<official-title>To amend the Fair Credit Reporting Act to establish additional reporting requirements to enhance the detection of identity theft, and for other purposes.</official-title>

<section id="H340362953D6D4299890576638DBB8754" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Credit Agencies Identity Theft Responsibilities Act of 2007</short-title></quote>.</text></section> 
<section id="H39E48042A46340139605AF2E7BDDDDE0"><enum>2.</enum><header>Identity theft reporting</header> 
<subsection id="H0E3DF125D6B24303BDB556999E607D13"><enum>(a)</enum><header>In general</header><text>Section 608 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681f">15 U.S.C. 1681f</external-xref>) is amended—</text> 
<paragraph id="H07D7F68BDF1B4681BF1D16D706911786"><enum>(1)</enum><text>by striking <quote>Notwithstanding the provisions of section 604</quote> and inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general</header-in-text>.—Notwithstanding the provisions of section 604</quote>; and</text></paragraph> 
<paragraph id="H2FDE9E5E118E446F8CE0C6C54E9DC354"><enum>(2)</enum><text>by adding at the end the following new subsection: </text> 
<quoted-block style="OLC" id="HA73353BFB91C4F719236EDCD93DE17BB" display-inline="no-display-inline"> 
<subsection id="H34B2A957607642BAB06F216CE34222F"><enum>(b)</enum><header>Suspicion of identity theft</header> 
<paragraph id="H9F8774175DDA4F7EB43B9BB54C7063F6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If, on the basis of information on consumers maintained or controlled by a consumer reporting agency, the consumer reporting agency has reason to suspect that identity theft may be occurring or may have occurred with respect to any consumer, the consumer reporting agency shall report the suspicion of identity theft, a brief description of the basis for the suspicion, together with any information described in subsection (a) relating to any consumer name involved to the United States Secret Service for review and appropriate action, including the provision of information to the Attorney General for criminal prosecution. If the Secret Service has reason to believe that any suspected case of identity theft reported under this paragraph involves any suspicion of terrorism or immigration violations, the Secret Service shall forward the information received under this paragraph to the Federal Bureau of Investigation or the Department of Homeland Security, respectively.</text></paragraph> 
<paragraph id="H0A64F42564B041A898D0D1E9AE6971A9"><enum>(2)</enum><header>Basis for suspicion of identity theft</header><text display-inline="yes-display-inline">For purposes of this subsection, a consumer reporting agency shall have reason to suspect that identity theft may be occurring or may have occurred under any of the following circumstances:</text> 
<subparagraph id="H0A7905A5561347C9A87397D49D387887"><enum>(A)</enum><text>The names of 3 or more consumers each have the same Social Security account number associated with the names.</text></subparagraph> 
<subparagraph id="H0DAA029FD9F64BBFB2B29211FE8E81A1"><enum>(B)</enum><text>3 or more home addresses are associated with the name of any consumer in any 1-year period.</text></subparagraph> 
<subparagraph id="H5A4345BD99C84AB9A1164C6FD500C84E"><enum>(C)</enum><text display-inline="yes-display-inline">More than 1 date of birth is associated with the name of any consumer or any Social Security account number.</text></subparagraph> 
<subparagraph id="H414E1E4EFC6A4590BC52BCFC9C346A9"><enum>(D)</enum><text>Any other circumstance the Commission may prescribe by regulation.</text></subparagraph></paragraph> 
<paragraph id="HBDD88D3CB30149A1B9003626EB8139C"><enum>(3)</enum><header>Duty to review</header><text display-inline="yes-display-inline">Each consumer reporting agency shall establish procedures, in accordance with regulations the Commission shall prescribe, for reviewing, at regular time intervals, all information on consumers maintained or controlled by the agency to determine whether there is any basis for suspicion of identity theft with respect to any consumer.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H4B2ADC4A8E7547070020C2EC242996C7"><enum>(b)</enum><header>Penalty</header><text>The Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681 et seq.</external-xref>) is amended by adding at the end the following new section:</text> 
<quoted-block style="USC" id="H421CEFF1B72B4251A6CC6490CBC2DE66" display-inline="no-display-inline"> 
<section id="HB9D8DC3D6915494B800379C8247B95EA"><enum>630.</enum><header>Criminal penalty</header><text display-inline="no-display-inline">Any individual who is an officer, director, employee, or agent of a consumer reporting agency and who intentionally causes the consumer reporting agency to fail to comply with any requirement of section 608(b) shall be imprisoned for not more than 2 years, fined under title 18, United States Code, or both. </text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H03A37EFFFD7D4FCFBC87389D5EF952AE"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for the Fair Credit Reporting Act is amended by inserting after the item relating to section 629 the following new item:</text>
