			 Water</header>
			<section display-inline="no-display-inline" id="HF4A4063A789C416EA87400A97000943D" section-type="subsequent-section"><enum>101.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Produced Water Utilization Act
			 of 2007</short-title></quote>.</text>
			</section><section id="H105753647CF44A0281ADFAB2A949EF7D"><enum>102.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text>
				<paragraph id="HB8DB09BE39864EEB92E84E9F12DF316"><enum>(1)</enum><text>The population of
			 the United States is increasing, and as the population increases, additional
			 potable water supplies are required to sustain individuals, agricultural
			 production, and industrial users, particularly in the Mountain West and desert
			 Southwest, where water resources are scarce.</text>
				</paragraph><paragraph id="H2D6C157BC1AC476B984503F052D134EC"><enum>(2)</enum><text>During the
			 development of domestic energy sources, including coalbed methane, oil, and
			 natural gas, water may be extracted from underground sources and brought to the
			 surface, often increasing energy production from subsurface geological
			 formations in the process.</text>
				</paragraph><paragraph id="HB679DEB91F424154B70600223FD28F87"><enum>(3)</enum><text>Produced water
			 frequently contains increased levels of potentially harmful dissolved solids,
			 rendering much of the water nonpotable and unsuitable for agricultural or
			 industrial uses, and encouraging reinjection of the water to subsurface
			 geological formations to safely dispose of it, which may lead to reduced
			 production of domestic energy resources and increased costs to
			 producers.</text>
				</paragraph><paragraph id="H17BDD01664F84B8384F4097855005713"><enum>(4)</enum><text>Increasing
			 environmentally responsible surface utilization of produced water would—</text>
					<subparagraph id="HBCEC63BABF0F42B4A604AA00C433F43D"><enum>(A)</enum><text>increase water
			 supplies available for agricultural and industrial use;</text>
					</subparagraph><subparagraph id="H9AB1CB2D561543518C4097B9A0125F04"><enum>(B)</enum><text>reduce the amount
			 of produced water returned to underground formations; and</text>
					</subparagraph><subparagraph id="HE041E671B95B4E3891DBB8CA5FF1332"><enum>(C)</enum><text>increase domestic
			 energy production by reducing costs associated with reinjection of produced
			 water to the subsurface.</text>
					</subparagraph></paragraph></section><section id="H081715B8CDA34A00A23920899F66183E"><enum>103.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="HE88D9C2346884791ACE4A26C751BD7E9"><enum>(1)</enum><header>Existing
			 program</header><text>The term <term>existing program</term> means a program at
			 the Department of Energy which is engaged in research, development,
			 demonstration, and commercial application of technologies for unconventional
			 domestic natural gas production and other domestic petroleum production as of
			 the date of enactment of this Act.</text>
				</paragraph><paragraph id="H49F2A4BACF634B079282D14300FA0066"><enum>(2)</enum><header>Produced
			 water</header><text>The term <term>produced water</term> means water from an
			 underground source that is brought to the surface as part of the process of
			 exploration for or development of coalbed methane, oil, natural gas, or any
			 other substance to be used as an energy source.</text>
				</paragraph><paragraph id="H7CDCBB2B00D749A5B6CC1FB27F988EA7"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
				</paragraph></section><section id="HF784170C5EFE462EA042142D629B64B5"><enum>104.</enum><header>Purposes</header>
				<subsection id="HC04F4D7E216341ED81542B53CE578B8E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 carry out under this title, in conjunction with an existing program, a program
			 of research, development, and demonstration of technologies for environmentally
			 sustainable utilization of produced water for use for agriculture, irrigation,
			 municipal, or industrial uses, or other environmentally sustainable purposes.
			 The program shall be designed to maximize the utilization of produced water in
			 the United States by increasing the quality of produced water and reducing the
			 environmental impacts of produced water.</text>
				</subsection><subsection id="H61515547202D4BF3ACFF79A140E66848"><enum>(b)</enum><header>Program
			 elements</header><text>The program under this title shall address the following
			 areas, including improving safety and minimizing environmental impacts of
			 activities within each area:</text>
					<paragraph id="H5EE166FB406144FA006860E7E1A2F28F"><enum>(1)</enum><text>Produced water
			 recovery, including research for desalination and demineralization to reduce
			 total dissolved solids in the produced water.</text>
					</paragraph><paragraph id="HBB33DA0BAE7B4E61A96B5E532279556C"><enum>(2)</enum><text>Produced water
			 utilization for agricultural, irrigation, municipal, or industrial uses, or
			 other environmentally sustainable purposes.</text>
					</paragraph><paragraph id="H2199A43A9882484AB5DB6E3400A95738"><enum>(3)</enum><text>Reinjection of
			 produced water into subsurface geological formations to increase energy
			 production.</text>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="H8C290DFF663940C29F85658C93C84716"><enum>(c)</enum><header>Program
			 administration</header><text>The program under this title shall be administered
			 by a consortium, administering an existing program, whose members have
			 collectively demonstrated capabilities and experience in planning and managing
			 research, development, demonstration, and commercial application programs for
			 unconventional natural gas and other petroleum production and produced water
			 utilization.</text>
				</subsection><subsection id="HAF48BCB23B7443009C87F2605FB4202"><enum>(d)</enum><header>Activities at the
			 national energy technology laboratory</header><text display-inline="yes-display-inline">The Secretary, through the National Energy
			 Technology Laboratory, shall carry out a program of research, development, and
			 demonstration activities complementary to and supportive of the research,
			 development, and demonstration programs under subsection (b).</text>
				</subsection><subsection id="HC901EE9E57B54859B9ED615867067B17"><enum>(e)</enum><header>Consultation</header><text>In
			 carrying out this title, the Secretary shall consult regularly with the
			 Secretary of the Interior and the Administrator of the Environmental Protection
			 Agency.</text>
				</subsection></section><section id="H59B94867621644E7A4105DCC3DCC3C7C"><enum>105.</enum><header>Sunset</header><text display-inline="no-display-inline">The authority provided by this title shall
			 terminate on September 30, 2016.</text>
			</section><section id="HB55F009C821340ED81FF55D99400E6B1"><enum>106.</enum><header>Funding</header>
				<subsection id="HBD32F438E74C4982864FD800E4E05282"><enum>(a)</enum><header>Allocation</header><text>Amounts
			 appropriated for this title for each fiscal year shall be allocated as
			 follows:</text>
					<paragraph id="H2FAACA759E18453084645C35A3BDFEC"><enum>(1)</enum><text>75
			 percent shall be for activities under section 104(a), (b), and (c).</text>
					</paragraph><paragraph id="HE7CF87A5594547F49D65C0B884F85451"><enum>(2)</enum><text>25 percent shall
			 be for activities under section 104(d) and other activities under section 104,
			 including administrative functions such as program direction, overall program
			 oversight, and contract management.</text>
					</paragraph></subsection><subsection id="HB3E5BEEF2F074200A454BA354142E22"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to carry
			 out this title $20,000,000 for each of fiscal years 2008 through 2016.</text>
				</subsection></section></title><title id="H2030153CEE0942B8A070049F312324B3"><enum>II</enum><header>Biomass</header>
			<section display-inline="no-display-inline" id="H033647A5560D48C5A723B979F37E10B8" section-type="subsequent-section"><enum>201.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Biomass Research, Development,
			 and Demonstration Act of 2007</short-title></quote>.</text>
			</section><section id="H259739BE6B744477884EA517A4B92303"><enum>202.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this title—</text>
				<paragraph id="HD4E12C7974F74F32005800D6D77E5EE4"><enum>(1)</enum><text>the term
			 <term>institution of higher education</term> has the meaning given that term in
			 section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>);
			 and</text>
				</paragraph><paragraph id="H204ADA98C82548E9B43128765CAF462B"><enum>(2)</enum><text>the term
			 <term>Secretary</term> means the Secretary of Energy.</text>
				</paragraph></section><section id="H549B114420204CB790D190D84500D69"><enum>203.</enum><header>Advanced biofuel
			 technologies</header>
				<subsection id="H044F920AF5FA4C65BD1695E6C0FD7783"><enum>(a)</enum><header>Amendments</header><text>Section
			 932 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16232">42 U.S.C. 16232</external-xref>) is amended—</text>
					<paragraph id="H349A7F026AB24F6AB659C59D930000DD"><enum>(1)</enum><text>in subsection
			 (b)(2), by inserting <quote>, including motor and other fuels from
			 biomass</quote> after <quote>biofuels</quote>; and</text>
					</paragraph><paragraph id="H6A582D81355748C6AA43B495EDD3BC87"><enum>(2)</enum><text>in subsection
			 (c)—</text>
						<subparagraph id="H69D97F5FCCBD49FFB2F54C5800B0A300"><enum>(A)</enum><text>by redesignating
			 paragraphs (2) through (4) as paragraphs (3) through (5), respectively;</text>
						</subparagraph><subparagraph display-inline="no-display-inline" id="H12DB9F443FFB4FF1A136FF1B00BFA688"><enum>(B)</enum><text>by adding the
			 following new paragraph after paragraph (1):</text>
							<quoted-block display-inline="no-display-inline" id="H49DB57B33F7D4519A6F39C1B9DD9C252" style="OLC">
								<paragraph id="H3594CA0CC86142A8ABCD8DEC3E83108"><enum>(2)</enum><text>technologies that
				would make biofuels produced from cellulosic feedstocks cost competitive with
				biofuels produced from corn by
				2012;</text>
								</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="HB78CECCFBF094F69B9F1C9CFF4DC1C5"><enum>(C)</enum><text>in paragraph (3),
			 as so redesignated by subparagraph (A) of this paragraph, by inserting <quote>,
			 including through conducting research and development on the production of
			 hydrocarbons and bioproducts other than ethanol from biomass</quote> after
			 <quote>systems</quote>; and</text>
						</subparagraph><subparagraph id="H92FBA280E49A4A6A8F7076E9DD2981AF"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (4), as so redesignated by
			 subparagraph (A) of this paragraph, by inserting <quote>, including through
			 conducting research and development on how to apply advanced genetic
			 engineering and advanced bioengineering techniques to increase the efficiency
			 and lower the cost of industrial-scale production of liquid fuels from
			 cellulosic feedstocks</quote> after <quote>facilities</quote>.</text>
						</subparagraph></paragraph></subsection><subsection id="H5564AB0B9ABF46388E64BC7EEFFBFB70"><enum>(b)</enum><header>Institution of
			 Higher Education Grants</header><text display-inline="yes-display-inline">The
			 Secretary shall designate not less than 10 percent of the funds appropriated
			 for carrying out section 932(d) of the Energy Policy Act of 2005 (42 U.S.C.
			 16232(d)) for grants to competitively selected institutions of higher education
			 around the country focused on meeting the objectives stated in such section
			 932(d).</text>
				</subsection><subsection id="HCE7470593CB04507A8F68BF97973A8B3"><enum>(c)</enum><header>Authorization of
			 Appropriations</header><text>Section 931(c) of the Energy Policy Act of 2005
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/16231">42 U.S.C. 16231(c)</external-xref>) is amended—</text>
					<paragraph id="H5916A81C8DA24DC293EF4BCC214DBEC"><enum>(1)</enum><text>in
			 subsection (c)(1), by striking <quote>$100,000,000</quote> and inserting
			 <quote>$150,000,000</quote>;</text>
					</paragraph><paragraph id="H81DB4B0F76D44F8097CD979AE9DEE6D"><enum>(2)</enum><text>in
			 subsection (c)(2), by striking <quote>$125,000,000</quote> and inserting
			 <quote>$160,000,000</quote>; and</text>
					</paragraph><paragraph id="H5514E55A856048BFB5F0C5978B2E00"><enum>(3)</enum><text>in
			 subsection (c)(3), by striking <quote>$150,000,000</quote> and inserting
			 <quote>$175,000,000</quote>.</text>
					</paragraph></subsection></section><section id="H9BD602CC187540F99710131414FD42A6"><enum>204.</enum><header>Bioenergy</header>
				<subsection id="HFBB4FA4265314239A61B25EEBF107DE"><enum>(a)</enum><header>Bioenergy
			 Program</header><text>Section 932(d)(1)(B) of the Energy Policy Act of 2005 (42
			 U.S.C. 16232(d)(1)(B)) is amended—</text>
					<paragraph id="H6C1CFE58474B4E788700EC2FB5604637"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of clause (iii); and</text>
					</paragraph><paragraph id="H535EA354625045A3AD02C9DF6200EBE4"><enum>(2)</enum><text>by adding after
			 clause (iv) the following new clause:</text>
						<quoted-block id="H08AEB06D2ABE40A58B24111C621CB9F3" style="OLC">
							<clause id="H8EB82A4E874B4423AE00093DD62CEE5"><enum>(v)</enum><text>biodegradable
				natural plastics in or from biomass;

			 Appropriations</header><text>Section 931 of the Energy Policy Act of 2005 (42
			 U.S.C. 16231) is amended—</text>

			 (c)(1), by inserting before the semicolon the following: <quote>, including
			 $25,000,000 for activities under section 932(d)(1)(B)(v)</quote>;</text>

			 as the <quote><short-title>Plug-In Hybrid Electric Vehicle
			 Act of 2007</short-title></quote>.</text>
			</section><section id="H95C903D2978746479B6274B5DABFFEFB"><enum>302.</enum><header>Near-term
			 vehicle technology program</header>
				<subsection id="H5975813F840542D2941693023C6CBA02"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="H4451ED67DB52440FA1286C574F6800E"><enum>(1)</enum><header>Battery</header><text>The
			 term <term>battery</term> means a device or system for the electrochemical
			 storage of energy.</text>
					</paragraph><paragraph id="HA1B0C8AB91DB49D7A0F5009C5DB5CA26"><enum>(2)</enum><header>Biomass</header><text>The
			 term <term>biomass</term> has meaning given the term in section 932 of the
			 Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16232">42 U.S.C. 16232</external-xref>).</text>
					</paragraph><paragraph id="HCECE964E9FDF4BBCAA6139C1F8A100FF"><enum>(3)</enum><header>E<enum-in-header>85</enum-in-header></header><text>The
			 term <term>E85</term> means a fuel blend containing 85 percent ethanol and 15

					</paragraph><paragraph id="H40C21FE93BB046B786FEC27E1CFFD518"><enum>(4)</enum><header>Electric drive
			 transportation technology</header><text>The term <term>electric drive
			 transportation technology</term> means—</text>
						<subparagraph id="H6D54CBC748F640960084C2E5C3529392"><enum>(A)</enum><text>vehicles that use
			 an electric motor for all or part of their motive power and that may or may not
			 use offboard electricity, including battery electric vehicles, fuel cell
			 vehicles, hybrid electric vehicles, plug-in hybrid electric vehicles, flexible
			 fuel plug-in hybrid electric vehicles, and electric rail; and</text>
						</subparagraph><subparagraph id="HB119007752F648CDB2005488D737DB9B"><enum>(B)</enum><text display-inline="yes-display-inline">related equipment, including electric
			 equipment necessary to recharge a plug-in hybrid electric vehicle.</text>
						</subparagraph></paragraph><paragraph id="HF18FE5CC740048ED9E8E777300B0326E"><enum>(5)</enum><header>Flexible fuel
			 plug-in hybrid electric vehicle</header><text>The term <term>flexible fuel
			 plug-in hybrid electric vehicle</term> means a plug-in hybrid electric
			 vehicle—</text>
						<subparagraph id="HDEB1F1B5FAF0402383DD686116F17352"><enum>(A)</enum><text>warranted by its
			 manufacturer as capable of operating on any combination of gasoline or E85 for
			 its onboard internal combustion or heat engine; or</text>
						</subparagraph><subparagraph id="HF0145CCF9CFE4CB894D2081C7406AADE"><enum>(B)</enum><text>that uses a fuel
			 cell for battery charging when disconnected from offboard power sources.</text>
						</subparagraph></paragraph><paragraph id="H13E247796C2345C4B2A34328E4A8882B"><enum>(6)</enum><header>Fuel cell
			 vehicle</header><text>The term <term>fuel cell vehicle</term> means an onroad
			 vehicle that uses a fuel cell (as defined in section 803 of the Energy Policy
			 Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16152">42 U.S.C. 16152</external-xref>)).</text>
					</paragraph><paragraph id="HF328704E2AA34D0393AAFA4C0468DB00"><enum>(7)</enum><header>Hybrid electric
			 vehicle</header><text>The term <term>hybrid electric vehicle</term> means an
			 onroad vehicle that—</text>
						<subparagraph id="HB6E35E9A8A734318B3006CB9B8156E72"><enum>(A)</enum><text>can operate on
			 either liquid combustible fuel or electric power provided by an onboard
			 battery; and</text>
						</subparagraph><subparagraph id="H3A1BB7E7BDF74A92AD4FD50740C151D8"><enum>(B)</enum><text>utilizes
			 regenerative power capture technology to recover energy expended in braking the
			 vehicle for use in recharging the battery.</text>
						</subparagraph></paragraph><paragraph id="H945208ACDC2E4883BE50391224FABEAA"><enum>(8)</enum><header>Plug-in hybrid
			 electric vehicle</header><text>The term <term>plug-in hybrid electric
			 vehicle</term> means a hybrid electric vehicle that can operate solely on
			 electric power for a minimum of 20 miles under city driving conditions, and
			 that is capable of recharging its battery from an offboard electricity
			 source.</text>
					</paragraph><paragraph id="H3EC86DC5E9D94A8CA6A42C12ECFD299"><enum>(9)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
					</paragraph></subsection><subsection id="H546D4526E3F740E294ECAF29E2877B8F"><enum>(b)</enum><header>Program</header><text>The
			 Secretary shall conduct a program of research, development, demonstration, and
			 commercial application on technologies needed for the development of plug-in
			 hybrid electric vehicles, including—</text>
					<paragraph id="H26F47A8E53684FF78200CA4E771027C1"><enum>(1)</enum><text display-inline="yes-display-inline">high capacity, high efficiency batteries,
			 to—</text>
						<subparagraph id="HDEF476E61EF14B448C16F273AB48B22D"><enum>(A)</enum><text>improve battery
			 life, energy storage capacity, and power delivery capacity, and lower cost;
			 and</text>
						</subparagraph><subparagraph id="HA75FAE6CE6E44B99818E2B94CBCB69AC"><enum>(B)</enum><text>minimize waste and
			 hazardous material production in the entire value chain, including after the
			 end of the useful life of the batteries;</text>
						</subparagraph></paragraph><paragraph id="HF00759D4F9014F87AA4C65BCC32B2E72"><enum>(2)</enum><text>high efficiency
			 onboard and offboard charging components;</text>
					</paragraph><paragraph id="HABDE89723C86407B8FCABAC81F84F870"><enum>(3)</enum><text>high power drive
			 train systems for passenger and commercial vehicles and for supporting
			 equipment;</text>
					</paragraph><paragraph id="H731B37C1A72F44D39284F00BBCE9E00"><enum>(4)</enum><text>onboard energy
			 management systems, power trains, and systems integration for plug-in hybrid
			 electric vehicles, flexible fuel plug-in hybrid electric vehicles, and hybrid
			 electric vehicles, including efficient cooling systems and systems that
			 minimize the emissions profile of such vehicles; and</text>
					</paragraph><paragraph id="H3128217B918D4AFFAA24235BCC823358"><enum>(5)</enum><text>lightweight
			 materials, including research, development, demonstration, and commercial
			 application to reduce the cost of materials such as steel alloys and carbon
			 fibers.</text>
					</paragraph></subsection><subsection id="H37E8A51ACC3D457C8005694D44B66344"><enum>(c)</enum><header>Plug-In hybrid
			 electric vehicle demonstration program</header>
					<paragraph id="H2C53084CD83B4BFEBA08C83D6E0087BF"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a competitive
			 grant pilot demonstration program to provide not more than 25 grants annually
			 to State governments, local governments, metropolitan transportation
			 authorities, or combinations thereof to carry out a project or projects for
			 demonstration of plug-in hybrid electric vehicles.</text>
					</paragraph><paragraph id="HE942AAC9665D4151A079F7AB03D84DB7"><enum>(2)</enum><header>Applications</header>
						<subparagraph id="H8EFB6EE4CAF841D78203E74EF24DB967"><enum>(A)</enum><header>Requirements</header><text>The
			 Secretary shall issue requirements for applying for grants under the
			 demonstration pilot program. The Secretary shall require that applications, at
			 a minimum, include a description of how data will be—</text>
							<clause id="HA90946A329794B929709DC61AD69BA90"><enum>(i)</enum><text>collected on
			 the—</text>
								<subclause id="H5BA3CBFBECC24A9C0009D8C5A46E8E56"><enum>(I)</enum><text>performance of the
			 vehicle or vehicles and the components, including the battery, energy
			 management, and charging systems, under various driving speeds, trip ranges,
			 traffic, and other driving conditions;</text>
								</subclause><subclause id="H89AA5CFDE79D447692A51C3D6F292C89"><enum>(II)</enum><text>costs of the
			 vehicle or vehicles, including acquisition, operating, and maintenance costs,
			 and how the project or projects will be self-sustaining after Federal
			 assistance is completed; and</text>
								</subclause><subclause id="H5CD84711CD4E4B76B0A600AA543F5E07"><enum>(III)</enum><text>emissions of the
			 vehicle or vehicles, including greenhouse gases, and the amount of petroleum
			 displaced as a result of the project or projects; and</text>
								</subclause></clause><clause id="H9841AC420B334EA8A9443D4D40AE94C5"><enum>(ii)</enum><text>summarized for
			 dissemination to the Department, other grantees, and the public.</text>
							</clause></subparagraph><subparagraph id="H18AE50E82CCD4B8B9BCD5F0079D776D2"><enum>(B)</enum><header>Partners</header><text>An
			 applicant under subparagraph (A) may carry out a project or projects under the
			 pilot program in partnership with one or more private entities.</text>
						</subparagraph></paragraph><paragraph id="H7CA0EB2EF0D74ADF884EB03B98671D04"><enum>(3)</enum><header>Selection
			 criteria</header>
						<subparagraph id="H2BBD21D82A4847D08B6DAC12A3F9D897"><enum>(A)</enum><header>Preference</header><text>When
			 making awards under this subsection, the Secretary shall consider each
			 applicant’s previous experience involving plug-in hybrid electric vehicles and
			 shall give preference to proposals that—</text>
							<clause id="H98C8788105B544AFB34493C2D2D2D538"><enum>(i)</enum><text display-inline="yes-display-inline">provide the greatest demonstration per
			 award dollar, with preference increasing as the number of miles that a plug-in
			 hybrid electric vehicle can operate solely on electric power under city driving
			 conditions increases; and</text>
							</clause><clause id="H08024CF22043480B882D93B6D2B5F55B"><enum>(ii)</enum><text>demonstrate the
			 greatest commitment on the part of the applicant to ensure funding for the
			 proposed project or projects and the greatest likelihood that each project
			 proposed in the application will be maintained or expanded after Federal
			 assistance under this subsection is completed.</text>
							</clause></subparagraph><subparagraph id="HACDB8721C4F14FDA9D8C78A3DE68E223"><enum>(B)</enum><header>Breadth of
			 demonstrations</header><text>In awarding grants under this subsection, the
			 Secretary shall ensure the program will demonstrate plug-in hybrid electric
			 vehicles under various circumstances, including—</text>
							<clause id="H14B3BB14EACB4BF386A25515FA543633"><enum>(i)</enum><text>driving
			 speeds;</text>
							</clause><clause id="H152DAA5308DE48DB86676727DB494D2F"><enum>(ii)</enum><text>trip
			 ranges;</text>
							</clause><clause id="HC97E987A8D0B41A3A9147E92D7E27779"><enum>(iii)</enum><text>driving
			 conditions;</text>
							</clause><clause id="H4B2D4DFDC5F242F6B7A35414ED344400"><enum>(iv)</enum><text>climate
			 conditions; and</text>
							</clause><clause id="H32DBD854325C4CBE8DF169AEED01E534"><enum>(v)</enum><text>topography,</text>
							</clause><continuation-text continuation-text-level="subparagraph">to
			 optimize understanding and function of plug-in hybrid electric vehicles.</continuation-text></subparagraph></paragraph><paragraph id="HF29ADAF968FB44B2958CD000B091D91D"><enum>(4)</enum><header>Pilot project
			 requirements</header>
						<subparagraph id="H6C789D61006E47B19BFAA20063AF2BA4"><enum>(A)</enum><header>Subsequent
			 funding</header><text display-inline="yes-display-inline">An applicant that has
			 received a grant in one year may apply for additional funds in subsequent
			 years, but the Secretary shall not provide more than $10,000,000 in Federal
			 assistance under the pilot program to any applicant for the period encompassing
			 fiscal years 2008 through fiscal year 2012.</text>
						</subparagraph><subparagraph id="H827810AEBD1844B7ADA8A2E4E5ABFBF1"><enum>(B)</enum><header>Information</header><text>The
			 Secretary shall establish mechanisms to ensure that the information and
			 knowledge gained by participants in the pilot program are shared among the
			 pilot program participants and are available to other interested parties,
			 including other applicants.</text>
						</subparagraph></paragraph><paragraph id="H167FAC762C6141D8B240607C081D25F1"><enum>(5)</enum><header>Award
			 amounts</header><text display-inline="yes-display-inline">The Secretary shall
			 determine grant amounts, but the maximum size of grants shall decline as the
			 cost of producing plug-in hybrid electric vehicles declines or the cost of
			 converting a hybrid electric vehicle to a plug-in hybrid electric vehicle
			 declines.</text>
					</paragraph></subsection><subsection id="HCD67A3D9144D49E190CD1937A1A76000"><enum>(d)</enum><header>Cost
			 sharing</header><text display-inline="yes-display-inline">The Secretary shall
			 carry out the program under this section in compliance with section 988(a)
			 through (d) and section 989 of the Energy Policy Act of 2005 (42 U.S.C.
			 16352(a) through (d) and 16353).</text>
				</subsection><subsection id="HB78DB9AF0B4D49E1A1259F2600A3E76"><enum>(e)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated to the
			 Secretary—</text>
					<paragraph commented="no" id="H44C96A687C524253BAC226AD90D332B4"><enum>(1)</enum><text display-inline="yes-display-inline">for carrying out subsection (b),
			 $250,000,000 for each of fiscal years 2008 through 2012, of which up to
			 $50,000,000 may be used for the program described in paragraph (5) of that
			 subsection; and</text>
					</paragraph><paragraph id="H9FE7D86AF027475BBFE6AE0817F00B"><enum>(2)</enum><text display-inline="yes-display-inline">for carrying out subsection (c),
			 $50,000,000 for each of fiscal years 2008 through 2012.</text>
					</paragraph></subsection></section></title><title id="H845F6974B5894BFDB938D9FCA6D20557"><enum>IV</enum><header>Energy
			 Storage</header>
			<section display-inline="no-display-inline" id="HE06D229E11A34C3691CA4F280900D337" section-type="subsequent-section"><enum>401.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Energy Storage Solutions for
			 America Act of 2007</short-title></quote>.</text>
			</section><section id="H66FC13BDAE67498B00E6A86E7F579D80"><enum>402.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds that—</text>
				<paragraph id="H03AA50F166194EBB8C6570BD89E414B"><enum>(1)</enum><text>as
			 demand rises by an estimated 40 percent in the electricity sector by 2030, we
			 will need solutions that are clean, reliable, and affordable; and</text>
				</paragraph><paragraph id="H26034735FFAA4A9FB7E3CA3B63DDC59D"><enum>(2)</enum><text>improved energy
			 storage capability will allow for more wind and solar energy because it
			 addresses the problem of intermittency inherent in these renewable sources of
			 energy.</text>
				</paragraph></section><section id="H69C95A3077AD47CCA239D4C32389EB75"><enum>403.</enum><header>Energy storage
			 systems for electricity transmission and distribution</header>
				<subsection id="H876FCAD79AA849AD86ADE1BF9FE608E"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="HBBD010E754194CCF94F9566F9B8DFE54"><enum>(1)</enum><header>Council</header><text>The
			 term <term>Council</term> means the Energy Storage Advisory Council established
			 under subsection (c).</text>
					</paragraph><paragraph id="H22CA39D068234BD6BB16C000C471F976"><enum>(2)</enum><header>Department</header><text>The
			 term <term>Department</term> means the Department of Energy.</text>
					</paragraph><paragraph id="HE8877B4D560748C999B9C946E2118FF2"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
					</paragraph></subsection><subsection id="H3B1065C3CF0B4AFB9856E21D5C02C8D"><enum>(b)</enum><header>Program</header><text>The
			 Secretary shall carry out a research, development, and demonstration program to
			 support the ability of the United States to remain globally competitive in
			 energy storage systems for electricity transmission and distribution.</text>
				</subsection><subsection id="HB4F5932C436D4203B0794D9BEBF334E1"><enum>(c)</enum><header>Energy Storage
			 Advisory Council</header>
					<paragraph id="HC72A1750264643FA8E62965FC72C9BA7"><enum>(1)</enum><header>Establishment</header><text>Not
			 later than 90 days after the date of enactment of this Act, the Secretary shall
			 establish an Energy Storage Advisory Council.</text>
					</paragraph><paragraph id="H5E1E6406C8B54A44ADA93CBCE3E7134D"><enum>(2)</enum><header>Composition</header>
						<subparagraph id="H5608F40D07E34ED2AD17852FF7CDE4EA"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), the Council shall consist of
			 not less than 15 individuals appointed by the Secretary, based on
			 recommendations of the National Academy of Sciences.</text>
						</subparagraph><subparagraph id="HC845DF8359B349EB94713E751552D651"><enum>(B)</enum><header>Energy storage
			 industry</header><text>The Council shall consist primarily of representatives
			 of the energy storage industry of the United States.</text>
						</subparagraph><subparagraph id="HC688D51701174038BB95F91008BA3DE"><enum>(C)</enum><header>Chairperson</header><text>The
			 Secretary shall select a Chairperson for the Council from among the members
			 appointed under subparagraph (A).</text>
						</subparagraph></paragraph><paragraph id="H0152B72077C940F1A9E6DC774EC9423"><enum>(3)</enum><header>Meetings</header>
						<subparagraph id="HA2EF9A9F114646D0BBA6A7443D5BA711"><enum>(A)</enum><header>In
			 general</header><text>The Council shall meet not less than once a year.</text>
						</subparagraph><subparagraph id="H51B3BB364ED0461A92D1E64BE3AFF427"><enum>(B)</enum><header>Federal Advisory
			 Committee Act</header><text>The Federal Advisory Committee Act (5 U.S.C. App.
			 2) shall apply to a meeting of the Council.</text>
						</subparagraph></paragraph><paragraph id="HF45D38072300497BBB38DB08BDA30979"><enum>(4)</enum><header>Plans</header><text>Not
			 later than 1 year after the date of enactment of this Act, in conjunction with
			 the Secretary, the Council shall develop 5-year plans for integrating basic and
			 applied research so that the United States retains a globally competitive
			 domestic energy storage industry for electricity transmission and
			 distribution.</text>
					</paragraph><paragraph id="H013EE3160D294230BC83B11715576E26"><enum>(5)</enum><header>Review</header><text>The
			 Council shall—</text>
						<subparagraph id="H64D1E09E58F44CB7AF4FD3882257BA0"><enum>(A)</enum><text>assess the
			 performance of the Department in meeting the goals of the plans developed under
			 paragraph (4); and</text>
						</subparagraph><subparagraph id="H3517CAC410524D1082BB112D4D96359D"><enum>(B)</enum><text>make specific
			 recommendations to the Secretary on programs or activities that should be
			 established or terminated to meet those goals.</text>
						</subparagraph></paragraph></subsection><subsection id="H84B0E202B3CE4328821B6D6E11663DB"><enum>(d)</enum><header>Basic research
			 program</header><text>The Secretary shall conduct a basic research program on
			 energy storage systems to support electricity transmission and distribution,
			 including—</text>
					<paragraph id="H6EFE5A4F8D6A450EA0F973DE52F6534"><enum>(1)</enum><text>materials
			 design;</text>
					</paragraph><paragraph id="H468ABFC4116F4FAAB9DA1386F21911E3"><enum>(2)</enum><text>materials
			 synthesis and characterization;</text>
					</paragraph><paragraph id="H929A81D0899440EFA76789397979D0A7"><enum>(3)</enum><text>electrolytes,
			 including bioelectrolytes;</text>
					</paragraph><paragraph id="H4233E1A8B1C04E3C889E7D00B5AD6334"><enum>(4)</enum><text>surface and
			 interface dynamics; and</text>
					</paragraph><paragraph id="HBB2E23D22A144569AD29E700646F2C23"><enum>(5)</enum><text>modeling and
			 simulation.</text>
					</paragraph></subsection><subsection id="HA2574451FB0B4D1EACC5E6F005658D1"><enum>(e)</enum><header>Applied research
			 program</header><text>The Secretary shall conduct an applied research program
			 on energy storage systems to support electricity transmission and distribution
			 technologies.</text>
				</subsection><subsection id="H0A2054EB1AEB480ABE3183EC26C9A5B0"><enum>(f)</enum><header>Review by
			 National Academy of Sciences</header><text>Not later than 5 years after the
			 date of enactment of this Act, the Secretary shall offer to enter into an
			 arrangement with the National Academy of Sciences to assess the performance of
			 the Department in making the United States globally competitive in energy
			 storage systems for electricity transmission and distribution.</text>
				</subsection><subsection id="H4229C29B394E4A5CA014DF3658D5F670"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Secretary to carry out—</text>
					<paragraph id="H5D37F30082354411B72D42FE82D8563D"><enum>(1)</enum><text>the basic research
			 program under subsection (d) $50,000,000 for each of fiscal years 2008 through
			 2012; and</text>
					</paragraph><paragraph id="H643933AF4F8044AFB5CFAE3563E3F46"><enum>(2)</enum><text>the applied
			 research program under subsection (e) $80,000,000 for each of fiscal years 2008
			 through 2012.</text>
					</paragraph></subsection></section></title><title id="HC9F11DC9244B44E300001000D184FC98"><enum>V</enum><header>Energy Efficient
			 Buildings</header>
			<section display-inline="no-display-inline" id="H2FAED754E164498E8BD2BB3A456E531" section-type="subsequent-section"><enum>501.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Energy Efficient Buildings Act
			 of 2007</short-title></quote>.</text>
			</section><section id="H391B87CC836F4AEE9EAE969EDDC8159E"><enum>502.</enum><header>Energy
			 efficient building grant program</header>
				<subsection id="H0BD63944F6884CB59BF04C48BCFB2289"><enum>(a)</enum><header>Energy Efficient
			 Building Pilot Grant Program</header>
					<paragraph id="H749F314246A24E09AFF09FFEBE821FBF"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 6
			 months after the date of enactment of this Act, the Secretary of Energy (in
			 this title referred to as the <quote>Secretary</quote>) shall establish a pilot
			 program to award grants to businesses and organizations for new construction of
			 energy efficient buildings, or major renovations of buildings that will result
			 in energy efficient buildings, to demonstrate innovative energy efficiency
			 technologies, especially those sponsored by the Department of Energy.</text>
					</paragraph><paragraph id="HCDAAF2F60601475BBB2CC6027D731144"><enum>(2)</enum><header>Awards</header><text>The
			 Secretary shall award grants under this subsection competitively to those
			 applicants whose proposals—</text>
						<subparagraph id="HFF5F52A47FDC42BD85BA812881BE889F"><enum>(A)</enum><text>best
			 demonstrate—</text>
							<clause id="HF86A969BF422404681C8C977C39C73D"><enum>(i)</enum><text>likelihood to meet
			 or exceed the standards referred to in subsection (b)(2);</text>
							</clause><clause id="HDAE9EFAF105148D3B475401F92BCB0B8"><enum>(ii)</enum><text>likelihood to
			 maximize cost-effective energy efficiency opportunities; and</text>
							</clause><clause id="H1A1F7CEF1F794FAD87D751FA02D6003C"><enum>(iii)</enum><text>advanced energy
			 efficiency technologies; and</text>
							</clause></subparagraph><subparagraph id="H125D32AB2D304DD8A9A6E81E93DC00C5"><enum>(B)</enum><text>maximize the
			 leverage of private investment for costs related to increasing the energy
			 efficiency of the building.</text>
						</subparagraph></paragraph><paragraph id="HF45FD92FB13F419FB5380070E73EFC00"><enum>(3)</enum><header>Consideration</header><text>The
			 Secretary shall give due consideration to proposals for buildings that are
			 likely to serve low and moderate income populations.</text>
					</paragraph><paragraph id="H3BAB4F03F8884A3E9257EB3C39D8978F"><enum>(4)</enum><header>Amount of
			 grants</header><text>Grants under this subsection shall be for up to 50 percent
			 of design and energy modeling costs, not to exceed $50,000 per building. No
			 single grantee may be eligible for more than 3 grants per year under this
			 program.</text>
					</paragraph><paragraph id="H993AE770DAC747BEBE53E194EDB5004"><enum>(5)</enum><header>Grant
			 payments</header>
						<subparagraph id="H841A53D814B245D6B844923BEB6588A9"><enum>(A)</enum><header>Initial
			 payment</header><text>The Secretary shall pay 50 percent of the total amount of
			 the grant to grant recipients upon selection.</text>
						</subparagraph><subparagraph id="HB801FDF44CB64DCF84C11DFC42B52000"><enum>(B)</enum><header>Remainder of
			 payment</header><text>The Secretary shall pay the remaining 50 percent of the
			 grant only after independent certification, by a professional engineer or other
			 qualified professional, that operational buildings are energy efficient
			 buildings as defined in subsection (b).</text>
						</subparagraph><subparagraph id="H0D00C9B27C734051B1941387680000AA"><enum>(C)</enum><header>Failure to
			 comply</header><text>The Secretary shall not provide the remainder of the
			 payment unless the building is certified within 6 months after operation of the
			 completed building to meet the requirements described in subparagraph (B), or
			 in the case of major renovations the building is certified within 6 months of
			 the completion of the renovations.</text>
						</subparagraph></paragraph><paragraph id="HA9D9BB06A6C1493B8E4B872C418DC5BB"><enum>(6)</enum><header>Report to
			 congress</header><text>Not later than 3 years after awarding the first grant
			 under this subsection, the Secretary shall transmit to Congress a report
			 containing—</text>
						<subparagraph id="H0B1D0E9FFA514A6A8BAF6704C87C94B4"><enum>(A)</enum><text>the total number
			 and dollar amount of grants awarded under this subsection; and</text>
						</subparagraph><subparagraph id="HB85892B414154D449019379C7700EDD7"><enum>(B)</enum><text>an estimate of
			 aggregate cost and energy savings enabled by the pilot program under this
			 subsection.</text>
						</subparagraph></paragraph><paragraph id="HB737B7BDA443423CADA89451DECA2C68"><enum>(7)</enum><header>Administrative
			 expenses</header><text>Administrative expenses for the program under this
			 subsection shall not exceed 10 percent of appropriated funds.</text>
					</paragraph></subsection><subsection id="H9147759CA447422C81C6101D47412B24"><enum>(b)</enum><header>Definition of
			 Energy Efficient Building</header><text>For purposes of this section the term
			 <quote>energy efficient building</quote> means a building that—</text>
					<paragraph id="HC309ABF327A7475D9263CDAF01A68B1C"><enum>(1)</enum><text>achieves a
			 reduction in energy consumption of—</text>
						<subparagraph id="HEED7DE7ED1E64C30B7AD0077B908962"><enum>(A)</enum><text>at least 30 percent
			 for new construction, compared to the energy standards set by the 2004
			 International Energy Conservation Code (in the case of residential buildings)
			 or ASHRAE Standard 90.1–2004; or</text>
						</subparagraph><subparagraph id="HAA332DF2FBBA47268EA0007FCFC701CC"><enum>(B)</enum><text>at least 20
			 percent for major renovations, compared to energy consumption before
			 renovations are begun;</text>
						</subparagraph></paragraph><paragraph id="H7B1018E7B7154D5D8492792270A2F100"><enum>(2)</enum><text>is constructed or
			 renovated in accordance with the most current, appropriate, and applicable
			 voluntary consensus standards, as determined by the Secretary, such as those
			 listed in the assessment under section 914(b), or revised or developed under
			 section 914(c), of the <act-name>Energy Policy Act of 2005</act-name>;
			 and</text>
					</paragraph><paragraph id="H48F8D20A32384C25A0CBE716AE05AFC5"><enum>(3)</enum><text>after construction
			 or renovation—</text>
						<subparagraph id="HDACDE00BF7F94747B043D3C409C369C1"><enum>(A)</enum><text>uses heating,
			 ventilating, and air conditioning systems that perform at no less than Energy
			 Star standards; or</text>
						</subparagraph><subparagraph id="HBDB4694BF5A74962809DE33E30C784AC"><enum>(B)</enum><text>if Energy Star
			 standards are not applicable, uses Federal Energy Management Program
			 recommended heating, ventilating, and air conditioning products.</text>
						</subparagraph></paragraph></subsection><subsection id="HB3A2830404FD472781C422D9B5AD89F3"><enum>(c)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated to the
			 Secretary for carrying out this section $10,000,000 for each of the fiscal
			 years 2008 through 2012.</text>
				</subsection></section></title><title id="H5BD4788A08724BB1AFB00060008EA8E"><enum>VI</enum><header>ARPA–E</header>
			<section display-inline="no-display-inline" id="H39A9D200F2324C2AB0006558B36DACE6" section-type="subsequent-section"><enum>601.</enum><header>Advanced Research
			 Projects Authority-Energy (ARPA–E)</header>
				<subsection id="HBFB02E3DE856494981B406111BA4B2BD"><enum>(a)</enum><header>Findings</header><text>The
			 Congress finds the following:</text>
					<paragraph id="H4D88271F56444656BB94F9F8AFE2F133"><enum>(1)</enum><text display-inline="yes-display-inline">The Department of Energy through existing
			 authorities and programs promotes technology transfer of basic and applied
			 research funded by the Department of Energy and performed at its national
			 laboratories, nonprofit and educational institutions, and the private sector,
			 but there is a need to more quickly identify opportunities to accelerate the
			 commercial application of new energy technologies to meet national energy
			 needs.</text>
					</paragraph><paragraph id="H23A1D3CEAEA24D72B3F1202C8BE000E6"><enum>(2)</enum><text display-inline="yes-display-inline">The principal Department of Energy program
			 organizations that already oversee various projects for basic and applied
			 research and commercialization of new energy technologies are the Office of
			 Science, the Office of Energy Efficiency and Renewable Energy, the National
			 Nuclear Security Administration, the Office of Fossil Energy, the Office of
			 Electricity Delivery and Energy Reliability, and the Office of Nuclear
			 Energy.</text>
					</paragraph><paragraph id="H9B0674D068F0494DB52146FC2B44F3DA"><enum>(3)</enum><text>A
			 more fully integrated Departmental approach to advanced energy research will
			 help bridge the gap between basic research and applied technology to overcome
			 long-term and high-risk technological barriers to the development of advanced
			 energy technologies.</text>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="H8D15B98857334E9F9D2BBDC5281258AD"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section—</text>
					<paragraph id="H4A1E05F819F040C9BECE2FB7C0EB9110"><enum>(1)</enum><text>the term
			 <quote>ARPA–E project</quote> means a project identified by the Secretary that
			 shows promise to accelerate efforts to overcome long-term and high-risk
			 technological barriers to the development of advanced energy technologies,
			 including projects on—</text>
						<subparagraph id="H228C32747770420BB35B18759CC8AB76"><enum>(A)</enum><text>advanced basic
			 energy-related research that shows unique innovation and scientific and
			 technical merit and the potential for commercial application;</text>
						</subparagraph><subparagraph id="H9AD64B68446749E7A7841771003808BD"><enum>(B)</enum><text>development of
			 resultant technologies and processes for energy supply and efficient end use;
			 and</text>
						</subparagraph><subparagraph id="H269FB7F0E3D74F2DB60986803F736949"><enum>(C)</enum><text>demonstration and
			 commercial application of the most promising energy technologies and research
			 applications on both a large and small scale; and</text>
						</subparagraph></paragraph><paragraph id="H59B015A9F49D43B4B6B27EC3C07F7FF"><enum>(2)</enum><text>the term
			 <term>Secretary</term> means the Secretary of Energy.</text>
					</paragraph></subsection><subsection id="H2D169037B2344D73BC00F33E76C3B506"><enum>(c)</enum><header>Selection
			 criteria</header><text>In identifying ARPA–E projects for support, the
			 Secretary shall—</text>
					<paragraph id="HEA65CC9BFD53422ABB1B00C0E0E5ABB1"><enum>(1)</enum><text>ensure that ARPA–E
			 projects do not alter the Department’s current balance of effort along the
			 spectrum of energy research and development activities;</text>
					</paragraph><paragraph id="H222918B0DB1C42FBB29DB0613F26DEAA"><enum>(2)</enum><text display-inline="yes-display-inline">consider the novelty, scientific and
			 technical merit, and potential transformative nature of the proposed
			 projects;</text>
					</paragraph><paragraph id="HE6F646B765DE4C3EB2D3C8EEFE91D8DC"><enum>(3)</enum><text display-inline="yes-display-inline">consider the demonstrated capabilities of
			 the applicants to successfully carry out the proposed research project;</text>
					</paragraph><paragraph id="HB7F1631079D1431D9929C7480214AC36"><enum>(4)</enum><text display-inline="yes-display-inline">consider the viability of avenues for
			 commercial application, including the transfer of technologies to the private
			 and public sector; and</text>
					</paragraph><paragraph id="HA4BE86AF3BDB42D3B946B8C0835CC31D"><enum>(5)</enum><text>consider such
			 other criteria as are established by the Secretary.</text>
					</paragraph></subsection><subsection id="HA0B80D7DA40F408EAC4CC05EC83E46CD"><enum>(d)</enum><header>Authorization</header><text>There
			 are authorized to be appropriated to the Secretary for carrying out ARPA–E
			 projects—</text>
					<paragraph id="HFBA200C5AAA04BE0A25088E7D5D1CE31"><enum>(1)</enum><text>$100,000,000 for
			 fiscal year 2008;</text>
					</paragraph><paragraph id="H8684B2926CB04A7A915B007C5FE26482"><enum>(2)</enum><text>$125,000,000 for
			 fiscal year 2009;</text>
					</paragraph><paragraph id="HBE483DE353F94EAC9C42F612FB009EA2"><enum>(3)</enum><text>$150,000,000 for
			 fiscal year 2010;</text>
					</paragraph><paragraph id="H988F15F5033C498C9819AA1E61852944"><enum>(4)</enum><text>$275,000,000 for
			 fiscal year 2011; and</text>
					</paragraph><paragraph id="H479689F5167B47EEA2BF1282B000B076"><enum>(5)</enum><text>$100,000,000 for
			 fiscal year 2012.</text>
					</paragraph></subsection><subsection id="HD691471BEB504D39A9ADE8EA4DA8BA29"><enum>(e)</enum><header>Personnel</header>
					<paragraph display-inline="no-display-inline" id="HE4CAF0A8933145B496537F8C3497F295"><enum>(1)</enum><header>Hiring of
			 personnel</header><text>The Secretary shall carry out a program of experimental
			 use of special personnel management authority in order to facilitate
			 recruitment of eminent experts in science or engineering for ARPA–E
			 projects.</text>
					</paragraph><paragraph id="HD4B09176B3494152BA965F3DB1CF96B8"><enum>(2)</enum><header>Special
			 personnel management authority</header><text display-inline="yes-display-inline">Under such program the Secretary may
			 utilize the hiring and management authorities described in section 1101(b),
			 (c), and (d) of the <act-name>Strom Thurmond National Defense Authorization Act
			 for Fiscal Year 1999</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/5/3104">5 U.S.C. 3104</external-xref> note), except that—</text>
						<subparagraph id="H079DDE3D639A469AB815FFA1EA40C509"><enum>(A)</enum><text>for purposes of
			 subsection (b)(1), the number of positions that may be appointed shall be no
			 more than 20; and</text>
						</subparagraph><subparagraph id="H5942D7D6F54F4BDBA6C828867B7F1896"><enum>(B)</enum><text>for purposes of
			 subsection (c), the term of initial appointments for employees may not exceed 3
			 years.</text>
						</subparagraph></paragraph></subsection><subsection id="HD6478515ABDF4D62B03CAFFEC3B8C787"><enum>(f)</enum><header>Protection of
			 Information</header>
					<paragraph display-inline="no-display-inline" id="HB6761203FD1247BAAFBE6DB9D63B8920"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Disclosure of
			 information that is submitted to the Department of Energy under a competitive
			 or noncompetitive process pursuant to the authority granted in this section is
			 not required under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code, for five years
			 after the date on which the information is received by the Department of
			 Energy. Such information includes—</text>
						<subparagraph id="HE6B4BE1427A64AE49C40C100EF60C7DB"><enum>(A)</enum><text>a proposal,
			 proposal abstract, and supporting documents;</text>
						</subparagraph><subparagraph id="H87CDF500565D4EBEA9B7E83279FD5949"><enum>(B)</enum><text>a business plan
			 submitted on a confidential basis; or</text>
						</subparagraph><subparagraph id="HBF3F65C23C6542A395B7A2E399489BF1"><enum>(C)</enum><text>technical
			 information submitted on a confidential basis.</text>
						</subparagraph></paragraph><paragraph id="H46ECE028F88D44968CBE0099C13C9E65"><enum>(2)</enum><header>Project
			 information</header><text>The Secretary, for a period of up to five years from
			 the receipt by the Department of information that results from any transaction
			 identified as an ARPA–E project, and which is of a character that it would be
			 protected from disclosure under the meaning of <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552(b)(4)</external-xref> of title 5,
			 United States Code, if the information had been obtained from a non-Government
			 party, may provide appropriate protections against the dissemination of such
			 information, including exemption from subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5,
			 United States Code.</text>
					</paragraph></subsection><subsection id="HFFCA80042194401FA6574582FBEAEC30"><enum>(g)</enum><header>Cost
			 sharing</header><text>Any transaction authorized by this section shall be cost
			 shared according to the principles set forth in section 988 of the
			 <act-name>Energy Policy Act of 2005</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/16352">42 U.S.C. 16352</external-xref>).</text>
				</subsection><subsection id="H9F859B297E824215A44DD13C4007101"><enum>(h)</enum><header>Coordination with
			 other Agencies</header><text display-inline="yes-display-inline">The Secretary
			 may coordinate program activities associated with an ARPA–E project with other
			 agencies, and may enter into agreements with other agencies to further the
			 success of an ARPA–E project. Where appropriate the Secretary shall coordinate
			 technology transfer efforts with the Technology Transfer Coordinator
			 established in section 1001 of the <act-name>Energy Policy Act of
			 2005</act-name>.</text>
				</subsection><subsection id="H5D8AB14B45F4426B8E239851F811D03D"><enum>(i)</enum><header>Award of Prize
			 Money</header><text>To the extent considered appropriate by the Secretary, the
			 Secretary may exercise the authority provided in section 1008 of the
			 <act-name>Energy Policy Act of 2005</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/16396">42 U.S.C. 16396</external-xref>) to award
			 prizes for achievements under an ARPA–E project.</text>
				</subsection><subsection id="HDECF216C36474C10A32BCCD525249262"><enum>(j)</enum><header>Relationship to
			 Other Authorities</header><text>The authorities granted by this section are in
			 addition to existing authorities granted to the Secretary, and are not intended
			 to supersede or modify any existing authorities.</text>
				</subsection><subsection id="HD03F27E2FED14955A8D80027FD86C95B"><enum>(k)</enum><header>Issuance of
			 Directive</header><text display-inline="yes-display-inline">Not later than 120
			 days after the date of enactment of this Act, the Department of Energy shall
			 issue a Directive that sets forth how the Department intends to identify,
			 manage, and administer ARPA–E projects.</text>
				</subsection><subsection id="HB0246FCE835448D0A97093DD00C2EA5"><enum>(l)</enum><header>Initial
			 projects</header><text>Not later than 270 days after the date of enactment of
			 this Act, the Secretary shall designate up to 2 ARPA–E projects for
			 funding.</text>
				</subsection><subsection id="H8A07205EA1D140BBB7DC00638DDE30E4"><enum>(m)</enum><header>Report to
			 Congress</header><text>Not later than one year after the date of enactment of
			 this Act, the Secretary shall submit a report to Congress describing the status
			 of any proposed or existing ARPA–E projects.</text>
				</subsection><subsection id="H02E3432614C743FAB19BEAE332C5EF89"><enum>(n)</enum><header>Positive
			 recommendation</header><text>The Secretary shall take no actions under this
			 section unless the study conducted under section 1821(b)(3) of the Energy
			 Policy Act of 2005 contains a recommendation that the management practices used
			 by the Defense Advanced Research Projects Agency are applicable to the research
			 programs at the Department of Energy.</text>
				</subsection></section></title><title id="H8BE692F51A4E47E38D87D2D48B962BD6"><enum>VII</enum><header>Green Energy
			 Education</header>
			<section display-inline="no-display-inline" id="HEBC64502CB264992948B483164870029" section-type="subsequent-section"><enum>701.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Green Energy Education Act of
			 2007</short-title></quote>.</text>
			</section><section id="HAD45A69836074B26B26BE3005764F3F"><enum>702.</enum><header>Definition</header><text display-inline="no-display-inline">For the purposes of this title:</text>
				<paragraph id="H7C230667E2F544AAB327E989FF9560D8"><enum>(1)</enum><header>Director</header><text>The
			 term <term>Director</term> means the Director of the National Science
			 Foundation.</text>
				</paragraph><paragraph id="H2B207EC68BCB406AABEC4B00530080BF"><enum>(2)</enum><header>High performance
			 building</header><text>The term <term>high performance building</term> has the
			 meaning given that term in section 914(a) of the Energy Policy Act of 2005 (42
			 U.S.C. 16194(a)).</text>
				</paragraph><paragraph id="HC6C3F565E6164B9CA6090000ACA06F8"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
				</paragraph></section><section id="H286F114E97D046BC9C20F26381B4F577"><enum>703.</enum><header>Graduate
			 training in energy research and development</header>
				<subsection id="H9EEBF2EDDFAA41F8B63E92BD00668FEF"><enum>(a)</enum><header>Funding</header><text>In
			 carrying out research, development, demonstration, and commercial application
			 activities authorized for the Department of Energy, the Secretary may
			 contribute funds to the National Science Foundation for the Integrative
			 Graduate Education and Research Traineeship program to support projects that
			 enable graduate education related to such activities.</text>
				</subsection><subsection id="HE52781E8505E4EBC84B6D03163D11589"><enum>(b)</enum><header>Consultation</header><text>The
			 Director shall consult with the Secretary when preparing solicitations and
			 awarding grants for projects described in subsection (a).</text>
				</subsection></section><section id="HAF2B736E2DDF4BF4B849D04C981D2084"><enum>704.</enum><header>Curriculum
			 development for high performance building design</header>
				<subsection id="H8B8B358267CE4378BB87E7ED87FE23"><enum>(a)</enum><header>Funding</header><text display-inline="yes-display-inline">In carrying out advanced energy technology
			 research, development, demonstration, and commercial application activities
			 authorized for the Department of Energy related to high performance buildings,
			 the Secretary may contribute funds to curriculum development activities at the
			 National Science Foundation for the purpose of improving undergraduate or
			 graduate interdisciplinary engineering and architecture education related to
			 the design and construction of high performance buildings, including
			 development of curricula, of laboratory activities, of training practicums, or
			 of design projects. A primary goal of curriculum development activities
			 supported under this section shall be to improve the ability of engineers,
			 architects, landscape architects, and planners to work together on the
			 incorporation of advanced energy technologies during the design and
			 construction of high performance buildings.</text>
				</subsection><subsection id="H64F948BF9A6B443D82B52F38066134EC"><enum>(b)</enum><header>Consultation</header><text>The
			 Director shall consult with the Secretary when preparing solicitations and
			 awarding grants for projects described in subsection (a).</text>
				</subsection><subsection id="HBE1C320F467C4726B38FA9BA892AF35"><enum>(c)</enum><header>Priority</header><text>In
			 awarding grants with respect to which the Secretary has contributed funds under
			 this section, the Director shall give priority to applications from
			 departments, programs, or centers of a school of engineering that are partnered
			 with schools, departments, or programs of design, architecture, and city,
			 regional, or urban planning.</text>
				</subsection></section></title><title id="H7A54C7AB80384AD6AB5C00ADD3F3BDA3"><enum>VIII</enum><header>Carbon Capture
			 and Sequestration</header>
			<section id="H9299917D0FA04BACADE88D38A7E1C1CF"><enum>801.</enum><header>Carbon capture
			 and sequestration study</header><text display-inline="no-display-inline">Not
			 later than 2 years after the date of enactment of this Act, the Secretary of
			 Energy shall transmit to the Congress the results of a study on the feasibility
			 of large-scale biological sequestration of carbon dioxide for coal power
			 systems, including an analysis of the feasibility of creating a closed loop
			 carbon cycle through biological sequestration.</text>
