<official-title>To amend the Clean Air Act to provide for a reduction in the number of boutique fuels, and for other purposes.</official-title>

<section id="H64558516CAD44A998552B885F189B1BC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Boutique Fuel Reduction Act of 2007</short-title></quote>.</text></section> 
<section id="H6E9870B09CF349E8A89D1025B5686985"><enum>2.</enum><header>Temporary waivers</header><text display-inline="no-display-inline">Section 211(c)(4)(C)(ii)(II) of the Clean Air Act (42 U.S.C.7545(c)(4)(C)(ii)(II)) is amended by inserting after <quote>equipment failure</quote> the following: <quote>, unexpected problems with distribution or delivery equipment that is necessary for transportation and delivery of fuel or fuel additives</quote>.</text></section> 
<section id="H61F501C096A2466083D8C5C07DC47391"><enum>3.</enum><header>Reduction in number of boutique fuels</header><text display-inline="no-display-inline">Section 211(c)(4)(C) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(c)(4)(C)</external-xref>) is amended as follows:</text> 
<paragraph id="H702A794368264A42B0757E20EDC6B3FD"><enum>(1)</enum><text display-inline="yes-display-inline">By redesignating the clause (v) added by section 1541(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; 119 Stat. 1106) as clause (vi).</text></paragraph> 
<paragraph id="H23676C3B4A4142F4A74586908CF7A5B"><enum>(2)</enum><text>In clause (vi) (as so redesignated)—</text> 
<subparagraph id="H837D5754F1124678806C00A5EDB7F106"><enum>(A)</enum><text>in subclause (I) by striking <quote>approved under this paragraph as of September 1, 2004, in all State implementation plans</quote> and by inserting in lieu there of <quote>set forth on the list published under subclause (II) (or on the revised list referred to in subclause (III) if the list has been revised) </quote>;</text></subparagraph> 
<subparagraph id="H71222171CE144B6BBF04199110EF6C57"><enum>(B)</enum><text>by amending subclause (III) to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="HB6271F208ADB4D088258C000B718D627" style="OLC"> 
<subclause id="H0A7A9A0B9667417BB5C0316FD4EEDBF6" indent="up2"><enum>(III)</enum><text display-inline="yes-display-inline">The Administrator shall, after notice and opportunity for comment, remove a fuel from the list published under subclause (II) if the Administrator determines that such fuel has ceased to be included in any State implementation plan or is identical to a Federal fuel control or prohibition promulgated and implemented by the Administrator. The Administrator shall publish a revised list reflecting the reduction in the number of fuels.</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HE3986D289E6C455AB9367697CE6ABA5"><enum>(C)</enum><text>in subclause (IV) by striking <quote>Subclause (I)</quote> and inserting <quote>Neither subclause (I) nor subclause (V)</quote> and by striking <quote>not</quote> and by striking <quote>if such new fuel</quote>; and </text></subparagraph> 
<subparagraph id="H2366CB42271E4E8F9328BCA38403F3C8"><enum>(D)</enum><text>by amending subclause (IV) to read as follows: </text> 
<quoted-block style="OLC" id="HEFDB8FF7FAEF48F3BC2B51A4D96C837C" display-inline="no-display-inline"> 
<subclause indent="down1" id="HD20DC5ED264F48B3BA9CBC6597C3C67F"> <enum>(IV)</enum> <text display-inline="yes-display-inline">Subclause (I) shall not limit the Administrator's authority to approve a control or prohibition respecting any new fuel under this paragraph in a State implementation plan or revision to a State implementation plan if such new fuel completely replaces a fuel on the list published under subclause (II) (or the revised list referred to in subclause (III) if the list has been revised) and if the Administrator, after consultation with the Secretary of Energy, publishes in the Federal Register after notice and comment a finding that, in the Administrator's judgment, such control or prohibition respecting such new fuel will not cause fuel supply or distribution interruptions or have a significant adverse impact on fuel producibility in the affected area or contiguous areas.</text> </subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> </paragraph></section>
