		<official-title display="yes">To amend the Fair Labor Standards Act, with
		  respect to civil penalties for child labor violations.</official-title>

		<section id="H28D758331D424BD891C7C1FF366FB1" section-type="section-one"><enum>1.</enum><header>Short title</header>
			<subsection id="HA59990367D82468D931254E9313D08B7"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Child Labor Protection Act of
			 2007</short-title></quote>.</text>
			</subsection><subsection id="H4C825FBE3031434FBEC8C619C74180C9"><enum>(b)</enum><header>In
			 general</header><text>Section 16(e) of the Fair Labor Standards Act of 1938
			 (29 U.S.C.
			 216(e)) is amended to read as follows:</text>
				<quoted-block id="HB315002D494D48589D7800FB9B7B5FF6" style="OLC">
					<subsection id="H96FC9BAF214247FBBC73380088863D18"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H3383720C77724F9EA87D006DD0EA3775"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H4907BCA157C047819300BBE478AD51A8"><enum>(A)</enum><text>Any person who violates
				the provisions of sections 12 or 13(c), relating to child labor, or any
				regulation issued pursuant to such sections, shall be subject to a civil
				penalty not to exceed—</text>
								<clause id="HB1C74DEB787E4F5685B750BDBE82DCAB"><enum>(i)</enum><text>$11,000 for each
				employee who was the subject of such a violation; or</text>
								</clause><clause id="HB5A23294BAEE402FB8A091D7D96CD310"><enum>(ii)</enum><text>$50,000 with
				regard to each such violation that causes the death or serious injury of any
				employee under the age of 18 years, which penalty may be doubled where the
				violation is a repeated or willful violation.</text>
								</clause></subparagraph><subparagraph id="H6CB8888BFFB74040B20500F96D5E00FE" indent="up2"><enum>(B)</enum><text>For purposes of subparagraph (A), the
				term <term>serious injury</term> means—</text>
								<clause id="H71D0368D85784078A94615A732C00B6"><enum>(i)</enum><text>permanent loss or substantial
				impairment of one of the senses (sight, hearing, taste, smell, tactile
				sensation);</text>
								</clause><clause id="H6F801EA9829E4C889EF48DE5BC4D5CD0"><enum>(ii)</enum><text>permanent loss or substantial
				impairment of the function of a bodily member, organ, or mental faculty,
				including the loss of all or part of an arm, leg, foot, hand or other body
				part; or</text>
								</clause><clause id="H75E6406CE97F4401001B8B9B95EED6D5"><enum>(iii)</enum><text>permanent paralysis or substantial
				impairment that causes loss of movement or mobility of an arm, leg, foot, hand
				or other body part.</text>
								</clause></subparagraph></paragraph><paragraph id="H130983C9D664428E9B1D2D5158177CE1" indent="up1"><enum>(2)</enum><text>Any person who repeatedly or
				willfully violates section 6 or 7, relating to wages, shall be subject to a
				civil penalty not to exceed $1,100 for each such violation.</text>
						</paragraph><paragraph id="HAAA8F70B084F43BDA1ECEB38206666E" indent="up1"><enum>(3)</enum><text>In determining the amount of any
				penalty under this subsection, the appropriateness of such penalty to the size
				of the business of the person charged and the gravity of the violation shall be
				considered. The amount of any penalty under this subsection, when finally
				determined, may be—</text>
							<subparagraph id="HAFD37745229942A2B200A51DDEBC7756"><enum>(A)</enum><text>deducted from any sums owing by the
				United States to the person charged;</text>
							</subparagraph><subparagraph id="H43D66094E99C4B48B94EC702374E13EF"><enum>(B)</enum><text>recovered in a civil action brought by
				the Secretary in any court of competent jurisdiction, in which litigation the
				Secretary shall be represented by the Solicitor of Labor; or</text>
							</subparagraph><subparagraph id="H7944C86E475346D9B6513BEC7261249B"><enum>(C)</enum><text>ordered by the court, in an action
				brought for a violation of section 15(a)(4) or a repeated or willful violation
				of section 15(a)(2), to be paid to the Secretary.</text>
							</subparagraph></paragraph><paragraph commented="no" id="HFBBD8AFA06264060B25DB1BD372C4618" indent="up1"><enum>(4)</enum><text>Any administrative determination by
				the Secretary of the amount of any penalty under this subsection shall be
				final, unless within 15 days after receipt of notice thereof by certified mail
				the person charged with the violation takes exception to the determination that
				the violations for which the penalty is imposed occurred, in which event final
				determination of the penalty shall be made in an administrative proceeding
				after opportunity for hearing in accordance with
				section
				554 of title 5, United States Code, and regulations to be
				promulgated by the Secretary.</text>
						</paragraph><paragraph id="HBD7EA0429A864469BA42CCFFB69CF243" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">Except for civil penalties collected for
				violations of sections 12 or 13(c), sums collected as penalties pursuant to
				this section shall be applied toward reimbursement of the costs of determining
				the violations and assessing and collecting such penalties, in accordance with
				the provision of section 2 of the Act entitled <quote>An Act to authorize the
				Department of Labor to make special statistical studies upon payment of the
				cost thereof and for other purposes</quote> (<external-xref legal-doc="usc" parsable-cite="usc/29/9a">29 U.S.C. 9a</external-xref>). Civil penalties
				collected for violations of sections 12 or 13(c) shall be deposited in the
				general fund of the
				Treasury.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H52533B4675A94D68B5E5F968882208E"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date of the enactment of this Act.</text>
