<official-title>To provide for a loan forgiveness program for certain individuals who serve as early childhood educators.</official-title>

<section id="H4E88533CC25B4702911F803DFABFE07F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Early Educator Loan Forgiveness Act of 2007</short-title></quote>.</text> </section> 
<section id="HB85A5DCE39154864A696843020A4B788" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header>Loan forgiveness for service as an early childhood educator</header><text display-inline="no-display-inline">Section 428K (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-11">20 U.S.C. 1078–11</external-xref>) is amended to read as follows:</text>

<section id="H03C0DF21174142BE9BD3D3E04EA66F4"><enum>428K.</enum><header>Loan forgiveness for service as an early childhood educator</header> 
<subsection id="HE920F93C1F944A0E99F3768537D0F63E"><enum>(a)</enum><header>Purposes</header><text>The purposes of this section are—</text> 
<paragraph id="HE43E4867FE66434DBB7933E2C628C34"><enum>(1)</enum><text display-inline="yes-display-inline">to encourage highly trained individuals to enter and continue in service as early childhood educators; and</text></paragraph> 
<paragraph id="H64030A538DCF47258721BFDCE859B325"><enum>(2)</enum><text display-inline="yes-display-inline">to reduce the burden of student debt for Americans who dedicate their careers to service as early childhood educators.</text></paragraph></subsection> 
<subsection id="H4454731E88FD4389B3AE01CD8290D7FB"><enum>(b)</enum><header>Program authorized</header> 
<paragraph id="HB228A2D738064334A654968F6FE7F424"><enum>(1)</enum><header>Loan forgiveness authorized</header><text display-inline="yes-display-inline">The Secretary is authorized to forgive, in accordance with this section, the student loan obligation of a borrower in the amount specified in <internal-xref idref="H1EB91EFA722049AEB691A8A4D828CC7D" legis-path="428K.(c)">subsection (c)</internal-xref>, for any new borrower after the date of enactment of the <short-title>Early Educator Loan Forgiveness Act of 2007</short-title>, who—</text> 
<subparagraph id="H9E9E56982C8240938B65E530F57F62F"><enum>(A)</enum><text display-inline="yes-display-inline">has been employed full-time for at least 5 consecutive complete school years as an early childhood educator in an eligible preschool program or eligible early childhood education program in a low-income community, and who is involved directly in the care, development, and education of infants, toddlers, or young children through age 5; and</text></subparagraph> 
<subparagraph id="HA577207494B246709F04020272D2E6F9"><enum>(B)</enum><text>is not in default on a loan for which the borrower seeks forgiveness.</text></subparagraph></paragraph> 
<paragraph id="H6B249E2AD6AA4E96A8A2A55C04B6D1D8" display-inline="no-display-inline"><enum>(2)</enum><header>Method of loan forgiveness</header><text>To provide loan forgiveness under <internal-xref idref="HB228A2D738064334A654968F6FE7F424" legis-path="428K.(b)(1)">paragraph (1)</internal-xref>, the Secretary is authorized to carry out a program—</text> 
<subparagraph id="H2B2189C546B04EB58F958D92A9192634"><enum>(A)</enum><text display-inline="yes-display-inline">through the holder of the loan, to assume the obligation to repay a qualified loan amount for a loan made, insured, or guaranteed under this part; and</text></subparagraph> 
<subparagraph id="H2C54608BC5BB42049293E5C00298891F"><enum>(B)</enum><text display-inline="yes-display-inline">to cancel a qualified loan amount for a loan made under part D of this title.</text></subparagraph></paragraph> 
<paragraph id="H0ADF73978641437DA53DAEE7395156C9"><enum>(3)</enum><header>Regulations</header><text>The Secretary is authorized to issue such regulations as may be necessary to carry out the provisions of this section.</text></paragraph></subsection> 
<subsection id="H1EB91EFA722049AEB691A8A4D828CC7D"><enum>(c)</enum><header>Qualified loan amount</header><text>The Secretary shall forgive not more than $5,000 in the aggregate of the student loan obligation of a borrower that is outstanding after the completion of the fifth consecutive school year of employment described in <internal-xref idref="HB228A2D738064334A654968F6FE7F424" legis-path="428K.(b)(1)">subsection (b)(1)</internal-xref>.</text></subsection> 
<subsection id="HE4B355C0437142389FD1F39658F8573C"><enum>(d)</enum><header>Construction</header><text>Nothing in this section shall be construed to authorize the refunding of any repayment of a loan.</text></subsection> 
<subsection id="HD5E4C1A731BA438C961F75A7B1A9FE7C"><enum>(e)</enum><header>Award basis</header><text>Loan forgiveness under this section shall be on a first-come, first-served basis and subject to the availability of appropriations.</text> </subsection> 
<subsection id="H3EA951C5D69C430FBB98064E5B75A374"><enum>(f)</enum><header>Ineligibility for double benefits</header><text>No borrower may receive a reduction of loan obligations under both this section and section 428J or 460.</text></subsection> 
<subsection id="HA074B81B585D460D9E3DE04700F856D0"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H42296125941B4308A85C22E58800849E" display-inline="no-display-inline"><enum>(1)</enum><header>Early childhood educator</header><text>The term <term>early childhood educator</term> means an early childhood educator who works directly with children in an eligible preschool program or eligible early childhood education program who has completed a baccalaureate or advanced degree in early childhood development, early childhood education, or in a field related to early childhood education.</text></paragraph> 
<paragraph id="H99E29E87D8434C2388E197A55214FCE7" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Eligible preschool program</header><text>The term <term>eligible preschool program</term> means a program that provides for the care, development, and education of infants, toddlers, or young children through age 5, meets any applicable State or local government licensing, certification, approval, and registration requirements, and is operated by—</text> 
<subparagraph id="H6A61FAF0BB314CD8BC06817BB524E5D6" commented="no"><enum>(A)</enum><text>a public or private school that may be supported, sponsored, supervised, or administered by a local educational agency;</text></subparagraph> 
<subparagraph id="H74D9D6C43DB544989CB5118D4023603F" commented="no"><enum>(B)</enum><text>a Head Start agency serving as a grantee designated under the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>);</text></subparagraph> 
<subparagraph id="H4DDAF5AD9BB84778A7F2075C40F1204F" commented="no"><enum>(C)</enum><text>a nonprofit or community based organization; or</text></subparagraph> 
<subparagraph id="HC7387FE099C54C70B16FF6004397A674" commented="no"><enum>(D)</enum><text>a child care program, including a home.</text></subparagraph></paragraph> 
<paragraph id="HF1BA2402FF3F4D46B2CF22097574533" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Eligible early childhood education program</header><text display-inline="yes-display-inline">The term <term>eligible early childhood education program</term> means—</text> 
<subparagraph id="H7BF0106709B94253A0BF385E4F783285" commented="no"><enum>(A)</enum><text>a family child care program, center-based child care program, State prekindergarten program, school program, or other out-of-home early childhood development care program, that—</text> 
<clause id="H63816B9BA4264D40986479B50075DCDE" commented="no"><enum>(i)</enum><text>is licensed or regulated by the State; and</text></clause> 
<clause id="HE580E72CD1834FB6BC878F6CF4F2A4A7" commented="no"><enum>(ii)</enum><text>serves 2 or more unrelated children who are not old enough to attend kindergarten; </text></clause></subparagraph> 
<subparagraph id="HDB831E910E814E3FBEC0DC030000F2C9" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a Head Start Program carried out under the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>); or</text></subparagraph> 
<subparagraph id="H50E0F015BB3F42A997BEDD8D8CEAD0AB" commented="no"><enum>(C)</enum><text>an Early Head Start Program carried out under section 645A of the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9840a">42 U.S.C. 9840a</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="H50FB8FF7E4DD47028DC44685F38BC58E"><enum>(4)</enum><header>Low-income community</header><text>In this subsection, the term <term>low-income community</term> means a community in which 70 percent of households earn less than 85 percent of the State median household income.</text></paragraph></subsection> 
<subsection id="H27E0C01A02A941ACABD8C56C6520C618" commented="no"><enum>(h)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section such sums as may be necessary for fiscal year 2008 and each of the 5 succeeding fiscal years.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
