		  Control Act relating to beach monitoring, and for other

		<section id="HD7064DF131BC4DA3B477DC04AA0000AC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Beach
			 Protection Act of 2008</quote>.</text>
		</section><section display-inline="no-display-inline" id="H3251C689810A4E42952CCBDEE7256932"><enum>2.</enum><header>Water pollution
			 source identification</header>
			<subsection id="H6A1A00F829A641188BCD4568355FE1E1"><enum>(a)</enum><header>Source
			 tracking</header><text display-inline="yes-display-inline">Section 406(b) of
			 the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1346">33 U.S.C. 1346(b)</external-xref>) is amended—</text>
				<paragraph id="HC153C519DB7E436E9D241ED4F63F8136"><enum>(1)</enum><text>by redesignating
			 paragraphs (3) and (4) as paragraphs (4) and (5), respectively; and</text>
				</paragraph><paragraph id="H3096609BBDBE43ABAB782685BEBDE838"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H093D56D861404ACBAFC6B31FA319167B" style="OLC">
						<paragraph id="HBEA7C7B3052B4F91B9F9DB4746213CD9"><enum>(3)</enum><header>Source
				identification programs</header><text display-inline="yes-display-inline">In
				carrying out a monitoring and notification program, a State or local government
				may develop and implement a coastal recreation waters pollution source
				identification and tracking program for coastal recreation waters adjacent to
				beaches or similar points of access that are used by the public and are not
				meeting applicable water quality standards for pathogens and pathogen
				indicators. If, in carrying out such source identification and tracking
				program, a source of pathogenic contamination is identified by such State or
				local government, such State or local government shall make information on the
				existence of such source available to the public on the Internet within 24
				hours of the identification of such
				source.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC161CE40654C49AB9086ECB7D4CF6788"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text>Section 406(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1346">33 U.S.C. 1346(i)</external-xref>) is
			 amended by striking <quote>$30,000,000 for each of fiscal years 2001 through
			 2005</quote> and inserting <quote>$40,000,000 for each of fiscal years 2008
			 through 2012</quote>.</text>
			</subsection><subsection id="HD77E5B0EB2C44088B004FE1F02C949D"><enum>(c)</enum><header>Prohibition on
			 earmarks</header><text display-inline="yes-display-inline">None of the funds
			 appropriated pursuant to section 406(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1346">33 U.S.C. 1346(i)</external-xref>) may be
			 used for a Congressional earmark as defined in clause 9(d) of rule XXI of the
			 Rules of the House of Representatives.</text>
			</subsection></section><section id="HA00FAC4CDC104C43B997DF992005B68E"><enum>3.</enum><header>Funding for
			 Beaches Environmental Assessment and Coastal Health Act</header><text display-inline="no-display-inline">Section 8 of the Beaches Environmental
			 Assessment and Coastal Health Act of 2000 (114 Stat. 877) is amended by
			 striking <quote>2005</quote> and inserting <quote>2012</quote>.</text>
		</section><section id="HFF02EE1A17EE49D6B024E2002BDA98E"><enum>4.</enum><header>State
			 reports</header><text display-inline="no-display-inline">Section
			 406(b)(4)(A)(ii) of the Federal Water Pollution Control Act (as redesignated by
			 section (2)(a)(1) of this Act) is amended by inserting <quote>and all
			 environmental agencies of the State with authority to prevent or treat sources
			 of pollution in coastal recreation waters</quote> after
			 <quote>public</quote>.</text>
		</section><section id="H40119EA60116454F8302442635470062"><enum>5.</enum><header>Use of rapid
			 testing methods</header>
			<subsection id="H1EC8543D5AE5497CA9EB1D5F86BCEB64"><enum>(a)</enum><header>Contents of
			 state and local government programs</header><text display-inline="yes-display-inline">Section 406(c)(4)(A) of the Federal Water
			 Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1346">33 U.S.C. 1346(c)(4)(A)</external-xref>) is amended by inserting
			 <quote>, including rapid testing methods,</quote> after
			 <quote>methods</quote>.</text>
			</subsection><subsection id="H3F66D17B40A04ED0AC9C8251A77CBEF2"><enum>(b)</enum><header>Revised
			 criteria</header><text display-inline="yes-display-inline">Section 304(a)(9)(A)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1314">33 U.S.C. 1314(a)(9)(A)</external-xref>) is amended by inserting <quote>and rapid
			 testing methods</quote> after <quote>methods</quote>.</text>
			</subsection><subsection display-inline="no-display-inline" id="HADA9C042D7464A44AD74448E25F630E3"><enum>(c)</enum><header>Validation and
			 Use of Rapid Testing Methods</header>
				<paragraph id="HE30EF241D2424314A733E07E8CAC41FB"><enum>(1)</enum><header>Validation of
			 Rapid Testing Methods</header><text display-inline="yes-display-inline">Not
			 later than October 1, 2010, the Administrator of the Environmental Protection
			 Agency shall complete an evaluation and validation of a rapid testing method
			 for the water quality criteria and standards for pathogens and pathogen
			 indicators described in section 303(i)(1)(A).</text>
				</paragraph><paragraph id="HDDE55DB64D85403E87B33DF977A623BE"><enum>(2)</enum><header>Guidance for Use
			 of Rapid Testing Methods</header>
					<subparagraph id="H204CCE5498B54221B0660004DDAAC76"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 180
			 days after completion of the validation under paragraph (1), and after
			 providing notice and an opportunity for public comment, the Administrator shall
			 publish guidance for the use at coastal recreation waters adjacent to beaches
			 or similar points of access that are used by the public of rapid testing
			 methods that will enhance the protection of public health and safety through
			 rapid public notification of any exceeding of applicable water quality
			 standards for pathogens and pathogen indicators.</text>
					</subparagraph><subparagraph id="H5B1C57F694F746A585557CF2C8C896EA"><enum>(B)</enum><header>Prioritization</header><text>In
			 developing such guidance, the Administrator shall prioritize the use of rapid
			 testing methods at those beaches or similar points of access that are the most
			 used by the public.</text>
					</subparagraph></paragraph></subsection><subsection id="HACCB523AEF114D7890383FCFCC1DA400"><enum>(d)</enum><header>Definition</header><text>Section
			 502 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H1A165A6F885C4B86B6AABC920062B200" style="OLC">
					<paragraph id="H86718A8B1FD04630A77FA7D5ED185010"><enum>(25)</enum><header>Rapid testing
				method</header><text display-inline="yes-display-inline">The term <term>rapid
				testing method</term> means a method of testing the water quality of coastal
				recreation waters for which results are available as soon as practicable and
				not more than 6 hours after a water quality sample is received by the testing
				facility.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H297793D450D347D99BE76BF9E280F2CC"><enum>6.</enum><header>Notification of
			 Federal, State, and local agencies</header><text display-inline="no-display-inline">Section 406(c)(5) of the Federal Water
			 Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1346">33 U.S.C. 1346(c)(5)</external-xref>) is amended—</text>
			<paragraph id="HC8E721C1578248B29453BF4FD7C829F"><enum>(1)</enum><text>by
			 striking <quote>prompt communication</quote> and inserting
			 <quote>communication, within 24 hours of the receipt of the results of a water
			 quality sample,</quote>;</text>
			</paragraph><paragraph id="HAB53D8E16D4A467388F688753B4476E9"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text>
				<subparagraph id="H51A196EBB46344FAAF63C049041B4274"><enum>(A)</enum><text>by inserting
			 <quote>(i) in the case of any State in which the Administrator is administering
			 the program under section 402,</quote> before <quote>the Administrator</quote>
			 the first place it appears; and</text>
				</subparagraph><subparagraph id="H12393068F2BA415092F882001C708D27"><enum>(B)</enum><text>by inserting at
			 the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H8EAD9D7FDF4C46618E7F8C7C3236A78F" style="OLC">
						<subparagraph id="HF9ABC62D87EF4C8286BCAC7FE2A70500"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of any State other than a State
				to which clause (i) applies, all agencies of the State government with
				authority to require the prevention or treatment of the sources of coastal
				recreation water pollution;
				and</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H4EB522379B154893A3367BDA8036AE94"><enum>(3)</enum><text>by redesignating
			 paragraphs (6) and (7) as paragraphs (7) and (8), respectively; and</text>
			</paragraph><paragraph id="H29C658BB745F4F789D3B89D81B894610"><enum>(4)</enum><text>by inserting after
			 paragraph (5) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H419C7BBE8A6E43FABDD600B9E9777189" style="OLC">
					<paragraph id="H424BBD62AACC488A9383005BFC5C23A"><enum>(6)</enum><text display-inline="yes-display-inline">measures for an annual report to the
				Administrator, in such form as the Administrator determines appropriate, on the
				occurrence, nature, location, pollutants involved, and extent of any exceeding
				of applicable water quality standards for pathogens and pathogen
				indicators;</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HCD73425439F64B2DB24E5FBFF8E844C3"><enum>7.</enum><header>Content of State
			 and local programs</header><text display-inline="no-display-inline">Section
			 406(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1346">33 U.S.C. 1346(c)</external-xref>) is
			 amended—</text>
			<paragraph id="H6B726123A4A94AF8B4EE74B4EEF3BF18"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (7) (as redesignated by section 6(3)
			 of this Act);</text>
			</paragraph><paragraph id="H56CCD45862F14F6CBF15428CA4C2896E"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (8) (as redesignated by section 6(3) of this
			 Act) and inserting a semicolon; and</text>
			</paragraph><paragraph id="H4B4036D813614FB391696EAD21B8F1FC"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H138C91B58D524804A5214BCCACB4D087" style="OLC">
					<paragraph id="HF477B708EE5F4594881D414B9F6855DF"><enum>(9)
				</enum><text display-inline="yes-display-inline">the availability of a
				geographic information system database that such State or local government
				program shall use to inform the public about coastal recreation waters and
				that—</text>
						<subparagraph id="H4CC01764EB1141169E5B90F5F64C92C6"><enum>(A)</enum><text>is publicly
				accessible and searchable on the Internet;</text>
						</subparagraph><subparagraph id="HF033F415099F4A00957440159C800609"><enum>(B)</enum><text>is organized by
				beach or similar point of access;</text>
						</subparagraph><subparagraph id="H42732358C2034A6BB12B78E37EA5508F"><enum>(C)</enum><text>identifies
				applicable water quality standards, monitoring protocols, sampling plans and
				results, and the number and cause of coastal recreation water closures and
				advisory days; and</text>
						</subparagraph><subparagraph id="H0490A20717F2492E95D82027A200CBE6"><enum>(D)</enum><text>is updated within
				24 hours of the availability of revised information;</text>
						</subparagraph></paragraph><paragraph id="HDD1127030BFB4F0294C36020A5DF9C08"><enum>(10)</enum><text display-inline="yes-display-inline">measures for the immediate posting of signs
				at beaches or similar points of access that are sufficient to give public
				notice following the results of any water quality sample that demonstrates an
				exceeding of applicable water quality standards for pathogens and pathogen
				indicators for the coastal recreation waters adjacent to such beaches or
				similar points of access; and</text>
					</paragraph><paragraph commented="no" id="H804FA6FD4FDC45F1002C7776AD4CE504"><enum>(11)</enum><text display-inline="yes-display-inline">measures to ensure that closures or
				advisories are made or issued within 24 hours after the State government
				determines that any coastal recreation waters in the State are not meeting or
				are not expected to meet applicable water quality standards for pathogens and
				pathogen
				indicators.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H8C151CA71D2D48A9AD1B45D951BE8F8"><enum>8.</enum><header>Compliance
			 review</header><text display-inline="no-display-inline">Section 406(h) of the
			 Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1346">33 U.S.C. 1346(h)</external-xref>) is amended—</text>
			<paragraph id="H2EE7366CF73D46B2B4434F3D97D6D81B"><enum>(1)</enum><text>by redesignating
			 paragraphs (1) and (2) as subparagraphs (A) and (B), respectively;</text>
			</paragraph><paragraph id="H8CC272FF1C1E473BB9FCA66E3716D371"><enum>(2)</enum><text>by moving such
			 subparagraphs 2 ems to the right;</text>
			</paragraph><paragraph id="H2BA0CF0748C74482A66C45007DD256F8"><enum>(3)</enum><text>by striking
			 <quote>In the</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H529EBC4C05114ACE90D5BB26C5C17F8C" style="OLC">
					<paragraph id="HC58A20993EE144DB9F04FA6D15F5D293"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In
				the</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HE8350E3FFA0A4D18991D962D46B0002B"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H5371812492434DF0A0A9D5AFB3AF6800" style="OLC">
					<paragraph id="HF5595B4EBBA944F9954B2E1D978406BE"><enum>(2)</enum><header>Compliance
				review</header><text display-inline="yes-display-inline">On or before July 31
				of each calendar year beginning after the date of enactment of this paragraph,
				the Administrator shall—</text>
						<subparagraph id="HF07B3DD1859D4283BB3CAD986D9E49DC"><enum>(A)</enum><text>prepare a written
				assessment of compliance with all statutory and regulatory requirements of this
				section for each State and local government and of compliance with conditions
				of each grant made under this section to a State or local government;</text>
						</subparagraph><subparagraph commented="no" id="H03171602981D45EBBAEABF39DE00F65F"><enum>(B)</enum><text>notify the State
				or local government of such assessment; and</text>
						</subparagraph><subparagraph id="H564D6AC4F66448CA91B860EC3E6400B1"><enum>(C)</enum><text display-inline="yes-display-inline">make each of the assessments available to
				the public in a searchable database on the Internet on or before December 31 of
				such calendar year.</text>
						</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H247F2C6CB71D45C3A3C287CBC06F74A2"><enum>(3)</enum><header>Corrective
				Action</header><text display-inline="yes-display-inline">If a State or local
				government that the Administrator notifies under paragraph (2) is not in
				compliance with any requirement or grant condition described in paragraph (2)
				fails to take such action as may be necessary to comply with such requirement
				or condition within one year of the date of notification, any grants made under
				subsection (b) to the State or local government, after the last day of such
				one-year period and while the State or local government is not in compliance
				with all requirements and grant conditions described in paragraph (2), shall
				have a Federal share of not to exceed 50 percent.</text>
					</paragraph><paragraph id="H56906966D0E142D9A5065393B6A4F493"><enum>(4)</enum><header>GAO
				review</header><text>Not later than December 31 of the third calendar year
				beginning after the date of enactment of this paragraph, the Comptroller
				General shall conduct a review of the activities of the Administrator under
				paragraphs (2) and (3) during the first and second calendar years beginning
				after such date of enactment and submit to Congress a report on the results of
				such
				review.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H05745DF0D36B4BC9B74151CED5984098" section-type="subsequent-section"><enum>9.</enum><header>Study of grant
			 distribution formula</header>
			<subsection id="H669BD52106814C41A4D1769D2BCE088"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than 30 days after the date of
			 enactment of this Act, the Administrator of the Environmental Protection Agency
			 shall commence a study of the formula for the distribution of grants under
			 section 406 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1346">33 U.S.C. 1346</external-xref>) for the
			 purpose of identifying potential revisions of such formula.</text>
			</subsection><subsection id="HDEC69BFC5EDE40C0BD444CC2C1DEB2A2"><enum>(b)</enum><header>Contents</header><text>In
			 conducting the study, the Administrator shall consider the base cost to States
			 of developing and maintaining water quality monitoring and notification
			 programs, the States’ varied beach monitoring and notification needs, including
			 beach mileage, beach usage, and length of beach season, and other factors that
			 the Administrator determines to be appropriate.</text>
			</subsection><subsection id="H12A11835BA174F0486E6B0CBD9AFE821"><enum>(c)</enum><header>Consultation</header><text>In
			 conducting the study, the Administrator shall consult with appropriate Federal,
			 State, and local agencies.</text>
			</subsection><subsection id="HBE36530998DB430A90A040F483406630"><enum>(d)</enum><header>Report</header><text>Not
			 later than 12 months after the date of enactment of this Act, the Administrator
			 shall submit to the Committee on Transportation and Infrastructure of the House
			 of Representatives and the Committee on Environment and Public Works of the
			 Senate a report on the results of the study, including any recommendation for
			 revision of the distribution formula referred to in subsection (a).</text>
			</subsection></section><section id="H7AAC6CDB96C944CDA080655930CAF1F4"><enum>10.</enum><header>Publication of
			 coastal recreation waters pathogen list</header><text display-inline="no-display-inline">Section 304(a)(9) of the Federal Water
			 Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1314">33 U.S.C. 1314(a)(9)</external-xref>) is amended by adding at the end
			 the following:</text>
			<quoted-block display-inline="no-display-inline" id="H28E728073E864245ACA52501609227E" style="OLC">
				<subparagraph id="H624C15F3DCCF4464B5DA3915E0AB9016"><enum>(C)</enum><header>Publication of
				pathogen and pathogen indicator list</header><text display-inline="yes-display-inline">Upon publication of the new or revised
				water quality criteria under subparagraph (A), the Administrator shall publish
				in the Federal Register a list of all pathogens and pathogen indicators studied
				under section
				104(v).</text>
				</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HF056FD2890B544D5BC921D59BCF2DD9F"><enum>11.</enum><header>Adoption of new
			 or revised criteria and standards</header><text display-inline="no-display-inline">Section 303(i)(2)(A) of the Federal Water
			 Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1313">33 U.S.C. 1313(i)(2)(A)</external-xref>) is amended by striking
			 <quote>paragraph (1)(A)</quote> each place it appears and inserting
			 <quote>paragraph (1)</quote>.</text>
		</section><section id="HCAC98F26754D4EA392E5E5A0CAC3E59C"><enum>12.</enum><header>Use of molecular
			 diagnostics for monitoring and assessing coastal recreation waters</header>
			<subsection id="H01EB1D5248F2481294C4A35DD4175CCF"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Administrator of the Environmental
			 Protection Agency shall conduct a study to assess the benefits of using
			 molecular diagnostics for monitoring and assessing the quality of coastal
			 recreation waters adjacent to beaches and similar points of access that are
			 used by the public.</text>
			</subsection><subsection id="H23FEE7C95C414FA0BB81F28BEAA2DF6C"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">In conducting the study, the Administrator
			 shall—</text>
				<paragraph id="H9A5B8946C38B4CD1B1517D001694C135"><enum>(1)</enum><text display-inline="yes-display-inline">to the extent practicable, evaluate the
			 full range of available rapid testing methods, as defined by section 502 of the
			 Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>), and methods that meet
			 prescribed performance standards, including—</text>
					<subparagraph id="H2A38555319A546E0AF6D79ACBCDC6017"><enum>(A)</enum><text>the amplified
			 nucleic acid assay method; and</text>
					</subparagraph><subparagraph id="H5572788DD1854647B239D28386777300"><enum>(B)</enum><text>the indicator
			 organisms enterococci and E. coli; and</text>
					</subparagraph></paragraph><paragraph id="H49C38D04629041DEBA451E7611E243AC"><enum>(2)</enum><text>compare the use of
			 molecular diagnostics to culture testing of same source water, including the
			 time for obtaining results, accuracy of results, and future
			 applicability.</text>
				</paragraph></subsection><subsection id="H6E5A43A6B9D241CBBFBA2E56705B0043"><enum>(c)</enum><header>Partnerships</header><text display-inline="yes-display-inline">Notwithstanding <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/63">chapter 63</external-xref> of title 31,
			 United States Code, the Administrator may award a grant or cooperative
			 agreement to a public or private organization to assist the Administrator in
			 carrying out the study.</text>
			</subsection><subsection id="HBE8CC9680B31457EA8E932D5E17FB19"><enum>(d)</enum><header>Report to
			 Congress</header><text>Not later than 2 years after the date of enactment of
			 this Act, the Administrator shall transmit to Congress a report on the results
			 of the study.</text>
			</subsection><subsection id="H0D0F143718DF4C1893574BDCDFDDAB31"><enum>(e)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 section.</text>
			</subsection></section><section display-inline="no-display-inline" id="HAFAD242B9C4C4A6882E7A3AE1CCDB607" section-type="subsequent-section"><enum>13.</enum><header>Monitoring Protocol
			 for Mercury</header>
			<subsection id="H1B489C4D2F7B422EA4FCC8ABBEC89EAA"><enum>(a)</enum><header>Review and
			 update of existing monitoring protocols</header><text display-inline="yes-display-inline">The Administrator of the Environmental
			 Protection Agency shall review and update existing monitoring protocols as
			 necessary for mercury affecting the coastal recreation waters of the Great
			 Lakes.</text>
			</subsection><subsection id="HFE5382EA143944AD8B17BAEC05AEA7B9"><enum>(b)</enum><header>Recommendations
			 on testing</header><text display-inline="yes-display-inline">In carrying out
			 subsection (a), the Administrator shall develop updated recommendations on
			 testing for the presence of mercury affecting the coastal recreation waters of
			 the Great Lakes, including the presence of mercury in Great Lakes sediment and
			 fish tissue.</text>
			</subsection><subsection id="H8E7D09CFB9CF459090D3F545221E6DF"><enum>(c)</enum><header>Publication of
			 water quality criteria</header><text display-inline="yes-display-inline">Nothing in this section shall delay the
			 schedule for publication of new or revised water quality criteria as required
			 by section 304(a)(9) of the Federal Water Pollution Control Act (33 U.S.C.
			 1314(a)(9)).</text>
			</subsection><subsection id="H90E7664004DB42D69F107589AA9DC650"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated such sums as may be necessary to carry out this
			 section.</text>
			</subsection></section><section display-inline="no-display-inline" id="H8BC14D5F43D4410C88DC652D78A0CF68" section-type="subsequent-section"><enum>14.</enum><header>National list of
			 beaches</header><text display-inline="no-display-inline">Section 406(g)(3) of
			 the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1346">33 U.S.C. 1346(g)(3)</external-xref>) is amended by
			 striking “The Administrator” and all that follows through the period and
			 inserting “Within 12 months after the date of the enactment of the Beach
			 Protection Act of 2008, and biennially thereafter, the Administrator shall
			 update the list described in paragraph (1).”.</text>
		</section><section id="H2DFC22F3EA7642A3A3C92D44AB8BCD9B"><enum>15.</enum><header>Impact of
			 climate change on pollution of coastal recreation waters</header>
			<subsection id="H3F4CEE9F3D0742BD962757FFD3FDFADA"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Administrator of the Environmental
			 Protection Agency shall conduct a study on the long-term impact of climate
			 change on pollution of coastal recreation waters.</text>
			</subsection><subsection id="H0E2D9796BD0847A8974490B0A693005B"><enum>(b)</enum><header>Report</header>
				<paragraph id="H0975AAB399344BC9B44263006587A310"><enum>(1)</enum><header>In
			 general</header><text>Not later than one year after the date of enactment of
			 this Act, the Administrator shall submit to Congress a report on the results of
			 the study conducted under subsection (a).</text>
				</paragraph><paragraph id="H8573D01979014F558375000736AD3714"><enum>(2)</enum><header>Information on
			 potential contaminant impacts</header><text>The report shall include
			 information on potential contaminant impacts on ground and surface water
			 resources as well as ecosystem and public health in coastal communities.</text>
				</paragraph><paragraph id="H916F3B4AFDA644508445918D8D2E4717"><enum>(3)</enum><header>Monitoring</header><text>The
			 report shall address monitoring required to document and assess changing
			 conditions of coastal water resources, recreational waters, and ecosystems and
			 review the current ability to assess and forecast impacts associated with
			 long-term change.</text>
				</paragraph><paragraph id="H63BC64314AA041FAB93498A6EECF6C8"><enum>(4)</enum><header>Federal
			 actions</header><text>The report shall highlight necessary Federal actions to
			 help advance the availability of information and tools to assess and mitigate
			 these effects in order to protect public and ecosystem health.</text>
				</paragraph><paragraph id="H256A8E079F80448984546D92455C6CF1"><enum>(5)</enum><header>Consultation</header><text>In
			 developing the report, the Administrator shall work in consultation with
			 agencies active in the development of the National Water Quality Monitoring
			 Network and the implementation of the Ocean Research Priorities Plan and
			 Implementation Strategy.</text>
				</paragraph></subsection></section></legis-body>
