<official-title>To implement certain measures to increase the effectiveness of international child abduction remedies, and for other purposes.</official-title> 
</form> 
<legis-body id="HA2551F544A7C4DC1A700C3149CE1EFC" style="OLC"> 
<section id="H48C805CBFA41407D8379DFFAE061316F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bring Our Children Home Act</short-title></quote>.</text> </section>
<section display-inline="no-display-inline" id="H3D468A76FE3041D5B2945244E5EF3BCF" section-type="subsequent-section"><enum>2.</enum><header>Amendment to the missing children’s assistance act</header><text display-inline="no-display-inline">Section 403(1) of the Missing Children’s Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5772">42 U.S.C. 5772(1)</external-xref>) is amended—</text> 
<paragraph id="HD8E074F3CFAA489FB5A642BBAE842846"><enum>(1)</enum><text>in the matter preceding subparagraph (A) by striking <quote>whose whereabouts are unknown to such individual’s legal custodian if</quote>,</text> </paragraph>
<paragraph id="H6149CDD049244EA5A9271700C101CBA"><enum>(2)</enum><text>in subparagraphs (A), (B), and (C)—</text> 
<subparagraph id="HA0E4FFDD06EF49718F7353230015FCF0"><enum>(A)</enum><text>by redesignating such subparagraphs as clauses (i), (ii), and (iii), respectively, and</text> </subparagraph>
<subparagraph id="H6BCE57A3DF5143179C005D00E07DE1CA"><enum>(B)</enum><text>by indenting the left margin of such subparagraphs 2 ems to the right,</text> </subparagraph></paragraph>
<paragraph id="H07B5373B32DA45E9BCD730CFF7F823C9"><enum>(3)</enum><text>by inserting before clause (i), as so redesignated, the following:</text> 
<quoted-block display-inline="no-display-inline" id="HA68B2400FA4F42688CF407CB7A49C63" style="traditional"> 
<subparagraph id="HEF1C5C7ED2D34B67814F883D853307BF"><enum>(A)</enum><text display-inline="yes-display-inline">whose whereabouts is unknown to such individual’s legal custodian if—</text> </subparagraph><after-quoted-block>, and</after-quoted-block></quoted-block> </paragraph>
<paragraph id="HF47CEC3411694C89BD44F8DB80D8775"><enum>(4)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H09AE37377A364C7D8DF86CFF538E6508" style="traditional"> 
<subparagraph id="H5807405B95294242BB90342071CA12E"><enum>(B)</enum><text display-inline="yes-display-inline">whose whereabouts is known to such individual’s legal custodian from whose control such child—</text> 
<clause id="HA68B9E8CA64540FB8CEA09E7DEF644D4"><enum>(i)</enum><text>was removed in violation of law; or</text> </clause>
<clause id="HDA111EBD33C443EC8F988CBC6800D2F8"><enum>(ii)</enum><text>is believed by such custodian to have been taken out of the United States without the consent of such custodian by, or for the benefit of, an individual who may possibly claim custodial rights with respect to such child;</text> </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
<section display-inline="no-display-inline" id="HAA1089FB1E884EBA9FC9C271881CDC77"><enum>3.</enum><header>Investigative assistance to law enforcement agencies to locate alien children missing in the United States</header><text display-inline="no-display-inline">The Attorney General shall make available to State and local law enforcement agencies, information describing the methods and procedures available to them to institute or assist an investigative search for an alien child who is believed to be in the United States and who is the subject of—</text> 
<paragraph id="HC55AB1D4EA17478883EAEA005E18AE7F"><enum>(1)</enum><text>an application under the Hague Convention on the Civil Aspects of International Parental Child Abduction, or</text> </paragraph>
<paragraph id="H5046C21289094B0DBAFED67B6056D706"><enum>(2)</enum><text>an Interpol yellow notice.</text> </paragraph></section>
<section id="H3DDDC6CF22A6464EA500B7D0C1C94EFD"><enum>4.</enum><header>State requirements</header><text display-inline="no-display-inline">Section 3702 of the Crime Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/5780">42 U.S.C. 5780</external-xref>) is amended—</text> 
<paragraph id="H12764C60CDAC4707996E357BF74FB1D4"><enum>(1)</enum><text>in paragraph (2) by striking <quote>and</quote> at the end, and</text> </paragraph>
<paragraph id="H0E93945AC1B64B779028AB15B21D05BC"><enum>(2)</enum><text>in paragraph (3)—</text> 
<subparagraph id="H37DC8DF64F064D6384C48831B9D2C6EE"><enum>(A)</enum><text>in subparagraph (B) by striking <quote>and</quote> at the end,</text> </subparagraph>
<subparagraph id="H9211C30D3A9947E4BC7751A67F1A100"><enum>(B)</enum><text>in subparagraph (C) by striking the period at the end and inserting <quote>; and</quote>, and</text> </subparagraph>
<subparagraph id="H1B223B55B0E74FBBBEDF3DC6DCB81F1"><enum>(C)</enum><text>by inserting after subparagraph (C) the following:</text>

<subparagraph id="HF5B3536FB32B4C2CBDB84D5DBFB68CC4"><enum>(D)</enum><text>a statement specifying whether the child is believed to have been taken outside of the United States;</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph></section>
<section id="H719AB77FD3D84309AF0093C92B9581FD"><enum>5.</enum><header>Amendments to International Child Abduction Remedies Act</header> 
<subsection id="H17136D4B26E546C5A57BB107B686BB4B"><enum>(a)</enum><header>Legal assistance, technical assistance, and training</header><text display-inline="yes-display-inline">Section 7 of the International Child Abduction Remedies Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11606">42 U.S.C. 11606</external-xref>) is amended by adding at the end the following new subsections:</text> 
<quoted-block display-inline="no-display-inline" id="HA8F06532034340980000FAB59F33D7B2" style="OLC"> 
<subsection id="HC4D71A01D4534D1BA400A81C59CBC603"><enum>(g)</enum><header>Legal assistance for victims of parental kidnapping grants</header> 
<paragraph id="H7AC92ED5EBC54F64B12D7747A715A13F"><enum>(1)</enum><header>Funding to legal services providers</header><text display-inline="yes-display-inline">The United States Central Authority shall establish a program to provide funding to legal services providers, including private attorneys, public officials acting pursuant to the Uniform Child Custody Jurisdiction and Enforcement Act, legal aid programs, and law school clinical programs, to provide direct legal or advocacy services on behalf of persons seeking remedies under the Convention, or other civil or criminal remedies in interstate or international parental kidnapping cases.</text> </paragraph>
<paragraph id="H17DCBEA333E841B5A0C25C050550EA79"><enum>(2)</enum><header>Training and technical assistance</header><text>The United States Central Authority, directly or through grants, shall provide training and technical assistance to recipients of funds under paragraph (1) to improve their capacity to offer legal assistance described in paragraph (1).</text> </paragraph></subsection>
<subsection id="HF2A92638C9FD4F498C13FE3007724BDC"><enum>(h)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The United States Central Authority shall encourage the Chief Justice of every State and the District of Columbia to designate a single court, or a limited number of courts, in which cases brought under the Convention may be heard. The United States Central Authority may provide technical assistance (including computers and Internet access) as necessary to foster consolidation of jurisdiction and implementation of the Convention, consistent with the purposes of the Convention.</text> </subsection>
<subsection id="H41EC1522036C4692B4A03FE3697289BE"><enum>(i)</enum><header>Training</header><text>The United States Central Authority shall provide or promote training of State court judges, lawyers, and law students on the civil and criminal laws pertaining to interstate and international parental kidnapping. To carry out this subsection, the United States Central Authority may make available funds under subsection (e) to State judicial educators, national, State, and local bar associations, and law schools. The United States Central Authority shall require recipients of such funds to report on the training programs they present, including the number of participants.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="HFE484C1C631A45F1BF5855C33701BF99"><enum>(b)</enum><header>Legal Services Corporation</header><text display-inline="yes-display-inline">The Legal Services Corporation may use funds made available to the Corporation for programs to represent aliens in proceedings brought in the United States under the Convention—</text> 
<paragraph id="H208874688E3240F3A7E0A21D67E28FAE"><enum>(1)</enum><text>if the individuals to whom the representation is provided otherwise meet the criteria of the Corporation for eligible clients under the Legal Services Corporation Act; and</text> </paragraph>
<paragraph id="H53F3A060015441348FB44B7BFDD6FF23"><enum>(2)</enum><text>whether or not such individuals are resident in the United States.</text> </paragraph></subsection>
<subsection id="H5A9ABBD4A8E24CAFAD00B65DAC58C813"><enum>(c)</enum><header>Court costs</header><text display-inline="yes-display-inline">Section 8(b) of the International Child Abduction Remedies Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11607">42 U.S.C. 11607(b)</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H0C65D1707F304B408031504CFD9FAE02" style="OLC"> 
<subsection id="HAC9259CD9C8545C3B1A056673C6BC8A1"><enum>(b)</enum><header>Costs incurred in civil actions</header> 
<paragraph id="H34250A6DDA7D4D52BEEAD8468B240222" indent="down1"><enum>(1)</enum><header>Payment of court costs by central authority</header><text>The Central Authority shall establish a program under which it provides, directly to the court or to petitioners and respondents, the funds necessary to pay the court costs of petitioners and respondents in actions brought under section 4, including court fees and the cost of translation services, expert witness testimony, and transcription services.</text> </paragraph>
<paragraph id="HA7B8E86F1DF94D3597E8C57F06AE5899" indent="down1"><enum>(2)</enum><header>Costs of legal counsel and travel</header><text display-inline="yes-display-inline">Petitioners may be required to bear the costs of legal counsel or advisors and travel costs for the return of the child involved and any accompanying persons, except as provided in paragraphs (3) and (4).</text> </paragraph>
<paragraph id="HC759E69863354FCC988BA31EF3EC4BB0" indent="down1"><enum>(3)</enum><header>Payments from other sources</header><text display-inline="yes-display-inline">Subject to paragraph (4), legal fees incurred in connection with an action brought under section 4 shall be borne by the petitioner unless they are covered by payments from Federal, State, or local legal assistance or other programs.</text> </paragraph>
<paragraph id="H7B3A35231DCB47B89147E595974E3057" indent="down1"><enum>(4)</enum><header>Costs borne by petitioner</header><text>Any court ordering the return of a child pursuant to an action brought under section 4 shall order the respondent to pay necessary expenses incurred by or on behalf of the petitioner (other than court costs for which the Central Authority pays under paragraph (1)), including legal fees, foster home or other care during the course of proceedings in the action, and transportation costs related to the return of the child, unless the respondent establishes that such order would be clearly inappropriate.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="H217C02A9D3544338B46817ED2D007DE8"><enum>(d)</enum><header>Federal Judicial Center</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/28/620">Section 620</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H5D088AF65EB24DCA92039C0038D56432" style="OLC"> 
<subsection id="HC0AED430A8AA488094361BB2DDB81348"><enum>(c)</enum><header>Continuing education and training programs</header><text display-inline="yes-display-inline">The Center shall include in its continuing education and training programs under subsection (b)(3), including the training programs for newly appointed judges, information on the Hague Convention on the Civil Aspects of International Child Abduction, the International Child Abduction Remedies Act, the International Parental Kidnapping Crime Act of 1993, and other Federal statutes pertaining to parental kidnapping within the jurisdiction of the Federal courts, and shall prepare materials necessary to carry out this subsection.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
<section id="H049F8B0F68394C6086D5DC38CB7BC200"><enum>6.</enum><header>Reports relating to international child abduction</header> 
<subsection id="H2A84B8F41A7F4113AE93AB609691C5D"><enum>(a)</enum><header>Report on progress in negotiating bilateral treaties with non-hague convention countries</header><text display-inline="yes-display-inline">The Secretary of State shall prepare and submit to the Congress an annual report on progress made by the United States in negotiating and entering into bilateral treaties (or other international agreements) relating to international child abduction with countries that are not contracting parties to the Hague Convention on the Civil Aspects of International Child Abduction.</text> </subsection>
<subsection id="HE39598E922A54CA5A1004D5CADC1019"><enum>(b)</enum><header>Report on human rights practices</header>
<paragraph commented="no" display-inline="yes-display-inline" id="HE4E37411B7BA44CE93B837CF10497C5B"><enum>(1)</enum><text display-inline="yes-display-inline">Section 116(d) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151n">22 U.S.C. 2151n(d)</external-xref>) is amended—</text> 
<subparagraph id="HDAA2CBADC61B431681A781CFBBA93806" indent="up1"><enum>(A)</enum><text>in paragraph (7), by striking “and” at the end and inserting a semicolon;</text> </subparagraph>
<subparagraph id="HA14E58E04EEA4772A866B84500562061" indent="up1"><enum>(B)</enum><text>in paragraph (8), by striking the period at the end and inserting “; and”; and</text> </subparagraph>
<subparagraph id="H94F2D6E1ABD7491E9823D3A700C2C20" indent="up1"><enum>(C)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HDBE28AADF1414733A8C5C1D6B22837F0" style="OLC"> 
<paragraph id="H5A0590674ED3452BBDBC4E4308ACFE6B"><enum>(9)</enum><text display-inline="yes-display-inline">the status of efforts in each country to prohibit international child abduction, including—</text> 
<subparagraph id="H019EEF6A052343F100A932AA9F00284D"><enum>(A)</enum><text display-inline="yes-display-inline">efforts to expedite the return of children to the country of their habitual residence; and</text> </subparagraph>
<subparagraph id="HE105FF1F3243450A8CAB789F0341CB44"><enum>(B)</enum><text display-inline="yes-display-inline">the extent to which the country respects the rights of custody and of access under the laws of other countries.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph>
<paragraph id="HB52776C0CC58481582859E375F143646" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Section 502B(b) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2304">22 U.S.C. 2304(b)</external-xref>) is amended by inserting after the sixth sentence the following: “Each report under this section shall include information on the status of efforts in each country to prohibit international child abduction, including efforts to expedite the return of children to the country of their habitual residence and the extent to which the country respects the rights of custody and of access under the laws of other countries.”.</text> </paragraph></subsection>
<subsection id="HD4FF6F2065894782BF7CDB043143BF"><enum>(c)</enum><header>Report on enforcement of <external-xref legal-doc="usc" parsable-cite="usc/18/1204">section 1204</external-xref> of title 18, united states code</header><text display-inline="yes-display-inline">The Attorney General, in consultation with the Secretary of State, shall prepare and submit to the Congress an annual report that contains a description of the status of each case involving a request during the preceding year for extradition to the United States of an individual alleged to have violated <external-xref legal-doc="usc" parsable-cite="usc/18/1204">section 1204</external-xref> of title 18, United States Code.</text> </subsection></section>
<section id="H96F9C3AF5114430FB1F5A4967DCA25C"><enum>7.</enum><header>Study on cooperation of airline industry</header> 
<subsection id="H5AFE3CEF3FF040ACBF85BC001E5F6FE3"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary of Transportation shall conduct a study of—</text> 
<paragraph id="H7BE238F6DCBC415EA7E5BC6D41006ED7"><enum>(1)</enum><text>the extent to which the domestic and foreign airline industries cooperate with the investigation of international child abduction cases, including cooperation with the Department of State, the Department of Justice, and the National Center for Missing &amp; Exploited Children; and</text> </paragraph>
<paragraph id="HE9DE43DF1E7F4CCC813FF2D6A06829ED"><enum>(2)</enum><text display-inline="yes-display-inline">any practices and procedures necessary to improve the ability of the domestic and foreign airline industries to cooperate with the investigation of international child abduction cases.</text> </paragraph></subsection>
<subsection id="H35E21BAA2C164182942820C389C0285F"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Transportation shall submit to Congress a report on the results of the study conducted under <internal-xref idref="H5AFE3CEF3FF040ACBF85BC001E5F6FE3" legis-path="7.(a)">subsection (a)</internal-xref>.</text> </subsection></section>
<section id="H77328D6D892E4CBE927BD86B13478D60"><enum>8.</enum><header>Additional funds for the investigation and prosecution of parental kidnapping</header><text display-inline="no-display-inline">In addition to funds otherwise authorized to be appropriated for the activities described in this section, there are authorized to be appropriated to the Child Exploitation and Obscenity Section of the Department of Justice for each of the fiscal years 2009 through 2012 such sums as may be necessary for the investigation and prosecution of violations of <external-xref legal-doc="usc" parsable-cite="usc/18/1204">section 1204</external-xref> of title 18, United States Code.</text> </section>
<section id="H4CDB060F0C184FBB8614EE0BCADE255"><enum>9.</enum><header>Authorization of funds for extradition</header><text display-inline="no-display-inline">There are authorized to be appropriated for each of fiscal years 2009 through 2012 such funds as may be necessary for the costs of extraditing individuals from foreign countries to the United States for violations of laws in the United States by reason of unlawfully removing a child from the child’s custodial parent.</text> </section>
<section id="H66FE5114BBEC4CA8B496D0DA40E0EA66"><enum>10.</enum><header>Grants for travel costs associated with the safe return of abducted children</header> 
<subsection id="HFE8E3C98B4BE4B718E07BBC4B1408200"><enum>(a)</enum><header>Program authorized</header><text display-inline="yes-display-inline">The Director of the Office of Victims of Crime of the Department of Justice shall, subject to the availability of appropriations, establish a Victim Travel in International Reunification Cases program to award grants to the National Center for Missing &amp; Exploited Children to reimburse parents, guardians, law enforcement, and other individuals, as appropriate, for travel costs related to the safe return of children from the United States who have been abducted and taken to foreign countries.</text> </subsection>
<subsection id="H2F532FFB7A46481B8F242932FBD199CA"><enum>(b)</enum><header>Use of grant funds</header><text display-inline="yes-display-inline">Travel costs under <internal-xref idref="HFE8E3C98B4BE4B718E07BBC4B1408200" legis-path="10.(a)">subsection (a)</internal-xref> that are reimbursed using funds under this section may include airfare and daily subsistence costs, including lodging, meals, and ground transportation.</text> </subsection>
<subsection id="HA56CEBDBE0DF442BBBE7FA2C311B3FE"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $250,000 for each of the fiscal years 2009 through 2012.</text> </subsection></section>
