		  penalty for violations under the Consumer Product Safety Act.</official-title>

		<section display-inline="no-display-inline" id="H0D7C2C27A5D545858853F0FBDFEAB7F3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Product Safety Civil Penalties
			 Improvement Act</short-title></quote>.</text>
		</section><section id="H00DC1E05B767417594AB68B0084CE3B"><enum>2.</enum><header>Maximum civil
			 penalties of the Consumer Product Safety Commission</header>
			<subsection id="H8EFC1F6C1C7F49AA8E7500A182D000B7"><enum>(a)</enum><header>Initial increase
			 in maximum civil penalties</header>
				<paragraph id="H8250390ADA5F436500ACCA7DA4CE70A"><enum>(1)</enum><header>Temporary
			 increase</header><text>Notwithstanding the dollar amounts specified for maximum
			 civil penalties specified in section 20(a)(1) of the Consumer Product Safety
			 Act (15 U.S.C.
			 2069(a)(1)), section 5(c)(1) of the Federal Hazardous
			 Substances Act, and section 5(e)(1) of the Flammable Fabrics Act
			 (15 U.S.C.
			 1194(e)(1)), the maximum civil penalties for any violation
			 specified in such sections shall be $5,000,000, beginning on the date that is
			 the earlier of the date on which final regulations are issued under section
			 3(b) or 360 days after the date of enactment of this Act.</text>
				</paragraph><paragraph id="HFC6F9A99F89D4A839DACE99FC9D90090"><enum>(2)</enum><header>Effective
			 date</header><text>Paragraph (1) shall cease to be in effect on the date on
			 which the amendments made by subsection (b)(1) shall take effect.</text>
				</paragraph></subsection><subsection id="HB58E7157433F43BCA4DADC005EDF55C5"><enum>(b)</enum><header>Permanent
			 increase in maximum civil penalties</header>
				<paragraph id="HFAFCBD59A5C544C6B5D9146207B2626B"><enum>(1)</enum><header>Amendments</header>
					<subparagraph id="HF5199B7C3B0748BCAF8EF67762A2A5F1"><enum>(A)</enum><header>Consumer Product
			 Safety Act</header><text display-inline="yes-display-inline">Section 20(a)(1)
			 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2069">15 U.S.C. 2069(a)(1)</external-xref>) is amended by
			 striking <quote>$1,250,000</quote> both places it appears and inserting
			 <quote>$10,000,000</quote>.</text>
					</subparagraph><subparagraph id="HCC87D5687AB24F45AB218F895D3730BD"><enum>(B)</enum><header>Federal
			 Hazardous Substances Act</header><text display-inline="yes-display-inline">Section 5(c)(1) of the Federal Hazardous
			 Substances Act (15
			 U.S.C. 1264(c)(1)) is amended by striking
			 <quote>$1,250,000</quote> both places it appears and inserting
			 <quote>$10,000,000</quote>.</text>
					</subparagraph><subparagraph id="HA981128F6A414528A54F4BDE6CE882C7"><enum>(C)</enum><header>Flammable
			 Fabrics Act</header><text display-inline="yes-display-inline">Section 5(e)(1)
			 of the Flammable Fabrics Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1194">15 U.S.C. 1194(e)(1)</external-xref>) is amended by
			 striking <quote>$1,250,000</quote> and inserting
			 <quote>$10,000,000</quote>.</text>
					</subparagraph></paragraph><paragraph id="HE5D9C8E15D4F45438BD43D5CBDD0051"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall take effect on
			 the date that is 1 year after the earlier of—</text>
					<subparagraph id="HCE434C789571493B9008ABF26F01098D"><enum>(A)</enum><text>the date on which
			 final regulations are issued pursuant to section 3(b); or</text>
					</subparagraph><subparagraph id="H2DACF9B5C007440795B4E8BFD62BE283"><enum>(B)</enum><text>360 days after the
			 date of enactment of this Act.</text>
					</subparagraph></paragraph></subsection></section><section id="H5B003A300E0E4058A108A9AB43F0D963"><enum>3.</enum><header>Determination of
			 penalties by the Consumer Product Safety Commission</header>
			<subsection id="HF17938CF682943E59E9D1D5E527605F9"><enum>(a)</enum><header>Factors to be
			 considered</header>
				<paragraph id="H8C141BCEEF6842988B122F018E20C7F"><enum>(1)</enum><header>Consumer Product
			 Safety Act</header><text display-inline="yes-display-inline">Section 20(b) of
			 the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2069">15 U.S.C. 2069(b)</external-xref>) is
			 amended—</text>
					<subparagraph id="H43335467573041C981B182D29CFF0DC"><enum>(A)</enum><text>by inserting
			 <quote>the nature, circumstances, extent, and gravity of the violation,
			 including</quote> after <quote>shall consider</quote>;</text>
					</subparagraph><subparagraph id="HCCB2BCD21B1F444DBA7ED1F4897F4D58"><enum>(B)</enum><text>by striking
			 <quote>products distributed, and</quote> and inserting <quote>products
			 distributed,</quote>; and</text>
					</subparagraph><subparagraph id="HAF19C671FEAB4071B0B3F3D08CA34864"><enum>(C)</enum><text>by inserting
			 <quote>, and such other factors as appropriate</quote> before the
			 period.</text>
					</subparagraph></paragraph><paragraph id="HE440713936464E0FB8B34858292332A4"><enum>(2)</enum><header>Federal
			 Hazardous Substances Act</header><text>Section 5(c)(3) of the Federal Hazardous
			 Substances Act (15
			 U.S.C. 1264(c)(3)) is amended—</text>
					<subparagraph id="H2D6516D0DE854A349090AA18FDFE7EE0"><enum>(A)</enum><text>by inserting
			 <quote>the nature, circumstances, extent ,and gravity of the violation,
			 including</quote> after <quote>shall consider</quote>;</text>
					</subparagraph><subparagraph id="H5011CD7087964300A4E47CC0DE713135"><enum>(B)</enum><text>by striking
			 <quote>substance distributed, and</quote> and inserting <quote>substance
			 distributed,</quote>; and</text>
					</subparagraph><subparagraph id="H5866CF0D6E7348E98947224FFA00FE38"><enum>(C)</enum><text>by inserting
			 <quote>, and such other factors as appropriate</quote> before the
			 period.</text>
					</subparagraph></paragraph><paragraph id="H3566AFD5512B4D31A580ED7B25FA6D34"><enum>(3)</enum><header>Flammable
			 Fabrics Act</header><text>Section 5(e)(2) of the Flammable Fabrics Act (15
			 U.S.C. 1194(e)(2)) is amended—</text>
					<subparagraph id="HEC69D1313E5E42E7A5DA2D956B73BC39"><enum>(A)</enum><text>by striking
			 <quote>nature and number</quote> and inserting <quote>nature, circumstances,
			 extent, and gravity</quote>;</text>
					</subparagraph><subparagraph id="H7D724794A0B44181A4DF4C21772680D5"><enum>(B)</enum><text>by striking
			 <quote>absence of injury, and</quote> and inserting <quote>absence of
			 injury,</quote>; and</text>
					</subparagraph><subparagraph id="H849C4ACC2DEA41018E2173C8FAF294CA"><enum>(C)</enum><text>by inserting
			 <quote>, and such other factors as appropriate</quote> before the
			 period.</text>
					</subparagraph></paragraph></subsection><subsection id="HF955F5C791D048BC9C024B98B5713CE6"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, and in accordance with the procedures of section 553 of
			 title 5, United States Code, the Commission shall issue a final regulation
			 providing its interpretation of the penalty factors described in section 20(b)
			 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2069">15 U.S.C. 2069(b)</external-xref>), section 5(c)(3)
			 of the Federal Hazardous Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1264">15 U.S.C. 1264(c)(3)</external-xref>), and section
			 5(e)(2) of the Flammable Fabrics Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1194">15 U.S.C. 1194(e)(2)</external-xref>), as amended
			 by subsection (a).</text>
