		<official-title>To amend title 10, United States Code, to revise the
		  definition of unlawful enemy combatant for purposes of laws administered by the
		  Secretary of Defense relating to military commissions, to establish a statutory
		  right of habeas corpus for individuals detained at the detention facility at
		  Naval Station, Guantanamo Bay, Cuba, and for other purposes.</official-title>

		<section id="H3C892B999B9B42DE901100CBDD6F3F1D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Military Commissions Revision Act of
			 2007</short-title></quote>.</text>
		</section><section id="HEA7CB4B5ADD2441F8DA9DA1873D5C621"><enum>2.</enum><header>Definition of
			 unlawful enemy combatant</header><text display-inline="no-display-inline">Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/10/948a">section 948a</external-xref> of title 10,
			 United States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="HE0AB078F643C456BAF953D76B477CBBB" style="USC">
				<paragraph id="H3EF9FCEB64FE4844B7E2C1F7A5767FB8"><enum>(1)</enum><header>Unlawful enemy
				combatant</header><text display-inline="yes-display-inline">The term “unlawful
				enemy combatant” means a person who has engaged in, attempted, or conspired to
				engage in acts of armed hostilities or terrorism against the United States or
				its co-belligerents, and who is not a lawful enemy
				combatant.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HEE962D7671564CBC8266D74D719DA9DF"><enum>3.</enum><header>Determination of
			 unlawful enemy combatant status by combatant status review tribunal not
			 dispositive for purposes of jurisdiction of military commissions</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/948d">Section 948d</external-xref> of title 10, United States
			 Code, is amended by striking subsection (c) and by redesignating subsection (d)
			 as subsection (c).</text>
		</section><section id="H78590D897822418000F7DF6D904D395C"><enum>4.</enum><header>Exclusion of
			 statements obtained by coercion</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/10/948r">Section 948r</external-xref> of title 10, United States
			 Code, is amended by striking subsections (c) and (d) and inserting the
			 following new subsection (c):</text>

				<subsection id="H60A6739B83F34FC2B7F9DB78AA2DA975"><enum>(c)</enum><header>Exclusion of
				statements obtained by coercion</header><text>A statement obtained by a degree
				of coercion less than torture may be admitted only if the military judge finds
				that—</text>
					<paragraph id="H6086265678124FCE924200FAA2D21BA9"><enum>(1)</enum><text>the totality of
				the circumstances indicates that the statement possesses probative value to a
				reasonable person;</text>
					</paragraph><paragraph id="H3D8B7B170B4E4B61B83500CD4C000000"><enum>(2)</enum><text>the interests of
				justice would best be served by admitting the statement into evidence;
				and</text>
					</paragraph><paragraph id="H55DC940B51DE4316801FCE9F2D968FE3"><enum>(3)</enum><text>the interrogation
				methods used to obtain the statement do not amount to cruel, inhuman or
				degrading
				treatment.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HA10B7F23023A4BF8A9A009B784635071"><enum>5.</enum><header>Habeas corpus
			 matters</header>
			<subsection id="H48CE8F41FC40434887D2DF05A1ADA1AF"><enum>(a)</enum><header>In
			 general</header><text>Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/28/2241">section 2241(e)</external-xref> of title 28, United
			 States Code, is amended to read as follows:</text>
				<quoted-block id="H34643F8F33F34E4D80F5C312385A079" style="USC">
					<paragraph id="H3CB44C9120254D5A8F3EEAFE77000A9"><enum>(1)</enum><text>No court, justice,
				or judge shall have jurisdiction to hear or consider an application for a writ
				of habeas corpus filed by or on behalf of an alien enemy combatant detained by
				the United States who has been determined by a Combatant Status Review
				Tribunal, or other administrative review body constituted in accordance with
				United States law, to have been properly detained as an enemy combatant, unless
				a period of two years has elapsed since the date of detention and no criminal
				charges are pending against the detainee at the time the writ is
				filed.</text>
					</paragraph><after-quoted-block></after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="HF56E55916614483A873E55AAEBA73205"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 950j of
			 title 10, United States Code, is amended by striking subsection (b).</text>
			</subsection></section><section id="H22CA92DF8FF04E59ACA2F5CA0FDE682"><enum>6.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act shall take effect on the date of the enactment of
			 this Act, and shall apply to all cases, without exception, pending on or after
			 the enactment of this Act, which relate to any aspect of the detention,
			 transfer, treatment, trial, or conditions of detention of an alien detained by
			 the United States since September 11, 2001.</text>
