<section id="HC1C115CA041441B7B609B9D9654C4200" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>High-Need Physician Workforce Incentives Act of 2007</short-title></quote>.</text></section> 
<section id="H781BBD499B46464A8E8FBE9B4DC6DD6"><enum>2.</enum><header>High-Need Physician Specialty Workforce Incentives</header><text display-inline="no-display-inline">Page E of title VII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/294n">42 U.S.C. 294n et seq.</external-xref>) is amended by adding at the end the following:</text>

<subpart id="H47E8ED9FAAFE49AE95FDD475F2B6D92"><enum>3</enum><header>High-Need Physician Specialty Workforce Incentives</header> 
<section id="H4A10EE4A3CA14342A05CA7F4BA741754"><enum>775.</enum><header>Scholarship program</header> 
<subsection id="H3197AB57DE36483983A89800578700B0"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to alleviate critical shortages of physicians in the fields of family practice, internal medicine, pediatrics, emergency medicine, general surgery, and obstetrics-gynecology.</text></subsection> 
<subsection id="H1944E9B0F8414A429C4D72A371698212"><enum>(b)</enum><header>Grants</header><text>The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall make grants to critical shortage health facilities to carry out a scholarship program described in this section.</text></subsection> 
<subsection id="H2406649886C441EFA5C39B53C964FB08"><enum>(c)</enum><header>Scholarships</header><text>A health facility receiving a grant under this section shall use the grant to enter into contracts with eligible individuals under which—</text> 
<paragraph id="H18B979FB42FB4FBF006853D4811E8BA6"><enum>(1)</enum><text>the facility agrees to provide the individual with a scholarship for each school year (not to exceed 4 school years) in which the individual is enrolled as a full-time student in a school of medicine or a school of osteopathic medicine; and</text></paragraph> 
<paragraph id="H4A9F1308F1F8431600A987C008888C6C"><enum>(2)</enum><text>the individual agrees—</text> 
<subparagraph id="HCE85734A9A4B4CCAA46DB2B6699E5949"><enum>(A)</enum><text>to maintain an acceptable level of academic standing;</text></subparagraph> 
<subparagraph id="H7AA5D3E8314543808C94870058BE6F7E"><enum>(B)</enum><text>to complete a residency in the field of family practice, internal medicine, pediatrics, emergency medicine, general surgery, or obstetrics-gynecology; and</text></subparagraph> 
<subparagraph id="HE5ABAE7B7F5E420FA546BF4DE5DB024"><enum>(C)</enum><text>after completing the residency, to serve as a physician at such facility in such field for a time period equal to the greater of—</text> 
<clause id="HB6553CEE255C43BD8DED1E02FE52E499"><enum>(i)</enum><text>one year for each school year for which the individual was provided a scholarship under this section; or</text></clause> 
<clause id="HBD77485AB2DC4029B0CD45E7DC4D4E38"><enum>(ii)</enum><text>two years.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HF055EE0CCDAE46B4BA54EA6765C0B034"><enum>(d)</enum><header>Amount of scholarship</header> 
<paragraph id="H058C952A8E7F4813A4105D824434E13C"><enum>(1)</enum><header>In general</header><text>The amount paid by a health facility to an individual through a scholarship under this section shall not exceed $30,000 for any school year.</text></paragraph> 
<paragraph id="H968E2CC8B02A49B4A64E866FC5A29B69"><enum>(2)</enum><header>Considerations</header><text>In determining the amount of a scholarship to be provided to an individual under this section, a health facility may take into consideration the individual’s financial need, geographic differences, and educational costs.</text></paragraph> 
<paragraph id="HE9A8A1F908914719A6DEDC97DED19807"><enum>(3)</enum><header>Exclusion from gross income</header><text>For purposes of the Internal Revenue Code of 1986, gross income shall not include any amount received as a scholarship under this section.</text></paragraph></subsection> 
<subsection id="H03BB4110A7AA4DDE97BDEC7313F86B33"><enum>(e)</enum><header>Application of certain provisions</header><text>The provisions of subpart III of part D of title III shall, except as inconsistent with this section, apply to the program established under this section in the same manner and to the same extent as such provisions apply to the National Health Service Corps Scholarship Program established in such subpart.</text></subsection> 
<subsection id="H235F5ED5F04045D4A8D635797F9144FA"><enum>(f)</enum><header>Definitions</header><text>In this subsection:</text> 
<paragraph id="H9C24AF31D1F947E593E9BD1C33B0A6AD"><enum>(1)</enum><text>The term <term>critical shortage health facility</term> means a public or private nonprofit health facility that does not serve a health professional shortage area (as such term is defined in section 332), but has a critical shortage of physicians (as determined by the Secretary) in the field of family practice, internal medicine, pediatrics, emergency medicine, general surgery, or obstetrics-gynecology.</text></paragraph> 
<paragraph id="HC59866779A894EEBBF002906AD1EAAD7"><enum>(2)</enum><text>The term <term>eligible individual</term> means an individual who is enrolled or accepted for enrollment as a full-time student in an accredited school of medicine or school of osteopathic medicine.</text></paragraph></subsection> 
<subsection id="H6B92E3DA8A3847F3B9DBBA78AAC2065"><enum>(g)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $5,000,000 for each of fiscal years 2008 through 2012.</text></subsection></section> 
<section id="H14E2545482B643F5B506C2A1990041F0"><enum>776.</enum><header>Loan repayment program</header> 
<subsection id="HE5EF933FB38948E098666FE1880219D6"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to alleviate critical shortages of physicians in the fields of family practice, internal medicine, pediatrics, emergency medicine, general surgery, and obstetrics-gynecology.</text></subsection> 
<subsection id="H7677F7AC1F8142B28EF5890014F7DDBC"><enum>(b)</enum><header>Loans</header><text>The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall establish a program of entering into contracts with eligible individuals under which—</text> 
<paragraph id="H665C4F759EF548C799E48BE73211029F"><enum>(1)</enum><text display-inline="yes-display-inline">the individual agrees to serve—</text> 
<subparagraph id="HA2973307BA4347E6B9B63F3C57DFA710"><enum>(A)</enum><text>as a physician in the field of family practice, internal medicine, pediatrics, emergency medicine, general surgery, or obstetrics-gynecology; and</text></subparagraph> 
<subparagraph id="H355A694380AB4DA8BEAA2F5E75376DE"><enum>(B)</enum><text>in an area that is not a health professional shortage area (as such term is defined in section 332), but has a critical shortage of physicians (as determined by the Secretary) in such field; and</text></subparagraph></paragraph> 
<paragraph id="H765F26E1E1B24A52A157F1774E46E72B"><enum>(2)</enum><text>the Secretary agrees to pay, for each year of such service, not more than $35,000 of the principal and interest of the undergraduate or graduate educational loans of the individual.</text></paragraph></subsection> 
<subsection id="HC2549435104F4BB48725032E2F24DF59"><enum>(c)</enum><header>Service requirement</header><text>A contract entered into under this section shall allow the individual receiving the loan repayment to satisfy the service requirement described in subsection (b)(1) through employment in a solo or group practice, a clinic, a public or private nonprofit hospital, or any other appropriate health care entity.</text></subsection> 
<subsection id="HF7032AFFA4724CDA90F2C5797F484800"><enum>(d)</enum><header>Application of certain provisions</header><text>The provisions of subpart III of part D of title III shall, except as inconsistent with this section, apply to the program established in this section to the same extent and in the same manner as such provisions apply to the National Health Service Corps Loan Repayment Program established in such subpart.</text></subsection> 
<subsection id="HA620AAE261B94F289FEEB80000ACA62F"><enum>(e)</enum><header>Definition</header><text>In this section, the term <term>eligible individual</term> means an individual with a degree in medicine or osteopathic medicine. </text></subsection> 
<subsection id="H46E3493C158447ABB57C7F98901F4CA1"><enum>(f)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $5,000,000 for each of fiscal years 2008 through 2012.</text></subsection></section> 
<section id="HD0C9904F317642DAAAA3A3B276001B79"><enum>777.</enum><header>Primary care physician retention and medical home enhancement grants</header> 
<subsection id="HDD9D22522BC3494B8D47621BF3BDA97"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall make grants to States to provide care management fees to physicians in medically underserved communities to support the provision of targeted, accessible, continuous, coordinated, and patient-centered care through a qualified medical home.</text></subsection> 
<subsection id="H367E8BD4FC8D4F3894535B5F5B4CB58E"><enum>(b)</enum><header>Qualified medical homes</header> 
<paragraph id="H866B592A669A408BAC2E541B20F0A288"><enum>(1)</enum><header>In general</header><text>In this section, the term <term>qualified medical home</term> means a physician-directed practice that is certified as a qualified medical home in accordance with this subsection.</text></paragraph> 
<paragraph id="H13F937C3D9524AC3B89B1534009F2587"><enum>(2)</enum><header>Actions by Secretary</header><text>Not later than 90 days after the date of the enactment of this subpart, the Secretary shall—</text> 
<subparagraph id="HF60D33BA602F4B0BA7B0D4B16522B4E7"><enum>(A)</enum><text display-inline="yes-display-inline">designate one or more objective external private-sector entities to certify physician-directed practices as qualified medical homes; and</text></subparagraph> 
<subparagraph id="HF9623EC582944B75BA14C047E0EFF17C"><enum>(B)</enum><text>issue requirements for such certification.</text></subparagraph></paragraph> 
<paragraph id="H0656B0DE99454CF881E9A3F8601C4F26"><enum>(3)</enum><header>Requirements</header><text>The requirements referred to in paragraph (2)(B) shall set forth a certification process whereby—</text> 
<subparagraph id="H327DD8226F644EE5BC51342D09DFEB48"><enum>(A)</enum><text>a physician-directed practice, in consultation with the State where the practice is located, submits an application on a voluntary basis to an entity designated by the Secretary under paragraph (2)(A); and</text></subparagraph> 
<subparagraph id="H51F13B874E64487790F580C1F9018279"><enum>(B)</enum><text>the entity certifies the practice as a qualified medical home if the practice demonstrates that the practice has capabilities to achieve improvements in the management and coordination of care of patients described in paragraph (4) by incorporating attributes of the care management model described in paragraph (5).</text></subparagraph></paragraph> 
<paragraph id="H13CAF31D58CD4941B800AC07EEE958A7"><enum>(4)</enum><header>Eligible patients</header><text display-inline="yes-display-inline">The patients referred to in paragraph (3)(B)—</text> 
<subparagraph id="H840132B80D3F43DE91C2EA10C733E98C"><enum>(A)</enum><text>are patients determined by the State involved under criteria developed by the Secretary to be underserved, special needs, or high risk patients; and</text></subparagraph> 
<subparagraph id="H9250E85517DC435996C99B00E8A706BF"><enum>(B)</enum><text>shall include individuals who—</text> 
<clause id="HA264678D88EA436DBE0528EED3EBD058"><enum>(i)</enum><text>are eligible for medical assistance under title XIX of the Social Security Act;</text></clause> 
<clause id="H700FB4CF3A4345CA9282EB3D3F2800CA"><enum>(ii)</enum><text>are eligible for child health assistance under title XXI of the Social Security Act; or</text></clause> 
<clause id="H798EBA69D4404833962004CF3763B358"><enum>(iii)</enum><text>otherwise lack health insurance.</text></clause></subparagraph></paragraph> 
<paragraph id="H9637CF77C8FE4361817F9846DECD78CD"><enum>(5)</enum><header>Care management model</header><text>The care management model referred to in paragraph (3)(B) is a model that uses health information technology and other physician-practice innovations to improve the management and coordination of patient care. Such a model includes the following conditions:</text> 
<subparagraph id="HE9E1DE1C62B24031B9D46B54EBEAC461"><enum>(A)</enum><text>Physicians advocate for their patients to support the attainment of optimal, patient-centered outcomes that are defined by a care planning process driven by a partnership between physicians, patients, and the patient’s family.</text></subparagraph> 
<subparagraph id="H42433847C108494D90002D4DAA7BC100"><enum>(B)</enum><text>Evidence-based medicine and clinical decision-support tools guide decision making.</text></subparagraph> 
<subparagraph id="HE05AEA10F59148CFBBC2AD16DA001800"><enum>(C)</enum><text>Physicians in the practice accept accountability for continuous quality improvement through voluntary engagement in performance measurement and improvement.</text></subparagraph> 
<subparagraph id="H3A7535A363DA4ABFB73551C669F1EB2"><enum>(D)</enum><text display-inline="yes-display-inline">Patients actively participate in decisionmaking; patients take personal responsibility for their own health through diet and lifestyle changes; and feedback is sought to ensure that patients’ expectations are being met.</text></subparagraph> 
<subparagraph id="HF718A1F191DA488989B91542C5BDE8CC"><enum>(E)</enum><text>Information technology is utilized appropriately to support optimal patient care, performance measurement, patient education, and enhanced communication.</text></subparagraph> 
<subparagraph id="HA1502C46C072414AB5AFB233A02FD264"><enum>(F)</enum><text>Patients and families participate in quality improvement activities at the practice level.</text></subparagraph></paragraph></subsection> 
<subsection id="HB14B8FECC8D5438C960690F31DF3F1DA"><enum>(c)</enum><header>Amount of care management fee</header> 
<paragraph id="HE47D54ADC53C433580F5837C58E0875D"><enum>(1)</enum><header>In general</header><text>As a condition on the receipt of a grant under this section, a State shall agree to determine the amount of each care management fee provided through the grant in accordance with the guidance issued by the Secretary under paragraph (2).</text></paragraph> 
<paragraph id="HAA3F2F3BF570474FA361F1CB3937BB39"><enum>(2)</enum><header>Guidance</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary shall issue guidance for determining the amount of a care management fee to be provided through a grant under this section. Such guidance shall take into account the costs of implementation, additional time by participating physicians, and training associated with compliance with this section. Such guidance shall include—</text> 
<subparagraph id="H6F5AD72CFF1D4C55B7E4C585C65F90F2"><enum>(A)</enum><text>recognition of the value of physician and clinical staff work associated with patient care that falls outside the face-to-face visit, such as the time and effort spent on educating family caregivers and arranging appropriate follow-up services with other health care professionals, such as nurse educators;</text></subparagraph> 
<subparagraph id="H8E243E2DA55349228868E259864E2FFE"><enum>(B)</enum><text>recognition of expenses that the qualified medical home will incur to acquire and utilize health information technology, such as clinical decision support tools, patient registries, and electronic medical records;</text></subparagraph> 
<subparagraph id="H48B21E80F3244046ADE1F354E154C225"><enum>(C)</enum><text>additional performance-based reimbursement payments based on reporting on evidence-based quality, cost of care, and patient experience measures;</text></subparagraph> 
<subparagraph id="H1F836513056140F1951DE2B67588B7FE"><enum>(D)</enum><text>reimbursement for separately identifiable e-mail and telephonic consultations, either as separately-billable services or as part of a global management fee;</text></subparagraph> 
<subparagraph id="HA5431EDF6CF448359472F0C22652B205"><enum>(E)</enum><text>recognition of the specific circumstances and expenses associated with physician practices of fewer that 5 full-time employees in implementing the attributes of a qualified medical home and care management model described in subsection (b); and</text></subparagraph> 
<subparagraph id="HA0DC7EB27F104A3B9392CDB050494BA0"><enum>(F)</enum><text>recognition and sharing of savings that may result from a qualified medical home.</text></subparagraph></paragraph></subsection> 
<subsection id="H4C5CD47133624AB59951B38421D77806"><enum>(d)</enum><header>Application</header><text display-inline="yes-display-inline">A State seeking a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require. Each such application shall describe the methodologies to be used by the State to determine the amount of care managements fees to be provided through the grant.</text></subsection> 
<subsection id="HD6D12D270316439F9DBE8F426212E300"><enum>(e)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $10,000,000 for each of fiscal years 2008 through 2012.</text></subsection></section> 
<section id="H6162824CFB954CD79EA3014BFB984E2F"><enum>778.</enum><header>Comprehensive geriatric training grants</header> 
<subsection id="H23583FA82FDB44AE8CF0600C4BB61BA"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall make grants to board-certified entities to establish or expand geriatric fellowship programs described in subsection (b).</text></subsection> 
<subsection id="H3FB5B96C6E3A414699FDDE3116CC6494"><enum>(b)</enum><header>Geriatric fellowship programs</header><text>A geriatric fellowship program funded through a grant under this section shall provide 1-year fellowships to train physicians practicing in rural areas or in the field of family practice, internal medicine, emergency medicine, general surgery, or obstetrics-gynecology, at any time during their careers, in geriatric medicine.</text></subsection> 
<subsection id="H06C78665C7EB491CA12CB2BEBAF317BA"><enum>(c)</enum><header>Amount</header><text>As a condition on the receipt of a grant under this section, an entity shall agree to expend not more than $50,000 of the grant per fellow.</text></subsection> 
<subsection id="H2A57487C169E4667BDEC88A81DDF0973"><enum>(d)</enum><header>Preference</header><text>In awarding grants under this section, the Secretary shall give preference to entities seeking to establish or expand a fellowship program in a rural area, a suburban area, or a medically underserved community.</text></subsection> 
<subsection id="HBDB892E77B824EDC86247D9B6626D4E6"><enum>(e)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $1,000,000 for each of fiscal years 2008 through 2012. </text></subsection></section> 
<section id="H09A7C641D8BD4E40BC4E41599689CE0"><enum>779.</enum><header>Reports to Congress</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of the <short-title>High-Need Physician Workforce Incentives Act of 2007</short-title>, and annually thereafter, the Secretary shall submit a report to the Congress—</text> 
<paragraph id="HB821E638D7E1448B8371FF6F3C8641E7"><enum>(1)</enum><text>identifying the number of grants and loans made under this section during the preceding 12-month period; and</text></paragraph> 
<paragraph id="HB218069999B344D9AD65084234BFBC8C"><enum>(2)</enum><text display-inline="yes-display-inline">describing the results achieved through such grants and loans, including the extent to which such grants and loans met the needs of the physician workforce in rural areas and in the fields of family practice, internal medicine, pediatrics, emergency medicine, general surgery, and obstetrics-gynecology.</text></paragraph></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HEC0DC2A82F5E41F9A807660495EEB53"><enum>3.</enum><header>Exemption from gross income for certain compensation paid to physicians by local governments for service in medically underserved areas</header> 
<subsection id="HFF20F3E134214BB7BD8C39E008934E2"><enum>(a)</enum><header>In general</header><text>Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to items specifically excluded from gross income) is amended by adding at the end the following new section:</text> 
<quoted-block style="OLC" id="H9AAFDFD091E64CE3891840AE7FF1B015" display-inline="no-display-inline"> 
<section id="H435881F3FDE64CA5BBF053561062F9AE"><enum>139B.</enum><header>Certain compensation paid to physicians by local governments for service in medically underserved areas</header> 
<subsection id="H735B2586046049FF9860F087D0C500F3"><enum>(a)</enum><header>In general</header><text>Gross income does not include compensation received by a physician (as defined in section 1861(r) of the Social Security Act) from a local government (as defined in section 1393(a)(5)) for qualified medical service.</text></subsection> 
<subsection id="HC0AD497758514B2D87DFA491E437A430"><enum>(b)</enum><header>Qualified medical service</header><text>For purposes of this section, the term <term>qualified medical service</term> means medical care described in section 213(d)(1)(A) which is performed—</text> 
<paragraph id="HF1A65F22FD9F483D87DB52E48D6EA32D"><enum>(1)</enum><text display-inline="yes-display-inline">in a medically underserved community (as defined in section 799B(6) of the Public Health Service Act), and</text></paragraph> 
<paragraph id="H60E055B8F754425C9E4800B4B9E503C0"><enum>(2)</enum><text>under a contract with the local government referred to in subsection (a) for the performance of such services for a period of not less than 4 years.</text></paragraph></subsection> 
<subsection id="H9EDDEF1BB92B4548A75F0582C926F3A"><enum>(c)</enum><header>No exemption from employment taxes</header><text>Compensation shall not fail to be taken into account as wages under any provision of subtitle C solely because such compensation is excluded from gross income under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H531F33CBAD824B8183409C690579D0DE"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for part III of subchapter B of chapter 1 of such Code is amended by inserting after the item relating to section 139A the following new item:</text>

<toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="H9AAFDFD091E64CE3891840AE7FF1B015" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded">
