<official-title>To amend the Higher Education Act of 1965 to establish a student loan forgiveness program for nurses.</official-title>

<section id="H825E068810FD49A2B200034F5F1290D0" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nurse Loan Forgiveness Act of 2007</short-title></quote>.</text></section> 
<section id="H5B9C421179A64FB0BD89CA6DFE3623C1" commented="no"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="H9C90ECAB989D4E1C9B69CD3BB0AFA6D6" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">According to 2005 statistics from the American Hospital Association, 118,000 nurses are needed to fill vacancies at our nation’s hospitals, and more than 75 percent of all hospital personnel vacancies are for nurses.</text></paragraph> 
<paragraph id="HF6A1FD72949D437C8733416ECCF748F5" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">According to a study by the Department of Health and Human Services in 2002, the United States will experience a 29 percent shortage in the number of nurses needed in the United States health care system by the year 2020, which translates into a shortage of more than 400,000 registered nurses nationwide.</text></paragraph> 
<paragraph id="HC1CBDD9D2A6A4E7BBF1740CCD0A1BD09" commented="no"><enum>(3)</enum><text>Research indicates that there is a great need for health care services, especially hospitals and prescription drugs, but there continues to be a 28 percent decrease in national licensure examination for all entry-level registered nurses.</text></paragraph> 
<paragraph id="H65029B079EFE4CBA9E2B73AACDC9FA1F" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">The Department of Labor projects a 29 percent increase in the need for nurses nationwide from 2004 to 2014, compared with a 13 percent increase for all other occupations.</text></paragraph> 
<paragraph id="H756D7A04B19040948EB19F530035C9B7" commented="no"><enum>(5)</enum><text>The General Accounting Office estimates that 40 percent of all registered nurses will be older than age 50 by the year 2010.</text></paragraph> 
<paragraph id="H0B4BDF5631634CCEB3D1630084C2D1C3" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">Of those registered nurses in 2004, an estimated 16 percent have chosen to not practice in the field.</text></paragraph></section> 
<section id="H219BF4DE904A409099CE00DCB3BF1568"><enum>3.</enum><header>Loan forgiveness program established</header><text display-inline="no-display-inline">Part B of title IV of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> is amended by inserting after section 428K (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-11">20 U.S.C. 1078–11</external-xref>) the following new section:</text>

<section id="H652A37D2C58F47AF8F00D31D6F3DADCB"><enum>428L.</enum><header>Loan forgiveness for nurses</header> 
<subsection id="HE1DA29EAF5A946DBB718E19308935EDE"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this section are—</text> 
<paragraph id="H1F2A3BE63EAD47A1B722F4D200F3D68B"><enum>(1)</enum><text display-inline="yes-display-inline">to encourage—</text> 
<subparagraph id="H7AE75F9F4C0E4106B21B643404ABF305"><enum>(A)</enum><text>individuals to enter and continue in the nursing profession; and</text></subparagraph> 
<subparagraph id="H6EEDCF90383A42BD976502AE5B52B5CB"><enum>(B)</enum><text>experienced nurses to instruct nurses entering the profession; and</text></subparagraph></paragraph> 
<paragraph id="HCB09686E43CE4DEC00D1D8804EC91B67"><enum>(2)</enum><text display-inline="yes-display-inline">to reward such individuals for their service in the nursing profession by reducing the burden of student debt.</text></paragraph></subsection> 
<subsection id="HBF61F211C5C941309348B41D274CD4C9" display-inline="no-display-inline"><enum>(b)</enum><header>Loan forgiveness</header> 
<paragraph id="H880ED0DEF9834C55A5ABB779E0EBB807"><enum>(1)</enum><header>Loan forgiveness authorized</header><text display-inline="yes-display-inline">The Secretary is authorized to forgive, in accordance with this section, the student loan debt of an eligible borrower in the amount specified in <internal-xref idref="HCB324B0070F943AB9EBFEACB1FA29C9" legis-path="__.(d)">subsection (d)</internal-xref> for each of the first 5 complete years of service described in <internal-xref idref="HA5BC5F04C7F64230B95B1095F903F854" legis-path="428L.(c)(1)">subsection (c)(1)</internal-xref> by such eligible borrower that occur after the date of enactment of this section.</text></paragraph> 
<paragraph id="HB9716C644F344A66AAD89FCD895FEFE0"><enum>(2)</enum><header>Method of loan forgiveness</header><text>To provide the loan forgiveness authorized in <internal-xref idref="H880ED0DEF9834C55A5ABB779E0EBB807" legis-path="__.(b)(1)">paragraph (1)</internal-xref>, the Secretary is authorized to carry out a program—</text> 
<subparagraph id="H4668161AEDE24A44A2C54F8CEC9838FC"><enum>(A)</enum><text>through the holder of the loan, to assume the obligation to repay a qualified loan amount for a loan made under this part; and</text></subparagraph> 
<subparagraph id="H24F3D6133E6B4411B1A4F48D678480F1"><enum>(B)</enum><text>to cancel a qualified loan amount for a loan made under part D of this title.</text></subparagraph></paragraph> 
<paragraph id="H4F24138EEC2F45C1B3DB0099E49F5F78" display-inline="no-display-inline"><enum>(3)</enum><header>Limitation on consolidation loans</header><text>A loan amount for a loan made under section 428C may be a qualified loan amount for the purposes of this section only to the extent that such loan amount was used to repay a Federal Direct Stafford Loan, a Federal Direct Unsubsidized Stafford Loan, or a loan made under section 428 or 428H for an eligible borrower, as determined in accordance with regulations prescribed by the Secretary.</text></paragraph></subsection> 
<subsection id="H9AD971CB818447A99E0826BC01E91700" display-inline="no-display-inline"><enum>(c)</enum><header>Eligible borrower</header><text>The Secretary is authorized to provide loan forgiveness under this section to any individual who—</text> 
<paragraph id="HA5BC5F04C7F64230B95B1095F903F854" display-inline="no-display-inline"><enum>(1)</enum><text>has been employed for at least one calendar year—</text> 
<subparagraph id="H2023F6271B6C4BE28F24B4132FEDB3C1"><enum>(A)</enum><text>as a full-time registered nurse in a health care facility or a health care setting approved by the Secretary of Health and Human Services for the purposes of this section; or</text></subparagraph> 
<subparagraph id="H7CAF6FF3A34048FEBF52985BCC1C47D3"><enum>(B)</enum><text display-inline="yes-display-inline">as a nursing instructor in a school of nursing as defined by the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/296">42 U.S.C. 296</external-xref>);</text></subparagraph></paragraph> 
<paragraph id="HDFF577B6F11D4B7796DDDB116804455"><enum>(2)</enum><text>if qualifying on the basis of the employment described in <internal-xref idref="H7CAF6FF3A34048FEBF52985BCC1C47D3" legis-path="428L.(c)(1)(B)">paragraph (1)(B)</internal-xref>, has received a Masters of Science in Nursing; and</text></paragraph> 
<paragraph id="H91BE266B790642BAB9A8BE85003767CC" display-inline="no-display-inline"><enum>(3)</enum><text>is not in default on a loan for which the borrower seeks forgiveness.</text></paragraph></subsection> 
<subsection id="H958FB590EBD94375898BDE28DD7294F0" display-inline="no-display-inline"><enum>(d)</enum><header>Loan forgiveness amounts</header><text display-inline="yes-display-inline">The Secretary shall, from funds appropriated under <internal-xref idref="H459A5C7BEB8A462389B2DCCB0055F705" legis-path="428L.(j)">subsection (j)</internal-xref>, forgive the loan obligation of an eligible borrower in accordance with <internal-xref idref="HCB324B0070F943AB9EBFEACB1FA29C9" legis-path="__.(b)(2)">subsection (b)(2) </internal-xref>and in the following increments:</text> 
<paragraph id="HBA34075617A04F95ACD67880927470B5"><enum>(1)</enum><text display-inline="yes-display-inline">After the first calendar year of employment described in <internal-xref idref="HA5BC5F04C7F64230B95B1095F903F854" legis-path="428L.(c)(1)">subsection (c)(1)</internal-xref>, not more than $2,000.</text></paragraph> 
<paragraph id="H2C5FBDCB46E64D47AD72840444B59201"><enum>(2)</enum><text>After the second such year of employment, not more than $2,500.</text></paragraph> 
<paragraph id="HD3F05741BA6C468DBDB5CE86CC53F3C9"><enum>(3)</enum><text>After the third such year of employment, not more than $3,000.</text></paragraph> 
<paragraph id="HF856F14DE869495A9B16E506CDA602A1"><enum>(4)</enum><text>After the fourth such year of employment, not more than $4,500.</text></paragraph> 
<paragraph id="HA45D8F6082AA4A34B26662E012E59FD7"><enum>(5)</enum><text>After the fifth such year of employment, not more than $5,000.</text></paragraph></subsection> 
<subsection id="HF105ED0DB428441B9126C49CD0A40046"><enum>(e)</enum><header>Application for loan forgiveness</header><text>An eligible borrower desiring loan forgiveness under this section shall submit a complete and accurate application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></subsection> 
<subsection id="H3B50283C88FF4A7BBD4F084F517868E0"><enum>(f)</enum><header>Priority</header><text>The Secretary shall grant loan forgiveness under this section on a first-come, first-served basis, and subject to the availability of appropriations.</text></subsection> 
<subsection id="H4743913DD08844FEB215AACFB2E7FA6C"><enum>(g)</enum><header>Regulations</header><text>The Secretary is authorized to prescribe such regulations as may be necessary to carry out the provisions of this section.</text></subsection> 
<subsection id="H11663E54245844DBA517ACB094A147CA"><enum>(h)</enum><header>Construction</header><text>Nothing in this section shall be construed to authorize the refunding of any repayment of any loan.</text></subsection> 
<subsection id="HF49F8FCB72DB46C98121EAAF858BA765"><enum>(i)</enum><header>Prevention of Double Benefits</header><text>No borrower may, for the same service, receive a benefit under both this section and subtitle D of title I of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12571">42 U.S.C. 12571 et seq.</external-xref>). No borrower may receive a benefit under this section for both employment described in <internal-xref idref="H2023F6271B6C4BE28F24B4132FEDB3C1" legis-path="428L.(c)(1)(A)">subsection (c)(1)(A)</internal-xref> and employment described in <internal-xref idref="H7CAF6FF3A34048FEBF52985BCC1C47D3" legis-path="428L.(c)(1)(B)">subsection (c)(1)(B)</internal-xref>.</text></subsection> 
<subsection id="H459A5C7BEB8A462389B2DCCB0055F705"><enum>(j)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for fiscal year 2008 and each of the 5 succeeding fiscal years.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
