<section id="HB173D47501BF43938148F1DE181D92E1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Violent Crime Reduction Act of 2007</short-title></quote>.</text></section> 
<title id="HB82B5A0E62684FC687E14C08CE6E1BF"><enum>I</enum><header>Violent Crime and Anti-Gang Violence Reforms</header> 
<section id="HE0E5463E5D8B42E1A1643BE609F64524"><enum>101.</enum><header>Increased penalties for violent crimes in aid of racketeering activity</header> 
<subsection id="H4291703C50DF45FE95BAD210F5AC0514"><enum>(a)</enum><header>Offense</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1959">Section 1959(a)</external-xref> of title 18, United States Code, is amended to read as follows:</text>

<subsection id="H939E59C23BDF4B8DBCA47CCA24DE36FD"><enum>(a)</enum><text>Whoever commits, or conspires, threatens, or attempts to commit, a crime of violence for the purpose of furthering the activities of an enterprise engaged in racketeering activity, or for the purpose of gaining entrance to or maintaining or increasing position in, such an enterprise, shall, unless the death penalty is otherwise imposed, in addition and consecutive to the punishment provided for any other violation of this chapter and in addition to being subject to a fine under this title—</text> 
<paragraph id="H1C96236B655D488BAE88A49CA05ED3D6"><enum>(1)</enum><text>if the crime of violence results in the death of any person, be sentenced to death or life in prison;</text></paragraph> 
<paragraph id="HAA244B6A095543E09228A200A9A32B07"><enum>(2)</enum><text>if the crime of violence is kidnapping, aggravated sexual abuse (as defined in section 521), maiming, or any assault resulting in serious bodily injury be imprisoned for life or any term of years not less than 20; and</text></paragraph> 
<paragraph id="H5CF53E19EF0047E9A6ABD0F76D7EC1DC"><enum>(3)</enum><text>in any other case, be imprisoned for life or for any term of years not less than 10.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H84FCEB6DA8FD4A97BB8217BF43686800"><enum>(b)</enum><header>Venue</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1959">Section 1959</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<subsection id="H44D1BC31EDA54B518D64AF74D6FC8802"><enum>(c)</enum><text>A prosecution for a violation of this section may be brought in—</text> 
<paragraph id="H79E02D0572C84027A2F5D86C41C0DD54"><enum>(1)</enum><text>the judicial district in which the crime of violence occurred; or</text></paragraph> 
<paragraph id="H05625760F9E24BB5B2689B7309008241"><enum>(2)</enum><text>any judicial district in which racketeering activity of the enterprise occurred.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H938042F10A9048CDB6EC1D652EB2FD1"><enum>102.</enum><header>Murder and other violent crimes committed during and in relation to a drug trafficking crime</header> 
<subsection id="H47E486676BB74729B24B8F818474599D"><enum>(a)</enum><header>In General</header><text>Part D of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H6B2755D633F746BAAE4075776BBAD1DE"><enum>424.</enum><header>Murder and other violent crimes committed during and in relation to a drug trafficking crime</header> 
<subsection id="H0E50E7B964164B43B6C3EBAA652E355" display-inline="yes-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Whoever commits, or conspires, or attempts to commit, a crime of violence during and in relation to a drug trafficking crime, shall, unless the death penalty is otherwise imposed, in addition and consecutive to the punishment provided for the drug trafficking crime and in addition to being subject to a fine under this title—</text> 
<paragraph id="H53AF174B81CE42BC8E51861300009DDA"><enum>(1)</enum><text>if the crime of violence results in the death of any person, be sentenced to death or life in prison;</text></paragraph> 
<paragraph id="H382D76822E184F39972FBDD5CCCD1C8C"><enum>(2)</enum><text>if the crime of violence is kidnapping, aggravated sexual abuse (as defined in section 521), maiming, or any assault resulting in serious bodily injury be imprisoned for life or any term of years not less than 20; and</text></paragraph> 
<paragraph id="H14532E9927E34BF0A1D6236F414FEECC"><enum>(3)</enum><text>in any other case, be imprisoned for life or for any term of years not less than 10.</text></paragraph></subsection> 
<subsection id="H6A37399E9F8B4D71B4EA6403BFA4D14C"><enum>(b)</enum><header>Venue</header><text>A prosecution for a violation of this section may be brought in—</text> 
<paragraph id="HF4275288DC2740B9B46FE9A711AB2505"><enum>(1)</enum><text>the judicial district in which the murder or other crime of violence occurred; or</text></paragraph> 
<paragraph id="HD3E7896225A749B187E8DD62B2FB7F6"><enum>(2)</enum><text>any judicial district in which the drug trafficking crime may be prosecuted.</text></paragraph></subsection> 
<subsection id="H4F0342896090451FA236478FD2A2DF1"><enum>(c)</enum><header>Definitions</header><text>As used in this section—</text> 
<paragraph id="HAD49FFDA9CE344DF85FF6EECF474A911"><enum>(1)</enum><text>the term <quote>crime of violence</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/18/16">section 16</external-xref> of title 18, United States Code; and</text></paragraph> 
<paragraph id="HFF674F1014A8488B8DBF83F4B3A23DD5"><enum>(2)</enum><text>the term <quote>drug trafficking crime</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/18/924">section 924(c)(2)</external-xref> of title 18, United States Code.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HAA29208BE00545A0B1F000D8E5E535DB"><enum>(b)</enum><header>Clerical Amendment</header><text>The table of contents for the Comprehensive Drug Abuse Prevention and Control Act of 1970 is amended by inserting after the item relating to section 423, the following:</text>

<section id="H2E4DF2752D6F40169637C74CC2004884" section-type="subsequent-section" display-inline="no-display-inline"><enum>103.</enum><header>Increase in enhanced penalties for using or carrying a firearm during and in relation to a crime of violence or drug trafficking crime</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/924">Section 924(c)(1)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H6903DD79182D458A886D2786D8C900B8"><enum>(1)</enum><text>in subparagraph (A)—</text> 
<subparagraph id="H53009C56E2EB47E18E4292FB00A1B580"><enum>(A)</enum><text>in clause (i), by striking <quote>5</quote> and inserting <quote>7</quote>; </text></subparagraph> 
<subparagraph id="H5991B6DFDC524458B7991DB9999BFFDD"><enum>(B)</enum><text>in clause (ii), by striking <quote>7</quote> and inserting <quote>10</quote>; and</text></subparagraph> 
<subparagraph id="HE5F622B01A964CB58FBF1DD3B6DC9D7F"><enum>(C)</enum><text>in clause (i), by striking <quote>10</quote> and inserting <quote>12</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H527E2FF665E1407FAA77F6BEFBF44089"><enum>(2)</enum><text>in subparagraph (B)(i), by striking <quote>10</quote> and inserting <quote>15</quote>.</text></paragraph></section> 
<section id="H8F41D434A51541F08DAA4D736F4D59AA"><enum>104.</enum><header>Exemption for off duty law enforcement officers under the Gun-Free School Zones Act</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/922">Section 922(q)(2)(B)(vi)</external-xref> of title 18, United States Code, is amended by inserting <quote>or while off-duty</quote> before the semicolon. </text></section></title> 
<title id="HA284BA34DF5B4D519B63338DA2FE8C17"><enum>II</enum><header>Multi-Jurisdictional Anti-Gang Task Forces</header> 
<section id="HBD9D946AFBF445C28879B3E1C67365AD"><enum>201.</enum><header>Assistance for multi-jurisdictional anti-gang task forces</header> 
<subsection id="H00D87105E7D5463683ECD58CED3EA481"><enum>(a)</enum><header>In general</header><text>The Attorney general, in consultation with appropriate State and local officials, shall—</text> 
<paragraph id="H049BC72A05514E848710F2851DED8200"><enum>(1)</enum><text>establish anti-gang task forces, consisting of Federal, State, and local law enforcement authorities, for the coordinated investigation, disruption, apprehension, and prosecution of criminal gangs and offenders;</text></paragraph> 
<paragraph id="HC0795AC9B3E14946B17D7BA7C6834E2F"><enum>(2)</enum><text>direct the reassignment or detailing from any Federal department or agency (subject to the approval of the head of that department or agency, in the case of a department or agency other than the Department of Justice) of personnel to each task force;</text></paragraph> 
<paragraph id="H9B6A35B20B56465391BACCA32BA8B894"><enum>(3)</enum><text>provide all necessary funding for the operation of the task force; and</text></paragraph> 
<paragraph id="HF3711D514B9745D887E8BB8B019039E0"><enum>(4)</enum><text>provide all necessary funding for national and regional meetings of task forces, and all other related organizations, as needed, to ensure effective operation of such teams through the sharing of intelligence, best practices and for any other related purpose.</text></paragraph></subsection> 
<subsection id="HDE0DEC92662743D7B8DE01D625CB2BE6"><enum>(b)</enum><header>Membership</header><text>The task forces shall consist of agents and officers, where feasible, from—</text> 
<paragraph id="H79361F4DB1E04DEAAAE88C2767CFDFB"><enum>(1)</enum><text>the Federal Bureau of Investigation;</text></paragraph> 
<paragraph id="H39281514EAD7415E9753E5ABEB7F142"><enum>(2)</enum><text>the Drug Enforcement Administration;</text></paragraph> 
<paragraph id="H3B698EFF9F7244978B5F945CEE4BA3E"><enum>(3)</enum><text>the Bureau of Alcohol, Tobacco, Firearms, and Explosives;</text></paragraph> 
<paragraph id="H5FC903E15E1F421A80DEC613C74CC800"><enum>(4)</enum><text>the United States Marshals Service;</text></paragraph> 
<paragraph id="HAC86477A61694BE78C443290E68F3713"><enum>(5)</enum><text>the Directorate of Border and Transportation Security of the Department of Homeland Security;</text></paragraph> 
<paragraph id="H3FF98A9E2BEE45FB9589756461AE5DCC"><enum>(6)</enum><text>the Department of Housing and Urban Development;</text></paragraph> 
<paragraph id="H9B22C5DF646542628074DA5EE2EEDBDE"><enum>(7)</enum><text>State and local law enforcement; and</text></paragraph> 
<paragraph id="H0654B25643EE4F0AA6D398179799A672"><enum>(8)</enum><text>Federal, State, and local prosecutors.</text></paragraph></subsection> 
<subsection id="H0AC7B259F6F64D3DAE1B055D62419FE1"><enum>(c)</enum><header>Authorization of Appropriations</header><text>There are authorized to be appropriated $20,000,000 for each of the fiscal years 2008 through 2011 to carry out this section.</text></subsection></section></title>
