<section section-type="section-one" id="HC2938850A66047FEBD1CF431E160119" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Human Cloning Prohibition Act of 2007</short-title></quote>.</text></section> 
<section id="HBD527041F7E041DF92ED2FB57FF9F668"><enum>2.</enum><header>Prohibition against human cloning</header> 
<subsection id="H08384E6B4E9E4EA594E417E930A5DF39"><enum>(a)</enum><header>In General</header><text>The <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>) is amended by adding at the end the following:</text>

<chapter id="HC4F3222B793E4807B4A132AB5E44B4C"><enum>X</enum><header>HUMAN CLONING</header> 
<section id="H7DC9BAF4200947CD8781FA25E1FDD418"><enum>1001.</enum><header>Prohibition against human cloning</header> 
<subsection display-inline="yes-display-inline" id="H914D95E9B66D442A8487C8E016CDC78"><enum>(a)</enum><header>In general</header><text>It shall be unlawful for any person—</text> 
<paragraph id="H482571B09C0745A0B4FC3C7BF0038B6"><enum>(1)</enum><text>to perform or attempt to perform human cloning; or</text></paragraph> 
<paragraph id="H2F8C203E1D9541A583C195D52567F4B0"><enum>(2)</enum><text>to ship, mail, transport, or receive the product of human somatic cell nuclear transfer technology knowing that such product is for the purpose of human cloning.</text> </paragraph></subsection> 
<subsection id="H1710A985D6A04175919250631CD3E847"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="HC48A2EEC53AF42419D48B82D9FB8CCA8"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>human cloning</term> means the implantation of the product of human somatic cell nuclear transfer technology into a uterus or the functional equivalent of a uterus.</text></paragraph>
<paragraph id="H49541ADAFD084BF8AAA62D4EE2993F75"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>human somatic cell nuclear transfer technology</term> means transferring the nuclear material of a human somatic cell into an egg cell from which the nuclear material has been removed or rendered inert.</text></paragraph> 
<paragraph id="HB07C2E8A37144E0C8EC4ECD08BD35C9D"><enum>(3)</enum><text>The term <term>person</term> includes a governmental entity.</text></paragraph></subsection> </section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H29695C2B80D840A49C3D6E44FC00ABFB"><enum>(b)</enum><header>Prohibited Acts</header> 
<paragraph id="H6858D707AB98432590538FB1F6001107"><enum>(1)</enum><header>In general</header><text>Section 301 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) is amended by adding at the end the following:</text>

<item indent="up5" id="HA4FCC8E6978D4BF28B11A0A467F6F83C"><enum>(jj)</enum><text>The violation of section 1001(a).</text></item><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H55F438AB87874A9399AB4CE5EF79975"><enum>(2)</enum><header>Criminal penalty</header><text>Section 303(b) of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/333">21 U.S.C. 333(b)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" act-name="Federal Food, Drug, and Cosmetic Act" id="H8D6F5E93418F47EF85E92892F8E1AAAC"> 
<paragraph indent="up1" id="H05DFD43CE6C948A4A537450043872DFB"><enum>(7)</enum><text>Notwithstanding subsection (a), any person who violates section 301(jj) shall be imprisoned not more than 10 years or fined in accordance with title 18, United States Code, or both.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HCDE9B97ADC1C48A889AA95E461B8DAA0"><enum>(3)</enum><header>Civil penalties</header><text>Section 303 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/333">21 U.S.C. 333</external-xref>) is amended—</text> 
<subparagraph id="HB622FDA12BE74F7AA7961741D17D65E8"><enum>(A)</enum><text>by redesignating subsection (g) as subsection (f); and</text></subparagraph> 
<subparagraph id="H41DC5215646C497CAF07CD88A7588B34"><enum>(B)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" act-name="Federal Food, Drug, and Cosmetic Act" id="H669D76CADD6346B68CA97000BC341528"> 
<subsection id="H409A330173C04602A977CF5F253E1E1D"><enum>(g)</enum> 
<paragraph display-inline="yes-display-inline" id="H3E5F702A0E8A45319C52007225E8DD11"><enum>(1)</enum><text>Any person who violates section 301(jj) shall be liable to the United States for a civil penalty in an amount not to exceed the greater of—</text> 
<subparagraph indent="up1" id="HF71B5E237519404E8428F7DEA0537C57"><enum>(A)</enum><text>$10,000,000; or</text></subparagraph> 
<subparagraph indent="up1" id="H0E105C73E79A49E39905BBEA5CE969C1"><enum>(B)</enum><text>an amount equal to the amount of any gross pecuniary gain derived from such violation multiplied by 2.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H5106F88B6C5E4CF087206689FD418F55"><enum>(2)</enum><text>Paragraphs (3) through (5) of subsection (f) apply with respect to a civil penalty under this subsection to the same extent and in the same manner as such paragraphs (3) through (5) apply with respect to a civil penalty under subsection (f).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H62AE13CCA48F4A91863C7C1C0060BDC1"><enum>(4)</enum><header>Forfeiture</header><text>Section 303 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name>, as amended by paragraph (3), is amended by adding at the end the following:</text> 
<quoted-block style="OLC" act-name="Federal Food, Drug, and Cosmetic Act" id="H1E507204DE5C4114B3AC97CD2D149F0"> 
<subsection id="H9C95E9A6F1E74B6384BBBB53DE52781D"><enum>(h)</enum><text>Any property, real or personal, derived from or used to commit a violation of section 301(jj), or any property traceable to such property, shall be subject to forfeiture to the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
