<official-title>To amend subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code, and <external-xref legal-doc="usc" parsable-cite="usc/18/1084">section 1084</external-xref> of title 18 of such Code to clarify the applicability of such provisions to games of skill, and establish certain requirements with respect to such games, and for other purposes.</official-title>

<legis-body id="H4D311C74528A463991F06758735600DC" style="OLC"> 
<section id="H1DA8B8E1FCBD4A3DB00428FA19D6DFAE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act shall be known as the <quote>Skill Game Protection Act</quote>.</text></section> 
<section id="H9B1A3A4B64604CEF809FEF11BF04662B"><enum>2.</enum><header>Congressional findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text> 
<paragraph id="HFC660F4B37DA4DFEA01BBDFA1E5FF068"><enum>(1)</enum><text>Millions of Americans enjoy competing with other players in a variety of games of skill, including bridge, mah-jong, backgammon, and poker, over the Internet, where the operator provides the Internet venue for competition and receives a fee for such service.</text></paragraph> 
<paragraph id="H2B0BB6D95C124DCEA5098E57F79D00A1"><enum>(2)</enum><text>For some Americans, these games provide their primary source of income. </text></paragraph> 
<paragraph id="H6F1599DE12644A13B4DB5D0096D82CD4"><enum>(3)</enum><text>While each of these games contains an element of chance, over any substantial interval, a player's success at any of these games is determined by that player's relative level of skill and is widely recognized as such. </text></paragraph> 
<paragraph id="HC62B2164D287444D8DB8CFA67428EED2"><enum>(4)</enum><text>Games where success is predominantly determined by the skill of the players involved, as a matter of law and of policy, are distinct from the games of chance traditionally described and addressed in Federal and State gambling statutes. </text></paragraph> 
<paragraph id="H21C02DA671D041C9BB8F2FD5B3D8C9D5"><enum>(5)</enum><text>Despite the fact that the language in <external-xref legal-doc="usc" parsable-cite="usc/18/1084">section 1084</external-xref> of title 18, United States Code, commonly referred to as the <quote>Wire Act</quote>, has been interpreted by Federal courts as applying only to betting on sports, some in law enforcement interpret the section as prohibiting the acceptance of both sports and non-sports betting through a communications device. </text></paragraph> 
<paragraph id="HC02201AA218E44F2B8B495B0A36DE400"><enum>(6)</enum><text>The Federal Government should take appropriate steps to ensure that, with respect to skill games—</text> 
<subparagraph id="H6CF47F4824CB4CF2B3467DD5E33F58EB"><enum>(A)</enum><text>minors are prevented from playing for money;</text></subparagraph> 
<subparagraph id="H40C94C712D4948BBAAEC5DA0382900D4"><enum>(B)</enum><text>persons with compulsive behavior should be identified and referred to treatment;</text></subparagraph> 
<subparagraph id="H27BB82F810FE4EE1A0DBB9B3F89220D0"><enum>(C)</enum><text>operators of such games should not be vulnerable to, or participate in criminal or terrorist money laundering; and</text></subparagraph> 
<subparagraph id="HCAF94CCCCF5F4B1A99357CD857B01C2"><enum>(D)</enum><text>appropriate taxes are collected.</text></subparagraph></paragraph></section> 
<section id="H71E9FCD82F6B4F1EA947F9BB9BE052E1"><enum>3.</enum><header>Clarification</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1084">Section 1084</external-xref> of title 18, United States Code, is amended by adding at the end the following new subsection: (f) </text> 
<quoted-block style="OLC" id="H78BFDFDC08414628B3ECE474DA53CB5" display-inline="no-display-inline"> 
<subsection id="H2EA74BF37E8B4EF3878D1C24E3DBDE90"><enum>(f)</enum><text display-inline="yes-display-inline">As used in this section, the term <quote>bets or wagers</quote> does not include operating, or participation in, poker, chess, bridge, mahjong or any other game where success is predominantly determined by a player’s skill, to the extent that— </text> 
<paragraph id="H3BEAB471A6834C35B067CCE620743F6F"><enum>(1)</enum><text>the game provides for competition only between and among participants, and not against the person operating the game; and </text></paragraph> 
<paragraph id="HA17631C66C7648EAB1007F188F782F66"><enum>(2)</enum><text>the operator is in compliance with regulations issued pursuant to <external-xref legal-doc="usc" parsable-cite="usc/31/5368">section 5368</external-xref> of title 31, United States Code.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HE760EB7820DB44E194D2EBF3FFF59990"><enum>4.</enum><header>Safeguards</header> 
<subsection id="HD471EA808CA047AE00F2A5EEF0C9E735"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code, is amended by adding at the end the following new section: </text>

<section id="HC424370481704A5386DFD075594BC753"><enum>5368.</enum><header>Games of skill</header><text display-inline="no-display-inline">Before the end of the 180-day period beginning on the date of the enactment of the Skill Game Protection Act, the Secretary shall prescribe regulations requiring each person who operates a game of skill on the Internet to maintain the following: </text> 
<paragraph id="H7F5155B3CB2C4400A7CD975C949007BF"><enum>(1)</enum><text>Appropriate safeguards to ensure that the individual participant depositing funds is 18 years of age or older. </text></paragraph> 
<paragraph id="HE867443AA6B849E09227B2CB2FA52094"><enum>(2)</enum><text>Appropriate safeguards to ensure that the individual participant is physically located in a jurisdiction that does not bar participation in the particular Internet games of skill in which the individual participates at the time in the individual participates. </text></paragraph> 
<paragraph id="H443BE41059754F3B8DCEF6BEC1000C5"><enum>(3)</enum><text>Appropriate mechanisms to ensure that all taxes relating to Internet games of skill due to Federal and State governments and to Indian tribes from individual participants are collected as required by at the time of any payment of any proceeds of Internet games of skill. </text></paragraph> 
<paragraph id="H7C4C3F8180194945B9FD5D27E78FD54F"><enum>(4)</enum><text>Appropriate safeguards to combat fraud and money laundering as may be prescribed by regulations issued by the Secretary or a designee of the Secretary. </text></paragraph> 
<paragraph id="H10A97C41D8BF46BF8C35823B00B75ED5"><enum>(5)</enum><text>Appropriate safeguards to combat compulsive participation in Internet games of skill. </text></paragraph> 
<paragraph id="H6D9EE3D858CA4059B6AABCF500120093"><enum>(6)</enum><text>Appropriate safeguards to protect the privacy and security of any person engaged in Internet games of skill.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0380AEF3CA8F407FB737BF06B6DB7B32"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/53">chapter 53</external-xref> of title 31, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/31/5367">section 5367</external-xref> the following new item:</text>

<section id="H388972968E9F4F25B7C79DDFFEFA27E8"><enum>5.</enum><header>Rules of construction</header> 
<subsection id="H63BE237A2FFD4845BE3575006D0040E"><enum>(a)</enum><header>Nonapplicability to games of skill</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/5362">Section 5362(1)(E)</external-xref> of title 31, United States Code, is amended—</text> 
<paragraph id="H55D8720F09694717B2F4781E231C84C6"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of clause (viii);</text></paragraph> 
<paragraph id="HA0223FD2F896468A85E4E11418D13F4D"><enum>(2)</enum><text>by striking the period at the end of clause (ix) and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="H76537ECBAC56414DB8CF43B750297F34"><enum>(3)</enum><text> by adding at the end the following new clause:</text>

<clause id="H40C118A79E4C4A5A92324D5540667750"><enum>(x)</enum><text display-inline="yes-display-inline">participation in any activity which does not constitute “bets or wagers” within the meaning of <external-xref legal-doc="usc" parsable-cite="usc/18/1084">section 1084(f)</external-xref> of title 18 and is operated in compliance with the regulations issued pursuant to section 5368.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H67E31ACDC73C4E1AA540355D1219A39C"><enum>(b)</enum><header>Nonapplicability to non-sports wagering</header><text display-inline="yes-display-inline">No provision of this Act, or amendment made by this Act to any other provision of law, shall be construed as implying that <external-xref legal-doc="usc" parsable-cite="usc/18/1084">section 1084</external-xref> of title 18, United States Code, applies or applied to non-sports wagering before or after the enactment of this Act.</text></subsection></section>
