<official-title>To amend the Food Security Act of 1985 to encourage owners and operators of privately-held farm, ranch, and forest land to voluntarily make their land available for access by the public under programs administered by States and tribal governments.</official-title>

<section id="H7FC8918556F74028AB4168B9008CCE57" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Voluntary Public Access and Wildlife Habitat Incentive Program Act of 2007</short-title></quote>.</text></section> 
<section id="HC26E2696A07A475DB419E62D76FD4C66"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="H787E1A0F7B6849B6B245DE92EA43EE76"><enum>(1)</enum><text>according to the United States Fish and Wildlife Service, in 2001, 82,000,000 individuals in the United States aged 16 years and older participated in wildlife-related recreation, including 48,000,000 individuals who hunted, and more than 66,000,000 who engaged in wildlife-related recreation such as observing, feeding, or photographing wildlife, in the United States;</text></paragraph> 
<paragraph id="H46A5A08D89E04D189DA52DC680526573"><enum>(2)</enum><text>individuals who participated in wildlife-related activities in 2001 spent—</text> 
<subparagraph id="HFAADFCC6E2CF4D0AA528CE7BF214FFF1"><enum>(A)</enum><text>an estimated $56,000,000,000 on hunting and fishing equipment and supplies; and</text></subparagraph> 
<subparagraph id="H35EAED124F394BE896D6EA073000A74D"><enum>(B)</enum><text>more than $28,000,000,000 on food, lodging, and transportation;</text></subparagraph></paragraph> 
<paragraph id="H35D998406F9946908283B05725CF071"><enum>(3)</enum><text>purchases of hunting and fishing licenses, permits, and stamps and excise taxes on goods used by hunters and fishers have generated billions of dollars for wildlife conservation, research, and management;</text></paragraph> 
<paragraph id="HEA63930B794C4689A93C572EEE9C008B"><enum>(4)</enum><text>the growing public demand for hunting and fishing opportunities accessible to the public is increasingly constrained by the limits on both public and private land resources;</text></paragraph> 
<paragraph id="H75C9B798E39F4B6B9327355FC6611E2F"><enum>(5)</enum><text>recreational hunting and fishing—</text> 
<subparagraph id="H6F3318BA02804A988E7C856288E01941"><enum>(A)</enum><text>provide essential funding sources for—</text> 
<clause id="H22E5426F6E094623AA23975827065E15"><enum>(i)</enum><text>wildlife habitat development;</text></clause> 
<clause id="H15E91D4F6F934B4392C93609441BFDFA"><enum>(ii)</enum><text>the conservation of wildlife;</text></clause> 
<clause id="HA8D5461CC46A473CBF579C67A2D06FE8"><enum>(iii)</enum><text>the preservation of ecosystems; and</text></clause> 
<clause id="H41DAB1DC852543EB85C7588585D2BF35"><enum>(iv)</enum><text>effective wildlife management; and</text></clause></subparagraph> 
<subparagraph id="HCDACBA2A073E492987EF5DA9F3E9CCB7"><enum>(B)</enum><text>contribute to the reduction of conflicts between people and wildlife;</text></subparagraph></paragraph> 
<paragraph id="H004A35802E5E4BE08D3800008216B37C"><enum>(6)</enum><text>limited public access on private land has often frustrated and disappointed hunters, fishers, and other naturalists and undermined the relationship between land owners and the general public;</text></paragraph> 
<paragraph id="H808E6405686A472AB95BE7F78F96C27C"><enum>(7)</enum><text>21 States and several tribal governments have established successful but modest walk-in programs to encourage public hunting on private farm, ranch, and forest land, yet the demand for such voluntary access programs remains largely unfulfilled;</text></paragraph> 
<paragraph id="H3BD02A7E3BAA4C76B6225FA4B00C2C1"><enum>(8)</enum><text>traditional agricultural production methods and markets have in recent years offered limited income opportunities for farm, ranch and forest land owners and operators; and</text></paragraph> 
<paragraph id="H29BDABF97F3044EEBB20967CEC597502"><enum>(9)</enum><text>current proposals to reform world agricultural trade favor the development of new methods to support the income of agricultural producers that have minimal impact on agricultural production and prices.</text></paragraph></section> 
<section id="HC13EC76CC67346BC844FF93D62363623"><enum>3.</enum><header>Voluntary public access and habitat incentive program</header> 
<subsection id="HCC0E605D39594B84B6A184F6CCFCBD50"><enum>(a)</enum><header>In general</header><text>Chapter 5 of subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839bb">16 U.S.C. 3839bb et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H3B65DB5C12734F868EDB2D6D95BB3BE"><enum>1240Q.</enum><header>Voluntary public access and habitat incentive program</header> 
<subsection id="HFF328ADB76414C978914DB6108F2601C"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish a voluntary public access program under which States and tribal governments may apply for grants to encourage owners and operators of privately-held farm, ranch, and forest land to voluntarily make that land available for access by the public for wildlife-dependent recreation, including hunting or fishing, under programs administered by the States and tribal governments.</text></subsection> 
<subsection id="HECE9B05B4E2341E392DFE170CFF06168"><enum>(b)</enum><header>Applications</header><text>In submitting applications for a grant under the program, a State or tribal government shall describe—</text> 
<paragraph id="HD946767C48AC4045ADFEB66907F000BA"><enum>(1)</enum><text>the benefits that the State or tribal government intends to achieve by encouraging public access to private farm and ranch land for—</text> 
<subparagraph id="HB88DAB986DC64811A127D3327C5200CE"><enum>(A)</enum><text>hunting and fishing; and</text></subparagraph> 
<subparagraph id="H9034130A1D694B6FBD8D6B009CC9095F"><enum>(B)</enum><text>to the maximum extent practicable, other recreational purposes; and</text></subparagraph></paragraph> 
<paragraph id="H1CDBA03BB50B40E9AF7090A226C2E552"><enum>(2)</enum><text>the methods that will be used to achieve those benefits.</text></paragraph></subsection> 
<subsection id="H6CC64752FB4841599600ED7C3BB581D"><enum>(c)</enum><header>Priority</header><text>In approving applications and awarding grants under the program, the Secretary shall give priority to States and tribal governments that propose—</text> 
<paragraph id="H5D5F59C7F4F944148B5FD3961FF653E2"><enum>(1)</enum><text>to maximize participation by offering a program the terms of which are likely to meet with widespread acceptance among landowners;</text></paragraph> 
<paragraph id="H126648401BB5490D8E87198EA77F1CCF"><enum>(2)</enum><text>to ensure that land enrolled under the State or tribal government program has appropriate wildlife habitat;</text></paragraph> 
<paragraph id="H74ECFF906996438C99A265291733DA3C"><enum>(3)</enum><text>to strengthen wildlife habitat improvement efforts on land enrolled in a special conservation reserve enhancement program described in 1234(f)(4) by providing incentives to increase public hunting and other recreational access on that land; and</text></paragraph> 
<paragraph id="HD5FAC530300A40CC8B63F7D038A5EC"><enum>(4)</enum><text>to use additional Federal, State, tribal government, or private resources in carrying out the program.</text></paragraph></subsection> 
<subsection id="HB87472B2FBA649278711CBA76678B2D7"><enum>(d)</enum><header>Relationship to other laws</header><text>Nothing in this section preempts a State or tribal government law (including any State or tribal government liability law).</text></subsection> 
<subsection id="HBEEF2A20331D4DCBB2F96C49B99E61E6"><enum>(e)</enum><header>Regulations</header><text>The Secretary shall promulgate such regulations as are necessary to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE249A6DD4F7745FD8CC653AFF13074C"><enum>(b)</enum><header>Funding</header><text>Section 1241(a) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3841">16 U.S.C. 3841(a)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="HCA62ECC5DA044A3D8373AE3C57287C"><enum>(8)</enum><text>The voluntary public access program under section 1240Q, using, to the maximum extent practicable, $20,000,000 in each of fiscal years 2008 through 2012.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H0C6201086DCD44D2AC5629BB415B5138"><enum>4.</enum><header>Prevention of excess base acres</header><text display-inline="no-display-inline">Section 1101(g)(2) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/7911">7 U.S.C. 7911(g)(2)</external-xref>) is amended by striking subparagraph (C).</text></section>
