<section id="HE71C8E2393C0405490466B76A91FED58" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Broadband Deployment Act</short-title></quote>. </text></section> 
<section id="HC5011324A87942E98832B133DF825B98"><enum>2.</enum><header>Codification of certain changes proposed by the Department of Agriculture to rules governing eligibility for the rural broadband access program</header> 
<subsection id="H48335D851C7C477C905CAA29504EC26D"><enum>(a)</enum><header>In general</header><text>Section 601(d) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb(d)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HB36574DE8B924563BB7CFDB6C7BC45C8" display-inline="no-display-inline"> 
<paragraph id="H7E03E439A4CB4047A3FC390D2F6CEE8"><enum>(4)</enum><header>Eligibility determinations</header><text>In determining the eligibility of an applicant for a loan or loan guarantee under this section:</text> 
<subparagraph id="H81D284AF87464E6F827653D41567ABB5"><enum>(A)</enum><header>Relaxation of market survey requirement</header><text display-inline="yes-display-inline">The Secretary shall not require the applicant to submit a market survey for a service area proposed in the application if the applicant is projecting less than a 15 percent penetration of households passed in the service area, by the end of the time period used in the study conducted by the Secretary to determine whether the project proposed in the application is financially feasible; and</text></subparagraph> 
<subparagraph id="H8E97D5FDDFBB4143B1CC3099E789DA2D"><enum>(B)</enum><header>Elimination of credit support requirement, including the cash on hand requirement</header><text>In lieu of imposing the credit support requirements set forth in <external-xref legal-doc="regulation" parsable-cite="cfr/7/1738.20">section 1738.20</external-xref> of title 7, Code of Federal Regulations, the Secretary—</text> 
<clause id="HD26A91DFD6BC426D89BDF2F8EDD9491F"><enum>(i)</enum><text display-inline="yes-display-inline">except as provided in clause (ii), shall require the applicant to demonstrate a minimum equity position equal to 20 percent of the requested loan amount at the time the application is submitted (or 10 percent of the amount, if the application proposes to serve an area in which at least 40 percent of the households do not have access to broadband service or are in an area in which broadband service is provided by only 1 provider);</text> </clause> 
<clause id="H6064A01540A243548999F2271BC8C663"><enum>(ii)</enum><text display-inline="yes-display-inline">may waive or modify the requirement of clause (i) to the extent that the waiver or modification—</text> 
<subclause id="H96AFE627153D46DAA47FE3754671E421"><enum>(I)</enum><text>does not result in the applicant having a projected negative cash position in any quarter in the time period referred to in subparagraph (A); and</text></subclause> 
<subclause id="H5B88FAB3FD8A42FCAA5FAD04CCDD8BD0"><enum>(II)</enum><text>is required to enable the provision of broadband service in an area that does not have access to broadband service or in which broadband service is provided by only 1 provider; and</text></subclause></clause> 
<clause id="H4A7CFDED18CF40F0B172DB5B09372F00"><enum>(iii)</enum><text display-inline="yes-display-inline">shall notify the applicant if financial analysis indicates that cash from operations and previous cash infusions would not be sufficient to enable to applicant to sustain a positive cash position throughout the time period referred to in subparagraph (A), and that additional cash requirements are needed to support the feasibility of the loan.</text></clause></subparagraph>
<subparagraph id="H585906BB6B7441F39D0296B915CA4E0"><enum>(C)</enum><header>Notice and comment on applications</header><text>As soon as is practicable after receipt of an application submitted pursuant to this section, the Secretary shall cause to be published in the Federal Register a notice that the application has been submitted (which shall include a copy of the application), and that the Secretary will accept comments from the public on the application during the 30-day period after the date the notice is so published.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD7C35DB736DE4B81AF67DA2CED35753"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on December 1, 2007.</text> </subsection></section>
