<official-title>To amend title 38, United States Code, to provide for the treatment of period of service in uniformed services as continued employment for purposes of pension and retirement benefits for individuals who die during the period of service.</official-title>

<section id="H0E3205967CFB4530A97011A790112FC0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Honoring Existing Retirement Obligations for Every Servicemember Act of 2007</short-title></quote>.</text> </section>
<section id="HE0AA809AF1C84C6FBC2039E4BDF1C00"><enum>2.</enum><header>Treatment of period of service in uniformed services as continued employment for purposes of pension and retirement benefits for individuals who die during the period of service</header> 
<subsection id="H4440E2B6B5774130B1D2E9FE0389E5AD"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">Chapter 43</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="H05060EB50FEC4D4793B6B599044B30A4"><enum>(1)</enum><text>in section 4312(f)—</text> 
<subparagraph id="H28105CD9DB7E44A5873E2B00B22564FF"><enum>(A)</enum><text>in paragraph (1), by striking <quote>paragraph (2)</quote> and inserting <quote>paragraphs (2) and (4)</quote>; and</text> </subparagraph>
<subparagraph id="HA5ACC7482FF44272B6053E8EE3440561"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H42E3B0601DFC406EAA85484D99017D15" style="USC"> 
<paragraph id="HDF478BF538CC4A5CA60014C01D104909" indent="up1"><enum>(4)</enum><text>In the case of a person referred to in subsection (a) who dies during the period of service in the uniformed services, a surviving relative of the person shall notify the employer referred to in that subsection of the person’s death as soon as possible after the death of the person.</text> </paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph>
<paragraph id="HC2E3A5DEC4884E6FAEF71B6485691764"><enum>(2)</enum><text>in section 4318, by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H40FE88B8DAD342BD91C01C53784C3630" style="USC"> 
<subsection id="HE161E03A6A5E46CDAC871CE89E89E37C"><enum>(d)</enum><text display-inline="yes-display-inline">In the case of a person referred to in subsection (a) of section 4312 who dies during the period of service in the uniformed services, the employer referred to in that subsection shall, upon receipt of notice of the person’s death, for purposes of any benefit covered by this section, treat the person as not having incurred a break in service with the employer or employers maintaining the plan until the date of the person’s death. That person shall have the same rights under this section as a person reemployed under this chapter and that employer shall be liable under this section with respect to that person in the same manner the employer is liable to a person reemployed under this section.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="H5842CB27F5444CD9B461474D35CFEA70"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this Act shall apply with respect to a person who dies on or after January 1, 2007.</text> </subsection></section>
