practical or available.</text></subsection> 
<subsection id="HCBF78556775544AAA1F5225CFE83D39D"><enum>(b)</enum><header>Short-term incentives</header><text>The Secretary shall consult shippers and other participants in transportation logistics and develop proposals for short-term incentives to encourage the use of short sea transportation.</text></subsection></section> 
<section id="HB334E1A78E0745FB85FF58D068B7503"><enum>55603.</enum><header>Financing of short sea transportation projects</header> 
<subsection id="HCA2119B3BA4C4A419E57AE75C78FB7E0"><enum>(a)</enum><header>Authority To make loan guarantee</header><text>The Secretary of Transportation, subject to the availability of appropriations, may make a loan guarantee for the financing of the construction, reconstruction, or reconditioning of a vessel that will be used for a short sea transportation project designated under section 55601.</text></subsection> 
<subsection id="H644A1A5D71C9407E86EF3FB8323645E7"><enum>(b)</enum><header>Terms and conditions</header><text>In making a loan guarantee under this section, the Secretary shall use the authority, terms, and conditions that apply to a loan guarantee made under chapter 537.</text></subsection> 
<subsection id="HB7BA7D4918EC42B28B9F00CDFABDD090"><enum>(c)</enum><header>General limitations</header><text>The total unpaid principal amount of obligations guaranteed under this chapter and outstanding at one time may not exceed $2,000,000,000.</text></subsection> 
<subsection id="H9ECD9235CF1D4A6582E6FE6B00CD4E01"><enum>(d)</enum><header>Full faith and credit</header><text>The full faith and credit of the United States Government is pledged to the payment of a guarantee made under this chapter, for both principal and interest, including interest (as may be provided for in the guarantee) accruing between the date of default under a guaranteed obligation and the date of payment in full of the guarantee.</text></subsection> 
<subsection id="H04010A866FAC4F6196D6DC74B5FCD611"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $25,000,000 to carry out this section for each of fiscal years 2008 through 2011.</text></subsection></section> 
<section id="HD7D3F2E0D4DC4303BF954E03B6B2F7C2"><enum>55604.</enum><header>Interagency coordination</header><text display-inline="no-display-inline">The Secretary of Transportation shall establish a board to identify and seek solutions to impediments hindering effective use of short sea transportation. The board shall include representatives of other Federal, State, and local governmental entities and private sector entities.</text></section> 
<section commented="no" id="H4DA65F3AAF52492C9736F246BD9E7C38"><enum>55605.</enum><header>Research on short sea transportation</header><text display-inline="no-display-inline">The Secretary of Transportation may conduct research on short sea transportation, regarding—</text> 
<paragraph commented="no" id="HC45347FD99364D6780BA2DEC60EFA33B"><enum>(1)</enum><text>the environmental and transportation benefits to be derived from short sea transportation alternatives for other forms of transportation;</text></paragraph> 
<paragraph commented="no" id="H6685A4E2C07C4D918FFD276861CC13EA"><enum>(2)</enum><text>technology, vessel design, and other improvements that would reduce emissions, increase fuel economy, and lower costs of short sea transportation and increase the efficiency of intermodal transfers; and</text></paragraph> 
<paragraph commented="no" id="H4A76DC08266A408482B854DD25FD7C11"><enum>(3)</enum><text>identify and seek solutions to impediments to short sea transportation projects designated under section 55601.</text></paragraph></section> 
<section commented="no" id="HC3380E1850304714A806115D007120CC"><enum>55606.</enum><header>Short sea transportation defined</header><text display-inline="no-display-inline">In this chapter, the term <quote>short sea transportation</quote> means the carriage by vessel of cargo—</text> 
<paragraph id="HB76ED9D45EB0412B93EBCFD30011EAB"><enum>(1)</enum><text>that is—</text> 
<subparagraph id="H8C4074AC1C434E2697ED11C04D57E252"><enum>(A)</enum><text>contained in intermodal cargo containers and loaded by crane on the vessel; or</text></subparagraph> 
<subparagraph id="H2176ADB5398D47D2BC4D803D77714C09"><enum>(B)</enum><text>loaded on the vessel by means of wheeled technology; and</text></subparagraph></paragraph> 
<paragraph commented="no" id="HC148007C85D64F3287BE09E32468ACC1"><enum>(2)</enum><text>that is—</text> 
<subparagraph id="HA06258B21BA04C2D9EEB483C7CE22945"><enum>(A)</enum><text>loaded at a port in the United States and unloaded at another port in the United States or a port in Canada located in the Great Lakes Saint Lawrence Seaway System; or</text></subparagraph> 
<subparagraph commented="no" id="HAEEA549E40DD4C999555DEC2E18B3B88"><enum>(B)</enum><text>loaded at a port in Canada located in the Great Lakes Saint Lawrence Seaway System and unloaded at a port in the United States.</text></subparagraph></paragraph></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC7C16B5E01E648589F033536A21BB5FD"><enum>(b)</enum><header>Clerical amendment</header><text>The table of chapters at the beginning of subtitle V of such title is amended by inserting after the item relating to chapter 555 the following:</text>

<paragraph id="H2CB167191330484D8592C41C96FF400"><enum>(1)</enum><header>Interim regulations</header><text>Not later than December 31, 2007, the Secretary of Transportation shall issue temporary regulations to implement the program under this section. Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, does not apply to a temporary regulation issued under this paragraph or to an amendment to such a temporary regulation.</text></paragraph> 
<paragraph id="H5B30A91CE2EA4F4E95166FD11EAE57D9"><enum>(2)</enum><header>Final regulations</header><text>Not later than October 1, 2008, the Secretary shall issue final regulations to implement the program under this section.</text></paragraph></subsection></section> 
<section id="HA5B2E14BDD774349B254B1817C8CF68"><enum>402.</enum><header>Short sea shipping eligibility for capital construction fund</header> 
<subsection id="H364BB36901D74E30B01F1208FBD3C42F"><enum>(a)</enum><header>Definition of qualified vessel</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/53501">Section 53501</external-xref> of title 46, United States Code, is amended—</text> 
<paragraph id="H3F1DF8B564A34A1EA536A34930B9F0DE"><enum>(1)</enum><text>in paragraph (5)(A)(iii) by striking <quote>or noncontiguous domestic</quote> and inserting <quote>noncontiguous domestic, or short sea transportation trade</quote>; and</text></paragraph> 
<paragraph id="H1F5671B81C784494B0CF1E52D503D946"><enum>(2)</enum><text>by inserting after paragraph (6) the following:</text>

<clause id="HBF82E3281B4B473A95E8EE45DE00A0BF"><enum>(i)</enum><text>contained in intermodal cargo containers and loaded by crane on the vessel; or</text></clause> 
<clause id="HDF3B1EAA36BA4E2A8B48FFE7CFF18B65"><enum>(ii)</enum><text>loaded on the vessel by means of wheeled technology; and</text></clause></subparagraph>

<subsection id="H514536C1E3994115924D097DAEE6DDA"><enum>(b)</enum><header>Allowable purpose</header><text>Section 53503(b) of such title is amended by striking <quote>or noncontiguous domestic trade</quote> and inserting <quote>noncontiguous domestic, or short sea transportation trade</quote>.</text></subsection></section> 
<section id="H50DFBB27A37A481590E7AE3C895326C8"><enum>403.</enum><header>Report</header><text display-inline="no-display-inline">Not later than one year after the date of enactment of this Act, the Secretary of Transportation shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the short sea transportation program established under the amendments made by section 401. The report shall include a description of the activities conducted under the program, and any recommendations for further legislative or administrative action that the Secretary considers appropriate.</text></section> 
<section id="HEEE5557727774AA2848CB374DCC9FFD5"><enum>404.</enum><header>Green ports initiative</header> 
<subsection id="HA26948DB5D094BD700CE6DE78471DE19"><enum>(a)</enum><header>In general</header> 
<paragraph display-inline="no-display-inline" id="HBAADA09A0DE147E291FFDFB74389DE3B"><enum>(1)</enum><header>Development and implementation</header><text>The Secretary of Transportation shall develop and implement a green port initiative to promote the use of technologies in United States ports and shipyards to reduce air emissions including particulate matter, nitrogen oxides, sulfur oxides, and carbon monoxides. The program may include—</text> 
<subparagraph id="HE6034487235B4B0EA29E61581CE2C6DD"><enum>(A)</enum><text>use of electric and low-emission vehicles for cargo handling equipment;</text></subparagraph> 
<subparagraph id="H1AEEF401608B4F5DB58DDB8779FC5E44"><enum>(B)</enum><text>use of electric shore power and low pollution auxiliary engines for vessels in port;</text></subparagraph> 
<subparagraph id="HF0DE6CE19E934038A0E9F81E09CE5CE4"><enum>(C)</enum><text>use of energy efficient lighting and other electrical products in ports;</text></subparagraph> 
<subparagraph id="H710A8B8D261E4310A9ED5E61EC2510F1"><enum>(D)</enum><text>use of best management practices to decrease emissions;</text></subparagraph> 
<subparagraph id="H8CE9FB150F7A4C4AB4C991F669B9321"><enum>(E)</enum><text>use of technology and best management practices to prevent pollution of the waters in ports; and</text></subparagraph> 
<subparagraph id="HBBE9957C36A945A3AA8D08FFEFB7C653"><enum>(F)</enum><text>use of other energy efficient or low emission technologies that the Secretary considers necessary.</text></subparagraph></paragraph> 
<paragraph id="H551C035770664F959113CE4135FC9485"><enum>(2)</enum><header>Green port award</header><text>The Secretary may issue a green port award to a port that meets the standards for that award prescribed by the Secretary for low emissions and pollution by a port.</text></paragraph></subsection> 
<subsection id="HAAEEEE3F9D684A0186EA1711671B516D"><enum>(b)</enum><header>Clean technology assistance</header> 
<paragraph id="H4DC98E6718EB4E4BB212A1CA80009E5"><enum>(1)</enum><header>In general</header><text>The Secretary may provide grants and low-cost revolving loans, as determined by the Secretary, on a competitive basis, to ports, terminal operators, and shipyards to achieve significant reductions in diesel emissions of particulate matter, nitrogen oxides, and sulfur oxides in United States ports.</text></paragraph> 
<paragraph id="H0F68C9534AD2445A9C754EEE9DA163BD"><enum>(2)</enum><header>Prioritization</header><text>The Secretary shall provide grants and loans to the applicants that will use the funds provided to remove the largest amount of pollutants for each dollar provided in the grant or loan.</text></paragraph> 
<paragraph id="H3D15D60D3A1241778573F500FB03BA7"><enum>(3)</enum><header>Applications</header> 
<subparagraph id="HC71382FB7A02427698A89DE021EA8E26"><enum>(A)</enum><header>In general</header><text>To receive a grant or loan under this subsection, a port, terminal operator, or shipyard shall submit to the Secretary an application at a time, in a manner, and including any information that the Secretary may require.</text></subparagraph> 
<subparagraph id="HC8D84C1804C04A978EBAF5F425B4BB3B"><enum>(B)</enum><header>Inclusions</header><text>An application under this paragraph shall include—</text> 
<clause id="H2E6C4401A42941B38C9B57396D54ABDB"><enum>(i)</enum><text>a description of the air quality of the area served by the port, terminal operator, or shipyard;</text></clause> 
<clause id="H82A854BA7F9D4E5B904063BCDE1D15F9"><enum>(ii)</enum><text>the quantity of air pollution produced in the port area served by the port, terminal operator, or shipyard;</text></clause> 
<clause id="H83FEA082C25A4E54B636F5D689DB7EDF"><enum>(iii)</enum><text>a description of the project proposed by the port, terminal operator, or shipyard, including the means by which the project will achieve a significant reduction in diesel emissions;</text></clause> 
<clause id="H193FBF793E2449E1A2885C22C900E774"><enum>(iv)</enum><text>an evaluation (using methodology approved by the Secretary) of the benefits of the emissions reductions of the proposed project;</text></clause> 
<clause id="H1478CF2580EF407CB2E44C58BE004EE8"><enum>(v)</enum><text>an estimate of the cost of the proposed project; and</text></clause> 
<clause id="H9268B4BA376740E6AFF83DB5746E2F52"><enum>(vi)</enum><text>provisions for the monitoring and verification of the project.</text></clause></subparagraph></paragraph> 
<paragraph id="H3826C45EF632484400C02CEF00C65E5"><enum>(4)</enum><header>Use of funds</header> 
<subparagraph id="HF37D2D15CB74408891D0BCB3B6ED8D07"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A port, terminal operator, or shipyard may use a grant or loan provided under this subsection to fund the costs of—</text> 
<clause id="HF62A17F00FBF4189AA2F04DA078D1C00"><enum>(i)</enum><text>a technology (including any incremental costs of a repowered or new diesel engine) that significantly reduces emissions through development and implementation of a certified engine configuration, verified technology, or emerging technology for—</text> 
<subclause id="H5531641592F74320B2365728B5685320"><enum>(I)</enum><text>a medium-duty truck or a heavy-duty truck;</text></subclause> 
<subclause id="HB9E12AB3037944688B09F6C6ED0059F5"><enum>(II)</enum><text>a marine engine;</text></subclause> 
<subclause id="H183335B238064A9F86F065FCB1EF21C"><enum>(III)</enum><text>a nonroad engine or vehicle used in applications such as handling of cargo; and</text></subclause> 
<subclause id="H58637798B4B24E0BA8C0000006EBB9B"><enum>(IV)</enum><text>electric shore power and low pollution auxiliary engines for vessels in port; and</text></subclause></clause> 
<clause id="H7183AC2614F04F079000A7A9C4B47E96"><enum>(ii)</enum><text>an idle-reduction program involving a vehicle or equipment.</text></clause></subparagraph> 
<subparagraph id="HE3741996EAFE46C0A571CECE199EC168"><enum>(B)</enum><header>Regulatory programs</header><text>Notwithstanding paragraph (1), no grant or loan provided under this subsection may be used to fund the costs of emissions reductions that are mandated under Federal, State, or local law.</text></subparagraph> 
<subparagraph id="H1FA37AA704E9476EBDD208AA2E403DFC"><enum>(C)</enum><header>Engines</header><text>A recipient of a grant or loan under this subsection may only use the funds under the grant or loan for engines that are certified for low emissions and technology that has been verified in a manner prescribed by the Secretary as producing low emissions.</text></subparagraph></paragraph> 
<paragraph id="HB6514E6D48454A16B79CAEFBC916DC81"><enum>(5)</enum><header>Federal share</header><text>The Federal share of the costs for a project for which a grant is made under this subsection may not exceed 90 percent.</text></paragraph> 
<paragraph id="H396CC3C3103146619E3E6F95B11CF2D8"><enum>(6)</enum><header>Limitation on amount</header><text>A grant or loan under this subsection may not exceed $1,000,000.</text></paragraph> 
<paragraph id="H92FD202758F94AC398A72BF300E9EB52"><enum>(7)</enum><header>Technical review team</header><text>The Secretary shall establish a technical review team comprised of members from agencies within the Department of Transportation to review proposals for grants and loans under this subsection. The Secretary shall select agencies to serve as review panel participants based on the Secretary’s determination that they possess the necessary expertise and knowledge to evaluate the proposals.</text></paragraph> 
<paragraph commented="no" id="HDC3E759964F14154B056A6F5EE2C22D7"><enum>(8)</enum><header>Authorization of Appropriations</header><text>There is authorized to be appropriated $25,000,000 for each of fiscal years 2008 through 2011 to carry out this subsection.</text></paragraph></subsection> 
<subsection commented="no" id="H1BB1E9C2EF3B448E9D7D908234319876"><enum>(c)</enum><header>Use of settlement amounts</header> 
<paragraph commented="no" id="H75E6B65C1EBE4B54B22374AE941E4DA7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Maritime Administrator, shall consult with the Attorney General regarding the payment to maritime emission reduction foundations authorized by the Administrator of amounts collected by the Government as a result of settlements relating to allegations of violations of environmental laws related to vessels, ports, and port-related services.</text></paragraph>

<subsection id="H1287C02D18264506ACC3277F70C3ACBF"><enum>(d)</enum><header>Testing program</header> 
<paragraph display-inline="no-display-inline" id="H89A42D9855D54B1497B9AF75F4BEDE18"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the Maritime Administrator, may establish a cooperative partnership with the Administrator of the Environmental Protection Agency, or any other agency the Secretary determines to be appropriate, to test emissions reduction technology on actual vessels.</text></paragraph> 
<paragraph id="H8FAACC80EE24418600F8595C61DF98BB"><enum>(2)</enum><header>Technologies to be tested</header><text>The program under this subsection shall be based on emergent and existing technologies that have been verified effective under laboratory conditions.</text></paragraph> 
<paragraph id="HB517FC5A432A4B95ADCE73ABFEDF9CA0"><enum>(3)</enum><header>Maintenance of vessel usability</header><text>Any technology tested under this subsection must not permanently alter or render the vessel on which it is tested ineffective for long-term Maritime Administration use.</text></paragraph> 
<paragraph id="H6C00AF88C3E5430AAB77CACB10EF9500"><enum>(4)</enum><header>Administration priorities and needs</header><text>The Secretary shall designate vessels as platforms for testing under this subsection in accordance with Maritime Administration priorities and needs.</text></paragraph> 
<paragraph id="HA3CD8637D2AA4AF08FBBAA0131DD14F9"><enum>(5)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary $6,000,000 to administer and implement cooperative partnerships established under paragraph (1).</text></paragraph></subsection></section></subtitle>

<paragraph id="H0388D8E9A4C946B8819D63BEB8882F89"><enum>(1)</enum><text>by redesignating subsections (b) and (c) as subsections (c) and (d), respectively;</text></paragraph>

<subsection id="H3C4F14D5949F41B59111044EECBE44AB"><enum>(b)</enum><header>Duty of the Administrator</header><text>In addition to other duties specified in this Act, the Administrator and the Secretary, respectively, shall have the following duties and authorities:</text> 
<paragraph id="H182711FAECD9410E9CC6351CA0FA48FD"><enum>(1)</enum><text>The Administrator shall, and no other person may, issue Engine International Air Pollution Prevention certificates in accordance with Annex VI and the International Maritime Organization’s Technical Code on Control of Emissions of Nitrogen Oxides from Marine Diesel Engines, on behalf of the United States for a vessel of the United States as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/46/116">section 116</external-xref> of title 46, United States Code. The issuance of Engine International Air Pollution Prevention certificates shall be consistent with any applicable requirements of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) or regulations prescribed under that Act.</text></paragraph> 
<paragraph id="HF95EB2E92DF14C890052F2EC28B82058"><enum>(2)</enum><text>The Administrator shall have authority to administer regulations 12, 13, 14, 15, 16, 17, 18, and 19 of Annex VI to the Convention.</text></paragraph> 
<paragraph id="H78FEBC4AFD0945909933C3D822CAB37"><enum>(3)</enum><text>The Administrator shall, only as specified in section 8(f), have authority to enforce Annex VI of the Convention.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HED856CE934A94E28ADA0637E57134D47"><enum>(3)</enum><text>in subsection (c), as redesignated—</text>

<paragraph id="HD2F1524DA5BB4E83A87E777800183916" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In prescribing any regulations under this section, the Secretary and the Administrator shall consult with each other, and with respect to regulation 19, with the Secretary of the Interior.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H4EC64581AEDB45D0BE1550320068519E"><enum>(C)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H34CC1BF9F1C047A78C99E217FBF4BE8" style="OLC"> 
<paragraph id="HAED062F047FC41E2954F13E17D17E67F" indent="up1"><enum>(5)</enum><text>No standard issued by any person or Federal authority, with respect to emissions from tank vessels subject to regulation 15 of Annex VI to the Convention, shall be effective until 6 months after the required notification to the International Maritime Organization by the Secretary.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></subparagraph></paragraph></section> 
<section id="H711E266C1C6E4DB390243D96A1185DB9"><enum>455.</enum><header>Certificates</header><text display-inline="no-display-inline">Section 5 (<external-xref legal-doc="usc" parsable-cite="usc/33/1904">33 U.S.C. 1904</external-xref>) is amended—</text>

<section id="HC16DA678966A4AF592D69534C31F8BA1"><enum>456.</enum><header>Reception facilities</header><text display-inline="no-display-inline">Section 6 (<external-xref legal-doc="usc" parsable-cite="usc/33/1905">33 U.S.C. 1905</external-xref>) is amended—</text> 
<paragraph id="H1AB88B2F717746F08EE34735F4C829A5"><enum>(1)</enum><text>in subsection (a) by adding at the end the following:</text>

<paragraph id="HF02DF09211AD4B1EBB93E258BF82EF8D" indent="up1"><enum>(3)</enum><text>The Secretary and the Administrator, after consulting with appropriate Federal agencies, shall jointly prescribe regulations setting criteria for determining the adequacy of reception facilities for receiving ozone depleting substances, equipment containing such substances, and exhaust gas cleaning residues at a port or terminal, and stating any additional measures and requirements as are appropriate to ensure such adequacy. Persons in charge of ports and terminals shall provide reception facilities, or ensure that reception facilities are available, in accordance with those regulations. The Secretary and the Administrator may jointly prescribe regulations to certify, and may issue certificates to the effect, that a port’s or terminal’s facilities for receiving ozone depleting substances, equipment containing such substances, and exhaust gas cleaning residues from ships are adequate.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph> 
<paragraph id="H4FF209C42FB4401CB21900E627CC8E56"><enum>(2)</enum><text>in subsection (b) by inserting <quote>or the Administrator</quote> after <quote>Secretary</quote>;</text></paragraph>

<paragraph display-inline="no-display-inline" id="HEA74838D20F84F349C66E0F59CA5D453" indent="up1"><enum>(2)</enum><text>If an inspection under this subsection or any other information indicates that a violation has occurred, the Secretary, or the Administrator in a matter referred by the Secretary, may undertake enforcement action under this section.</text></paragraph> 
<paragraph id="H262680C5FB00431B94B11EA1585350A6" indent="up1"><enum>(3)</enum><text>Notwithstanding subsection (b) and paragraph (2) of this subsection, the Administrator shall have all of the authorities of the Secretary, as specified in subsection (b) of this section, for the purposes of enforcing regulations 17 and 18 of Annex VI to the Convention to the extent that shoreside violations are the subject of the action and in any other matter referred to the Administrator by the Secretary.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>

<subsection id="H7D92E002D47241CC8712D0C70055569B"><enum>(a)</enum><header>Cooperative agreement</header><text>Subchapter I of chapter 475 of tite 49, United States Code, is amended by adding at the end the following:</text>

<section id="HD2E3737E08B745C788FBC0522C97C4AF"><enum>47511.</enum><header>CLEEN engine and airframe technology partnership</header> 
<subsection id="H38BF3EB738104EACB7785335E3585954"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Federal Aviation Administration shall enter into a cooperative agreement, using a competitive process, with an institution, entity, or consortium to carry out a program for the development, maturing, and certification of CLEEN engine and airframe technology for aircraft over the next 10 years.</text></subsection> 
<subsection id="H4543D272060A4541B8C04FBB8D364D5B"><enum>(b)</enum><header>CLEEN engine and airframe technology defined</header><text>In this section, the term <quote>CLEEN engine and airframe technology</quote> means continuous lower energy, emissions, and noise engine and airframe technology.</text></subsection> 
<subsection id="H6694A0655423468E88D388DA42E305E2"><enum>(c)</enum><header>Performance objective</header><text>The Administrator shall establish the following performance objectives for the program, to be achieved by September 30, 2015:</text> 
<paragraph id="H4638268F225E4FE1B3538FE123CD92DF"><enum>(1)</enum><text>Development of certifiable aircraft technology that reduces greenhouse gas emissions by increasing aircraft fuel efficiency by 25 percent relative to 1997 subsonic jet aircraft technology.</text></paragraph> 
<paragraph id="H38451CD665C540FAAAD1B2A284DE0043"><enum>(2)</enum><text>Development of certifiable engine technology that reduces landing and takeoff cycle nitrogen oxide emissions by 50 percent, without increasing other gaseous or particle emissions, over the International Civil Aviation Organization standard adopted in 2004.</text></paragraph> 
<paragraph id="H00B320BDF9F64F218B58B8C2D005BEDC"><enum>(3)</enum><text display-inline="yes-display-inline">Development of certifiable aircraft technology that reduces noise levels by 10 decibels at each of the 3 certification points relative to 1997 subsonic jet aircraft technology.</text></paragraph> 
<paragraph id="H240DF8D6634E4A45A6EAAE5EC6406100"><enum>(4)</enum><text>Determination of the feasibility of the use of alternative fuels in aircraft systems, including successful demonstration and quantification of the benefits of such fuels.</text></paragraph> 
<paragraph id="H04ED6F07A24A433EA6CED45BB20015F2"><enum>(5)</enum><text>Determination of the extent to which new engine and aircraft technologies may be used to retrofit or re-engine aircraft to increase the integration of retrofitted and re-engined aircraft into the commercial fleet.</text></paragraph></subsection> 
<subsection id="H317486E7C4444FCBBE81F683B7980647"><enum>(d)</enum><header>Clean coal to jet fuel research</header> 
<paragraph id="H9E037D634F264CFDBB13E1FDF5F8FA90"><enum>(1)</enum><header>Establishment of research program</header><text>The Secretary of Transportation shall conduct a research program related to developing jet fuel from clean coal through grants or other measures authorized under section 106(l)(6) of such title, including reimbursable agreements with other Federal agencies. The Secretary may include as a purpose of the program a demonstration of the capture and sequestration of the carbon dioxide produced in the conversion process of coal to jet fuel. The program shall include participation by educational and research institutions that have existing facilities and experience in the development and deployment of technology that processes coal to aviation fuel.</text></paragraph> 
<paragraph id="H25099A5E8E4A433EB224C365E1757B11"><enum>(2)</enum><header>Designation of institute as a center of excellence</header><text>Within 6 months after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall designate through a competitive process an institution described in subsection (a) as a Center of Excellence for Coal to Jet Fuel Research.</text></paragraph></subsection> 
<subsection id="HC8A2C196502D44BABA84E33F691CEFA"><enum>(e)</enum><header>Funding</header><text display-inline="yes-display-inline">Of amounts appropriated under section 48102(a), not more than the following amounts may be used to carry out this section:</text> 
<paragraph id="HD0A826B5327144C9BDCF1DE0F7EFB56"><enum>(1)</enum><text>$6,000,000 for fiscal year 2008.</text></paragraph> 
<paragraph id="H45E29EC9667A4BDDAD336978DACFCB"><enum>(2)</enum><text>$22,000,000 for fiscal year 2009.</text></paragraph> 
<paragraph id="H8FB59AA48B0A4A6686C3DA1FC1AFCDA"><enum>(3)</enum><text>$33,000,000 for fiscal year 2010.</text></paragraph>

<subsection id="H827FF5A39DCD49A08DA9C94D42D324A"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Transportation shall establish a pilot program to carry out not more than 6 environmental mitigation demonstration projects at public-use airports.</text></subsection> 
<subsection id="H03FA7300F940477C85143FEE442F1E83"><enum>(b)</enum><header>Grants</header><text>In implementing the program, the Secretary may make a grant to the sponsor of a public-use airport from funds apportioned under <external-xref legal-doc="usc" parsable-cite="usc/49/47117">section 47117(e)(1)(A)</external-xref> of title 49, United States Code, to carry out an environmental mitigation demonstration project to measurably reduce or mitigate aviation impacts on noise, air quality, or water quality in the vicinity of the airport.</text></subsection> 
<subsection commented="no" id="HCDECD4BC62894F659F64E16C3CD4126B"><enum>(c)</enum><header>Eligibility for passenger facility fees</header><text display-inline="yes-display-inline">An environmental mitigation demonstration project that receives funds made available under this section may be considered an eligible airport-related project for purposes of section 40117 of such title.</text></subsection> 
<subsection id="H67476DD3E1D14AFB892CD629A0200088"><enum>(d)</enum><header>Selection criteria</header><text>In selecting among applicants for participation in the program, the Secretary shall give priority consideration to applicants proposing to carry out environmental mitigation demonstration projects that will—</text> 
<paragraph id="H779551F574734B3281AC496C95DC943B"><enum>(1)</enum><text>achieve the greatest reductions in aircraft noise, airport emissions, or airport water quality impacts either on an absolute basis or on a per dollar of funds expended basis; and</text></paragraph> 
<paragraph id="HAB7240A020F04DA28D4CF1AA36F25EFB"><enum>(2)</enum><text>be implemented by an eligible consortium.</text></paragraph></subsection> 
<subsection id="HAC32141F11E043C8A808C14619E449C"><enum>(e)</enum><header>Federal share</header><text display-inline="yes-display-inline">Notwithstanding any provision of subchapter I of chapter 471 of such title, the United States Government share of allowable project costs of an environmental mitigation demonstration project carried out under this section shall be 50 percent.</text></subsection> 
<subsection id="H2B6D317DDA244F6C93ADC2F0EECE8B7F"><enum>(f)</enum><header>Maximum amount</header><text>The Secretary may not make grants for a single environmental mitigation demonstration project under this section in a total amount that exceeds $2,500,000.</text></subsection> 
<subsection id="HB97C07AE732A4C838F41EB7EF9C83D04"><enum>(g)</enum><header>Publication of information</header><text>The Secretary may develop and publish information on the results of environmental mitigation demonstration projects carried out under this section, including information identifying best practices for reducing or mitigating aviation impacts on noise, air quality, or water quality in the vicinity of airports.</text></subsection> 
<subsection id="HF42BAF220FBE4765B035015CCC9D1D00"><enum>(h)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> 
<paragraph id="HC0C39759D5F04E5AA774F3CE2F6553C4"><enum>(1)</enum><header>Eligible consortium</header><text>The term <quote>eligible consortium</quote> means a consortium of 2 or more of the following entities:</text> 
<subparagraph id="H242B8EE4C82F4EC98C69938ED4D9F318"><enum>(A)</enum><text>A business incorporated in the United States.</text></subparagraph> 
<subparagraph id="H6B3E80EC0F574A03866007F931D81375"><enum>(B)</enum><text>A public or private educational or research organization located in the United States.</text></subparagraph> 
<subparagraph id="HA86C5A1BAF3F4E92B1F5F1DED6120C9"><enum>(C)</enum><text>An entity of a State or local government.</text></subparagraph> 
<subparagraph id="HC9ADEDBFF5194F3399D22817D301D9E"><enum>(D)</enum><text>A Federal laboratory.</text></subparagraph></paragraph> 
<paragraph id="H7F06CE6A4993422184375F38E23DB93D"><enum>(2)</enum><header>Environmental mitigation demonstration project</header><text>The term <quote>environmental mitigation demonstration project</quote> means a project that—</text> 
<subparagraph id="H3897228935E5473C8926755BAD6765F"><enum>(A)</enum><text>demonstrates at a public-use airport environmental mitigation techniques or technologies with associated benefits, which have already been proven in laboratory demonstrations;</text></subparagraph> 
<subparagraph id="H3DBC327E41634039A3E5E647B41CEA82"><enum>(B)</enum><text>utilizes methods for efficient adaptation or integration of innovative concepts to airport operations; and</text></subparagraph> 
<subparagraph id="HAF2B8FBDFA6B40FCAE67A82EF0E59EED"><enum>(C)</enum><text>demonstrates whether a technique or technology for environmental mitigation identified in research is—</text> 
<clause id="HABF283B4F4C147FB9BF7D694B7EB2FFC"><enum>(i)</enum><text>practical to implement at or near multiple public-use airports; and</text></clause> 
<clause id="H5532010B39B643ECACC41D23FB4EA59C"><enum>(ii)</enum><text>capable of reducing noise, airport emissions, greenhouse gas emissions, or water quality impacts in measurably significant amounts.</text></clause></subparagraph></paragraph></subsection></section></title> 
<title id="H706694033D534B1DA300D7DD4C1F20F2"><enum>VI</enum><header>Public Buildings</header> 
<subtitle id="HD9B3ADC9D01B4BD49B7C3C29E2A19F14"><enum>A</enum><header>General Services Administration</header>

<subsection id="HEEBEECD63E0D4752B3031C14EFAD8B75"><enum>(b)</enum><header>Minimum performance requirements for leased space</header><text>Section 3307 of such of title is amended—</text> 
<paragraph id="H69274A52C5DA4142A88511434FA5C945"><enum>(1)</enum><text>by redesignating subsections (f) and (g) as subsections (g) and (h), respectively; and</text></paragraph> 
<paragraph id="H4C4D6F143D024EB79787A431BAF37DF3"><enum>(2)</enum><text>by inserting after subsection (e) the following:</text>

<subsection id="H50D401E2BF3D471EA3E5006400E32057"><enum>(a)</enum><header>Construction, alteration, and acquisition of public buildings</header><text>Each public building constructed, altered, or acquired by the Administrator of General Services shall be equipped, to the maximum extent feasible as determined by the Administrator, with lighting fixtures and bulbs that are energy efficient.</text></subsection> 
<subsection id="H287317C198AE4737833DA84B37CBAFEA"><enum>(b)</enum><header>Maintenance of public buildings</header><text display-inline="yes-display-inline">Each lighting fixture or bulb that is replaced by the Administrator in the normal course of maintenance of public buildings shall be replaced, to the maximum extent feasible, with a lighting fixture or bulb that is energy efficient.</text></subsection> 
<subsection id="H96800A30FADC4011A3759E07ADA3183"><enum>(c)</enum><header>Considerations</header><text>In making a determination under this section concerning the feasibility of installing a lighting fixture or bulb that is energy efficient, the Administrator shall consider—</text> 
<paragraph id="HD1ADCD42BB9C4809B085C9382C778100"><enum>(1)</enum><text>the life-cycle cost effectiveness of the fixture or bulb;</text></paragraph> 
<paragraph id="HF2D5B60465A448818D24C89C13980266"><enum>(2)</enum><text>the compatibility of the fixture or bulb with existing equipment;</text></paragraph> 
<paragraph id="H68CE436B29794D6AA804828480E884F6"><enum>(3)</enum><text>whether use of the fixture or bulb could result in interference with productivity;</text></paragraph> 
<paragraph id="H6A47F2EAE01C4A0800A4018667C109E"><enum>(4)</enum><text>the aesthetics relating to use of the fixture or bulb; and</text></paragraph> 
<paragraph id="H000695BAD49E47B7AA6F76C94FCD5961"><enum>(5)</enum><text>such other factors as the Administrator determines appropriate.</text></paragraph></subsection> 
<subsection id="H0AF21F14E4024A63A2B87FEDFDFE6539"><enum>(d)</enum><header>Energy star</header><text display-inline="yes-display-inline">A lighting fixture or bulb shall be treated as being energy efficient for purposes of this section if—</text> 
<paragraph id="HE3DFDAFDD6F94F889D4DFDCADAF6C72F"><enum>(1)</enum><text>the fixture or bulb is certified under the Energy Star program established by section 324A of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294a">42 U.S.C. 6294a</external-xref>); or</text></paragraph> 
<paragraph id="H54BBC4981F2940018FB96B7900814E5"><enum>(2)</enum><text>the Administrator has otherwise determined that the fixture or bulb is energy efficient.</text></paragraph></subsection> 
<subsection id="H4A02FC580E6D4F8CB703E5BC46C824AC"><enum>(e)</enum><header>Applicability of Buy American Act</header><text>Aquisitions carried out pursuant to this section shall be subject to the requirements of the Buy American Act (<external-xref legal-doc="usc" parsable-cite="usc/41/10c">41 U.S.C. 10c et seq.</external-xref>).</text></subsection> 
<subsection id="H743A991544AB443DB5C1E72B2349531F"><enum>(f)</enum><header>Effective date</header><text>The requirements of subsections (a) and (b) shall take effect one year after the date of enactment of this subsection.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>

<section id="H2560EE3AAAB3445A9CA31CFB2B913B00" section-type="subsequent-section"><enum>603.</enum><header>Installation of photovoltaic system at department of energy headquarters building</header> 
<subsection id="HFA72D25AF14F419C8E9B34B05C09F530"><enum>(a)</enum><header>In general</header><text>The Administrator of General Services shall install a photovoltaic system, as set forth in the Sun Wall Design Project, for the headquarters building of the Department of Energy located at 1000 Independence Avenue, SW., Washington, DC, commonly known as the Forrestal Building.</text></subsection> 
<subsection id="HE2F1391D852842A392B2BB87078930BC"><enum>(b)</enum><header>Funding</header><text>There shall be available from the Federal Buildings Fund established by <external-xref legal-doc="usc" parsable-cite="usc/40/592">section 592</external-xref> of title 40, United States Code, $30,000,000 to carry out this section. Such sums shall be derived from the unobligated balance of amounts made available from the Fund for fiscal year 2007, and prior fiscal years, for repairs and alternations and other activities (excluding amounts made available for the energy program). Such sums shall remain available until expended.</text></subsection>

<subsection id="H915950AB45B04A20916E61A6B9A7CFF9"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Except as provided by subsection (b), on and after January 1, 2009, a general service incandescent lamp shall not be purchased or installed in a Coast Guard facility by or on behalf of the Coast Guard.</text></subsection> 
<subsection id="H04C7B532B56A4DA7B8EF4E4F31AC2343"><enum>(b)</enum><header>Exception</header><text>A general service incandescent lamp may be purchased, installed, and used in a Coast Guard facility whenever the application of a general service incandescent lamp is—</text> 
<paragraph id="HB81FCAFBF1774739B6E5B038D4C2A696"><enum>(1)</enum><text>necessary due to purpose or design, including medical, security, and industrial applications;</text></paragraph> 
<paragraph id="H0426861861A049B0B129D300C77CCEAD"><enum>(2)</enum><text>reasonable due to the architectural or historical value of a light fixture installed before January 1, 2009; or</text></paragraph> 
<paragraph id="H3C55BDDD71F748B6B0517DE6EDB25455"><enum>(3)</enum><text>the Commandant of the Coast Guard determines that operational requirements necessitate the use of a general service incandescent lamp.</text></paragraph></subsection> 
<subsection id="H1745974E5A484FA8911F70B748B6B300"><enum>(c)</enum><header>Limitation</header><text>In this section, the term <quote>facility</quote> does not include a vessel or aircraft of the Coast Guard.</text></subsection></section></subtitle> 
<subtitle id="HEBFACADE34AA44F3902D8C17C179F92D"><enum>C</enum><header>Architect of the Capitol</header> 
<section id="H29FFBCE0B90A4386A74CEB9EA75F1E79"><enum>651.</enum><header>Capitol complex photovoltaic roof feasibility study</header> 
<subsection id="H34942DF33C794677B95219B75D5717B2"><enum>(a)</enum><header>Study</header><text>The Architect of the Capitol may perform a feasibility study regarding construction of a photovoltaic roof for the Rayburn House Office Building.</text></subsection> 
<subsection id="H271AE44B7F864201AE426933A5C3BB1"><enum>(b)</enum><header>Report</header><text>Not later than 6 months after the date of enactment of this Act, the Architect of the Capitol shall transmit to the Committee on Transportation and Infrastructure of the House of Representatives a report on the results of the feasibility study and recommendations regarding construction of a photovoltaic roof for the building referred to in subsection (a).</text></subsection> 
<subsection id="H8B1CBCA36F6F4493A614AA79FA006874"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for fiscal year 2008.</text></subsection></section> 
<section id="HBC4019EAEFF049BEB032169C411092B3"><enum>652.</enum><header>Capitol complex E–85 refueling station</header> 
<subsection id="HD564398B6B71465984E68EE4B087BFB9"><enum>(a)</enum><header>Construction</header><text>The Architect of the Capitol may construct a fuel tank and pumping system for E–85 fuel at or within close proximity to the Capitol Grounds Fuel Station.</text></subsection> 
<subsection id="H74E2164EC68F46A287885536BB078567"><enum>(b)</enum><header>Use</header><text>The E–85 fuel tank and pumping system shall be available for use by all legislative branch vehicles capable of operating with E–85 fuel, subject to such other legislative branch agencies reimbursing the Architect of the Capitol for the costs of E–85 fuel used by such other legislative branch vehicles.</text></subsection> 
<subsection id="HF60735E6736F4B0081CF28BADACC9654"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for fiscal year 2008.</text></subsection></section> 
<section id="H251F8F0F44244836A77E1F5D1226CB25"><enum>653.</enum><header>Energy and environmental measures in Capitol complex master plan</header> 
<subsection id="H86AAB340F229443F84F5BD455DE4AD36"><enum>(a)</enum><header>In general</header><text>To the maximum extent practicable, the Architect of the Capitol shall include energy efficiency measures, climate change mitigation measures, and other appropriate environmental measures in the Capitol Complex Master Plan.</text></subsection> 
<subsection id="H8334C6970ABA472B8D94CBB8A5C9EC71"><enum>(b)</enum><header>Report</header><text>Not later than 6 months after the date of enactment of this Act, the Architect of the Capitol shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Rules of the Senate a report on the energy efficiency measures, climate change mitigation measures, and other appropriate environmental measures included in the Capitol Complex Master Plan pursuant to subsection (a).</text></subsection></section> 
<section id="H60886582B5F24C2DACBE17077B5F5866" display-inline="no-display-inline" section-type="subsequent-section"><enum>654.</enum><header>Capitol Power Plant</header> 
<subsection id="H2E9C6F3EEB054A00B350F7EB59C6F49"><enum>(a)</enum><header>In general</header><text>For the purpose of reducing carbon dioxide emissions, the Architect of the Capitol shall install technologies for the capture and storage or use of carbon dioxide emitted from the Capitol Power plant as a result of burning coal.</text></subsection> 
<subsection id="H18AB310A0469440387E754DB792191E9"><enum>(b)</enum><header>Capitol power plant defined</header><text>In this section, the term <quote>Capitol power plant</quote> means the power plant constructed in the vicinity of the Capitol Complex in the District of Columbia pursuant to the Act of April 28, 1904 (33 Stat. 479, chapter 1762), and designated under the Act of March 4, 1911 (<external-xref legal-doc="usc" parsable-cite="usc/2/2162">2 U.S.C. 2162</external-xref>).</text></subsection></section></subtitle></title> 
<title id="H74587A23559D416F9F5900698736B91"><enum>VII</enum><header>Water Resources and Emergency Management Preparedness</header> 
<subtitle id="H4C0BFB0514E047F1002DAB0545B3D206"><enum>A</enum><header>Water Resources</header> 
<section id="H17028BFAF1C746258D62DCD531ACF22D"><enum>701.</enum><header>Policy of the United States</header><text display-inline="no-display-inline">It is the policy of the United States that all Federal water resources projects—</text> 
<paragraph id="HEA22B8437C8249BB91DF819FF54DEAD1"><enum>(1)</enum><text>reflect national priorities for flood damage reduction, navigation, ecosystem restoration, and hazard mitigation and consider the future impacts of increased hurricanes, droughts, and other climate change-related weather events;</text></paragraph> 
<paragraph id="H412B7AD1AC744285AADF4BEABAF5B213"><enum>(2)</enum><text>avoid the unwise use of floodplains, minimize vulnerabilities in any case in which a floodplain must be used, protect and restore the extent and functions of natural systems, and mitigate any unavoidable damage to aquatic natural system; and</text></paragraph> 
<paragraph id="H98404D857D5649190050F17921DF5F7D"><enum>(3)</enum><text>to the maximum extent possible, avoid impacts to wetlands, which create natural buffers, help filter water, serve as recharge areas for aquifers, reduce floods and erosion, and provide valuable plant and animal habitat.</text></paragraph></section> 
<section id="H35E0A183480B47FD9C00F8A91FDD9B69"><enum>702.</enum><header>21st Century Water Commission</header> 
<subsection id="H65597E1AAE754494B6C2F74692EF2DFE"><enum>(a)</enum><header>Establishment</header><text>There is established a commission to be known as the 21st Century Water Commission (in this section referred to as the <quote>Commission</quote>).</text></subsection> 
<subsection id="HA9364236A53243FEB7C4F5F514509F0"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">The duties of the Commission shall be to—</text> 
<paragraph id="HE72BA6E0CC91497AA584CEECC0A98388"><enum>(1)</enum><text>use existing water assessments and conduct such additional studies and assessments as may be necessary to project—</text> 
<subparagraph id="HD31A4F32064740609F21A9CB07179D3C"><enum>(A)</enum><text>future water supply and demand;</text></subparagraph> 
<subparagraph id="H911568690B8B4D8B9E6B767190344DA9"><enum>(B)</enum><text>impacts of climate change to our Nation’s flood risk and water demand; and</text></subparagraph> 
<subparagraph id="H208273902F78498FBC3F93B314002698"><enum>(C)</enum><text>associated impacts of climate change on water quality;</text></subparagraph></paragraph> 
<paragraph id="H46ED200E6C5E4A3FB5DDB18A1E1E300"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H57EB0622441A4F1A9E84F89D2EF4FB3E"><enum>(A)</enum><text>study current water management programs of Federal, interstate, State, and local agencies and private sector entities directed at increasing water supplies and improving the availability, reliability, and quality of freshwater resources; and</text></subparagraph> 
<subparagraph id="H049ADA20B47C49A2BD8439E266CFC935" indent="up1"><enum>(B)</enum><text>evaluate such programs’ hazard mitigation strategies and contingency planning in light of climate change impacts, including sea level rise, flooding, and droughts; and</text></subparagraph></paragraph> 
<paragraph id="H717307A56C9D4B73B794088E02BB8DA6"><enum>(3)</enum><text>consult with representatives of such agencies and entities to develop recommendations, consistent with laws, treaties, decrees, and interstate compacts, for a comprehensive water strategy to—</text> 
<subparagraph id="H8BB7839F4AA84B43B0F6DEAAE81FBACC"><enum>(A)</enum><text>recognize the primary role of States in adjudicating, administering, and regulating water rights and water uses;</text></subparagraph> 
<subparagraph id="H4A0866F7010640FE946F1CB4077F1B4E"><enum>(B)</enum><text>identify incentives intended to ensure an adequate and dependable supply of water to meet the needs of the United States for the next 50 years and incentives to include the future impacts of climate change on water supply and quality for the next 50 years;</text></subparagraph> 
<subparagraph id="H1EF3CE79CDD242CB804CC19400C88B33"><enum>(C)</enum><text>eliminate duplication and conflict among Federal governmental programs;</text></subparagraph> 
<subparagraph id="H56A546ECDCF9498EA3063C2606D7B49F"><enum>(D)</enum><text>consider all available technologies (including climate change predictions, advanced modeling and mapping of wetlands, floodplains, and other critical areas) and other methods to optimize water supply reliability, availability, and quality, while safeguarding and enhancing the environment and planning for the potential impacts of climate change on water quality, water supply, flood and storm damage reduction, and ecosystem health;</text></subparagraph> 
<subparagraph id="H0723CFA675A746678FAAE5FD95956F40"><enum>(E)</enum><text>recommend means of capturing excess water and flood water for conservation and use in the event of a drought;</text></subparagraph> 
<subparagraph id="HD4CF09809756409C8726CA762150B139"><enum>(F)</enum><text>identify adaptation techniques, or further research needs of adaptation techniques, for effectively conserving freshwater and coastal systems as they respond to climate change;</text></subparagraph> 
<subparagraph id="HF854856BE87F4A76993BAE4D9697B77C"><enum>(G)</enum><text display-inline="yes-display-inline">suggest financing options, incentives, and strategies for development of comprehensive water management plans, holistically designed water resources projects, conservation of existing water resource infrastructure (including recommendations for repairing aging water infrastructure) and to increase the use of nonstructural elements (including green infrastructure and low impact development techniques);</text></subparagraph> 
<subparagraph id="H94CE7C829D494CDE98105C66D38E0000"><enum>(H)</enum><text display-inline="yes-display-inline">suggest strategies for avoiding increased mandates on State and local governments;</text></subparagraph> 
<subparagraph id="H3EE37C18508D419B8997DD98E64015FA"><enum>(I)</enum><text>suggest strategies for using best available climate science in projections of future flood and drought risk, and for developing hazard mitigation strategies to protect water quality, in extreme weather conditions caused by climate change;</text></subparagraph> 
<subparagraph id="H296856F613AA4829831F98E2D6F1B289"><enum>(J)</enum><text>identify policies that encourage low impact development, especially in areas near high priority aquatic systems;</text></subparagraph> 
<subparagraph id="H36C430332611476BBC777DC8484B63A2"><enum>(K)</enum><text>suggest strategies for encouraging the use of, and reducing biases against, nonstructural elements and low impact development techniques when managing stormwater, including features that—</text> 
<clause id="H657F1B94C7A24AC8A0CD41CE4FB161DE"><enum>(i)</enum><text>preserve and restore natural processes, landforms (such as floodplains), natural vegetated stream side buffers, wetlands, or other topographical features that can slow, filter, and naturally store stormwater runoff and flood waters for future water supply and recharge of natural aquifers;</text></clause> 
<clause id="H8DF47A374C0745F8B2D885AB5E53E3FA"><enum>(ii)</enum><text>utilize natural design techniques that infiltrate, filter, store, evaporate, and detain water close to its source; or</text></clause> 
<clause id="H1CE55D350C9748DDA75764DCF914C8A3"><enum>(iii)</enum><text>minimize the use of impervious surfaces in order to slow or infiltrate precipitation;</text></clause></subparagraph> 
<subparagraph id="H44EBE73E37304571A377DA19606FE289"><enum>(L)</enum><text>suggest strategies for addressing increased sewage overflow problems due to changing storm dynamics and the impact of aging stormwater and wastewater infrastructure, population growth, and urban sprawl;</text></subparagraph> 
<subparagraph id="HB5D685C39515430D86F2F358FCE230BC"><enum>(M)</enum><text>promote environmental restoration projects that reestablish natural processes; and</text></subparagraph> 
<subparagraph id="H20795A0E147C4C79A7DD18000472268B"><enum>(N)</enum><text>identify opportunities to promote existing or create regional planning, including opportunities to integrate climate change into water infrastructure and environmental conservation planning.</text></subparagraph></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H4386DD65B7AA40AF99B19823C8352FB2"><enum>(c)</enum><header>Membership</header> 
<paragraph id="HC7C553AB85F04023998FABB623DE5B1"><enum>(1)</enum><header>Number and appointment</header><text>The Commission shall be composed of 8 members who shall be appointed, not later than 90 days after the date of enactment of this Act, as follows:</text> 
<subparagraph id="H66BCDC5AD53E40148D7DFDB8443962F8"><enum>(A)</enum><text>2 members appointed by the President.</text></subparagraph> 
<subparagraph id="H849E4D87304941DDBAB056390059DF4C"><enum>(B)</enum><text>2 members appointed by the Speaker of the House of Representatives from a list of 4 individuals—</text> 
<clause id="H7D5E7182F49345E9B38771E15E9EF342"><enum>(i)</enum><text>2 nominated for that appointment by the chairman of the Committee on Transportation and Infrastructure of the House of Representatives; and</text></clause> 
<clause id="H3ADDACAABD69492A888031A8C7F8AB21"><enum>(ii)</enum><text>2 nominated for that appointment by the chairman of the Committee Natural Resources of the House of Representatives.</text></clause></subparagraph> 
<subparagraph id="H16EC1E4A86B64170B70257AF75E1FD20"><enum>(C)</enum><text>2 members appointed by the majority leader of the Senate from a list of 4 individuals—</text> 
<clause id="HDE2E2DB455C94EFF883394B4A21BD566"><enum>(i)</enum><text>2 nominated for that appointment by the chairman of the Committee on Environment and Public Works of the Senate; and</text></clause> 
<clause id="H917AA77BD07B4752AA34D5EED64157DF"><enum>(ii)</enum><text>2 nominated for that appointment by the chairman of the Committee on Energy and Natural Resources of the Senate.</text></clause></subparagraph> 
<subparagraph id="HDEB217E6766D4245A7F7BC7513EDC94D"><enum>(D)</enum><text>One member appointed by the minority leader of the House of Representatives from a list of 2 individuals—</text> 
<clause id="H170DAA6E40F54D0D95AC2BA7F3024DE6"><enum>(i)</enum><text>one nominated for that appointment by the ranking member of the Committee on Transportation and Infrastructure of the House of Representatives; and</text></clause> 
<clause id="HC5E3BE945FAD40FAA7D0BAC887EC3DA"><enum>(ii)</enum><text>one nominated for that appointment by the ranking member of the Committee on Natural Resources of the Senate.</text></clause></subparagraph> 
<subparagraph id="H4DE2E37072364831B3BAFCF3FDE2167"><enum>(E)</enum><text>1 member appointed by the minority leader of the Senate from a list of 2 individuals—</text> 
<clause id="HD48111151B534EC0AACD862623A5C455"><enum>(i)</enum><text>one nominated for that appointment by the ranking member of the Committee on Environment and Public Works of the Senate; and</text></clause> 
<clause id="HBE55D7684C6B4D3BB93EB358FA63336D"><enum>(ii)</enum><text>one nominated for that appointment by the ranking member of the Committee on Energy and Natural Resources of the Senate.</text></clause></subparagraph></paragraph> 
<paragraph id="HFDFAE2498A034CCDB364CABDECBF5CD1"><enum>(2)</enum><header>Qualifications</header> 
<subparagraph id="H8D81ECE906554388B1F85EFB9DC473EA"><enum>(A)</enum><header>Recognized standing and distinction</header><text>Members shall be appointed to the Commission from among individuals who are of recognized standing and distinction in water policy issues.</text></subparagraph> 
<subparagraph id="HB3A34AB11E084E33B5FD5F64E6071C91"><enum>(B)</enum><header>Limitation</header><text>A person while serving as a member of the Commission may not hold any other position as an officer or employee of the United States, except as a retired officer or retired civilian employee of the United States.</text></subparagraph> 
<subparagraph id="HB88A0C5497904E849CE33155334776A9"><enum>(C)</enum><header>Other considerations</header><text>In appointing members of the Commission, every effort shall be made to ensure that the members represent a broad cross section of regional and geographical perspectives in the United States.</text></subparagraph></paragraph> 
<paragraph id="HA8C12D983F9B48308997674460B7B907"><enum>(3)</enum><header>Chairperson</header><text>The Chairperson of the Commission shall be elected by a majority vote of the members of the Commission.</text></paragraph> 
<paragraph id="H6B6D105BA0284CD80078EA967947F9F"><enum>(4)</enum><header>Terms</header><text>Members of the Commission shall serve for the life of the Commission.</text></paragraph> 
<paragraph id="H80943B7851674D8099741BB188B6CFDF"><enum>(5)</enum><header>Vacancies</header><text>A vacancy on the Commission shall not affect its operation and shall be filled in the manner in which the original appointment was made.</text></paragraph> 
<paragraph id="HCC527B3AC60843E100D6FC79E833A221"><enum>(6)</enum><header>Compensation and travel expenses</header><text>Members of the Commission shall serve without compensation; except that members shall receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of chapter 57, United States Code.</text></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H37D63CB1EB514E50003013AE8236B994"><enum>(d)</enum><header>Meetings and quorum</header> 
<paragraph id="H6082DC8FCA2F43C7909D969D6582C84C"><enum>(1)</enum><header>Meetings</header><text>The Commission shall hold its first meeting not later than 60 days after the date on which all original members are appointed under subsection (c) and shall hold additional meetings at the call of the Chairperson or a majority of its members.</text></paragraph> 
<paragraph id="H9DE8EE7944084615B42700B0DD7755C8"><enum>(2)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum for the transaction of business.</text></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H7427F887DAFC435D9CC2D30450F52E30"><enum>(e)</enum><header>Director and staff</header> 
<paragraph id="HBD544E9467F449A788B03800D61D3DA6"><enum>(1)</enum><header>Director</header><text display-inline="yes-display-inline">The Commission shall have a Director who shall be appointed by the Speaker of the House of Representatives and the majority leader of the Senate, in consultation with the minority leader of the House of Representatives, the chairmen of the Committees on Resources and Transportation and Infrastructure of the House of Representatives, the minority leader of the Senate, and the chairmen of the Committee on Energy and Natural Resources and Environment and Public Works of the Senate.</text></paragraph> 
<paragraph id="HA8C6CB4C1390404E892CC02D8779D7C2"><enum>(2)</enum><header>Applicability of certain civil service laws</header><text>The Director and staff of the Commission may be appointed without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, and may be paid without regard to the provisions of chapter 51 and subchapter III of chapter 53 of that title relating to classification and General Schedule pay rates; except that an individual so appointed may not receive pay in excess of the annual rate of basic pay for GS–15 of the General Schedule.</text></paragraph></subsection> 
<subsection id="H525B4F5EF26B4A7689004F1615C291E"><enum>(f)</enum><header>Hearings</header> 
<paragraph id="H8792EE68DF074AE8B397FF41DC033774"><enum>(1)</enum><header>Minimum number</header><text>The Commission shall hold no fewer than 10 hearings during the life of the Commission.</text></paragraph> 
<paragraph id="HF0C4560AF44A4482ACD46E61C0EDC5C4"><enum>(2)</enum><header>In conjunction with meetings</header><text>Hearings may be held in conjunction with meetings of the Commission.</text></paragraph> 
<paragraph id="HAC70EB4628EF4184BE60BDFE51FE1BC6"><enum>(3)</enum><header>Testimony and evidence</header><text>The Commission may take such testimony and receive such evidence as the Commission considers appropriate to carry out this section.</text></paragraph> 
<paragraph id="H8AF0BFF141224A6EACBA801600142000"><enum>(4)</enum><header>Specified</header><text>At least one hearing shall be held in Washington, District of Columbia, for the purpose of taking testimony of representatives of Federal agencies, national organizations, and Members of Congress. At least one hearing shall focus on potential water resource issues relating to climate change and how to mitigate the harms of climate change-related weather events.</text></paragraph> 
<paragraph id="H4934B0FD8BDD4FB4AA7C6E356F8F49F"><enum>(5)</enum><header>Nonspecified</header><text>Hearings, other than those referred to in paragraph (4), shall be scheduled in distinct geographical regions of the United States. In conducting such hearings, the Commission should seek to ensure testimony from individuals with a diversity of experiences, including those who work on water issues at all levels of government and in the private sector.</text></paragraph></subsection> 
<subsection id="H2AA1AA8830514F75A874066DE2E2302C"><enum>(g)</enum><header>Information and support from federal agencies</header><text>Upon request of the Commission, the head of a Federal department or agency shall—</text> 
<paragraph id="H14B4BFD93DD24497BB420057BA7C5FDF"><enum>(1)</enum><text>provide to the Commission, within 30 days of the request, such information as the Commission considers necessary to carry out this section; and</text></paragraph> 
<paragraph id="H4A0767D0B49D4804AE909D64851F63C2"><enum>(2)</enum><text>detail to temporary duty with the Commission on a reimbursable basis such personnel as the Commission considers necessary to carry out this section.</text></paragraph></subsection> 
<subsection id="HD932FFD547CB4561BEC65433ABBF1215"><enum>(h)</enum><header>Interim reports</header><text>Not later than one year after the date of the first meeting of the Commission, and every year thereafter, the Commission shall submit an interim report containing a detailed summary of its progress, including meetings held and hearings conducted before the date of the report, to—</text> 
<paragraph id="H9B3E59E3C24B4AC7A4B507B94C05903C"><enum>(1)</enum><text>the President; and</text></paragraph> 
<paragraph commented="no" id="H9F5631EABBD74BDAA3159EAF6F6FE1A"><enum>(2)</enum><text>Congress.</text></paragraph></subsection> 
<subsection id="HC51095107A0D44449F00BF492029CC27"><enum>(i)</enum><header>Final report</header><text>As soon as practicable, but not later than 5 years after the date of the first meeting of the Commission, the Commission shall submit a final report containing a detailed statement of the findings and conclusions of the Commission and recommendations for legislation and other policies to implement such findings and conclusions to—</text> 
<paragraph id="H104943A667C84AB9A02D974E3590CD62"><enum>(1)</enum><text>the President;</text></paragraph>

<paragraph id="H7A1D4CE27BD64AC2A8118CBCAF3DA947"><enum>(3)</enum><text>the Committee on Energy and Natural Resources and the Committee on the Environment and Public Works of the Senate.</text></paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H4D85BFE0AEA348F094000072FC78606F"><enum>(j)</enum><header>Termination</header><text>The Commission shall terminate not later than 30 days after the date on which the Commission transmits a final report under subsection (h)(1).</text></subsection> 
<subsection commented="no" id="HDBD33F86BD034285A6FB33C751BDD7DC"><enum>(k)</enum><header>Applicability of federal advisory committee act</header><text>The Federal Advisory Committee Act (5 U.S.C. App. 1 et seq.) shall not apply to the Commission.</text></subsection> 
<subsection id="H93087C046AC24C60AB31CA7B004CFCA8"><enum>(l)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $12,000,000 to carry out this section.</text></subsection></section> 
<section id="H97E0E94E92AF4C30A22541B864BBF3FC"><enum>703.</enum><header>Improving hydropower capabilities</header> 
<subsection id="HD5D84BE88A884B67A61C9BFE11AB4EF7"><enum>(a)</enum><header>Study</header><text>The Secretary of the Army shall conduct a study on the potential for reduced fossil fuel consumption through an increase in hydropower capabilities of the Corps of Engineers.</text></subsection> 
<subsection id="H6066A44BBBE64AC4AD0747BD6498DEE7"><enum>(b)</enum><header>Contents</header><text>The study shall include an examination of the potential for improving hydropower capabilities at dams owned or operated by the Corps of Engineers, including the ecological impacts of such capabilities.</text></subsection> 
<subsection id="HF7C70709D8604A19B316455B8F2FF496"><enum>(c)</enum><header>Report</header><text>Not later than one year after the date of enactment of this Act, the Secretary shall submit to Congress a report containing the results of the study conducted under this section.</text></subsection></section> 
<section id="H040EA23E9BEB45489B87E6533603EA89"><enum>704.</enum><header>Study of Potential Impacts of Climate Change on Water Resources and Water Quality</header> 
<subsection id="H074B457A82014BF4893C488217D68649"><enum>(a)</enum><header>National academy study</header><text>The Administrator of the Environmental Protection Agency shall enter into an arrangement with the National Academy of Sciences under which the Academy shall—</text> 
<paragraph id="HAC51FE8F522D4079BFEFF5663B608279"><enum>(1)</enum><text>identify the potential impacts of climate change on the Nation’s water resources, watersheds, and water quality, including the potential for impacts to wetlands, shoreline erosion, and saltwater intrusion as a result of sea level rise, and the potential for significant regional variation in precipitation events to impact Federal, State, and local efforts to attain or maintain water quality;</text></paragraph> 
<paragraph id="HDFAC31A1975D409F8D1CE5CE7CF5BEFD"><enum>(2)</enum><text>assess the extent to which Federal and State efforts under the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) and other ocean and coastal laws may be affected by climate change;</text></paragraph> 
<paragraph id="HBB9D29FF2DED4B7CB77000DCD349E1FF"><enum>(3)</enum><text>identify prudent steps to assess emerging information and identify appropriate response actions to meet the requirements of such Act, including provisions to attain or maintain water quality standards and for adequate stream flows for wetlands and aquatic resources; and</text></paragraph> 
<paragraph id="HA5C499D1A688489E00F169AB513073A5"><enum>(4)</enum><text>recommend, if necessary, potential legislative or regulatory changes to address impacts of global climate change on efforts to restore and maintain the chemical, physical, and biological integrity of the Nation’s waters.</text></paragraph></subsection> 
<subsection id="HCFC8C0A1936A41C0936D09B76675DD5F"><enum>(b)</enum><header>Recommendations</header><text>Not later than 2 years after the date of the enactment of this Act, the Administrator shall transmit to Congress a report on the results of the study under this section.</text></subsection></section> 
<section id="HE99C8B3F253C41F8AB52C9657C00F293"><enum>705.</enum><header>Impacts of climate change on Corps of Engineers projects</header> 
<subsection id="H3AC3D054A5EC475BA1F3D6B7F26260A1"><enum>(a)</enum><header>In general</header><text>The Secretary of the Army shall ensure that water resources projects and studies carried out by the Corps of Engineers after the date of enactment of this Act take into account the potential short and long term effects of climate change on such projects.</text></subsection> 
<subsection id="H0BCAD56C05444F9CB23E05B3F122C7B1"><enum>(b)</enum><header>Consideration</header><text>In carrying out this section, the Secretary shall utilize a representative range of climate change scenarios, including the current analyses of the United States Climate Change Science Program and the Intergovernmental Panel on Climate Change.</text></subsection> 
<subsection id="HF182D17C47FA48A499BCE30D165FB60"><enum>(c)</enum><header>Report to congress</header><text>Not later than one year after the date of enactment of this Act, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a report on the implementation of this section.</text></subsection></section></subtitle> 
<subtitle id="H9FDCF2FB188B4CB5AC3E09D1955B79FF"><enum>B</enum><header>Emergency Management</header> 
<section id="H247FF1A3816047DDABF5E900CC1CBC3"><enum>731.</enum><header>Effects of climate change on FEMA preparedness, response, recovery, and mitigation programs</header> 
<subsection id="H20E608332E1142AE86DCCEC1EA3A700"><enum>(a)</enum><header>Study</header><text>The Administrator of the Federal Emergency Management Agency shall conduct a comprehensive study of the increase in demand for the Agency’s emergency preparedness, response, recovery, and mitigation programs and services that may be reasonably anticipated as a result of an increased number and intensity of natural disasters affected by climate change, including hurricanes, floods, tornadoes, fires, droughts, and severe storms.</text></subsection> 
<subsection id="H07293EC2258244648000001C9BCD1F25"><enum>(b)</enum><header>Contents</header><text>The study shall include an analysis of the budgetary and personnel needs of meeting the increased demand for Agency services referred to in subsection (a).</text></subsection> 
<subsection id="H20BCB9E7732749B89200E2112875FD11"><enum>(c)</enum><header>Report</header><text>Not later than one year after the date of enactment of this Act, the Administrator shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report and any legislative recommendations on the study conducted under this section.</text></subsection></section></subtitle></title>
