<official-title>To amend the Internal Revenue Code of 1986 to repeal the inclusion in gross income of Social Security benefits and tier 1 railroad retirement benefits.</official-title>

<section section-type="section-one" id="HDED7129095B24666BFE89F958FAA6F99" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Seniors Financial Security Act of 2007</short-title></quote>.</text></section> 
<section id="HD285AC80395A4B6DB20628D76F724CAC"><enum>2.</enum><header>Repeal of inclusion in gross income of Social Security benefits and tier 1 railroad retirement benefits</header> 
<subsection id="H2FB0B13E0762415A81A137C9002382C9"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/86">Section 86</external-xref> of the Internal Revenue Code of 1986 (relating to taxation of social security and tier 1 railroad retirement benefits) is hereby repealed.</text></subsection> 
<subsection id="H6EBBDB8476F5454CA4BBD5CE7DF388E5"><enum>(b)</enum><header>Technical and Conforming Amendments</header> 
<paragraph id="H89682644252145248100E16E2C5E87B"><enum>(1)</enum><text>Subparagraph (B) of section 22(c)(3) of such Code (relating to treatment of certain workmen’s compensation benefits) is amended by striking <quote>any amount treated as a social security benefit under section 86(d)(3)</quote> and inserting <quote>if, by reason of section 224 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (or by reason of section 3(a)(1) of the Railroad Retirement Act of 1974), any benefit otherwise payable under title II of the <act-name parsable-cite="SSA">Social Security Act</act-name> or the Railroad Retirement Act of 1974 is reduced by reason of the receipt of a benefit under a workmen’s compensation act, the portion of such benefit received under the workmen’s compensation act which equals such reduction</quote>.</text></paragraph> 
<paragraph id="H3C97370DE11D47AAA33ED0371DF28FAF"><enum>(2)</enum><text>Paragraph (3) of section 72(r) of such Code (defining tier 1 railroad retirement benefit) is amended by striking “has the meaning given such term by section 86(d)(4)” and inserting “means—</text>

<subparagraph id="HD77FB99C33964AD28DB82C83CE1EE38C"><enum>(A)</enum><text>the amount of the annuity under the Railroad Retirement Act of 1974 equal to the amount of the benefit to which the taxpayer would have been entitled under the <act-name parsable-cite="SSA">Social Security Act</act-name> if all of the service after December 31, 1936, of the employee (on whose employment record the annuity is being paid) had been included in the term <term>employment</term> as defined in the <act-name parsable-cite="SSA">Social Security Act</act-name>, and</text></subparagraph> 
<subparagraph id="H5B3985FACE454D00841162B7C9B76124"><enum>(B)</enum><text>a monthly annuity amount under section 3(f)(3) of the Railroad Retirement Act of 1974.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H3337EC59001C43ADBD19A75BD900A8BD"><enum>(3)</enum><text>Sections 135(c)(4)(B), 137(b)(3)(B), 199(d)(2)(A), 221(b)(2)(C)(ii), and 222(b)(2)(C)(ii) of such Code are each amended by striking <quote>86,</quote>.</text></paragraph> 
<paragraph id="HC979C2A11D2746EC999C06E996F43E27"><enum>(4)</enum><text>Clause (i) of section 219(g)(3)(A) of such Code is amended by striking <quote>sections 86 and 469</quote> and inserting <quote>section 469</quote>.</text></paragraph> 
<paragraph id="H9C2F9AC761CF4E7DB7CD1464F8A724F0"><enum>(5)</enum><text>Subparagraph (F) of section 469(i)(3) of such Code is amended by striking clause (i) and by redesignating clauses (ii), (iii), and (iv) as clauses (i), (ii), and (iii), respectively.</text></paragraph> 
<paragraph id="HB777E6386B7A40A38C57ACD723BB0034"><enum>(6)</enum><text>Paragraph (8) of section 861(a) of such Code (treating social security benefits as United States sourced) is hereby repealed.</text></paragraph> 
<paragraph id="HDFCB318367FA4886B584AF88BB18194"><enum>(7)</enum><text>Paragraph (3) of section 871(a) of such Code (relating to taxation of social security benefits by nonresident aliens) is hereby repealed.</text></paragraph> 
<paragraph id="H34FF3CF9A5314221BBE6FF6C98902F40"><enum>(8)</enum><text>Subsection (g) of section 1441 of such Code (relating to withholding of tax on nonresident aliens) is hereby repealed.</text></paragraph> 
<paragraph id="H83072DCFDD7D459D82F0C4CFCB002485"><enum>(9)</enum><text>Subparagraph (C) of section 3402(p)(1) of such Code is amended by striking clause (i) and by redesignating clauses (ii), (iii), and (iv) as clauses (i), (ii), and (iii), respectively.</text></paragraph> 
<paragraph id="HC50428C162F9432197DA184F0074C800"><enum>(10)</enum><text>Paragraph (4) of section 6015(d) of such Code is amended by striking the last sentence.</text></paragraph> 
<paragraph id="H6DC33C4FDBE94DC0B8B6D5A86E252665"><enum>(11)</enum><text>Section 6050F of such Code (relating to returns relating to social security benefits) is hereby repealed.</text></paragraph> 
<paragraph id="H7E4EFD193C3B4CE8B035C730E24E7734"><enum>(12)</enum><text>Paragraph (1) of section 6050G(a) of such Code (relating to returns relating to certain railroad retirement benefits) is amended by striking <quote>section 86(d)(4)</quote> and inserting <quote>section 72(r)(3)</quote>.</text></paragraph>

<subparagraph display-inline="yes-display-inline" id="HFA2ABBF4F5CE4948AC5138B7A2928595"><enum>(A)</enum><text>Section 6103(h) of such Code (relating to disclosure) is amended by striking paragraph (5) and by redesignating paragraph (6) as paragraph (5).</text></subparagraph> 
<subparagraph indent="up1" id="H92575E7DAD88415EA5FC7F54D26335F4"><enum>(B)</enum><text>Paragraph (4) of section 6103(p) of such Code is amended by striking <quote>(h)(5),</quote> each place it appears.</text></subparagraph> 
<subparagraph indent="up1" id="H3B02888A0A854712B133E972B1BEB213"><enum>(C)</enum><text>Subsection (k) of section 1113 of the <act-name parsable-cite="RFPA78">Right to Financial Privacy Act of 1978</act-name> is hereby repealed.</text></subparagraph></paragraph> 
<paragraph id="H4CDDF79220104C68BF2D00A336590522"><enum>(14)</enum><text>The table of sections for part II of subchapter B of chapter 1 of such Code is amended by striking the item relating to section 86.</text></paragraph> 
<paragraph id="H2928B26804E748FB8639478FD8D14523"><enum>(15)</enum><text>The table of sections for subpart B of part III of subchapter A of chapter 61 of such Code is amended by striking the item relating to section 6050F.</text></paragraph></subsection> 
<subsection id="HEDA9FB87652C43B0B71E7621DA7789C"><enum>(c)</enum><header>Effective Date</header><text>The amendments made by this section shall apply to benefits received after December 31, 2006, in taxable years ending after such date.</text></subsection> 
<subsection id="HE593BE0A020F4C7E9026F0E6EA76E900"><enum>(d)</enum><header>Trust Funds Held Harmless</header><text>There are hereby appropriated (out of any money in the Treasury not otherwise appropriated) for each fiscal year to each fund under the <act-name parsable-cite="SSA">Social Security Act</act-name> or the Railroad Retirement Act of 1974 an amount equal to the reduction in the transfers to such fund for such fiscal year by reason of the amendments made by this section.</text></subsection></section>
