<official-title>To amend title 49, United States Code, to facilitate the resolution of disputes between the Administrator of the Federal Aviation Administration and employees of the Administration in the course of collective negotiations.</official-title>

<section id="H7249EE6CA467467FB82FD067C4505DAA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Aviation Administration Fair Labor Management Act of 2007</short-title></quote>.</text></section> 
<section id="H14C165AF4E42410E9EE1F746853EBB21"><enum>2.</enum><header>Impasse procedures</header> 
<subsection id="HFF9AA9D4F0D548D9B7310801C3EF9077"><enum>(a)</enum><header>Mediation</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/40122">Section 40122(a)(2)</external-xref> of title 49, United States Code, is amended by striking the second sentence and all that follows and inserting the following: <quote>If the services of the Federal Mediation and Conciliation Service do not lead to an agreement, the provisions of subsection (j) shall apply.</quote>. </text></subsection> 
<subsection id="H227ABB1D21EB447C8148106EBAAEB1B4"><enum>(b)</enum><header>Impasse procedures</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/40122">Section 40122</external-xref> of title 49, United States Code, is amended—</text> 
<paragraph id="HF19E0F05A3294A24970010F8F5480648"><enum>(1)</enum><text>by redesignating subsection (j) as subsection (k); and</text></paragraph> 
<paragraph id="H2E4996DA1DE446E995CA56837EB9F889"><enum>(2)</enum><text>by inserting after subsection (i) the following:</text>

<subsection id="HF576974A65BC44D2AB728280F39C2779"><enum>(j)</enum><header>Impasse procedures</header> 
<paragraph id="HF32063E37DFC4BA8AFA51CCFB800AEF8"><enum>(1)</enum><header>Certification of negotiation impasse</header><text>If the Administration and the exclusive bargaining representatives of employees of the Administration participate in a mediation process of the Federal Mediation and Conciliation Service with respect to a negotiation under subsection (a) and the Service is unable to resolve a negotiation impasse between the parties—</text> 
<subparagraph id="H8756ABFB3AB5409599C019E2D09CCEE8"><enum>(A)</enum><text>the Service shall issue a written certification of the negotiation impasse; and</text></subparagraph> 
<subparagraph id="H79782549C550448EA37539FFCA7591D2"><enum>(B)</enum><text>not later than 60 days following the date of issuance of the written certification, the parties of the negotiation shall request the Federal Service Impasses Panel described in <external-xref legal-doc="usc" parsable-cite="usc/5/7119">section 7119</external-xref> of title 5 to consider the matter.</text></subparagraph></paragraph> 
<paragraph id="H05FC07164BEB40EF9F5448739C60BB36"><enum>(2)</enum><header>Authority of Federal Service Impasses Panel</header><text>If a negotiation impasse is presented to the Panel under this subsection, the Panel shall investigate and consider the matter, and take actions with respect to the matter, using the authorities of the Panel under <external-xref legal-doc="usc" parsable-cite="usc/5/7119">section 7119</external-xref> of title 5 and regulations issued to carry out such section. </text></paragraph> 
<paragraph id="HF4C5B78E53D14F538E796305A5001D8E"><enum>(3)</enum><header>Factors</header><text>In providing assistance to resolve a negotiation impasse presented to the Panel under this subsection, the Panel, or any private arbitrator selected pursuant to <external-xref legal-doc="usc" parsable-cite="usc/5/7119">section 7119(b)(2)</external-xref> of title 5, shall take into consideration, to the extent relevant to the matter and in addition to any other relevant factors, the following:</text> 
<subparagraph id="H23FFCB31FFC24F6296DBD84BBE9CD85"><enum>(A)</enum><text>The wages, hours, and conditions of employment of the employees involved in the impasse proceeding as compared to the wages, hours, and conditions of employment of—</text> 
<clause id="H32EF8B506567428BB54131ED52C0B4ED"><enum>(i)</enum><text>employees performing similar services;</text></clause> 
<clause id="H9B679D92990F4749ACCA2FC54BC47751"><enum>(ii)</enum><text>employees in positions requiring similar skills and working under similar conditions; and</text></clause> 
<clause id="HAF8D7FAA36714179A6FE0000A9F5E4E2"><enum>(iii)</enum><text>other employees generally in public and private employment in comparable communities.</text></clause></subparagraph> 
<subparagraph id="H25904D96C1404527B51CDE595EC798D0"><enum>(B)</enum><text>The overall compensation paid to the employees involved in the impasse proceeding, including—</text> 
<clause id="H14E9BA18BA7B4D3DA0ADA600046E4EE9"><enum>(i)</enum><text>direct wage compensation;</text></clause> 
<clause id="H0E6965D27F5142A3B41CE94BBF7EA442"><enum>(ii)</enum><text>overtime and premium pay;</text></clause> 
<clause id="H0640610D8F0D4C0D85CA00A8B8C664E"><enum>(iii)</enum><text>vacations, holidays, and other excused time;</text></clause> 
<clause id="HF0602BC228AD492300086643CE758BC5"><enum>(iv)</enum><text>insurance, pensions, medical, and hospitalization benefits; and</text></clause> 
<clause id="H02EBFB1C3B154B669B4E54EF1444299B"><enum>(v)</enum><text>all other benefits received.</text></clause></subparagraph> 
<subparagraph id="HF49605E671924A3CB7DBB410A8D1090"><enum>(C)</enum><text display-inline="yes-display-inline">The financial ability of the Administration to pay, as determined after review of the Administration’s current and preceding fiscal year budgets for salaries, operations, and maintenance.</text></subparagraph> 
<subparagraph id="H83635C04F4874AF7A5DB5579F5832F35"><enum>(D)</enum><text display-inline="yes-display-inline">Changes in the average consumer prices for goods and services, commonly known as the cost of living.</text></subparagraph> 
<subparagraph id="H9FABBD7CE1034DAEAF1EE6D5A00621B"><enum>(E)</enum><text display-inline="yes-display-inline">The peculiarities of the employment of the employees involved in the impasse proceeding as compared to employees in other trades and professions, including hazards of employment, physical qualifications, educational qualifications, mental qualifications, and job training and skills.</text></subparagraph> 
<subparagraph id="HC6419E9B663443758F18B592C8569D66"><enum>(F)</enum><text>The terms of collective agreements negotiated between the parties involved in the impasse in the past providing for compensation and benefits, including the provisions for—</text> 
<clause id="HAB5DD2E37A7B454BA400FF513054295E"><enum>(i)</enum><text>salary, insurance, and retirement benefits;</text></clause> 
<clause id="H599E7950197A4DB7ADCEC2F8F16BEB53"><enum>(ii)</enum><text>medical and hospitalization benefits; and</text></clause> 
<clause id="HBE1B09C2D58443D585E3D97CD4DEFDF9"><enum>(iii)</enum><text>paid time off.</text></clause></subparagraph> 
<subparagraph id="H9C1E7A01EDB9453494DDA652A86DBAA"><enum>(G)</enum><text>The impact of each proposal for resolving the impasse on—</text> 
<clause id="H36B9C03FD5E3478997857B117CCDE6CE"><enum>(i)</enum><text>the interests and welfare of the public;</text></clause> 
<clause id="HF6901EBCC59746A588C6908FDCA6854F"><enum>(ii)</enum><text display-inline="yes-display-inline">the continued provision of services to the public;</text></clause> 
<clause id="HC08E345187984664AA8D7DF0CD9D5F00"><enum>(iii)</enum><text>the compensation and benefits of other employee groups and bargaining units of the Administration; and</text></clause> 
<clause id="H39411A2A384E494F9F9607FB69486687"><enum>(iv)</enum><text>the air traffic control modernization efforts of the Administration.</text></clause></subparagraph> 
<subparagraph id="HE722F4747CE947E7859FDB2639AFC7D0"><enum>(H)</enum><text display-inline="yes-display-inline">Such other factors as are normally and customarily considered in determining compensation, benefits, and other conditions of employment in proceedings conducted by the Panel.</text></subparagraph></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H3CAC5A5D15C44948B2752F83B2A8BB8C"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendment made by this Act shall apply to changes described in <external-xref legal-doc="usc" parsable-cite="usc/49/40122">section 40122(a)(1)</external-xref> of title 49, United States Code, being negotiated or in impasse on or after May 31, 2007.</text></section>
